Title 8Laws of Bermuda Item 31Provided that neither of them can institute criminal proceedingsagainst the other with respect to property while they are living together.(3) In this section "property", used with respect to a wife,means her separate property.Offences by partners and members of companies with respect topartnership or corporate property.52 Any person who, being a member of a partnership, corporationor any association recognized as a company by the Companies <strong>Act</strong> 1981[title 17 item 5] does any act or makes any omission with respect to theproperty of the partnership, corporation or company which, if he werenot a member of the partnership, corporation or company, wouldconstitute an offence, is criminally responsible to the same extent as ifhe were not such member.PART IVPURPOSE AND PRINCIPLES OF SENTENCINGPurpose53 The fundamental purpose of sentencing is to promote respect forthe law and to maintain a just, peaceful and safe society by imposingjust sanctions that have one or more of the following objectives—(a) to protect the community;(b) to reinforce community-held values by denouncingunlawful conduct;(c) to deter the offender and other persons from committingoffences;(d) to separate offenders from society, where necessary;(e) to assist in rehabilitating offenders;(f) to provide reparation for harm done to victims;(g) to promote a sense of responsibility in offenders byacknowledgement of the harm done to victims and to thecommunity.[Section 53 repealed and substituted by 2001:29 effective 29 October 2001]Fundamental principle54 A sentence must be proportionate to the gravity of the offenceand the degree of responsibility of the offender.[Section 54 repealed and substituted by 2001:29 effective 29 October 2001]39
