Executive Summary:<br />

As part of the development of the University of Warwick, a Section 106 agreement was signed,<br />

which included the provision of waiting restrictions to deter student <strong>and</strong> staff parking in residential<br />

roads.<br />

The initial restrictions were introduced in May 2010 <strong>and</strong> further changes have been made to the<br />

restrictions in response to monitoring, objections, 2 petitions <strong>and</strong> comments received from local<br />

residents.<br />

This report details the findings of the monitoring. In addition a petition has been received<br />

requesting the introduction of a residents' parking scheme in Freeburn Causeway.<br />

In accordance with the <strong>City</strong> <strong>Council</strong>'s procedure for dealing with petitions for waiting restrictions<br />

they are reported to the Cabinet Member (<strong>City</strong> Services) for a decision as to how to proceed.<br />

The cost of introducing the parking scheme was funded from the Section 106 agreement.


Recommendations:<br />

The Cabinet Member is recommended to:<br />

i) endorse the results of the monitoring,<br />

ii) approve that consultation is undertaken with residents of Freeburn Causeway in regard<br />

to the introduction of a residents' parking scheme <strong>and</strong> subject to a positive response<br />

utilise an Experimental TRO to introduce a residents' parking scheme.<br />

iii) approve that consultation is undertaken with residents of Thimbler Road to determine if<br />

waiting restrictions are required <strong>and</strong> subject to a positive response utilise an<br />

Experimental TRO to introduce waiting restrictions.<br />

Review of University of Warwick Section 106 Parking Scheme &<br />

Response to Petition Requesting Residents' Parking in Freeburn Causeway<br />

1. Context (or background)<br />

1.1 Waiting restrictions have been introduced in the area around the University of Warwick as<br />

part of a Section 106 agreement relating to its development. The waiting restrictions were<br />

originally introduced as an experimental TRO, which was varied <strong>and</strong> has now been made<br />

permanent. It was requested by the Cabinet Member that monitoring was undertaken <strong>and</strong><br />

the findings reported back. This report details the results of the monitoring. In addition a<br />

petition of 28 signatures has been received requesting the introduction of a residents' parking<br />

scheme in Freeburn Causeway.<br />

2. Options considered <strong>and</strong> recommended proposal<br />

2.1 Parking surveys have been undertaken regularly in the area surrounding the University of<br />

Warwick following the introduction <strong>and</strong> amendments to the parking scheme.<br />

2.2 The monitoring has shown that general compliance with the restrictions is good. In these<br />

areas no further changes are proposed. However, some changes have occurred to parking<br />

patterns with transference of parking in to surrounding residential areas.<br />

2.3 The results of the parking trends revealed by the surveys are shown in Appendix C. These<br />

show the positive affect of the waiting restrictions on roads such as Kirby Corner Road,<br />

Leighton Close <strong>and</strong> The Spinney. They also show the increasing number of vehicles being<br />

parked on Freeburn Causeway <strong>and</strong> Thimbler Road.<br />

2.4 A petition of 28 signatures has been received from residents of Freeburn Causeway<br />

requesting a residents' parking scheme. The petition also states<br />

'Due to Warwick University increasing parking charges on campus, this has increased the<br />

level of students parking their cars on local streets instead of using public transport. This<br />

seriously inconveniences local residents who in some cases, have to park the other end of<br />

the street. This is also not encouraging a greener community. Elderly residents or residents<br />

with disabilities also struggle to park outside their own properties. Also, visibility has been<br />

reduced due to lines of cars down the street, making this more dangerous for children<br />

crossing the road.'<br />

2.5 Residents' parking schemes have been introduced in nearby roads, Moat House Lane, Onley<br />

Terrace <strong>and</strong> parts of Sir Henry Parkes Road, Charter Avenue <strong>and</strong> Kirby Corner Road where<br />

there is limited available off street parking.<br />

2.6 It is proposed, subject to approval <strong>and</strong> a positive response to consultation, to extend the<br />

residents' parking scheme to include Freeburn Causeway.<br />

2.7 It is proposed to consult with residents on Thimbler Road to ascertain if non resident parking<br />

is creating problems. Due to the layout of the road there are long sections of road which are<br />

not fronted by properties. If necessary a waiting restriction could be introduced.<br />

2.8 It is possible that installing a residents' parking scheme on Freeburn Causeway as petitioned,<br />

could result in the non residential parking transferring in to Thimbler Road.<br />

2.9 The first issue of residents' permits will be funded from the S.106 funds <strong>and</strong> will be issued in<br />

accordance with <strong>Coventry</strong> <strong>City</strong> <strong>Council</strong>'s Rules of Residents' Parking; once funding is<br />

exhausted the permits will have to be paid for by residents.<br />

3. Results of consultation undertaken<br />

3.1 An initial presentation was made to the Ward Forum in November 2009. Following this a<br />

Street news consultation was undertaken. Approximately 3200 Street news were issued in<br />

December 2009 to residents who might be affected by parking by staff <strong>and</strong> students from the<br />

University. The consultation was also posted on the <strong>Council</strong>s website. 377 responses were<br />

received (12% response rate).<br />

3.2 A questionnaire was issued to residents of The Spinney in September 2011 regarding the<br />

possible introduction of a 1 hour restriction in the morning <strong>and</strong> afternoon. 75% if the<br />

residents responded, all in favour of the proposals.<br />

3.3 Residents of Freeburn Causeway <strong>and</strong> Thimbler Road have not yet been consulted on any<br />

potential scheme.<br />

4. Timetable for implementing this decision<br />

4.1 If approved residents of Freeburn Causeway <strong>and</strong> Thimbler Road will be consulted regarding<br />

parking by end of April 2012.<br />

4.2 Monitoring in the form of parking surveys in the area around the University of Warwick will be<br />

continue to be on going.<br />

5. Comments from Director of Finance <strong>and</strong> Legal Services<br />

5.1 Financial implications<br />

The funds used to implement the waiting restrictions are from an external source, these<br />

relate to the Section 106 agreement in regard to the development of the University of<br />

Warwick c. £50,000 remains for the introduction of changes.<br />

5.2 Legal implications.<br />

A Traffic Regulation Order (TRO) can be made where it appears to be expedient to introduce<br />

restrictions in order to preserve or improve the amenities of the area through which a road<br />

runs.<br />

In making a TRO, the <strong>Council</strong> has to have regard to <strong>and</strong> strike a balance between various<br />

issues e.g. safe/convenient movement of traffic, provision of adequate parking facilities,<br />

maintaining access to premises, passage of buses.<br />

An experimental TRO takes immediate effect upon making <strong>and</strong> can remain in force for up to<br />

18 months. The first 6 months of such an order st<strong>and</strong> as an objection period <strong>and</strong> any<br />

objection received must be considered when deciding whether or not to make an<br />

experimental order permanent or to ab<strong>and</strong>on it.<br />

An experimental order can be varied during its operation provided at least 6 months of the<br />

total 18 month experimental period is remaining. This 6 month period functions as the<br />

objection period to the varied order.<br />

This will contribute to the <strong>City</strong> <strong>Council</strong>s objective of making <strong>Coventry</strong> an attractive <strong>and</strong><br />

enjoyable place to be, for local residents, as student parking was impacting on their daily<br />

lives. The restrictions may also assist to encourage staff <strong>and</strong> students of the University to<br />

utilise other more sustainable methods of transport rather than the car.<br />

Blue badge holders will still be able to park in the restricted areas, subject to them not<br />

The restrictions may also assist to encourage staff <strong>and</strong> students of the University to use other<br />

more sustainable methods of transport rather than the car, which will have a positive impact<br />

on climate change.<br />
