II. Need for legal policy action and requirements for a possible legal instrument<br />

on social services <strong>of</strong> general interest<br />

Based on the outcomes and conclusions <strong>of</strong> the first part, the second part <strong>of</strong> the study<br />

explores the question whether and to what extent circumstances which are specific to the<br />

social sector should be addressed in a special legal act on social services <strong>of</strong> general interest.<br />

De lege ferenda Art 16(3) EC <strong>of</strong> the Treaty <strong>of</strong> Lisbon would create a suitable legal basis for<br />

such an act.<br />

In our opinion, it could include the following aspects:<br />

- More precise criteria for distinction between economic and non-economic services<br />

- Horizontal definition <strong>of</strong> de minimis threshold levels for services <strong>of</strong> general economic<br />

interest under State aid and public procurement law<br />

- Clarification as to the kind <strong>of</strong> conditions under which the unrestricted application <strong>of</strong><br />

fundamental freedoms could call into question the proper operation <strong>of</strong> services <strong>of</strong><br />

general interest, especially by summarising the grounds <strong>of</strong> justification developed by<br />

case-law in respect <strong>of</strong> social services<br />

- Clarification concerning the admissibility <strong>of</strong> obligations to take a specific legal form<br />

favouring non-pr<strong>of</strong>it-making operators<br />

- A separate regime on the treatment <strong>of</strong> public service compensation which accounts for<br />

circumstances which are specific to the social sector<br />

- Special rules concerning the award <strong>of</strong> contracts for social services: revised rules for<br />

in-house procurement; wider scope for direct awards <strong>of</strong> contracts without competition<br />

- Definition <strong>of</strong> universal-service obligations<br />

o Obligation to guarantee access to such services <strong>of</strong> a certain quality and at an<br />

affordable price for all people irrespective <strong>of</strong> their economic, social or<br />

geographic situation<br />

o Right to individual access to such services<br />

o Measures <strong>of</strong> price formation or price fixing to ensure that those on low<br />

incomes or with special social needs can access the service<br />

o Obligation <strong>of</strong> continuity to ensure permanent supply <strong>of</strong> the service<br />

o Measures <strong>of</strong> consumer protection and pre-contractual and contractual<br />

information requirements<br />
