frequently asked questionsWhat are the best areas to exhibit in?On average, <strong>Fieldays</strong> attracts between 120,000 to 130,000 visitorsfrom throughout <strong>New</strong> <strong>Zealand</strong> and the world each year, thereforeall sites at <strong>Fieldays</strong> benefit from significant pedestrian traffic. Forincreased exposure consider participating in the Premier Feature inthe heart of <strong>Fieldays</strong> (refer to pages 4 & 5).REMEMBER: An appealing exhibit or display will always attract themost attention!Will my site be powered?Yes – all sites are powered. Indoor sites include up to 10 ampssingle phase and outdoor sites include up to 16 amps single phase.For additional power requirements, see page 22.Can I have the same site I had last year?Only if you have reserved your site (NOTE: Not all sites are able tobe reserved). If you are not a reserved site holder you do not havespecial rights to a site you have exhibited on at previous <strong>Fieldays</strong>.To ensure you have the best opportunity to secure a site for the2012 <strong>Fieldays</strong>, we recommend you apply before site allocationbegins on 1st December 2011. Exhibitors with motorcycles, small generators and similar productsleft displayed outside secured marquees, should have an alarmedsecurity loop through the frames or cages of each product. In orderto steal a product the offender(s) would be required to breakthe circuit and activate the alarm. This could be remotely monitoredon site by site security and responded too immediately.3. Marquees and buildings that can be secured or closed off onsite could have a radio controlled infra-red detector fitted that can beoperated by a hand-held remote and again monitored andresponded to by onsite security. Contact the <strong>Fieldays</strong> officefor further information.4. Every site should have a secure area or unit not accessible to bythe public for securing cash, Exhibitors handbags, computers andcellphones etc not in use. These products left unattended in sitesmay be stolen by the opportunist thief.5. Failure to do so will be considered as a relinquishment of the reservedsite(s) for the current year and the site will be sold for the current <strong>Fieldays</strong>.Cancellation of ContractIf an exhibitor should cancel the contract or terminate a site booking:Prior to 26 March 2012 any refund shall be at the Society’s discretion,notwithstanding that a portion shall be retained to defray expenses/costs.On or after 26 March 2012 the Society shall retain all monies received.The Society has the right to cancel this contract and to retain any monies paidin relation to this contract if the Exhibitor:Infringes any of the Exhibiting Conditions and/orDoes not occupy the site during the full period of the <strong>Fieldays</strong> to whichthis contract applies and/orDoes not occupy the site by 5:00pm on the day preceding the openingday of <strong>Fieldays</strong>.Cancellation/Postponement of <strong>Fieldays</strong>If the Society finds it necessary or expedient to cancel or postpone <strong>Fieldays</strong>,this contract will cease to operate upon notice to that effect, signed by the CEO,being served on the Exhibitor in any of the following ways:Handing it to her/him in an envelope; orBy couriered mail to her/his address as it appears in the contract; orBy handing or offering it to any person who appears, or is thought by the Managerto be, an employee or agent of the Exhibitor.The Society shall not be liable to the Exhibitor for any compensation whatsoever asa result of the cancellation or postponement of <strong>Fieldays</strong>.No refund of any monies paid will be made to Exhibitors in the event of <strong>Fieldays</strong>being cancelled or postponed.No refund of any monies paid will be made to Exhibitors cancelling the contract.ExhibitsThe Manager or any other person appointed by the Society, has the power toenter an Exhibitor’s site at any time and remove any article, sign, picture or printedmatter which in her/his own opinion may cause offence to the public, or is not inkeeping with the requirements of the Society.If an Exhibitor does not exhibit for the full period of the <strong>Fieldays</strong> (i.e. breaks downor abandons the site prior to the official closing of <strong>Fieldays</strong> without approval) theSociety has the right to decline future applications from that Exhibitor. The Exhibitormay also be liable for early break down penalties as outlined in the ExhibitorHandbook.Control of products and services:The intent of the <strong>New</strong> <strong>Zealand</strong> <strong>National</strong> <strong>Agricultural</strong> <strong>Fieldays</strong> is to exhibit productsand services that will assist the farmer in farming activities and production.Products and services exhibited must be related to the business of agriculture,horticulture or relevant primary production, or those exhibits accepted in the RuralLiving area under a priority order. Note: Boats are excluded from the <strong>Agricultural</strong>area unless written approval is gained from the Society.