In 1987 Mr. Terry returned to the goldindustry as Land Manager for AmericanBarrick Resources Corporation,predecessor to Barrick GoldCorporation. In 1992 Barrick GoldstrikeMines completed mineral surveys,patent applications and mineral reportsfor certain mining and mill site claims atthe Goldstrike property - specifically, thePost-Betze open pit and Meikleunderground mines. In 1993 Secretaryof Interior Bruce Babbitt refused to signthe mineral patents. Barrick filed apetition for a Writ of Mandamus inFederal District Court in Reno, Nevada.In the spring of 1995 Secretary Babbittsigned the patents.In 1995 Mr. Terry left AAPL, letting hisCPL designation lapse, to accept anappointment from Governor Michael O.Leavitt to be Director of Utah School &Institutional Trust Lands Administration,an appointed position equivalent to theelected Land Commissioners in otherwestern states like Texas and NewMexico.From 1995 to 2001 the permanentschool trust fund grew from $94 millionto over $400 million, annual revenuesgrew from $15 million to $80 million andthe state completed the largest landexchange in the U. S. A. outside ofAlaska.Mr. Terry re-joined AAPL and passedthe CPL exam in 2001. Since that timehe has served the AAPL as a Directorfrom Utah, as Chair of the Public LandsCommittee and currently chairs thePublications Committee. He is also apast President of the Utah Associationof Professional Landmen.He enjoys alpine skiing, traveling,college football, major league springtraining and spending time with hisfamily.Course ObjectivesThe primary purpose of the Oil and GasLand Review course is to prepare eachlandman for the CPL or RPL exam. Thecourse covers many of the areas (althoughnot all) that a landman might becomeinvolved with over a career. It is primarily areview, and those taking the exam shouldnot rely solely upon the review in preparingfor the exam.The course is also a great opportunity foranyone interested in a review of thesematerials. We receive many comments fromattendees that they learned a lot from thecourse and remembered things longforgotten.The first five sections plus ethics are part ofthe RPL Review. The entire course is part ofthe CPL Review.This is a two-and-a-half-day course, withapproximately eighteen hours of classlecture. Attendees will be provided a boundworkbook containing course materialsReal Property LawThe review begins with a thoroughdiscussion of the types of property, variousmethods of acquiring title, the types ofdeeds and the attributes of warranty andspecial warranty deeds, the types ofownership and important differences,including life estates and remaindermen.This section also includes a review of therequirements to record documents and thevarious recording statutes. The sectionconcludes with a brief discussion of theprimary real property law differencesbetween Louisiana and other states.Land DescriptionsThis section discusses the three primarytypes of US land descriptions: RectangularSurvey (Township-Range), Metes andBounds (and how to plat), and the variousTexas land descriptions.Contract LawThe discussion on Contract Law will coverthe basic elements of a contract, the typesof contracts, requirements of a valid contractand the penalty for breach, offers andtermination of offers, the legal capacity to

costs. The focus is on developing a broadunderstanding of this area.EthicsThis section covers the AAPL Code ofEthics and Standards of Practice which arethe basis of conduct, business principles,and ideals for all AAPL members. Sincethere are no licensing requirements forlandmen and since membership in AAPL isvoluntary, these ethical standards are a keyelement of AAPL membership and being aprofessional landman.Information on the requirements for CPLand RPL are included below.Continuing Education CreditsBy attending the entire course, RPLs andCPLs will earn 18 education credits,including one ethics credit. There is nolonger an option to sit for the CPL exam tosatisfy additional continuing educationcredits.EXAMINATIONSYou may take the exam prior to approval ofyour CPL or RPL application, but only if youqualify based on the questionnaire below.The results of your exam will have nobearing on the approval of your application.Each applicant is responsible forascertaining their qualifications (viaeducation/experience) for becoming a CPLor a RPL. See the questionnaire below forrequirements, or visit the AAPL website atwww.landman.org for information about therequirements and an application form.CPL ExaminationThe CPL exam is offered on Thursday, July25. The exam covers all chapters of thecourse material. The CPL Exam is acomprehensive test of the skills andknowledge required of a landman with sevenor more years of experience. The reviewand the book cover most of the material onthe exam but the prospective CPL isexpected to bring experience and skills tothe table.RPL ExaminationThe RPL exam is offered on either Tuesday,July 23rd or Thursday, July 25 th . The RPLExam covers the course material inChapters 1-7.The RPL exam is a comprehensive test ofthe skills and knowledge required of alandman with three or more years ofexperience. The requestmust indicate the reason that assistance isneeded, the years of AAPL membership(minimum two years), and list all otherprograms for which tuition assistance wasapproved (maximum of two events peryear). The names of registrants requestingfinancial assistance will remain confidential.Tuition assistance is available for all AAPLoperated education programs except theannual meeting. This includes all AAPLInstitutes, Seminars, Workshops, and Oiland Gas Land Reviews (CPL/RPL) andexam. Assistance for these programs islimited to two per year. Assistance is alsoavailable for all AAPL on-line programs withno limit to the programs watched.
