DepartmentsFrom the PresidentBruce StebbinsAs I take on my new role as <strong>PHCC</strong> <strong>Ohio</strong> president,I’d like to thank Rocco, Debbie, Mary, and Joycefor all the hard work involved in putting on agreat convention. Kalahari was a large venue to“tame”, but everything ran without a hitch. If I’m wrong, noone noticed because the team took care of it! I’d also like toexpress my gratitude to the vendors who took the time to makethe trade show a success. Lastly, a huge thanks to all our <strong>PHCC</strong>family who made it a priority to attend. As we all know, it’s notalways easy to get away from the business for many days. Mymotto for the last few years has been, “I refuse to participate inthe recession.” The large number of attendees gives me hopethat the economy is coming back around for many of us in theindustry.I really thought the paragraph above was enough sentimentsfor the magazine, but Rocco told me otherwise. I was informedthe president is expected to actually write an ARTICLE!!! So,I said to Rocco, “I’m just a plumber! I don’t think about thingspeople want to read! I think about running 30 feet of pipe 60feet in the air and not killing myself in the process! I thinkabout how I am going to keep all my guys working and theirfamilies fed? I think about keeping the company my grandpastarted 84 years ago in business!” Then it all came to me…In 1926 my grandpa, Cecil Stebbins, grew tired ofworking for his uncle. He set off on his own and startedStebbins Plumbing. Times grew hard around 1936 when theGreat Depression hit, so he put the business aside and took ajob for Inland Manufacturing, now known as Delphi. By 1946,the economy had improved and he, along with my grandmaMildred, were once again able to get Stebbins Plumbing up andrunning. By 1951, they were able to move the shop to WestCarrollton, and that’s where we’ve been ever since. StebbinsPlumbing actually joined the local Dayton <strong>PHCC</strong> chapter in1960.“Generation II,” as my family lovingly refers to thechildren of Cecil & Mildred, basically grew up in the plumbingbusiness. The sons, Don, Bob, & Joe began working for theirdad as young teenagers. The daughters, Janice & Arlene,worked in the office where they were eventually joined by thedaughters-in-law, Paulene & Eleanor. All this time, <strong>PHCC</strong> was6 OHIO PHC CONTRACTOR • <strong>Volume</strong> <strong>2011</strong>, <strong>Issue</strong> 1a large part of Stebbins Plumbing & Heating. My uncle, JoeStebbins, was state president in 1999. His wife Deana was afaithful member of the Auxiliary as well. It was only naturalthat I, as well as cousin’s Gene, John, & Brian, would followin the great footsteps laid before us & become plumbers. Andeventually “Generation II” had paid their dues to the industry,& the torch was passed to me. In turn, my dream is for thiscompany to continue when my torch has burned out.I can’t help but think about the many other family owned &operated members we have in <strong>PHCC</strong>. Some of my best friendsin the business share my story – Waker Plumbing in Dayton,Joe Schmitt & Sons Plumbing & Heating in Englewood andNieman Plumbing, Inc in Cincinnati. The list goes on and onwith some slight variances for all, but the common denominatoris FAMILY. They have all experienced hardships & found waysto keep their heads above the toilet bowl (so to speak!).I consider the <strong>PHCC</strong> organization a family as well.Whether you’re a company with 90 years under your belt ora new company trying to learn the ropes, we take care of ourown. This is something I’ve tried to focus on during our recentmembership drive. I continue to grow my company thanksin part to many of the relationships I’ve made through thisorganization. I passionately believe we, as an organization,owe it to ourselves to continue growing. We must focus on theNEXT GENERATION—just as all the family businesses havedone through the years. We must not only teach them what weknow, but be open-minded enough to realize we do not knoweverything. There are always new & better opportunities to bepursued.I intend to bring fresh ideas to the table this year in order tobroaden our <strong>PHCC</strong> family. I plan to attend chapter meetings andconcentrate on finding ways to add to our local memberships. Iwill share what I know, and listen for things I can learn. DepartmentsKeeping ScoreMichael Bohinc. CPAHow has your bottom line been lately? Is it trendingup or trending down? What about your materialcosts (copper, fixtures, etc.)