Expiation notice issued giving<br />

28 days to pay. – Refer to<br />

“Your Choices”, failure to carry<br />

out any <strong>of</strong> your choices before<br />

the due date has expired, a<br />

reminder notice will be issued.<br />

REMINDER NOTICE<br />

Additional fees are incurred<br />

when a reminder notice is<br />

issued. A $30.00 reminder<br />

notice fee and a $11.00 motor<br />

vehicle search fee is applied<br />

to the notice. Therefore an<br />

extra $41.00 will be incurred.<br />

21 days are given to pay the<br />

reminder notice which<br />

includes the original expiation<br />

fee, reminder notice and motor<br />

vehicle search fee. Refer to<br />

“Your Choices”, failure to carry<br />

out any <strong>of</strong> your choices before<br />

the due date has expired on<br />

the reminder notice, a court<br />

certificate will be issued.<br />

COURT CERTIFICATE<br />

When a court certificate is<br />

issued by the Magistrate’s<br />

Court, court fees are added<br />

onto the amount owing, eg<br />

minimum court fees are<br />

$143.00. Once a court<br />

certificate is issued you can<br />

only make payment to the<br />

Court House, failure to make<br />

payment will result in further<br />

penalties issued by the<br />

Magistrate’s Court, eg -loosing<br />

your drivers licence, unable to<br />

register vehicles etc.<br />

YOUR CHOICES ARE:<br />

⇒ Pay expiation before the due date on the<br />

notice has expired, or<br />

⇒ Write to the <strong>City</strong> Manager with mitigating<br />

circumstances requesting the notice to<br />

be reviewed. This must be completed<br />

before the due date on the notice has<br />

expired, or<br />

⇒ Organise part-payments with the<br />

Magistrate Court to pay the expiation fee<br />

<strong>of</strong>f. (only if the Expiation fee or fees is<br />

$50.00 or more) This must be arranged<br />

before the due date on the notice<br />

expires, or<br />

⇒ Take the matter to court to have the<br />

Magistrate decide on the outcome. This<br />

also must be arranged before the due<br />

date on the notice has expired.<br />

167 No Stopping Signs<br />

A driver must not stop on a road or in an area to which a<br />

“No Stopping” sign applies.<br />

169 No stopping on a road with<br />

a yellow edge line<br />

A driver must not stop at the side <strong>of</strong> a road marked with a continuous yellow<br />

edge line.<br />

NOTE:<br />

You must not stop or park your vehicle in any area<br />

where a “No Stopping” sign or a continuous yellow<br />

edge line applies, even to pick up or let out passengers<br />

or goods.<br />

203 Disabled Parking Zones<br />

(1) A driver must not stop in a <strong>parking</strong> area for people with disabilities<br />

unless:<br />

(a) the driver's vehicle displays a current <strong>parking</strong> permit for people with<br />

disabilities; and<br />

(b) the driver complies with the conditions <strong>of</strong> use <strong>of</strong> the permit.<br />

194 Stopping near a fire hydrant<br />

A driver must not stop within 1 metre <strong>of</strong> a fire hydrant, fire hydrant indicator,<br />

or fire plug indicator.<br />

(fire hydrant means an upright pipe with a spout,<br />

nozzle or other outlet for drawing water from a main<br />

or service pipe in case <strong>of</strong> fire or other emergency).<br />

200 Stopping on roads - heavy and<br />

long vehicles<br />

(1) The driver <strong>of</strong> a heavy vehicle, or long vehicle, must not stop on a road<br />

in a built-up area for longer than 1 hour.<br />

(Heavy vehicle means a vehicle<br />

with a GVM <strong>of</strong> 4.5 tonnes or<br />

more.<br />

long vehicle means a vehicle<br />

that, together with any load or<br />

projection, is 7.5 metres long, or<br />

longer.)<br />

168 No Parking Signs<br />

1) The driver <strong>of</strong> a vehicle must not stop on a road or in an area to which a<br />

no <strong>parking</strong> sign applies, unless the driver:<br />

(a) is dropping <strong>of</strong>f, or picking up, passengers or goods; and<br />

