Hazardous Substances and New Organisms Act 1996<br />

Hazardous Substances (Dangerous Goods and Scheduled Toxic Substances) Transfer <strong>Notice</strong> 2004<br />

Pursuant to section 160A of the Hazardous Substances and New Organisms Act 1996 (in this notice referred<br />

to as the Act), the Environmental Risk Management Authority gives the following notice.<br />

1. Title<br />

This notice is the Hazardous Substances (Dangerous Goods and Scheduled Toxic Substances) Transfer<br />

<strong>Notice</strong> 2004.<br />

2. Commencement<br />

This notice comes into force on 1 April 2004.<br />

3. Deemed assessment and approval<br />

(1) On the commencement of this notice, the substances described in Schedule 1 (dangerous goods), that<br />

were, immediately before that commencement, subject to Part XIV of the Act, cease to be subject to<br />

that Part.<br />

(2) On the commencement of this notice, the substances described in Schedule 2 (scheduled toxic<br />

substances), that were, immediately before that commencement, subject to Part XIII of the Act, cease<br />

to be subject to that Part.<br />

(3) The substances described in Schedule 1 (other than gases that are not hazardous substances) and<br />

Schedule 2 are deemed to have been assessed and approved by the Authority under section 29 of the<br />

Act.<br />

4. Deemed hazard classification<br />

(1) The substances described in Schedule 1 (dangerous goods) are deemed to have the hazard<br />

classifications specified opposite their descriptions in Schedule 1.<br />

(2) The substances described in Schedule 2 (scheduled toxic substances) are deemed to have the hazard<br />

classifications specified opposite their descriptions in Schedule 2.<br />

5. Application of controls and changes to controls<br />

(1) The controls that apply to the substances described in Tables 1 to 3 (hazardous gases) of Schedule 1<br />

are as follows:<br />