(c)i)ii)(d)7.4(a)(b)(c)7.57.67.77.87.97.107.117.127.137.147.158.08.18.28.38.4The Society reserves the right to require an Exhibitor to immediately removeany particular product or service (whether in whole or in part) from <strong>Fieldays</strong>where the Society is satisfied in its absolute discretion that:such product or service is agricultural or horticultural related; andan authorised <strong>New</strong> <strong>Zealand</strong> importer and/or an authorised <strong>New</strong> <strong>Zealand</strong>distributor has made a substantiated claim to the Society that the Exhibitordoes not have the authority to deal with the particular product or servicein trade.The Society has a policy related to qualifying exhibits and this is availableupon enquiry to the Society.Promotions by Exhibitors in the <strong>Agricultural</strong> Exhibition Areas. The Societyencourages promotions/activities on an Exhibitor’s site. Promotions usingproducts should preferably be agricultural or horticultural related. Howeverpromotional products that are not agricultural/horticultural related may beused as a promotional tool, provided they are:Not sold or raffled, and do not promote or display the seller or manufacturerof the non agricultural product.Not the major portion of the display or exhibit.Part of some bona fide marketing/promotional link to the Exhibitor’s ownproducts or services (e.g. bold agricultural/horticultural product name onthe product).All exhibits must be in as new condition. The offering for sale of secondhandequipment/tractors is not permitted without written consent from theSociety. Imported trucks up to the age of 7 years suitable for agriculturemay be permitted with written consent from the Society.Exhibitors must man the site/s covered by this contract and are responsiblefor the condition of their site during the currency of <strong>Fieldays</strong>.Exhibitors may provide light refreshments on their site if written consent hasbeen granted to them to do so by the <strong>Fieldays</strong> Society. Exhibitors must notcharge for these light refreshments. Note: Espresso coffee is not to be soldor given away without approval from the Society.Alcoholic beverages shall not be sold anywhere – for cash or exchangedfor vouchers – except in the Society’s own controlled areas.Exhibitors may promote and take orders from their stands. The selling anduplifting of goods sold from stands is allowed provided that Exhibitorsreplenish stock so as not to deplete stands.Onsite activities are encouraged but Exhibitors shall not conduct any raffle,competition, game, or sell by auction, unless approved in writing by theSociety.The distribution of any form of promotional material or other forms ofmarketing including promotional staff outside of the Exhibitors siteboundary is prohibited. Exhibitors are encouraged to utilise the <strong>Fieldays</strong>official marketing channels including but not limited to; <strong>Fieldays</strong> websiteadvertising, <strong>Fieldays</strong> Buying Guide & Programme advertising, <strong>Fieldays</strong>Focus advertising, the hire of the approved <strong>Fieldays</strong> Cheerleaders and BigScreen advertising.The promotion of animals at <strong>Fieldays</strong> may be done through the use ofproduction and progeny figures. Show records must not be used.Exhibitors selling or displaying vehicles on their site must ensure at least70% of all vehicles displayed are commercial vehicles - i.e. utes, vans,trucks, 4x4 commercials etc. Cars must not take up to more than 30% ofthe site and must not be the major focus of the site. This excludes vehiclesutilised for Exhibitor staff transportation or re-stocking which must beparked off site in the designated car parks.The Society may accept or decline any application for exhibiting rights.The Society reserves the right to allocate sites for exhibitors where theydeem most appropriate.Site Preparation and SafetyThe delivery of equipment and construction of displays must be completedby 5:00pm on the day preceding the opening day of <strong>Fieldays</strong>.Exhibitors must comply with local body bylaws and requirements and Actsof Parliament (including OSH Act) which govern the erection of strategies,the display and/or sale of machinery, vehicles and/or other products orgoods of the Exhibitor and Aviation Safety Regulations. It is a condition ofexhibiting at <strong>Fieldays</strong> that all Exhibitors submit a list of identified hazardsposed by their site along with remedies to eliminate, isolate or minimisethese. Forms will be available to complete online www.fieldays.co.nz andmust be submitted by the relevant deadline.Exhibitors with displays that allow members of the public to move orexamine items, must ensure that items are ones that cannot cause injury;and if moved can be put back in the same safe situation.Each Exhibitor must keep all display equipment and signs, etc within theirallocated site boundaries. For Outdoor Sites the walls of all marquees andtents must not be closer to the boundary that the requirement of the Waipa24

