3. Results of consult<strong>at</strong>ion undertaken<br />
3.1 Consult<strong>at</strong>ion has been carried out in respect of the new Toucan crossing on <strong>Banner</strong> <strong>Lane</strong>.<br />
Objections were received to the notice of intent and Cabinet Member (City Services) gave<br />
approval <strong>for</strong> the scheme to go ahead <strong>at</strong> the meeting on 23 April 2013.<br />
3.2 An objection has been received in regard to the proposal to upgrade the existing Pelican<br />
crossing to a Toucan crossing on <strong>Broad</strong> <strong>Lane</strong> outside The Woodlands Academy. This<br />
objection will be heard by Cabinet Member (Public Services) <strong>at</strong> a future meeting.<br />
3.3 In<strong>for</strong>m<strong>at</strong>ion on the planning applic<strong>at</strong>ions rel<strong>at</strong>ing to <strong>Banner</strong>brook Park is publicly available<br />
and has been discussed in local resident and neighbourhood <strong>for</strong>ums.<br />
4. Timetable <strong>for</strong> implementing this decision<br />
4.1 The new Toucan crossing and the upgrade to the existing Pelican crossing should be<br />
completed by the end of 2013.<br />
4.2 The timetable <strong>for</strong> the improvement of the <strong>Banner</strong> <strong>Lane</strong> / <strong>Broad</strong> <strong>Lane</strong> junction is to be<br />
confirmed.<br />
5. Comments from Director of Finance and Legal Services<br />
5.1 Financial implic<strong>at</strong>ions<br />
The S106 agreement and S278 agreement between Persimmon Homes Ltd and Coventry<br />
City Council is the source of the funds <strong>for</strong> the new Toucan crossing, the upgrade to the<br />
existing Pelican crossing and the new junction arrangements <strong>at</strong> <strong>Banner</strong> <strong>Lane</strong> / <strong>Broad</strong> <strong>Lane</strong>.<br />
5.2 Legal implic<strong>at</strong>ions<br />
The Council has a range of highway and traffic management powers available with which<br />
to address road safety and traffic management issues, consistent with Department <strong>for</strong><br />
Transport guidelines. Furthermore, the Council has powers to install, alter or remove<br />
pedestrian crossings subject to it having consulted the Police and it having given public<br />
notice of its proposals and it considering any responses received (Section 23 Road Traffic<br />
Regul<strong>at</strong>ion Act 1984).<br />
Section 278 of the Highways Act 1980 allows highway authorities to enter into legal<br />
agreements with developers <strong>for</strong> the execution of highway works <strong>at</strong> the developer’s expense<br />
where those works will be of benefit to the public.<br />
6. Other implic<strong>at</strong>ions<br />
6.1 How will this contribute to achievement of the Council's key objectives / corpor<strong>at</strong>e<br />
priorities (corpor<strong>at</strong>e plan/scorecard) / organis<strong>at</strong>ional blueprint / Local Area<br />
Agreement (or Coventry Sustainable Community Str<strong>at</strong>egy)?<br />
The improvements which have been negoti<strong>at</strong>ed and included in the S106 agreement and<br />
the S278 agreement contribute to ensuring th<strong>at</strong> children and young people are safe. They<br />
also contribute to making places and services easily accessible.<br />
6.2 How is risk being managed?<br />
