CRIMINAL CODE ACT <strong>1907</strong>Unlawful assembly99 Any person who takes part in an unlawful assembly is guilty of asummary offence, and is liable to imprisonment for twelve months.Riot100 Any person who takes part in a riot is guilty of a misdemeanourand is liable on conviction by a court of summary jurisdiction to imprisonmentfor twelve months, and on conviction on indictment to imprisonmentfor two years.Making of proclamation101 Whenever any persons, to the number of twelve or more, are riotouslyassembled together, any magistrate, any Justice of the Peace, orthe Provost Marshal General, may go amongst them, or as near as he cansafely come to them, and command or cause to be commanded with aloud voice that silence be kept while the proclamation next hereinaftermentioned is made, and then openly and with a loud voice make proclamation,or cause proclamation to be made, in these words or to the likeeffect:"Our Sovereign Lady the Queen charges and commandsall persons here assembled immediately to dispersethemselves and peaceably to depart to their habitations,or to their lawful business, or they will be guilty offelony, and will be liable to be imprisoned for threeyears. God Save the Queen".Offences in connection with making of proclamation and remainingassembled after proclamation102 (1) Any person who, wilfully and knowingly and by force, opposes,obstructs or hurts any person who goes to make or begins tomake any proclamation in pursuance of section 101, and thereby preventsthe proclamation being made, is guilty of a felony, and is liable toimprisonment for three years.(2) Any persons who, being so assembled, continue together tothe number of twelve or more, and do not disperse themselves within thespace of an hour after the making of the proclamation, are each guilty ofa felony, and are each liable to imprisonment for three years.(3) When the making of the proclamation is prevented, anypersons who, being so assembled, and to whom the proclamation wouldor ought to have been made if the making thereof had not been so prevented,and who, knowing of such prevention, continue together to thenumber of twelve or more, and do not disperse themselves within thespace of an hour after the time of such prevention, are each guilty of afelony, and are each liable to imprisonment for three years.80