? What about your fuelcosts? Health insurance premiums? I’m pretty surethat those items are trending up and putting significant pressureon your bottom line. There’s no question that we’ve beendealing with a challenging economy here in <strong>Ohio</strong> for the lastfew years. What is in question is where we are exactly in therecovery process? Based on what I’ve seen and heard, I believethat we’re just starting back up the hill of the roller coaster.When your costs are rising despite your best efforts tohold them in check, you must revisit and adjust your pricingaccordingly. Your ability to maintain your financial stability, letalone grow your business is jeopardized when you hold or evenreduce your pricing to your client base. Based on the currenteconomic climate, I think it’s an appropriate time to revisit thebasics of knowing the true costs associated with your businessand developing your pricing based on those costs.It’s important to remember a lot more than just the materialcost and actual labor time go into the price of a job. You haveto include the cost of employee benefits and payroll taxes, thecost of labor time that you can’t directly bill to the client and, ofcourse, the biggest item often forgotten, overhead.Overhead isn’t one item but a grouping of costs associatedwith operating a profitable business. Three of the biggestoverhead expenses that impact your break even cost areunbilled time, vehicle expenses (especially fuel) and owner’ssalary. Other overhead expenses include: rent, office salaries,insurance, utilities, equipment costs and, yes, even accountingfees.When I’m asked to review someone’s financial positionand pricing structure, invariably the biggest issue I find isthat they haven’t included ALL of the costs of their businessin the pricing of their services. It’s a shame that this is stillthe biggest issue in our industry when people like Frank Blauhave been preaching and teaching this topic for over 25 years.In the last decade, a number of companies and associationshave developed software programs that walk you through thisprocess.I want to take a moment to share one of those programswith you. Let me state upfront that I have no vested financialinterest in this program. I was asked and honored to contributeto its’ updating and I believe it’s a great program. The <strong>PHCC</strong>Educational Foundation has recently released an updated,enhanced version of the “<strong>PHCC</strong> Overhead & PricingCalculator.” This excel program is simple enough for a “noncomputer”person to use yet robust enough for the experiencedsoftware user.The program automates all of the steps involved incalculating the true cost of operating your business anddeveloping your pricing. The spreadsheets include: labor costs,overhead costs, break-even calculation, profitable sellingprice, budgets and target revenues & profit goals. The programincludes tutorials that help you use the worksheets and inputyour own information. It also comes with a printed guide withadditional instructions and examples you can follow.This program is a valuable tool for the “one-man” shop ora company with up to 50 field employees. The program costs$199 for <strong>PHCC</strong> members and $249 for non members. I promiseyou that you can recover the cost of the software in just a fewservice calls. Again, I have no financial interest in the software.It’s just the best I’ve seen for its’ price. PUCO RescindsAdministrative RulesApplying to PrivateCommercial MotorCarriersThe Public Utilities Commission of <strong>Ohio</strong> (PUCO)rescinded administrative rules applying to privatecommercial motor vehicles with a gross vehicle weight(GVW) between 10,001 and 26,000 pounds operating inintrastate commerce.“The PUCO has received feedback from numerous interestedparties, including lawmakers and industry members, that theserules deserve additional review,” said PUCO Chairman Todd A.Snitchler. “It is important for the PUCO to operate at the speedof business and implement regulations that promote safetywhile at the same time allow businesses to compete and operateefficiently. Today’s decision is a step in that direction.”In 2008, the Commission approved amendments to <strong>Ohio</strong>’smotor carrier safety rules that applied PUCO jurisdiction toprivate commercial motor vehicles with a GVW between10,001 and 26,000 pounds that transport property or passengerson a not-for-hire basis within <strong>Ohio</strong>. 2010-<strong>2011</strong><strong>PHCC</strong> <strong>Ohio</strong> Annual ReportPRESIDENTS REPORT- Dennis SchlekieAs I recall the past year starting with our Convention atthe Hilton Easton (Today’s Puzzle…Tomorrows Solution)and ending with our convention at the first time ever KalahariResort, I will try to put the pieces of the puzzle together for allto review. <strong>PHCC</strong> is constantly working on your behalf to findtomorrows solution and tame the contracting jungle.The past year was extremely successful with our transitionto a new executive director. Rocco Fana has kept the drive of theassociation going with new and better technology, an enhancedwebsite with more information, communicating to all chapters,as well as visiting every chapter personally to get to know everymember. With Rocco’s initiative, we are now embarking on ourfirst ever statewide membership drive. Dates are set for March16 