AGENDAREGULAR BUSINESS MEETINGW. R. SATZ SCHOOLJUNE 25, 2013 8:00 PMRESOLVED, that the governing body of the Holmdel Township Board of Education, in the Countyof Monmouth, in the State of New Jersey hereby set its bid threshold to $36,000.00; and be itfurtherRESOLVED, that the governing body hereby appoints Michael R. Petrizzo, CPA as the QualifiedPurchasing Agent to exercise the duties of a purchasing agent pursuant to N.J.S.A. 18A:18A-2b,with specific relevance to the authority, responsibility, and accountability of the purchasing activityof the Board of Education; and be it furtherRESOLVED, that in accordance with N.J.A.C. 5:34-5.2 the Board of Education Secretary ishereby authorized and directed to forward a certified copy of this resolution and a copy ofMichael R. Petrizzo’s certification to the Director of the Division of Local Government Services.MOTION: SECOND: VOTE:9ff.Approval of Authorization for the Holmdel Township Board of Education to Enter in a CooperativePricing Agreement with the Middlesex Regional Educational Services CommissionWHEREAS: N.J.S.A. 40A:11-11(5) authorizes contracting units to establish a Cooperative PricingSystem and to enter into Cooperative Pricing Agreements for its administration; andWHEREAS: the Middlesex Regional Educational Services Commission, hereinafter referred to asthe “Lead Agency " has offered voluntary participation in a Cooperative Pricing System for thepurchase of goods and services;WHEREAS: The governing body of the Holmdel Township Board of Education, County ofMonmouth, State of New Jersey duly considered participation in a Cooperative Pricing System forthe provision and performance of goods and services;NOW, THEREFORE BE IT RESOLVED as follows:This RESOLUTION shall be known and may be cited as the Cooperative Pricing Resolution of theHolmdel Township Board of EducationPursuant to the provisions of N.J.S.A. 40A:11-11(5), the School Superintendent is herebyauthorized to enter into a Cooperative Pricing Agreement with the Lead Agency.The Lead Agency shall be responsible for complying with the provisions of the Local PublicContracts Law (N.J.S.A. 40A:11-1 et seq.) and all other provisions of the revised statutes of theState of New Jersey.MOTION: SECOND: VOTE:32

SATZ SCHOOLJUNE 25, 2013 8:00 PM9gg.Approval of Custodian of Records Public Access to RecordsResolved:That the Board approve the Custodian of Records Public Access to Records asfollows:WHEREAS:P.L. 2001, c.404 (C.47:1A-7), known as the Public Access Law, amends andsupplements P.L. 1963, c 73.P.L. 1995, c.23 and P.L. 1998, c.17 regarding publicaccess to government records, andWHEREAS: the law designates that a person be designated as the custodian of a governmentrecord, andWHEREAS: copies of permitted government records must be provided to persons upon writtenrequest and upon prepayment of fees prescribed by law or regulation, andNOW, THEREFORE, BE IT RESOLVED that the Board of Education appoints the BusinessAdministrator/Board Secretary as the custodian of government records, andBE IT FURTHER RESOLVED, that the Holmdel Township School District approves theform on file in the Business Office for the use of any person, who requests accessto a government record, andBE IT FURTHER RESOLVED, that the fees should be reviewed and approved annually by theBoard of Education.MOTION: SECOND: VOTE:9hh.Approval of Doctrine of NecessityResolved:WHEREAS: the School ethics Act, N.J.S.A. 18A:12-21 et seq. was enacted by theNew Jersey State Legislature to ensure and preserve public confidence in schoolBoard members and school administrators and to provide specific ethical standardsto guide their conduct; andWHEREAS: questions have arisen regarding how a Board should invoke theDoctrine of Necessity when a quorum of a Board of Education has conflicts ofinterest on a matter required to be voted upon; andWHEREAS: the School Ethics Commission has provided some guidance in PublicAdvisory Opinion A03-98 (April 1, 1998) but finds that there is a need to repeatand clarify its opinion; andBE IT FURTHER RESOLVED that the Boards of Education and Charter SchoolBoards of Trustees that invoke the Doctrine are directed to read the resolution at aregularly scheduled public meeting, post it where it posts public notices for 30 daysand provide the Commission with a copy;33
