Smidt to approve the installation of a 1,000 gallon propane tank at St. Francis Memorial Hospitalsubject to the approval of the State Fire Marshall. Motion carried.Don Roeber, President of the Park Board, appeared before the Council and reported on thePark budget and the future needs at the parks.The City Administrator advised that West Point Public School is in the process of installing awind-generator and the City needs to establish a rate base if generation occurs and the unit generatesout onto the City’s grid. Following discussion, Grovijohn introduced the following resolution andmoved its adoption:A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF WEST POINT,NEBRASKA, ESTABLISHING A RATE FOR NET METERING OF RENEWABLE ENERGYRESOURCES WITHIN THE CITY’S ELECTRIC SERVICE AREA PURSUANT TOSECTION 6-501 OF THE MUNICIPAL CODE; PROVIDING FOR TERMS ANDCONDITIONS FOR NET METERING APPLICATIONS; AND REPEALING ALLORDINANCES AND RESOLUTIONS IN CONFLICT WITH THIS RESOLUTION.Seconded by Ell. Resolution adopted.Motion made by Smidt and seconded by Ell that the additional assets pledged by F & MBank as security for all deposits of the City be approved. Motion carried.Moved by Smidt, seconded by Grovijohn, to approve the Manager Application filed byVeterans Club West Point (Vets Pointe Food & Spirits, Inc) located at 246 S. Main Street,naming Linda D. Henry as manager. Motion carried.Moved by Ell, seconded by Smidt, to approve the application of Petro Mart for a SpecialDesignated Liquor Permit for a wedding reception and dance on October 23, 2010. Motion carried.Moved by Smidt, seconded by Grovijohn, to approve the application of Rush’s Liquor Storefor a special designated liquor permit for sampling/tasting of beverages on November 12 and 13,2010. Motion carried.Moved by Ell, seconded by Smidt, to approve the application of Rush’s Liquor Store for aspecial designated liquor permit for the West Point Community Theater Production on November 5,6, 7, 12 and 13, 2010. Motion carried.

Motion carried.Moved by Smidt, seconded by Ell, to approve the application of the West Point VolunteerFire Department for a Special Designated Liquor Permit for the Firemen’s New Year’s Eve Danceon December 31, 2010. Motion carried.Moved by Paus, seconded by Ell, to approve the claim of Hugo Plumbing & Heating forservices and supplies in the amount of $33,132.66. Motion carried.Next the Council considered Ordinance No. 1321 on its second reading. This ordinanceallows for the sale and discharge of fireworks during New Year’s Eve and increases the fees.Ordinance No. 1321 was then read by title only:AN ORDINANCE OF THE CITY OF WEST POINT, NEBRASKA, AMENDING SECTIONS7-402 AND 7-403 OF THE REVISED MUNICIPAL CODE RELATING TO SALE OFFIREWORKS; REPEALING EXISTING SECTIONS 7-402 AND 7-403 AND ALLORDINANCES IN CONFLICT; PRESCRIBING THE TIME WHEN THIS ORDINANCESHALL BE IN FORCE AND TAKE EFFECT; AND TO PROVIDE FOR THE PUBLICATIONOF THIS ORDINANCE IN PAMPHLET FORM.Motion was made by Smidt to approve Ordinance No. 1321 on its second reading. This motionfailed for lack of a second. Several Councilmembers opposed the sale and discharge of fireworks onNew Year’s Eve but not the increase in fees. It was decided that the ordinance would be revised toreflect only the increase in fees and be presented to the Council at the next meeting.Moved by Grovijohn, seconded by Smidt, to adjourn at 8:40 o'clock P.M.
