Philosophy of Discipline
Welcome to Oak Grove High School. We want you to have a rewarding learning experience for your
child. In order to have a good experience and be successful on our campus, it starts with understanding our
discipline codes regarding student conduct. One of the important responsibilities for a student on campus
is to have good behavior on campus.
As you know, parents are the child’s first teachers and will remain the most important teachers during
the course of the child’s life. However, it must be recognized from the onset that the school and parents
should work together in harmony to prepare a child for school to work in our society.
Oak Grove High School’s administration and staff are committed to the goals of being positive, effective,
and maintaining an orderly disposition on campus. As such, we reserve the right to amend behavior
and discipline policies as deemed necessary.
ESUHSD Parent Handbook
The ESUHSD Parent Handbook includes the Uniform Disciplinary Chart, Board Policies, and references
to California Education Code and California Penal Codes related to students. The Uniform Disciplinary
Chart is a compilation of rules and infractions most often committed by students. Continued violations of
the same rule or regulation will result in an involuntary transfer to another East Side Union High School
District school. Every attempt will be made to follow the dictates of the chart displayed. However, the
Administration does reserve the right to objectively determine punishment based on the seriousness of a
particular infraction and the previous discipline record of the student who commits the offense.
No Tolerance Policy
All forms of hazing, bullying, harassing or fighting or conspiracies to engage in fighting are strictly prohibited
including any “gang” activity such as flashing signs or intimidation postures or large group stand
offs. Acts specifically included in the above are:
• Fighting on any school grounds, in a school vehicle or at any school sponsored activity;
• Fights initiated at school but taking place elsewhere;
• Fights which affect any pupil in the East Side Union High School District;
• Causing, attempting to cause or threatening to cause physical injury to another person;
• Any student who transmits information between students or groups that causes or tends to cause a
fight is guilty of conspiring to fight.
Possession of tobacco, paraphernalia, drugs or drug paraphernalia, intent to sell or distribute is also prohibited.
Violators shall be subject to suspension or expulsion and possible citation when applicable by San
Jose Police Department for violation of Penal Code.
Students who are reasonably suspected to be under the influence of Alcohol or any drug before school,
during school, after school and during any school activity such as a school dance will be subject to a
breathalyzer by staff and SJPD and receive a citation and/or be arrested by SJPD. Students will also be
disciplined by School Administration accordingly. Violators are subject to suspension, arrest, transfer to
another school in the district, and/or expulsion.
Bullying is aggressive behavior that involves unwanted, negative actions. Bullying involves a pattern
of behavior repeated over time and an imbalance of power or strength. Education Code 48900 permits
a student to be suspended from school or recommended for expulsion for engaging in acts of bullying,
including bullying committed by means of electronic acts.
Any student involved in pranks, where damage to or theft of school or private property occurs, shall be
suspended from school and subject to expulsion or transfer, referral to appropriate law enforcement agency
and loss of all school privileges and activities (i.e. senior picnic, senior ball, graduation, athletics).
Visitors and Guests to Campus
Unauthorized visitors or guests are not allowed on campus before, during or after school. Visitors,
upon entering the school grounds, shall register in the administration office and identify themselves and
the nature of their business in order to receive a guest badge. Unathorized individuals are subject to arrest
for trespassing. Parents are encouraged to visit school and classes; however, no person shall be permitted
access to pupils in a classroom without prior approval of the principal.
School Policies
& Discipline
Education Code
48900 define grounds
for suspension or
expulsion.
Education Code 48908:
All pupils shall comply
with the regulations,
pursue the required
course of study, and
submit to the authority
of the teachers of the
schools.
Oak Grove places a
heavy emphasis upon
the safety of its students
and staff. We
will do everything
within our authority
to ensure a safe and
orderly environment
for all members of
our educational community.
All students
are reminded that if
they are having any
difficulties with other
students on campus,
they are to report the
problem to the office
so the situation may
be remedied before it
comes to a physical
confrontation.