A copy of the Exhibitor’s Healthand Safety Policy must be lodged with the <strong>Fieldays</strong> office prior to <strong>Fieldays</strong>.All Exhibitors shall examine their displays for hazards and take steps toeliminate, protect and mitigate against potential injury to the greatest extentpractical.All tent and marquee pegs must be covered with bags or shrubs, as mustother dangerous spikes, protruding objects, etc.The flying of balloons, blimps etc shall conform with the Society’s publishedrestrictions and within CAA guidelines.Exhibitors must, before digging any holes or driving any objects into theground, ensure that there are no underground power cables or water pipesthat could be damaged or cause injury to the Exhibitor or their staff. Alldamage caused by Exhibitors or their staff will be repaired at the Exhibitorsexpense. DO NOT DIG BETWEEN PARALLEL RED LINES.Fire precautions. Each Exhibitor must have at least one suitable fireextinguisher readily available onsite.The dropping of advertising leaflets or other similar material either onsite orfrom aircraft over <strong>Fieldays</strong> is prohibited (including car park areas).All livestock shall be led by two people at all times when being movedaround the <strong>Fieldays</strong> exhibition site.VehiclesNo vehicles other than those nominated as eligible products arepermitted on exhibition sites during the <strong>Fieldays</strong> hours (8:00am to5:00pm). Cars and vehicles parked on roadways and cable lanes between8:00am and 5:00pm will be removed at the Exhibitor’s risk and expense.Contact details must remain on the dash, failure to do so will result inimmediate removal of the vehicle at the owners risk and expense.RemovalExhibitors must ensure the removal, safety/security of exhibit material after<strong>Fieldays</strong> closure.Exhibitors must vacate the <strong>Fieldays</strong> site as follows:Exhibitors in the Mystery Creek Pavilion and the Event Zone must vacatewithin four (4) days of the close of <strong>Fieldays</strong>.All outdoor sites will be given until 22 June 2012 to remove their exhibitsfrom the property (except those in the Event Zone).If an Exhibitor does not exhibit for the full period of the <strong>Fieldays</strong> (i.e. breaksdown or abandons the site prior to the official closing of <strong>Fieldays</strong> withoutapproval) the Society has the right to decline future applications from thatExhibitor. The Exhibitor may also be liable for early break down penalties asoutlined in the Exhibitor Handbook.Exhibitors in the Rural Living and Innovation Centre clear span marqueesare likely to have the covers over their sites removed one day after <strong>Fieldays</strong>closure.Exhibitors must take all steps to ensure their site is returned to its originalcondition within the timeframes listed in Condition 10.2 following theclosure of <strong>Fieldays</strong>. Failure to do so will result in the Exhibitor having topay reinstatement costs and a bond being placed on the Exhibitor forsubsequent events (please ensure sub-contractors are aware of thisClause).Exhibitors whose items remain on the property at the end of the timeframeslisted in Clause 10.2 from the closing of <strong>Fieldays</strong> will be liable for any legalcosts resulting, plus a site rental of $100.00 + GST per day until the itemsare removed from the <strong>Fieldays</strong> property.Insurance and SecurityAlthough the Society arranges night security four days prior to, during andtwo days after the event, the Society shall not be liable for loss or damageto the Exhibitor’s property whilst it is on the <strong>Fieldays</strong> site.Exhibitors are advised to arrange their own insurance cover for theirproperty, including contents, plant, machinery, stock, monies, motorvehicles and mobile plant and equipment.All Exhibitors must arrange General (Public) Liability insurance coverwith a sum insured limit of not less than $2,000,000 (two million). Thislimit does not in any way limit your liability. The Society may require