OCHLOCKONEE BAY TRAIL – PHASE IV FDIP PROJECT # 414032-1-58-01FEDERAL PROJECT # S E 8886 (004)submitted by Contractor to Design Professional within thirty (30) calendar days after Notice ofAward is received by Contractor.7.3. If Contractor wishes to furnish or use a substitute item of material or equipment,Contractor shall make application to the Design Professional for acceptance thereof, certifying thatthe proposed substitute shall perform adequately the functions and achieve the results called for bythe general design, be similar and of equal substance to that specified and be suited to the same useas that specified. The application shall state that the evaluation and acceptance of the proposedsubstitute will not prejudice Contractor's achievement of substantial completion on time, whether ornot acceptance of the substitute for use in the Work will require a change in any of the Contract<strong>Documents</strong> (or in the provisions of any other direct contract with the COUNTY for the Project) toadapt the design to the proposed substitute and whether or not incorporation or use of the substitutein connection with the Work is subject to payment of any license fee or royalty. All variations of theproposed substitute from that specified will be identified in the application and availablemaintenance, repair and replacement service shall be indicated. The application also shall contain anitemized estimate of all costs that will result, directly or indirectly, from acceptance of suchsubstitute, including costs for redesign and claims of other contractors affected by the resultingchange, all of which shall be considered by the Design Professional in evaluating the proposedsubstitute. The Design Professional may require Contractor to furnish at Contractor's expenseadditional data about the proposed substitute.7.4. If a specific means, method, technique, sequence or procedure of construction isindicated in or required by the Contract <strong>Documents</strong>, Contractor may furnish or utilize a substitutemeans, method, sequence, technique or procedure of construction acceptable to the DesignProfessional, if Contractor submits sufficient information to allow the Design Professional todetermine that the substitute proposed is equivalent to that indicated or required by the Contract<strong>Documents</strong>. The procedures for submission to and review by the Design Professional shall be thesame as those provided herein for substitute materials and equipment.7.5. The Design Professional shall be allowed a reasonable time within which to evaluateeach proposed substitute. The Design Professional shall be the sole judge of acceptability, and nosubstitute will be ordered, installed or utilized without the Design Professional's and the COUNTY'sprior written acceptance which shall be evidenced by either a Change Order or an approved ShopDrawing. The COUNTY may require Contractor to furnish at Contractor's expense a specialperformance guarantee or other surety with respect to any substitute. The Design Professional willrecord time required by the Design Professional and the Design Professional's consultants inevaluating substitutions proposed by Contractor and making changes in the Contract <strong>Documents</strong>occasioned thereby. Whether or not the COUNTY accepts a proposed substitute, Contractor shallreimburse the COUNTY for the charges of the Design Professional and the Design Professional'sconsultants for evaluating each proposed substitute.SECTION 00700 – GENERALCONDITIONS PAGE 6 OF 21
