In 1987 Mr. Terry returned to the goldindustry as L<strong>and</strong> Manager for <strong>American</strong>Barrick Resources Corporation,predecessor to Barrick GoldCorporation. In 1992 Barrick GoldstrikeMines completed mineral surveys,patent applications <strong>and</strong> mineral reportsfor certain mining <strong>and</strong> mill site claims atthe Goldstrike property - specifically, thePost-Betze open pit <strong>and</strong> Meikleunderground mines. In 1993 Secretaryof Interior Bruce Babbitt refused to signthe mineral patents. Barrick filed apetition for a Writ of M<strong>and</strong>amus inFederal District Court in Reno, Nevada.In the spring of 1995 Secretary Babbittsigned the patents.In 1995 Mr. Terry left AAPL, letting his<strong>CPL</strong> designation lapse, to accept anappointment from Governor Michael O.Leavitt to be Director of Utah School &Institutional Trust L<strong>and</strong>s Administration,an appointed position equivalent to theelected L<strong>and</strong> Commissioners in otherwestern states like Texas <strong>and</strong> NewMexico.From 1995 to 2001 the permanentschool trust fund grew from $94 millionto over $400 million, annual revenuesgrew from $15 million to $80 million <strong>and</strong>the state completed the largest l<strong>and</strong>exchange in the U. S. A. outside ofAlaska.Mr. Terry re-joined AAPL <strong>and</strong> passedthe <strong>CPL</strong> exam in 2001. Since that timehe has served the AAPL as a Directorfrom Utah, as Chair of the Public L<strong>and</strong>sCommittee <strong>and</strong> currently chairs thePublications Committee. He is also apast President of the Utah Associationof Professional L<strong>and</strong>men.He enjoys alpine skiing, traveling,college football, major league springtraining <strong>and</strong> spending time with hisfamily.Course ObjectivesThe primary purpose of the <strong>Oil</strong> <strong>and</strong> <strong>Gas</strong>L<strong>and</strong> <strong>Review</strong> course is to prepare eachl<strong>and</strong>man for the <strong>CPL</strong> or <strong>RPL</strong> exam. Thecourse covers many of the areas (althoughnot all) that a l<strong>and</strong>man might becomeinvolved with over a career. It is primarily areview, <strong>and</strong> those taking the exam shouldnot rely solely upon the review in preparingfor the exam.The course is also a great opportunity foranyone interested in a review of thesematerials. We receive many comments fromattendees that they learned a lot from thecourse <strong>and</strong> remembered things longforgotten.The first five sections plus ethics are part ofthe <strong>RPL</strong> <strong>Review</strong>. The entire course is part ofthe <strong>CPL</strong> <strong>Review</strong>.This is a two-<strong>and</strong>-a-half-day course, withapproximately eighteen hours of classlecture. Attendees will be provided a boundworkbook containing course materialsReal Property LawThe review begins with a thoroughdiscussion of the types of property, variousmethods of acquiring title, the types ofdeeds <strong>and</strong> the attributes of warranty <strong>and</strong>special warranty deeds, the types ofownership <strong>and</strong> important differences,including life estates <strong>and</strong> remaindermen.This section also includes a review of therequirements to record documents <strong>and</strong> thevarious recording statutes. The sectionconcludes with a brief discussion of theprimary real property law differencesbetween Louisiana <strong>and</strong> other states.L<strong>and</strong> DescriptionsThis section discusses the three primarytypes of US l<strong>and</strong> descriptions: RectangularSurvey (Township-Range), Metes <strong>and</strong>Bounds (<strong>and</strong> how to plat), <strong>and</strong> the variousTexas l<strong>and</strong> descriptions.Contract LawThe discussion on Contract Law will coverthe basic elements of a contract, the typesof contracts, requirements of a valid contract<strong>and</strong> the penalty for breach, offers <strong>and</strong>termination of offers, the legal capacity to


costs. The focus is on developing a broadunderst<strong>and</strong>ing of this area.EthicsThis section covers the AAPL Code ofEthics <strong>and</strong> St<strong>and</strong>ards of Practice which arethe basis of conduct, business principles,<strong>and</strong> ideals for all AAPL members. Sincethere are no licensing requirements forl<strong>and</strong>men <strong>and</strong> since membership in AAPL isvoluntary, these ethical st<strong>and</strong>ards are a keyelement of AAPL membership <strong>and</strong> being aprofessional l<strong>and</strong>man.Information on the requirements for <strong>CPL</strong><strong>and</strong> <strong>RPL</strong> are included below.Continuing Education CreditsBy attending the entire course, <strong>RPL</strong>s <strong>and</strong><strong>CPL</strong>s will earn 18 education credits,including one ethics credit. There is nolonger an option to sit for the <strong>CPL</strong> exam tosatisfy additional continuing educationcredits.EXAMINATIONSYou may take the exam prior to approval ofyour <strong>CPL</strong> or <strong>RPL</strong> application, but only if youqualify based on the questionnaire below.The results of your exam will have nobearing on the approval of your application.Each applicant is responsible forascertaining their qualifications (viaeducation/experience) for becoming a <strong>CPL</strong>or a <strong>RPL</strong>. The exam covers all chapters of thecourse material. The <strong>CPL</strong> <strong>Exam</strong> is acomprehensive test of the skills <strong>and</strong>knowledge required of a l<strong>and</strong>man with sevenor more years of experience. The review<strong>and</strong> the book cover most of the material onthe exam but the prospective <strong>CPL</strong> isexpected to bring experience <strong>and</strong> skills tothe table.<strong>RPL</strong> <strong>Exam</strong>inationThe <strong>RPL</strong> exam is offered on either Tuesday,July 23rd or Thursday, July 25 th . The <strong>RPL</strong><strong>Exam</strong> covers the course material inChapters 1-7.The <strong>RPL</strong> exam is a comprehensive test ofthe skills <strong>and</strong> knowledge required of al<strong>and</strong>man with three or more years ofexperience.