(b) does not leave the vehicle unattended; and<br />

(c) completes the dropping <strong>of</strong>f, or picking up, <strong>of</strong> the passengers or<br />

goods, and drives on, as soon as possible and, in any case, within the<br />

required time (which is 2 minutes) after stopping.<br />

(2) For this rule, a driver leaves a vehicle unattended if the driver leaves<br />

the vehicle so that the driver is over 3 metres from the closest point <strong>of</strong><br />

the vehicle.<br />

170 Stopping in or near an<br />

intersection<br />

A driver must not stop on a road within 10 metres from the nearest point <strong>of</strong> an<br />

intersecting road at an intersection without traffic lights.<br />

195 Stopping at or near a bus stop<br />

A driver (except the driver <strong>of</strong> a public bus) must not stop at a bus stop sign,<br />

or on the road, within 20 metres before a bus stop sign on the road that<br />

indicates the bus stop, and 10 metres after the bus stop sign.<br />

197 Stopping on a path, dividing<br />

strip or nature strip<br />

A driver must not stop on a bicycle path, footpath, shared path or dividing<br />

strip, or a nature strip adjacent to a road. The footpath is generally adjacent<br />

a road between the kerb or edge <strong>of</strong> a road and the adjacent property<br />

boundary line.<br />

189 Double Parking<br />

A driver must not stop on a road:<br />

(a) if the road is a two-way road — between the centre <strong>of</strong> the road and<br />

another vehicle that is parked at the side <strong>of</strong> the road; or<br />

(b) if the road is a one-way road — between the far side<br />

<strong>of</strong> the road and another vehicle that is parked at the<br />

side <strong>of</strong> the road.


198 Obstructing access to and<br />

from a footpath, driveway etc<br />

(1) A driver must not stop on a road in a position that obstructs access by<br />

vehicles or pedestrians to or from a footpath ramp or a similar way <strong>of</strong><br />

access to a footpath, or a bicycle path or passageway:<br />

(2) A driver must not stop on or across a driveway or other way <strong>of</strong> access<br />

for vehicles travelling to or from adjacent land.<br />

208 Parallel Parking<br />

Unless there are signs or markings on the road to indicate some other<br />

method, you must park parallel to the edge <strong>of</strong> the road and footpath.<br />

The rules are:<br />

(a) Park your vehicle so that it is facing in the same direction as the moving<br />

traffic;<br />

(b) On a two-way road, park your vehicle parallel to and as near as<br />

practicable to the left edge <strong>of</strong> the road;<br />

(c) On a one-way road, park parallel to and as near as practicable to the<br />

left or right edge <strong>of</strong> the road;<br />

179 Stopping in a loading zone<br />

1) A driver must not stop in a loading zone unless the driver is driving:<br />

(a) a commercial vehicle that is dropping <strong>of</strong>f, or picking up, goods<br />

(d) Where <strong>parking</strong> bays are marked on the road, leave your vehicle entirely<br />

within a single bay, unless the vehicle is too wide or long to fit<br />

completely within the bay;<br />

(e) Where there are no <strong>parking</strong> bays, leave at least one metre between<br />

your vehicle and the vehicles in front and behind.<br />

(b) a vehicle, other than a commercial vehicle, that is dropping <strong>of</strong>f,<br />

picking up, goods that are difficult to handle bec<strong>au</strong>se <strong>of</strong> their weight<br />

or size<br />

(In this regulation, “commercial vehicle” means a motor<br />

vehicle constructed solely or mainly for the carriage <strong>of</strong><br />

goods (including a vehicle commonly called a utility, but<br />

excluding a vehicle <strong>of</strong> the kind commonly called a station<br />

wagon or station sedan).<br />

2) A driver who is permitted to stop in a loading zone must not stay<br />

continuously in the zone for longer than 30 minutes.<br />

208(6) White Line<br />

If the road has a continuous dividing line or a dividing strip, the driver must<br />

position the vehicle at least 3 metres from any dividing line or dividing strip,<br />

unless otherwise indicated by information on or with a <strong>parking</strong> control sign.
