Subject: Qld Govt should release FULL advice opposing referendum<br />

A message from LGAQ President Margaret de Wit<br />

Local Government Minister David Crisafulli has written to all councils saying the Queensland Government will<br />

now advocate the No case in the upcoming referendum. He says advice received by the Government warns the<br />

current wording of the proposed change to the Constitution would allow the Federal Government to put<br />

conditions on funding of local communities. I suggest you call on the Minister to publicly release this advice in<br />

full, just as the LGAQ has done with legal opinions from several sources, including former NSW Supreme Court<br />

chief justice Jim Spigelman, showing that the change would NOT increase the Federal Government?s power<br />

over states or local communities. We should expose this last minute about face by the Government for what it<br />

is, a political tactic. There is too much at stake for your community to be distracted from the true purpose of this<br />

referendum, to protect vital programs such as Roads to Recovery from legal challenge.<br />
