Title 8Laws of Bermuda Item 31Effect of changes in law18 (1) A person cannot be punished for doing an act or making anomission unless the act or omission constituted an offence under the lawin force when it occurred; nor unless doing the act or making theomission under the same circumstances would constitute an offenceunder the law in force at the time when he is charged with the offence.(2) If the law in force when the act or omission occurred differsfrom that in force at the time of conviction, the offender cannot bepunished to any greater extent—(a) than was authorized by the former law; or(b) than is authorized by the latter law.Trial in certain cases of homicide19 If any person is unlawfully hurt upon the sea, or at any place outof Bermuda, and dies in consequence thereof in Bermuda, or if any personis unlawfully hurt in Bermuda, and dies in consequence thereofupon the sea, or at any place out of Bermuda, then every such offence,whether the offence amounts to murder or manslaughter, or beingaccessory to murder or manslaughter, may be dealt with in Bermuda inthe same manner in all respects as if such offence had been committedwholly in Bermuda.Offences procured or counselled by persons out of Bermuda20 (1) Any person who, having while out of Bermuda procuredanother person to do an act or make an omission in Bermuda of suchnature that, if he had himself done the <strong>Act</strong> or made the omission inBermuda, he would have been guilty of an offence, afterwards comes intoBermuda, is by such coming into Bermuda guilty of an offence of thesame kind, and is liable to the same punishment, as if he had himselfdone the act or made the omission in Bermuda.(2) Any person who, having while out of Bermuda counselled orprocured the commission of an offence which is actually committed inBermuda, afterwards comes into Bermuda, is by such coming intoBermuda guilty of an offence of the same kind, and is liable to the samepunishment, as if he had been in Bermuda when the offence wascommitted.Offences procured in Bermuda to be committed out of Bermuda21 (1) Any person who while in Bermuda procures to anotherperson to do an act or make an omission at a place out of Bermuda ofsuch a nature that, if he had himself done the act or made the omissionin Bermuda, he would have been guilty of an offence, and that, if he hadhimself done the act or made the omission, he would have been guilty ofan offence under the laws in force in the place where the act or omission29
