As the commercial, industrialand financial capital of China, Shanghai is well positioned torealize its development plans, though much work remains tobe done. Further reforms are needed to build the foundationof a modern IFC with advanced financial services productsand a supportive regulatory regime. Shanghai Customsshould continue to clarify new regulations and reconsiderexisting protocols to improve the facilitation of merchandisemovement for foreign companies. Ongoing human resource(HR) constraints need to be addressed with a commitment tofurther develop the city’s talent pool.launched Achieving 2020: An assessment of Shanghai’s planto become an international financial center by 2020, to offerrecommendations for Shanghai to consider in its plan. Theseinclude:• The need for well-defined, highly intermediated financialmarkets, and the ability to create and deliver financialproducts within those markets.• Shanghai needs depth in both the number and thecompetitiveness of market participants—mutually infinancial institutions and institutional investors.• Shanghai needs to cultivate a deep reservoir of knowledgeable,innovative, and proficient finance professionals.• There must be appropriate financial infrastructure andregulatory parameters that facilitate the development ofthe aforementioned three issues.(For more information refer to the Financial Services chapter.)Regional IssuesAmCham Shanghai and AmCham China are committed toassisting Shanghai in achieving its 2020 development goalsand look forward to enhancing our long-standing partnershipwith the Shanghai Municipal Government in supportof those efforts.Ongoing Regulatory IssuesDeveloping Shanghai into an IFCIn 2009, the State Council declared Shanghai would establishitself as one of the world’s preeminent international financialcenters (IFC) by 2020. The ambitious and far reachingplan calls for Shanghai to feature a mature financial systemthat boasts well-established financial institutions, advancedmarkets and a wide range of globally competitive financialproducts and services, as well as advanced tax, credit,regulatory and legal systems to support the IFC objective.Shanghai, as well as China as a whole, likely would gain enormousbenefits in becoming an IFC, ranging from advancingeconomic development and garnering national prestige toattracting top-level professional talents and stimulating cityinfrastructure and other quality of life improvements.In June 2012, AmCham Shanghai and Brookings InstitutionCustoms & LogisticsThough Shanghai Customs has made significant progressin increasing efficiency and reducing bottlenecks, includingincreased integration of Shanghai Customs and the ShanghaiEntry-Exit Inspection and Quarantine Bureau (CIQ), challengesremain. For example, Joint Announcement No. 203,implemented by the General Administration of QualitySupervision, Inspection and Quarantine (AQSIQ) andGeneral Administration of Customs (GAC) in 2012, addeda number of product categories to the compulsory inspectioncategory that were previously not subject to inspection,adversely affecting companies’ supply chain operations.Additionally, Regulation 33 went into effect in 2010,requiring co-signees of imports and shippers of exportedsamples and/or advertising materials to obtain a customsregistration number or hire an import/export tradingcompany to do it for them. Express delivery companies havehad difficulty adapting to the regulation, resulting in longerclearance times for relevant goods.Going forward, AmCham Shanghai and AmCham Chinarecommend that Shanghai Customs:• Inform management of foreign companies concerningregulations, and how to address and resolve compliance352| 2013 White Paper | AmCham China |

| Shanghai |issues to help enterprises build more awareness on keyrules;• Issue further instructions on how to maximize thevarious benefits of the ASEAN-China Free Trade Area;• Improve explanations concerning the differences amongShanghai’s several bonded zones, and integrate andsimplify the types of bonded zones so that enterpriseoperations can be more efficient; and• Instruct enterprises on the technical complexities andvaried practices within port customs, as well as inspectionand quarantine, tariff classifications, certification,clearance, and valuation.achieved the previous year. Shanghai’s foreign trade volumeamounted to US $437 billion in 2012, with a trade deficit ofUS $23 billion. Exports amounted to US $207 billion, down1.4 percent from 2011, while imports reached US $230 billion,a 1 percent increase year-on-year. Retail sales rose 9 percentover 2011. Contracted foreign direct investment (FDI) intoShanghai increased 3.7 percent in 2012 to RMB 525 billion.This is a striking affirmation of the international businesscommunity’s recognition of Shanghai as a leading Asia-Pacific business hub.Financial Services ReformsRegional Issues(For more information refer to the Customs chapter andExpress Delivery Services chapter.)HR ConstraintsAttracting, developing and retaining skilled workersand professionals continues to be a challenge for businessesin Shanghai, and more needs to be done to supportShanghai’s talent pool. AmCham Shanghai and AmChamChina encourage Shanghai to evaluate its educationalinfrastructure and its efficacy in producing highly skilledlabor. Initiatives such as partnerships between business andeducation, study abroad programs for Chinese students andincentives for overseas students and recent graduates tomove to Shanghai would go a long way toward filling theexisting talent vacuum.HR continues to be a leading challenge for American businessesin Shanghai. According to AmCham Shanghai’s2011-2012 China Business Report, 90 percent of companiessay HR constraints hinder their business operations to someextent. Stricter enforcement and narrow interpretation ofregulations for obtaining Chinese work visas and permitsalso contribute to this challenge. AmCham Shanghai andAmCham China applaud Shanghai’s further efforts toaddress the talent vacuum. A long-term HR initiative thatencourages industry-academia partnerships, more studyabroad programs, investment from foreign academic institutions,and easing of visa requirements for overseas studentsis necessary to support Shanghai’s economy as it transformsinto a global economic hub.