<strong>Montana</strong> Agricultural Chemical Ground Water Protection Act(MACGWPA)The <strong>Montana</strong> Agricultural ChemicalGround Water Protection Act, Title 80,Chapter 15, MCA is administeredjointly by <strong>the</strong> Departments <strong>of</strong> Agriculture<strong>and</strong> Environmental Quality. Thislaw establishes <strong>Montana</strong> policy protectingwater resources <strong>and</strong> <strong>the</strong> use <strong>of</strong>agricultural chemicals. Both agencieswill:‣ Protect ground water <strong>and</strong><strong>the</strong> environment from impairmen<strong>to</strong>r degradationdue <strong>to</strong> <strong>the</strong> use <strong>of</strong> agriculturalchemicals.‣ Ensure that agriculturalchemicals are properly <strong>and</strong>correctly used.‣ Provide management <strong>of</strong> agriculturalchemicals whichwill prevent, minimize <strong>and</strong>mitigate <strong>the</strong>ir presence inground water.‣ Provide education <strong>and</strong> training<strong>of</strong> agricultural chemicalapplica<strong>to</strong>rs <strong>and</strong> <strong>the</strong> generalpublic on ground water protection,agricultural chemicaluse, <strong>and</strong> <strong>the</strong> use <strong>of</strong>alternative agriculturalmethods.Water Quality St<strong>and</strong>ardsThe <strong>Montana</strong> Department <strong>of</strong> EnvironmentalQuality (DEQ) is responsiblefor <strong>the</strong> adoption <strong>of</strong> ground waterquality st<strong>and</strong>ards for agriculturalchemicals for which federal st<strong>and</strong>ardsexist <strong>and</strong> for those agricultural chemicalswhose presence has been verifiedin ground water. Upon request from<strong>the</strong> MDA, DEQ develops or requestEPA <strong>to</strong> develop a interim numericalst<strong>and</strong>ard for agricultural chemicals forwhich <strong>the</strong>re is no existing st<strong>and</strong>ard.Water quality st<strong>and</strong>ards are used byboth agencies in assessing potentialthreats <strong>to</strong> human health from consumption<strong>of</strong> contaminated groundwater.Moni<strong>to</strong>ringBoth <strong>the</strong> MDA <strong>and</strong> DEQ are required<strong>to</strong> conduct moni<strong>to</strong>ring <strong>of</strong> ground waterresources <strong>to</strong> determine:1) Whe<strong>the</strong>r residues <strong>of</strong> agriculturalchemicals are present in groundwater, <strong>and</strong>2) The likelihood <strong>of</strong> an agriculturalchemical entering ground water.Both <strong>the</strong> MDA <strong>and</strong> <strong>the</strong> DEQ review<strong>and</strong> evaluate moni<strong>to</strong>ring <strong>and</strong> samplingdata jointly. The departments, incooperation, determine <strong>the</strong> appropriateresponse <strong>to</strong> contamination. Suchdeterminations are based upon waterquality st<strong>and</strong>ards, water classification(i.e. how <strong>the</strong> water is used) <strong>and</strong> risk <strong>to</strong>human health, based on consumptionpatterns.Management PlansThe MDA is responsible for <strong>the</strong> developmen<strong>to</strong>f management plans whichprovide for <strong>the</strong> protection <strong>of</strong> groundwater resources through <strong>the</strong> managemen<strong>to</strong>f agricultural chemicals.