and 17. Our staff, Rocco, Debbie and Mary, has kept stabilityalong with changes. We are blessed to have all three.Over 25 members from both <strong>PHCC</strong> and ACCA attendedLegislative Day at the Statehouse on May 18 th . The issuesexpressed to our legislators were residential licensing, reducedworkers compensation premiums, reform of the dig lawand utility competition. Sen. Steve Buehrer, who initiallysponsored the residential licensing bill, is now the director ofthe <strong>Ohio</strong> BWC. Palmer McNeal and Kitty Zwissler, our toptwolobbyists, have spoken with Sen. Jim Hughes to possiblyre-introduce the bill again this year. The good news is that thebill is written and does not have to be re-written. Our objectivetoday is to keep pushing very strongly to get this bill passed. Itis has come to our attention that media outlets, as well as somemunicipalities are taking the stance that residential plumbingneeds no licensing. This is very wrong, so I believe residentiallicensing must be our #1 priority.In regards to utility competition, our media blitz was asuccess. After almost a year of press releases and newsletters,we received the attention of former PUCO chairman AlanSchriber and media relations contact Shana Eisenstein. Ourposition was broadcast over 25 radio stations across <strong>Ohio</strong> andincluded responses by the PUCO. It was our goal to get theirattention. Now that we have it, we must pursue negotiating toget some of our lost work back as well as to keep the utilitiesout of our industry.<strong>PHCC</strong> <strong>Ohio</strong> chapters took the lead to host classes to certifycontractors in the Lead Safe Renovation, Repair, and PaintingRule. <strong>PHCC</strong> National was also involved with getting thedeadline extended to comply from April 23, 2010 to October1st, 2010.For the second year in a row, the <strong>PHCC</strong> <strong>Ohio</strong> met withthe leadership from the Mechanical Contractors Association.Discussion centered on what is best for our industry and whatplan is needed to proceed to fight for the betterment of ourindustry.The <strong>PHCC</strong> National Convention was a great success. Idon’t have the exact numbers of how many attended from <strong>Ohio</strong>,but I saw a lot of familiar faces. The facilities at the Paris Hotelin Las Vegas were first class, networking was phenomenal andthe seminars and Expo taught us how to save and make moneyin our businesses by just being a member of <strong>PHCC</strong>.I would like to recognize and congratulate Joe Schlueter asour new <strong>PHCC</strong> National Zone 1 Director. Joe replaced VinceMarzulli last fall.The PUCO motor carrier rules regarding service vehiclesweighing more than 10,000 pounds, <strong>PHCC</strong> <strong>Ohio</strong> wasinstrumental in getting these regulations pushed back untilJanuary 1, 2012.Just around the corner is National Legislative Day inWashington, DC. From past experience, I encourage anyonewho has the time, to attend. To be able to meet face-to-face withour Congressional reps, Senators and their aides to discuss ourissues is priceless. Anything and everything accomplished todayis because of relationship building.In closing I would like to thank everyone who helpedmake my past year as your president very rewarding. You knowwho you are and I thank you. I would especially like to thankRocco Fana who encouraged me every step of the way and didit graciously. Membership- Work is already in progress to make <strong>2011</strong> a yearfor engagement with <strong>PHCC</strong> National, its affiliated chapters andits members, and to communicate a concise, clear and unifiedmessage about the value proposition <strong>PHCC</strong> offers its membersand the industry. The focus is a collaborative effort to providetimely and relevant programs and services that will stimulatemember participation and growth throughout the Federation.Communications- <strong>2011</strong> will be a year for change in the way<strong>PHCC</strong> national communicates with members, non-membersand the PHC industry. We will engage members on a new level,encouraging them to communicate with us and interact witheach other. The intent is for members to perceive <strong>PHCC</strong> as avaluable business partner they can count on.Government Relations- <strong>PHCC</strong> National will continue tostrengthen its voice on Capitol Hill and engage members inthe legislative process. This year’s Legislative Conference andvisits to Capitol Hill is scheduled for May 11-12. Additionally,we will assist members in developing constituent relationshipswith representatives in their districts.Technical/Codes- The Technical & Code Services Departmentand committees are focused on developing strategies thattake advantage of opportunities in emerging markets andtechnologies to create new services and education programs,assist in solving challenges from reduced consumptions, andexplore the