Brothers and Sisters,<br />

As you all know by now CP Rail has served notice on the Union to cancel Local<br />

Rules and Agreements. As of February 03 2013 new calling order and board placement rules are now<br />

in place. There are numerous items under these new rules that we have concern with and are<br />

grieving.<br />

We are providing this message as guidance to the membership, if you require information on how to<br />

operate under these rules, we encourage you to contact us for clarification.<br />

In the immediate future if you have any doubt as to a claim please submit an IP claim, explaining<br />

what your work entailed and pass on any information to your Union representative that you think<br />

may require some clarification. We expect that as the company moves forward and implements vast<br />

changes to our working conditions, that we may be filing many grievances.<br />

Agreements and Rules left in place:<br />

WPP and 7 day board system remains in effect thus the VTP and any other local rule pertaining to the WPP/7<br />

day also remain in place.<br />

Commuter Rail – Ad Hoc Calling Procedures<br />

Fraser Surry Dock agreement, remains as in effect.<br />

Letter of Understanding Operation of Train Between Boston Bar and Coquitlam/Thorton Yard – Pilotless<br />

Detour Agreement<br />

Fixed Rate CPR Trains Thru CN Thorton<br />

VIF Agreement<br />

RB Switcher Agreement - tentative<br />

No Scoop Rule – AFHT ONLY<br />

Short Rules - All rules pertaining to the repositioning remain:<br />

Pool Calls for anything other than straightaway<br />

Spare Board – 125 miles or less<br />

Respective of other person remaining first out (repo’d turn already first out)<br />

3 hours minimum rest after repositioned.<br />

Can only repo 1 st out once.<br />

Try to use the Y in the short turn window of your tie up if available otherwise contact CD<br />

Please try to observe these rules, abuse will only cause us to lose these as well.<br />

There are no longer any provision to call Extra Road Switchers, it has now reverted back to the pre flat rate<br />

requirements, Extra Transfer(short turn) Initial Time, Run Miles, TJ and Final time can be claimed.


All unassigned calls will be called from the Pools first: straightaway, TCS, short turns and unassigned work<br />

trains. In every case the pool turn should come with you not remain in the pool. Try to observe this and let us<br />

know.<br />

Board Placement; awaiting turn is one of the main concerns. Returning from personal, unfit, sick, injured,<br />

miles, missed calls; turn is in you will be placed into your turn, if turn is out you will be held off until turn<br />

comes in. We are disputing this, as such please record the time you book on and if possible take a snapshot of<br />

the pool to see who you should have been booked on after. At this time we are advising members to put in<br />

runaround claims for each turn that is called ahead of you.<br />

Sparerunning is also another concern. The company is allowing conductors to sparerun in any class of<br />

assigned service. The Collective Agreement only provides for sparerunning in classes of service other than the<br />

class of service currently assigned. Meaning, a Roadswitcher Cndr cannot sparerun on another Roadswitcher.<br />

Please watch for violations and submit Lost Wage claims or Run Arounds. Also, non-reduced brakepersons are<br />

being allowed to sparerun in unassgned service. However the senior sparerunner must be senior to the first<br />

out spare trainman. The company is no longer making this distinction. Please observe for violations and<br />

submit Run Arounds.<br />

There is no longer any provision for unassigned engineers to take extra work. There are separate Auxiliary<br />

Boards for assigned engineers/trainpersons to take extra work on days off as well for engineers/trainpersons<br />

off for miles.<br />

In addition since we have laid off members, the privilege off reducing carry over miles is no longer in effect.<br />