ESUHSD Board Policy:
notice of intent to visit
a classroom must be
given in writing to the
principal (and to the
teachers) at least 24
hours before the time
of the visit.
Dress Code and Grooming
ESUHSD Administrative
Regulation
5132: Students are
expected to dress
in a manner that is
neat and appropriate
for school work. A
full list of dress code
standards is included
in the ESUHSD
Parent Handbook.
Students and their parents are responsible for student’s cleanliness, clothing, and neat appearance.
Items worn to school should not interfere with the learning process. Students who dress in a manner that is
inconsistent with the dress code policy will be sent to the office and will either be sent home to change into
proper school attire, or someone will have to bring them proper attire from home. Any class time missed
because of improper dress is unexcused, and teachers have the discretion as to whether students will be
allowed to make up the work. Repeated violations will result in disciplinary action.
In order to maintain an appropriate campus environment, we request and expect all students to dress
appropriately for Oak Grove’s campus. Our policy is very simple. Students should report to school dressed
in “Clean, Covered, and Appropriate” apparel. Parents of Oak Grove students are asked to help promote a
safe and academic environment for their children. When purchasing school clothes, please keep the following
guidelines in mind:
• Backpacks must be free of writing. Only the student’s name, written in block letters, is permitted on
backpacks or other personal items.
• Belts must be the appropriate size (long hanging belts are not permitted) or must be tucked into belt
loops. No engraved, stamped, punched out, lifted initials or numbers shall be permitted on any belt or
buckle. Belts must not be worn lower than the waist.
• Hats/caps/head coverings, bandanas, scarves, head rags, wave caps, doo rags, etc., are not allowed.
Only official Oak Grove headgear is allowed. All hats will be confiscated by school officials. Hats will
only be returned on Fridays after 7th period of the week following the confiscation. Beanies may only
be worn during inclement weather. Repeat offenders of our hat policy will receive appropriate discipline
per district policy for defiance.
• Jewelry (spiked bracelets, spiked necklaces, wallet chains etc.) that is sharp/dangerous may not be worn
at school.
• Pajamas, sleep wear, slippers/house shoes, blankets are not allowed.
• Pants must be worn so that undergarments are not visible. No sagging or oversized pants will be permitted.
Pants with holes in them must not violate the 5-inch measurement. Pants must fit the waistline -
anything larger will be considered oversized.
• Shirts, jackets, and other articles of clothing denoting gang affiliation are not allowed. Any article of
clothing or accessory (e.g. jewelry, belts, backpacks, notebook, etc.) which displays gang symbols/affiliation
(with numbers, area codes, letters, etc.), profanity, or products and slogans which promote/advertise
tobacco, alcohol, drugs, sex, sexism (e.g. Hooters, Skin silhouettes), violence, suicide, racism, or
interferes with school work, creates disorder or disrupts the educational process is not allowed. Clothing
that is provocative or intended to intimidate others is not allowed. Bathing suits, beachwear, halter
tops, spaghetti straps, tube tops, backless tops, see-through outfits, or off-the-shoulder blouses, shirts or
outfits are not appropriate or acceptable for the school environment. All shirts and blouses must have
sleeves (with at least 2” wide straps) and completely cover the stomach, chest, shoulders and back. Bare
midriffs are not allowed.
• Shorts, skirts, skorts, or dresses must be size appropriate (arm extended at side, short or skirt bottom
reaches finger tips); tight fitting shorts, short shorts and cutoffs are prohibited. Shorts/pants with holes
showing undergarments are not acceptable. Appropriate shorts must be worn for physical education
activities and athletic practices. Note: Shorts, dresses, skorts, and skirts must be in compliance when
leggings/tights are worn under the skirt.
All clothing items
must be picked up
within 30 days from
the confiscation date;
otherwise, they will
be turned over to
charity organizations.
