Such changes may be effected by FieldOrder or by other written order. Such changes shall be binding on the Contractor.11. CLAIMS AND DISPUTES.11.1. A Claim is a demand or assertion by one of the parties seeking an adjustment orinterpretation of the terms of the Contract <strong>Documents</strong>, payment of money, extension of time or otherrelief with respect to the terms of the Contract <strong>Documents</strong>. The term "Claim" also includes otherdisputes and matters in question between the COUNTY and Contractor arising out of or relating tothe Contract <strong>Documents</strong>. The responsibility to substantiate a Claim shall rest with the party makingthe Claim.11.2. Claims by the Contractor shall be made in writing to the COUNTY and DesignProfessional within forty-eight (48) hours after the first day of the event giving rise to such Claim orelse the Contractor shall be deemed to have waived the Claim. Written supporting data shall besubmitted to the COUNTY and Design Professional within fifteen (15) calendar days after theoccurrence of the event, unless the COUNTY grants additional time in writing, or else theContractor shall be deemed to have waived the Claim. All claims shall be priced in accordance withthe provisions of Subsection 10.4.11.3. The Contractor shall proceed diligently with its performance as directed by theCOUNTY, regardless of any pending Claim, action, suit or administrative proceeding, unlessotherwise agreed to by the COUNTY in writing. The COUNTY shall continue to make payments inaccordance with the Contract <strong>Documents</strong> during the pendency of any Claim.12. OTHER WORK.12.1. The COUNTY may perform other work related to the Project at the site by theCOUNTY's own forces, have other work performed by utility owners or let other direct contracts. Ifthe fact that such other work is to be performed is not noted in the Contract <strong>Documents</strong>, writtennotice thereof will be given to Contractor prior to starting any such other work. If Contractorbelieves that such performance will involve additional expense to Contractor or require additionaltime, Contractor shall send written notice of that fact to the COUNTY and Design Professionalwithin forty-eight (48) hours of being notified of the other work. If the Contractor fails to send theabove required forty-eight (48) hour notice, the Contractor will be deemed to have waived any rightsit otherwise may have had to seek an extension to the Contract Time or adjustment to the ContractAmount.12.2. Contractor shall afford each utility owner and other contractor who is a party to sucha direct contract (or the COUNTY, if the COUNTY is performing the additional work with theCOUNTY's employees) proper and safe access to the site and a reasonable opportunity for theintroduction and storage of materials and equipment and the execution of such work and shallproperly connect and coordinate its Work with theirs. Contractor shall do all cutting, fitting andpatching of the Work that may be required to make its several parts come together properly andSECTION 00700 – GENERALCONDITIONS PAGE 10 OF 21
