Executive Summary:<br />

A petition with 97 sign<strong>at</strong>ures and an e-petition with 10 sign<strong>at</strong>ures have been presented by<br />

Councillor Thomas to request a pedestrian crossing on <strong>Broad</strong> <strong>Lane</strong> <strong>at</strong> its junction with <strong>Banner</strong><br />

<strong>Lane</strong>. In accordance with the City Council's procedure <strong>for</strong> dealing with petitions, those rel<strong>at</strong>ing to<br />

requests <strong>for</strong> pedestrian crossings are heard by the Cabinet Member (Public Services).<br />

The cost of traffic management and road safety measures is usually funded from the Highways<br />

Maintenance and Investment Capital Programme budget through the Local Transport Plan or<br />

through developer contributions via S106 or S278 agreements.<br />

There is a Section 106 agreement and a S278 agreement in place with the developer of the<br />

<strong>Banner</strong>brook Park est<strong>at</strong>e to provide a new Toucan crossing on <strong>Banner</strong> <strong>Lane</strong> and to upgrade the<br />

existing Pelican crossing on <strong>Broad</strong> <strong>Lane</strong> to a Toucan crossing. These enhancements will provide<br />

a route of controlled pedestrian crossings between <strong>Banner</strong>brook Park and Eastern Green. In<br />

addition, the proposed alter<strong>at</strong>ion of the junction of <strong>Banner</strong> <strong>Lane</strong> and <strong>Broad</strong> <strong>Lane</strong> will incorpor<strong>at</strong>e<br />

uncontrolled pedestrian crossing points.<br />

Recommend<strong>at</strong>ions:<br />

The Cabinet Member (City Services) is recommended to note the measures which are being<br />

funded through S106 and S278 contributions and to approve th<strong>at</strong> no additional pedestrian<br />

crossing measures are provided.<br />

Report title:<br />

<strong>Petition</strong> – <strong>Request</strong> <strong>for</strong> a <strong>Pedestrian</strong> <strong>Crossing</strong> <strong>at</strong> <strong>Broad</strong> <strong>Lane</strong> / <strong>Banner</strong> <strong>Lane</strong> Junction<br />

1. Context (or background)<br />

1.1 A petition with 97 sign<strong>at</strong>ures and an e-petition with 10 sign<strong>at</strong>ures have been presented by<br />

Cllr Thomas regarding a request <strong>for</strong> a pedestrian crossing on <strong>Broad</strong> <strong>Lane</strong> near <strong>Banner</strong><br />

<strong>Lane</strong>. A loc<strong>at</strong>ion plan can be found in Appendix A. The petition st<strong>at</strong>es “We, the<br />

undersigned, call on Coventry City Council to provide a pedestrian crossing across <strong>Broad</strong><br />

<strong>Lane</strong> <strong>at</strong> its junction with <strong>Banner</strong> <strong>Lane</strong>. Many primary-aged children living <strong>at</strong> <strong>Banner</strong>brook<br />

Park <strong>at</strong>tend St Andrew’s Infants or Eastern Green Juniors. To support the School Travel<br />

Plans <strong>at</strong> these schools, we urge Coventry City Council to provide these children and their<br />

parents with a safe pedestrian route to school.”<br />

2. Options considered and recommended proposal<br />

2.1 Many of the primary school aged children living in the new housing development <strong>at</strong><br />

<strong>Banner</strong>brook Park, <strong>Banner</strong> <strong>Lane</strong>, <strong>at</strong>tend St Andrew’s Infant School or Eastern Green Junior<br />

School. If they walk to/from school, then it is necessary <strong>for</strong> them (and their carers) to cross<br />

<strong>Broad</strong> <strong>Lane</strong> and many also cross <strong>Banner</strong> <strong>Lane</strong>.<br />

2.2 The junction of <strong>Broad</strong> <strong>Lane</strong> and <strong>Banner</strong> <strong>Lane</strong> is a priority t-junction. There is no footway on<br />

the south side of <strong>Broad</strong> <strong>Lane</strong> from <strong>Banner</strong> <strong>Lane</strong> towards Berkswell. At the current time<br />

there are no <strong>for</strong>mal pedestrian crossings on this route except <strong>at</strong> <strong>Broad</strong> <strong>Lane</strong> near Farcroft<br />

Avenue (outside The Woodlands Academy), which is 290m from the <strong>Banner</strong> <strong>Lane</strong> junction,<br />

altern<strong>at</strong>ively there are pedestrian dropped kerbs 100m from the junction. <strong>Broad</strong> <strong>Lane</strong> is 7m<br />

wide and has a speed limit of 30 mph denoted by the presence of street lights.<br />

2.3 In the previous three years (to 31 March 2013) there have been seven personal injury<br />

collisions on <strong>Broad</strong> <strong>Lane</strong> between its junctions with Hockley <strong>Lane</strong> and The Woodlands<br />

Academy. None of these have involved pedestrians.<br />

2.4 There is a Section 106 agreement and a Section 278 agreement in place with the<br />

developer of the <strong>Banner</strong>brook Park est<strong>at</strong>e to make the following improvements (this list is a<br />

subset of those agreed):<br />

Replacement of the existing priority junction with a roundabout;<br />

Implement<strong>at</strong>ion of a Toucan crossing on <strong>Banner</strong> <strong>Lane</strong> near Astoria Drive; and<br />

Upgrade of the existing Pelican crossing on <strong>Broad</strong> <strong>Lane</strong> to a Toucan crossing.<br />

