Report –
Review of University of Warwick Section 106 Parking Scheme &
Response to Petition Requesting Residents' Parking in Freeburn Causeway
Is this a key decision?
No
Executive Summary:
As part of the development of the University of Warwick, a Section 106 agreement was signed,
which included the provision of waiting restrictions to deter student and staff parking in residential
roads.
The initial restrictions were introduced in May 2010 and further changes have been made to the
restrictions in response to monitoring, objections, 2 petitions and comments received from local
residents.
This report details the findings of the monitoring. In addition a petition has been received
requesting the introduction of a residents' parking scheme in Freeburn Causeway.
In accordance with the City Council's procedure for dealing with petitions for waiting restrictions
they are reported to the Cabinet Member (City Services) for a decision as to how to proceed.
The cost of introducing the parking scheme was funded from the Section 106 agreement.
Recommendations:
The Cabinet Member is recommended to:
i) endorse the results of the monitoring,
ii) approve that consultation is undertaken with residents of Freeburn Causeway in regard
to the introduction of a residents' parking scheme and subject to a positive response
utilise an Experimental TRO to introduce a residents' parking scheme.
iii) approve that consultation is undertaken with residents of Thimbler Road to determine if
waiting restrictions are required and subject to a positive response utilise an
Experimental TRO to introduce waiting restrictions.
Report title:
Review of University of Warwick Section 106 Parking Scheme &
Response to Petition Requesting Residents' Parking in Freeburn Causeway
1. Context (or background)
1.1 Waiting restrictions have been introduced in the area around the University of Warwick as
part of a Section 106 agreement relating to its development. The waiting restrictions were
originally introduced as an experimental TRO, which was varied and has now been made
permanent. It was requested by the Cabinet Member that monitoring was undertaken and
the findings reported back. This report details the results of the monitoring. In addition a
petition of 28 signatures has been received requesting the introduction of a residents' parking
scheme in Freeburn Causeway.
2. Options considered and recommended proposal
2.1 Parking surveys have been undertaken regularly in the area surrounding the University of
Warwick following the introduction and amendments to the parking scheme.
2.2 The monitoring has shown that general compliance with the restrictions is good. In these
areas no further changes are proposed. However, some changes have occurred to parking
patterns with transference of parking in to surrounding residential areas.
2.3 The results of the parking trends revealed by the surveys are shown in Appendix C. These
show the positive affect of the waiting restrictions on roads such as Kirby Corner Road,
Leighton Close and The Spinney. They also show the increasing number of vehicles being
parked on Freeburn Causeway and Thimbler Road.
2.4 A petition of 28 signatures has been received from residents of Freeburn Causeway
requesting a residents' parking scheme. The petition also states
'Due to Warwick University increasing parking charges on campus, this has increased the
level of students parking their cars on local streets instead of using public transport. This
seriously inconveniences local residents who in some cases, have to park the other end of
the street. This is also not encouraging a greener community. Elderly residents or residents
with disabilities also struggle to park outside their own properties. Also, visibility has been
reduced due to lines of cars down the street, making this more dangerous for children
crossing the road.'
2.5 Residents' parking schemes have been introduced in nearby roads, Moat House Lane, Onley
Terrace and parts of Sir Henry Parkes Road, Charter Avenue and Kirby Corner Road where
there is limited available off street parking.
2.6 It is proposed, subject to approval and a positive response to consultation, to extend the
residents' parking scheme to include Freeburn Causeway.
2.7 It is proposed to consult with residents on Thimbler Road to ascertain if non resident parking
is creating problems. Due to the layout of the road there are long sections of road which are
not fronted by properties. If necessary a waiting restriction could be introduced.
2.8 It is possible that installing a residents' parking scheme on Freeburn Causeway as petitioned,
could result in the non residential parking transferring in to Thimbler Road.
3
2.9 The first issue of residents' permits will be funded from the S.106 funds and will be issued in
accordance with Coventry City Council's Rules of Residents' Parking; once funding is
exhausted the permits will have to be paid for by residents.
3. Results of consultation undertaken
3.1 An initial presentation was made to the Ward Forum in November 2009. Following this a
Street news consultation was undertaken. Approximately 3200 Street news were issued in
December 2009 to residents who might be affected by parking by staff and students from the
University. The consultation was also posted on the Councils website. 377 responses were
received (12% response rate).
3.2 A questionnaire was issued to residents of The Spinney in September 2011 regarding the
possible introduction of a 1 hour restriction in the morning and afternoon. 75% if the
residents responded, all in favour of the proposals.
3.3 Residents of Freeburn Causeway and Thimbler Road have not yet been consulted on any
potential scheme.
4. Timetable for implementing this decision
4.1 If approved residents of Freeburn Causeway and Thimbler Road will be consulted regarding
parking by end of April 2012.
4.2 Monitoring in the form of parking surveys in the area around the University of Warwick will be
continue to be on going.
5. Comments from Director of Finance and Legal Services
5.1 Financial implications
The funds used to implement the waiting restrictions are from an external source, these
relate to the Section 106 agreement in regard to the development of the University of
Warwick c. £50,000 remains for the introduction of changes.
5.2 Legal implications.
A Traffic Regulation Order (TRO) can be made where it appears to be expedient to introduce
restrictions in order to preserve or improve the amenities of the area through which a road
runs.
In making a TRO, the Council has to have regard to and strike a balance between various
issues e.g. safe/convenient movement of traffic, provision of adequate parking facilities,
maintaining access to premises, passage of buses.
An experimental TRO takes immediate effect upon making and can remain in force for up to
18 months. The first 6 months of such an order stand as an objection period and any
objection received must be considered when deciding whether or not to make an
experimental order permanent or to abandon it.
An experimental order can be varied during its operation provided at least 6 months of the
total 18 month experimental period is remaining. This 6 month period functions as the
objection period to the varied order.
6.1 How will this contribute to achievement of the Council's key objectives / corporate
priorities (corporate plan/scorecard) / organisational blueprint / LAA (or Coventry
SCS)?
This will contribute to the City Councils objective of making Coventry an attractive and
enjoyable place to be, for local residents, as student parking was impacting on their daily
lives. The restrictions may also assist to encourage staff and students of the University to
utilise other more sustainable methods of transport rather than the car.
6.2 How is risk being managed?
6.4 Equalities / EIA
Blue badge holders will still be able to park in the restricted areas, subject to them not
parking in a dangerous or obstructive manner and adhering to the rules governing blue
badge parking.
6.5 Implications for (or impact on) the environment
The restrictions may also assist to encourage staff and students of the University to use other
more sustainable methods of transport rather than the car, which will have a positive impact
on climate change.
6.6 Implications for partner organisations?
