ONTARIO CANOE TRIP OUTFITTERS LIMITEDDBA: AO BOATWERKS, AND ALGONQUIN OUTFITTERS (AO)RELEASE OF LIABILITY, WAIVER OF CLAIMSASSUMPTION OF RISKS AND INDEMNITY AGREEMENTBy signing this document you will waive certain legal rights, including the right to sue.PLEASE READ CAREFULLYDEFINITIONSIn this agreement the rental and/or use of equipment, or instruction of White Water Kayaking, White WaterCanoeing, Kayaking, Canoeing, and Rafting, shall be referred to as “Paddlesports and related activities”.ACKNOWLEDGEMENT – PADDLESPORTS AND RELATED ACTIVITIES SAFETYI acknowledge that I have been advised to wear a Personal Floatation Device (PFD) and a helmet where necessarywhile participating in Paddlesports and related activities. Instruction in the proper use of the PFD is availablefrom the staff. I am aware that the physical exertion required by Paddlesports and related activities, and theforces exerted on the body can activate or aggravate pre-existing physical injuries, conditions, symptoms, orcongenital defects. I have been advised to seek medical advice if I know or suspect that my physical condition maybe incompatible with Paddlesports and related activities. I acknowledge that I am not nor will I be under theinfluence of drugs or alcohol while participating in Paddlesports and related activities.AWARENESS AND ASSUMPTION OF RISKI acknowledge that I have the right to inspect the rental equipment outlined above and ensure that it is ingood working order.I agree to return the same equipment in identical condition, save normal wear and tear.I accept responsibility for any loss or damage, however caused, and agree to reimburse AO Boatwerks forsuch loss or damage.I acknowledge that these Paddlesports and related activities will entail risk of injury to my person orproperty.I acknowledge that included in these risks are negligence on the part of AO Boatwerks, it’s directors,officers, employees, guides, instructors, independent contractors, subcontractors and representatives, andother participants (referred to in the rest of this agreement as “AO Boatwerks AND OTHERS”). I freelyaccept and fully assume all such risks and the possibility of personal injury, death, property damage,expense and related loss, including loss of income by reason of the operation, handling, existence, use,transportation or maintenance of the equipment by or while in my hands or those of my employees, agentsor carriers.

RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENTIn consideration of AO Boatwerks furnishing services and/or equipment to enable me to participate in thiswilderness trip, I agree as follows:1. To waive any and all claims that I may have in the future against AO Boatwerks AND OTHERS2. To release AO Boatwerks AND OTHERS for any and all liability for any personal injury, death, propertydamage, expense and related loss, including loss of income that I or my next of kin may suffer as a resultof my participation in this activity, due to any cause whatsoever, including negligence, breach of contract,or breach of any statutory duty of care3. To hold harmless and indemnify AO Boatwerks AND OTHERS from any and all liability for any damage toproperty of, or personal injury to, any third party, resulting in my participation in this activity and/or byreason of the condition of the equipment or it’s suitability for the work it may be required to perform.I HAVE READ THIS AGREEMENT AND UNDERSTAND IT. Understanding the risk involved in the Paddlesports and related activities,I hereby provide consent to AO Boatwerks AND OTHERS to seek emergency treatment for the minor if deemed necessaryby AO Boatwerks AND OTHERS.