Items of “RED” are not permitted on campus. This includes: shoes, belts, shirts, tops, jackets, etc. Any
clothing item resembling “gang attire” or any items suggestive of gang affiliation identified by San Jose
Police are not permitted on campus, this includes, but is not limited to the following apparel: Cali shirts,
telephone area codes (408), Scar face, items with 13 or 14, or items with N or S on their belt buckles or on
other parts of their person. No professional athlete team jerseys (Raiders, 49’ers, Sharks) are allowed on
school grounds. No “Juggalo” apparel or insignia are allowed on campus. San Jose Police has indicated
that “Juggalo” are part of gang activity and the State of California has identified Party Crews as gang affiliated;
therefore, these items may not be worn on campus.
Personal Needs
6
Personal messages will not be accepted and/or delivered to students, even if the parent calls. If a message
must be delivered to a student, the parent/guardian will have to come to the school and make the
request in person. Oak Grove does not accept flowers or balloons for delivery to students.

Dance Rules
Dances are generally held from 8:00 p.m. – 11:00 p.m, with doors closing at 9:30 p.m. Students must
be picked up from the dance within 30 minutes from the end of the dance. The cost to enter a dance (other
than the Grand Ball) is $5 with an ASB card and $10 without. Non Oak Grove students may attend as a
guest, but must be accompanied by an Oak Grove High School student and must be pre-registered at the
Student Bank. Guest passes are $15.
All students must provide a current school ID in order to enter the dance. All school and district rules,
including those pertaining to dress code and behavior, must be followed. Students who violate a policy are
subject to disciplinary action which could result in suspension and or expulsion (drugs, alcohol or weapons).
Oak Grove High School will enforce a “No Freak Dancing” policy. “Freak Dancing” will not be allowed
at any school dance.
1. “Freak Dancing” is defined as follows:
a. Any dancing that imitates sexual behavior
b. Any dancing that is sexually suggestive
c. Any dancing where chairs, tables or walls are used
d. Any bumping or grinding of bodies
2. Dancers must keep their feet on the floor.
3. Lying on the ground, being in a horizontal position or bending over is not allowed.
Staff members, police officers, parents and administrators will be enforcing these rules. Students engaging
in any of these behaviors will be asked to leave the dance and may lose the privilege of attending future
school events.
The goal of the “No
Freak Dancing”
policy is not to curb
freedom of expression
but has been designed
and put into place in
order to maintain a
comfortable, safe and
inviting atmosphere
for all students.
Cell Phones and Electronic Devices
Cell phones are permitted on campus but must be turned off and out-of-sight during class time and
are only to be used during non-instructional minutes. Cell phones are not to be used as calculators or as
watches. Oak Grove High School is not responsible for lost, stolen, or confiscated electronic devices, nor
will we investigate lost or stolen items. Please keep items of high value at home.
Violations for electronic devices confiscated by staff members include:
• First Violation: Confiscated items will be held for one day (24 hours) starting from the day of the infraction.
The student’s parent and the student must report to the administration office between 2:30 and
3:30 pm to retrieve their electronic device. Both parent and student must provide photo identification
and describe the electronic devices prior to the release of the item to the owner. Also, both the parent
and student must sign an administrative log acknowledging future consequences.
• Second Violation: Upon the second violation, the electronic device will be held for 3 school days.
After the 3 days, the student and his/her parent may come to the administrative office between 2:30 and
Academic Integrity Policy
We believe that the primary goal of an educational institution must be to facilitate all aspects of learning
and to promote the values of our society. The goal of the education institution is to create an environment
where ethical behavior and the pursuit of academic excellence are promoted. Cheating demonstrates a lack
of integrity and character that is inconsistent with the goals and values of OGHS. This policy is designed
to prevent improper conduct, which would give any student and unfair advantage. Please refer to the
school website for more information regarding this policy.
of any tobacco products or paraphernalia. If a student is cited for tobacco use or possession The
County of Santa Clara Juvenile Probation Department’s Juvenile Diversion Unit will notify them of two
choices:
1. MANDATORY Counseling Program for one (1) day at the American Lung Association (ALA) of
Attendance Policies and Procedures
In order to maximize your highest academic achievement in high school, you will need to develop and
maintain good attendance habits and punctuality. Every student must be in school unless it is necessary
for him/her to be absent due to illness, medical/dental appointment, court subpoena or the funeral of an immediate
family member. These are the only absences from school which will be excused.
