3. Results of consultation undertaken
3.1 Consultation has been carried out in respect of the new Toucan crossing on Banner Lane.
Objections were received to the notice of intent and Cabinet Member (City Services) gave
approval for the scheme to go ahead at the meeting on 23 April 2013.
3.2 An objection has been received in regard to the proposal to upgrade the existing Pelican
crossing to a Toucan crossing on Broad Lane outside The Woodlands Academy. This
objection will be heard by Cabinet Member (Public Services) at a future meeting.
3.3 Information on the planning applications relating to Bannerbrook Park is publicly available
and has been discussed in local resident and neighbourhood forums.
4. Timetable for implementing this decision
4.1 The new Toucan crossing and the upgrade to the existing Pelican crossing should be
completed by the end of 2013.
4.2 The timetable for the improvement of the Banner Lane / Broad Lane junction is to be
confirmed.
5. Comments from Director of Finance and Legal Services
5.1 Financial implications
The S106 agreement and S278 agreement between Persimmon Homes Ltd and Coventry
City Council is the source of the funds for the new Toucan crossing, the upgrade to the
existing Pelican crossing and the new junction arrangements at Banner Lane / Broad Lane.
5.2 Legal implications
The Council has a range of highway and traffic management powers available with which
to address road safety and traffic management issues, consistent with Department for
Transport guidelines. Furthermore, the Council has powers to install, alter or remove
pedestrian crossings subject to it having consulted the Police and it having given public
notice of its proposals and it considering any responses received (Section 23 Road Traffic
Regulation Act 1984).
Section 278 of the Highways Act 1980 allows highway authorities to enter into legal
agreements with developers for the execution of highway works at the developer’s expense
where those works will be of benefit to the public.
6. Other implications
6.1 How will this contribute to achievement of the Council's key objectives / corporate
priorities (corporate plan/scorecard) / organisational blueprint / Local Area
Agreement (or Coventry Sustainable Community Strategy)?
The improvements which have been negotiated and included in the S106 agreement and
the S278 agreement contribute to ensuring that children and young people are safe. They
also contribute to making places and services easily accessible.