2.5 With the implement<strong>at</strong>ion of the Toucan crossing on <strong>Banner</strong> <strong>Lane</strong> near Astoria Drive and the<br />

upgrade of the existing Pelican crossing outside The Woodlands Academy, a walking route<br />

is being provided with controlled crossing points between the <strong>Banner</strong>brook Park est<strong>at</strong>e and<br />

Eastern Green. It is anticip<strong>at</strong>ed th<strong>at</strong> this work will be completed by the end of 2013.<br />

2.6 As highlighted above, the S106 agreement between Persimmon Homes Limited and<br />

Coventry City Council includes the replacement of the existing priority junction <strong>at</strong> <strong>Banner</strong><br />

<strong>Lane</strong> / <strong>Broad</strong> <strong>Lane</strong> with a roundabout, as shown in Appendix B. The proposed design of the<br />

roundabout is such th<strong>at</strong> there will be splitter islands in the centre of the carriageway on<br />

each approach and these will incorpor<strong>at</strong>e dropped kerbs with tactile paving (see Appendix<br />

B). These will provide an improved uncontrolled crossing route <strong>for</strong> pedestrians.<br />

2.7 Having taken into consider<strong>at</strong>ion the proposed S106 and S278-funded improvements<br />

described above, it is recommended th<strong>at</strong> no additional pedestrian crossing measures are<br />

needed.<br />

3. Results of consult<strong>at</strong>ion undertaken<br />

3.1 Consult<strong>at</strong>ion has been carried out in respect of the new Toucan crossing on <strong>Banner</strong> <strong>Lane</strong>.<br />

Objections were received to the notice of intent and Cabinet Member (City Services) gave<br />

approval <strong>for</strong> the scheme to go ahead <strong>at</strong> the meeting on 23 April 2013.<br />

3.2 An objection has been received in regard to the proposal to upgrade the existing Pelican<br />

crossing to a Toucan crossing on <strong>Broad</strong> <strong>Lane</strong> outside The Woodlands Academy. This<br />

objection will be heard by Cabinet Member (Public Services) <strong>at</strong> a future meeting.<br />

3.3 In<strong>for</strong>m<strong>at</strong>ion on the planning applic<strong>at</strong>ions rel<strong>at</strong>ing to <strong>Banner</strong>brook Park is publicly available<br />

and has been discussed in local resident and neighbourhood <strong>for</strong>ums.<br />

4. Timetable <strong>for</strong> implementing this decision<br />

4.1 The new Toucan crossing and the upgrade to the existing Pelican crossing should be<br />

completed by the end of 2013.<br />

4.2 The timetable <strong>for</strong> the improvement of the <strong>Banner</strong> <strong>Lane</strong> / <strong>Broad</strong> <strong>Lane</strong> junction is to be<br />

confirmed.<br />

5. Comments from Director of Finance and Legal Services<br />

5.1 Financial implic<strong>at</strong>ions<br />

The S106 agreement and S278 agreement between Persimmon Homes Ltd and Coventry<br />

City Council is the source of the funds <strong>for</strong> the new Toucan crossing, the upgrade to the<br />

existing Pelican crossing and the new junction arrangements <strong>at</strong> <strong>Banner</strong> <strong>Lane</strong> / <strong>Broad</strong> <strong>Lane</strong>.<br />

5.2 Legal implic<strong>at</strong>ions<br />

The Council has a range of highway and traffic management powers available with which<br />

to address road safety and traffic management issues, consistent with Department <strong>for</strong><br />

Transport guidelines. Furthermore, the Council has powers to install, alter or remove<br />

pedestrian crossings subject to it having consulted the Police and it having given public<br />

notice of its proposals and it considering any responses received (Section 23 Road Traffic<br />

Regul<strong>at</strong>ion Act 1984).<br />

Section 278 of the Highways Act 1980 allows highway authorities to enter into legal<br />

agreements with developers <strong>for</strong> the execution of highway works <strong>at</strong> the developer’s expense<br />

where those works will be of benefit to the public.<br />

6. Other implic<strong>at</strong>ions<br />

6.1 How will this contribute to achievement of the Council's key objectives / corpor<strong>at</strong>e<br />

priorities (corpor<strong>at</strong>e plan/scorecard) / organis<strong>at</strong>ional blueprint / Local Area<br />

Agreement (or Coventry Sustainable Community Str<strong>at</strong>egy)?<br />

The improvements which have been negoti<strong>at</strong>ed and included in the S106 agreement and<br />

the S278 agreement contribute to ensuring th<strong>at</strong> children and young people are safe. They<br />

also contribute to making places and services easily accessible.<br />

6.2 How is risk being managed?<br />

6.4 Equalities / EIA<br />

No specific equalities impact assessment has been carried out. However, the provision of a<br />

Toucan crossing on <strong>Banner</strong> <strong>Lane</strong> and the upgrade of the Pelican crossing on <strong>Broad</strong> <strong>Lane</strong><br />

will have a positive impact on all pedestrians who wish to use controlled crossing facilities<br />

to walk or cycle between the housing and facilities of <strong>Banner</strong>brook Park and Eastern<br />

Green. Furthermore, the proposed junction improvement will have a positive impact on<br />

those wishing to take a shorter route, albeit using uncontrolled facilities.<br />

6.5 Implic<strong>at</strong>ions <strong>for</strong> (or impact on) the environment<br />

There is a positive impact on the environment arising from choices made by residents to<br />

walk or cycle r<strong>at</strong>her than use a car to travel between <strong>Banner</strong>brook Park and Eastern<br />

Green.<br />