All students arriving late to school must have a note from a parent/guardian. It is the responsibility
of the student to drop off the note signed by the parent and report directly to class; admits and tardy slips
will only be issued for excused tardies. If no parent/guardian verification is received, absences or tardies
will remain unexcused for each class affected. Also, students who must leave campus before the end of the
school day must obtain an “Advance Absence” pass through the Attendance Office prior to leaving school.
Failure to obtain an “Advance Absence” pass from the Attendance Office prior to leaving school, even
with parent permission, will result in unexcused period absences. Students who do not follow attendance
procedures may be referred for disciplinary action.
Procedures for Student Absences
1. Contact the school (408-347-6522). It is required that a parent/guardian telephone the school as soon
as possible to advise the school of the nature of and clear the absence.
2. In cases where a student is or will be absent for a period of less than five days, a parent/guardian
should call the school daily and advise the Attendance Office of the condition of the student. The parent/guardian
is also encouraged to contact the counseling office and teachers through School Loop for
lesson assignments that have been missed. Following this procedure will help prevent the student from
falling behind in his/her work.
3. If you know in advance that the absence will be more than five days in length, please contact the Attendance
Secretary to apply for Short Term Independent Studies (STIS). This should be done at least
five days in advance of the absence. STIS is an optional temporary educational alternative to classroom
instruction. A student’s parents/guardian can opt for STIS when their child is likely to be away
from school for no less than 5 days and no more than 15 consecutive days per semester.
4. Each teacher will receive daily computerized “Absence Reports” that specify the status (excused, unexcused,
cut, etc.) of all absent students from his/her class the previous day. If a student does not bring
his/her note to the Attendance Office early on the day he/she returns to classes, his/her name will appear
on the report as “unverified” and the teacher will assume his/her absences to be a “cut” after five
(5) days. Detention will be assigned for these “cuts”. The parent will still be able to clear an absence,
however, the detention will remain for failure to clear the absence during the first five (5) days.
Attendance
California Education
Code 48200: Regular
attendance is mandatory
for all students.
Student Hall Passes:
Students should not
leave a scheduled class
at any time during the
school day without
permission. If it is
necessary to leave the
classroom, he/she must
receive a hall pass
from the teacher.
No students are
allowed to leave class
during the first or last
10 minutes of class.
Students who are
on campus without
permission or out of
class without an appropriate
hall pass
will be charged with a
“cut” from their current
class on the day.
School Attendance Review Board
Students with excessive absences will be subject to review by the School Attendance Review Board.
(SARB). SARB is a truancy reduction program that operates in alliance with the District Attorney’s office.
A student who has three or more unexcused or uncleared absences or who is tardy three times for more
than thirty minutes in a school year is considered a truant. A student with more than six unexcused period
absences or tardies in a school year will be assigned to attend a meeting with a school official.
Failure of the student to improve attendance may result in a referral to the SARB Board, where the
student and an accompanying parent/guardian will be informed of consequences. Continued truancy
will result in a citation by the District Attorney for the student to attend Juvenile Court, where the judge
may impose necessary sanctions on both the student and the parent/guardian. During the SARB process,
students may receive: a citation of $350 and up, community service hours, and/or the loss of their driver’s
license for one year or more.
All students who are considered chronic truants will be assigned Saturday School either by the Oak
Grove’s administration or by the District Attorney’s Office.
Science Camp
Juniors and seniors with a GPA of 2.0 or better are eligible to attend one Science Camp per year. The
volunteer agreement and application must be completed and turned in to the Associate Principal for approval
two weeks prior to the start date of any camp. Only students with good attendance (no more than 3
unverified period absences) and no recent disciplinary problems or referrals will be allowed to attend. No
requests will be approved during standardized testing.