proofthat liability cover has been arranged. The Society will not be responsiblefor any claim.NoiseThe use of amplifiers or loud-speakers by Exhibitors is at the discretionof the Society.12.213.013.113.213.313.413.513.614.014.1(a)(b)(c)(d)15.015.116.016.117.017.1(a)(b)(c)18.018.1Noisy machines must be demonstrated on sites one at a time only, and suchdemonstrations must not offend neighbouring Exhibitors. The Society maylimit times of use for noisy machines, loudhailers or amplifiers.Subletting or Allowing Other Firms on SitesThe Exhibitor shall not assign, on-sell or part with the possession of the wholeor any part of the site, other than under 13.2 below.Exhibitors who invite other firms to display or demonstrate on their site mustensure that the firms concerned complete another Site Application Form andpay the sublet charge, or the original Exhibitor shall be liable to pay the subletcharge themselves.Those to whom sites are sublet must be agriculture/horticulture/primaryproduction Exhibitors.No Exhibitor may display on their site the name of any firm which is not anExhibitor and has not paid the sublet fee.Equipment which is not represented by the manufacturer or a distributor maynot be demonstrated or allowed onto another Exhibitor’s site.All signs, hoardings, stickers or promotions outside the Exhibitor’s site mustbe approved by the Society and will be liable for the charges set out by theSociety.Use of Exhibitor Address InformationBy completing a Site Application Form the Exhibitor agrees and the Societyacknowledges that:Exhibitor contact details can be forwarded to the Society’s Strategic Partners,ANZ and The University of Waikato.Exhibitor details will be made available to the media for use in compiling the<strong>Fieldays</strong> newspaper supplements, for Programme preparation and for theSociety to use in promotional/educational material about <strong>Fieldays</strong>.Exhibitor details will be made available to nominated companies that haveexhibit resource materials.Exhibitor details may be used to develop loyalty card initiatives ore-commerce opportunities.Pavilion Air SpaceExhibitors in the Mystery Creek Pavilion have the opportunity to use air spaceabove their sites with no extra fee provided their site is situated directly undera catwalk as indicated on the Mystery Creek Pavilion site map. Banners etcmay be hung off the catwalk, but those seeking to use their ‘air space’ mustobtain consent and prior approval from the <strong>Fieldays</strong> Society. All requestsfor consent must be received by email, fax or letter at least 14 days priorto <strong>Fieldays</strong>. The Society will hang flags and banners. Any item weighingmore than 15kg is to have an engineers certificate, any associated costsfor Equipment, rigging or labour to hang any item over 15kg’s will be at theExhibitors expense. The Society reserves the final right to accept or declinea request for the use of air space. The Exhibitor shall be responsible for anydamage caused through erection or dismantling signage, whatsoever.Transmitting DevicesExhibitors shall notify the Society of any device (excluding cellular phones)that the Exhibitor intends to use prior to, during and post the event. TheSociety reserves the right to limit or prohibit the use of any transmitting deviceused by an Exhibitor, irrespective of radio apparatus for exhibitor or frequencyapproval.Force MajeureNeither party shall be liable for any failure or delay in complying with anyobligation imposed on it under this Agreement if:The failure or delay arises from an act of god, nature, war or government, anycivil disturbance, or any labour disruption (a “force majeure event”);That party, on becoming aware of the force majeure event, promptly notifiesthe other party advising of the nature and expected duration of, and theobligation affected by, the force majeure event; andThat party uses its best endeavours:• To mitigate the effects of the force majeure event on that party’s obligationsunder this Agreement; and• To perform that party’s obligations under this Agreement on time despite theforce majeure event.An obligation to pay money is never excused by force majeure.If a party fails substantially to meet an essential obligation under thisAgreement continuously for three months as a result of a force majeure eventdespite meeting all its obligations under this Clause, the other party may giveone months notice terminating this Agreement.Terms and ConditionsAt any time The Society may modify, add or remove conditions under thisagreement. If a change to these conditions does occur The Society will notifyexhibitors through the next instalment of the <strong>Fieldays</strong> Exhibitor <strong>New</strong>sletter.25
