L 217/22 EN Official Journal of the European Communities5. 8. <strong>98</strong>— voluntary agreements to which a publicauthority is a contracting party and whichprovide, in the general interest, for compliancewith technical specifications or otherrequirements or rules on services, excludingpublic procurement tender specifications,— technical specifications or other requirementsor rules on services which are linkedto fiscal or financial measures affecting theconsumption of products or services byencouraging compliance with such technicalspecifications or other requirementsor rules on services; technical specificationsor other requirements or rules on serviceslinked to national social security systemsare not included.This comprises technical regulations imposedby the authorities designated by the MemberStates and appearing on a list to be drawn upby the Commission before 5 August 1999 (*),in the framework of the Committee referred toin Article 5.The same procedure shall be used for amendingthis list;’(f) point 10 shall be renumbered 12 and the firstsubparagraph shall read as follows:4. The sixth subparagraph of Article 8(1) shall be replacedby the following:‘With respect to the technical specifications or otherrequirements or rules on services referred to in thethird indent of the second subparagraph of point 11 ofArticle 1, the comments or detailed opinions of theCommission or Member States may concern onlyaspects which may hinder trade or, in respect of ruleson services, the free movement of services or thefreedom of establishment of service operators and notthe fiscal or financial aspects of the measure.’;5. Article 9 shall be amended as follows:(a) Paragraphs 2 and 3 shall be replaced by the following:‘2. Member States shall postpone:— for four months the adoption of a draft technicalregulation in the form of a voluntaryagreement within the meaning of the secondindent of the second subparagraph of point 11of Article 1,— without prejudice to paragraphs 3, 4 and 5, forsix months the adoption of any other draft technicalregulation (except for draft rules onservices),‘12. “draft technical regulation”, the text of a technicalspecification or other requirement or of arule on services, including administrativeprovisions, formulated with the aim of enactingit or of ultimately having it enacted as atechnical regulation, the text being at a stage ofpreparation at which substantial amendmentscan still be made;’3. Article 6 shall be amended as follows:(a) the following subparagraph shall be added to paragraph1:‘The Committee shall meet in a specific compositionto examine questions concerning InformationSociety services.’;(b) the following paragraph shall be added:‘8. With respect to rules on services, theCommission and the Committee may consultnatural or legal persons from industry or academia,and where possible representative bodies, capable ofdelivering an expert opinion on the social andsocietal aims and consequences of any draft rule onservices, and take notice of their advice wheneverrequested to do so.’;from the date of receipt by the Commission of thecommunication referred to in Article 8(1) if theCommission or another Member State delivers adetailed opinion, within three months of that date,to the effect that the measure envisaged may createobstacles to the free movement of goods within theinternal market;— without prejudice to paragraphs 4 and 5, forfour months the adoption of any draft rule onservices, from the date of receipt by theCommission of the communication referred toin Article 8(1) if the Commission or anotherMember State delivers a detailed opinion,within three months of that date, to the effectthat the measure envisaged may create obstaclesto the free movement of services or to thefreedom of establishment of service operatorswithin the internal market.With regard to draft rules on services, detailedopinions from the Commission or Member Statesmay not affect any cultural policy measures, inparticular in the audiovisual sphere, which MemberStates might adopt in accordance with Communitylaw, taking account of their linguistic diversity,their specific national and regional characteristicsand their cultural heritage.