feasibility of creating a Certified Water AuditorProgram.CONVENTION COMMITTEE- Bruce Stebbins, Co-ChairThe Annual Convention and Trade Show are being heldin Sandusky at the Kalahari Resorts March 8-11. Our theme,Taming the Contracting Jungle.I’d like to thank my co-chairman Jim Ellia with ACCA,the entire Committee and the staff for another great job thisyear! The Committee met several times throughout the yearand there have been a lot of people working hard behind thescenes to make this another successful event! We’ve broughtin new speakers and topics for the seminars, we’ve updated theformat, and our EXPO includes 80 plus exhibitors. We thinkthis year’s convention will meet and exceed your educationaland networking needs. Make sure to share ideas and mostimportant…have fun!LEGISLATIVE COMMITTEE- Liana Driscoll, ChairmanPalmer McNeal & Kitty Zwissler, Legislative ConsultantsOur Voice was heard in Columbus! More than 25 contractorsparticipated in this year’s Legislative Day at the Statehouse inColumbus on May 18. Similar to 2009, Legislative Day was aone-day event with an issues briefing to kick-off the event andfinished with a reception at the Statehouse Crypt in the evening.Together, members took their leadership in the PHC industry aswell as their pro-business message to the Statehouse.BWC Group Rating- <strong>PHCC</strong> voiced their opinion to preservethe BWC Group Rating program. After the BWC Board votedto reduce the maximum credibility to 65% with a break evenfactor essentially taking it down to 51%, ACCA memberscontacted members of the Senate Insurance, Commerceand Labor Committee in support of a senate bill that wouldsuspend additional changes to BWC premiums paid by workerscompensation group participants.EPA Lead Safe Repair Renovation Rules- <strong>PHCC</strong> <strong>Ohio</strong> and<strong>PHCC</strong> National tracked progress of new regulations adoptedby the US EPA, effective in April 2010, which requires that allcontractors who perform renovation, repair and painting projectsthat disturb lead-based paint in homes, child care facilities, andschools built before 1978 must be certified by the EPA and mustfollow specific work practices to prevent lead contamination.We maintained contact with legislators to work onthe potential for a state administered program allowingenforcement, fee collection and the development of standards atthe state level.PUCO Chairman Schriber Retired- Public UtilitiesCommission of <strong>Ohio</strong> Chairman Alan Schriber retired at the endof 2010. Schriber led the PUCO for nearly 12 years. He was firstappointed to serve as a PUCO commissioner by Gov. Celestefrom 1983 to 1989. He was appointed chairman by Gov. Taft in1999 and reappointed by Taft in 2004. He was also reappointedby Gov. Strickland in 2007 and 2009.OUPS Legislation- The introduction of the OUPS bill resultedin legislation intended to improve the call before you dignotification system as a means of preventing or minimizingdamage to subsurface facilities as a result of excavationsoccurring in <strong>Ohio</strong>. OGS and <strong>PHCC</strong> worked closely with thesponsor throughout the year. The bill had very few committeehearings in the Senate in 2010.SB 289 Contractor Licensing- In early August 2010 SB 289,Contractor Licensing, was introduced by Sen. Buehrer. The billwill license residential heating, ventilating, and air conditioningcontractors, refrigeration contractors, electrical contractors,plumbing contractors, and hydronics contractors and to makechanges to the law regulating those contractors.With the current administration and new senate and houseof representative, we will be dealing with several challengeswith this bill. Those in the majority are telling us that anyrequirement of an additional license or permit is viewed ashaving an “adverse impact on business.” The governor isthinking that as well - he mentioned it numerous times duringhis State of the State address, “no more regulations…no morethings that inhibit businesses from remaining, expanding in<strong>Ohio</strong> or relocating to <strong>Ohio</strong>.”Sen. Buehrer had forewarned us about the current “lessgovernment” climate strongly existing in the senate, houseand governor’s office. Director for the governor, to brief him and get a sense of wherethey would be on this bill.As information is available, <strong>PHCC</strong> will pass it along to ourmembership.Plumbing Journeyman Licensing: We continue to look for abill to be introduced while urging legislators to pass residentiallicensing prior to journeyman licensing.PUCO Motor Carrier Rules Delayed- The Public UtilitiesCommission of <strong>Ohio</strong> (PUCO) delayed active enforcementof the rules for private commercial motor vehicles with agross vehicle weight between 10,001 and 26,000 pounds inintrastate commerce. Safety violations cited against driverswill not be assessed a civil forfeiture until Jan. 1, 2012. OGScontacted Rep. Cheryl Grossman (R-Grove City) on herpotential legislation to counter new rules for commercial motorvehicles and continues to be closely involved in interested partydiscussions with the PUCO. More detailed information on therules is available at the PUCO site. www.puco.ohio.govHome Improvement Tax Credit (HB 286)- Many bills thisyear were introduced that may have harmed our industry, but afew helped. <strong>PHCC</strong> was following this bill to exempt from realproperty taxation home improvements greater than $5,000 forfive years. This bill will have a positive effect on both the newresidential and remodeling construction market.The committee continues to monitor and act when calledupon by our lobbyists.CODES COMMITTEE- Ron Schmitt, ChairmanResidential Sprinklers Removed From Code- The ResidentialConstruction Advisory Committee (RCAC) took action inNovember to remove the mandatory sprinkler provision in the2009 Residential Code of <strong>Ohio</strong>. They then went on to adoptlanguage proposed by fire officials out of the 2012 InternationalResidential Code as an alternative to sprinklers.According to the fire officials’ testimony, their mainconcern was the engineered joist systems and the time relatedto burn through on these components. Basically, under newlanguage, all residential structures using engineered floorsystems and dimensional lumber less than a 2 x 10 will requirea drywall separation from the floor above. After discussion, thecommittee voted unanimously to include the provision.At its first meeting of <strong>2011</strong>, the RCAC elected a newChairman and Vice-Chairman of the Committee. We’re toldthat the code will be ready in September of this year. There aresome changes that will affect the PHC industry. They have beenprovided in a separate handout.The <strong>2011</strong> NEC is available through NFPA, but the RCAChas not yet seen the total package. The presentation givenby members of the International Association of ElectricalInspectors (IAEI) only focused on some substantial changes inthe code. <strong>PHCC</strong> will continue to monitor the progress of the<strong>2011</strong> NEC and ensure it goes through the proper review process.MEMBERSHIP- Jim Haberek, ChairmanWe continued to promote a “Benefit of the Month,” whichincluded: <strong>Ohio</strong> Convention, Legislative and Regulatory Efforts,Speedway, License Bond Program, Workers Comp GroupProgram, Networking at Convention and Legislative Day.<strong>PHCC</strong> Members/Volunteers also participated in the FamousSupply Expo Sept 14-15, 2010 to promote <strong>PHCC</strong> and recruitnew members.Along with ACCA <strong>Ohio</strong>, and our 7 Chapters: Akron,Central <strong>Ohio</strong>, Cincinnati, Dayton, Eastern <strong>Ohio</strong>, Northeast<strong>Ohio</strong> and Stark County, will be participating in our first everDIRECTDrive Membership Drive.50+ members from <strong>PHCC</strong> and ACCA participated ina 6-hour training session in Columbus on Jan 26. TrainingDay gave us everything we needed to insure a successfulDIRECTDrive and <strong>PHCC</strong> members took away tools, ideas andstrategies to use in their businesses. Members earned 1-hourCEU in business toward their licenses.The Drive is set for March 16 and 17 with a kick-offparty on March 15. Members will be calling contractors andassociates they know that should belong to <strong>PHCC</strong>. Around 5:30pm on the second day of the Drive there will be a short wrap-upparty to celebrate our success.If you know a contractor or associate that should be amember of <strong>PHCC</strong>, contact your local chapter with the info orplan on participating March 16 and 17!UTILITY COMPETITION- Jim Thornton, ChairmanThe Utility Competition Committee remained busy overthe past year with a Media Campaign designed to educateelected officials, consumers and members. The highlight of thecampaign came toward the end of the year when <strong>PHCC</strong> <strong>Ohio</strong>President, Dennis Schlekie, and Executive Director, RoccoFana, were interviewed on NPR (over 26 stations carried theinterview). Various press releases and newsletters were sentout and it was one of the top issues discussed at this year’sLegislative Day.We also filed a complaint with the Federal TradeCommission on Utility <strong>Issue</strong>s and have put together a “FactSheet for Fair Gas Utility Competition.”Planned events include contacting the State AttorneyGeneral’s Office on Utility Competition <strong>Issue</strong>s along withsetting up a meeting.IMAGE - Rob Fetz, ChairmanPromoting <strong>PHCC</strong> and the professionalism of our membersto consumers remained a priority in 2010.We held combined conference calls with the MembershipCommittee and established various goals that we’ve worked onduring the year. Our goals included:Use materials already available to <strong>PHCC</strong>- <strong>PHCC</strong> logos andbrochures are available to all members.