(For more information refer to the Human Resourceschapter.)Recent DevelopmentsShanghai’s Business ClimateIn 2012, Shanghai’s GDP expanded 7.5 percent to RMB 2.01trillion (US $319 billion), down from an 8.2 percent growthrate in 2011. The easing of the city’s output in 2012 was inline with the national economy, which moderated to 7.8percent GDP growth, down from a 9.2 percent growth rateShanghai continues to build the infrastructure to achieveits goal of becoming an IFC by 2020. In April, the quota forforeign investment as stipulated under the Qualified ForeignInstitutional Investor (QFII) program was raised from US $30billion to US $80 billion, opening the door for more foreigninvestment. The new QFII provisions also allow for widerareas of investment, an increased foreign shareholder capand lower qualification thresholds. Another major financialreform in 2012 was the approval for Citigroup to issue itsown credit cards in China, the first non-Asian and secondnon-Chinese bank to do so. Previously, foreign firms wererequired to partner with a Chinese bank to issue credit cards.Meanwhile, China continues to move forward cautiouslywith internationalizing the RMB to encourage wider use ofthe currency in global trade and investment. In November2011, regulators approved four more companies to issue dimsum RMB-denominated bonds in Hong Kong. In December,China Construction Bank issued RMB 1 billion worth of dimsum bonds in London, becoming the first Chinese creditorto raise capital in the London yuan bond market after HSBCbecame the first bank to list dim sum bonds there in April.Small and Medium EnterprisesThe number of US small- and medium-sized enterprises(SME) targeting Shanghai, and China as a whole, as a destinationfor investment, export sales, and business expansioncontinues to climb. Nearly one-third of AmCham Shanghaimembers are small businesses and entrepreneurs, which aredefined as businesses with fewer than 500 employees. USSMEs are increasingly expanding into China to take advantageof growing business opportunities, bringing with themthe latest technology, management expertise and industryleadership. According to US Commerce Department data,China is the third largest export market for US SMEs, registeringUS $30.4 billion in export sales in 2010—more than athird of all US goods exports to China that same year.Many SMEs are reluctant to expand their business overseasbecause of a variety of challenges. In China, these range fromday-to-day challenges like an unclear regulatory environment,cultural challenges and human resource constraints,to systemic hindrances such as market access limitationsand a legal system tilted in favor of local Chinese compa-354| 2013 White Paper | AmCham China |

AmCham Shanghai’s SME Center, a physical andvirtual resource, is one such public-private partnership thatSMEs are encouraged to use to help address the challengesof doing business in China, as well as create business andinvestment partnerships with Chinese SMEs and stateownedenterprises (SOEs) that the SME Center is planningto help facilitate.Yangtze River Delta (YRD) IntegrationShanghai is and will continue to function as the anchor ofan integrated Yangtze River Delta region. The YRD, whichincludes Shanghai and the Jiangsu and Zhejiang provinces,has generated close to one-fifth of China’s GDP despiteaccounting for only two percent of the country’s land areaand 11 percent of the national population. The Americanbusiness community is proud of its strong presence in theYRD and the important role US companies have played inits economic development. The YRD now boasts 4,000 USenterprises and investment projects that are taking advantageof new manufacturing facilities and research and developmentcenters.AmCham Shanghai continues to emphasize the need forfurther integration of the YRD to enhance economic developmentof the region and operates a YRD Center in Suzhouto support the increasing number of US companies that areexpanding aggressively into the YRD. A more integratedYRD with a consistent set of regulations and laws willlead to synergies in areas such as customs, education andtraining, labor, intellectual property rights protections andenforcement, taxation and transportation and logistics. Thestrength of the YRD comes from its functioning as a singleeconomic powerhouse for the country, capitalizing on thesum of its strengths, instead of a disparate group of rivalcities and provinces.Customs & LogisticsIn 2012, AmCham Shanghai continued its collaborativeefforts to improve communication between Americaninvestedcompanies and Shanghai Customs. AmChamShanghai’s Customs Taskforce met with Customs andCIQ officials throughout the year to discuss a number ofimportant developments. One of those developments,the November rollout of paperless customs, will provideadvanced clearance for AA-rated companies and onlinepayment of duties—currently, 85 percent of duties are paidonline. Clearance processing is now available 24 hours a daythroughout the year. Other developments include CIQ, theMaritime Bureau, Shanghai Airport Group and MaritimeInternational Port Group all signing MOUs to integrateparallel trade practices. Plans are underway to establishbilateral communications through various channels such astrade associations and enterprises to collect feedback, andto provide a contact point for large companies with regionalheadquarters in Shanghai and a coordination center forcompanies to address emergencies encountered during theclearance process.In September, the State Postal Bureau granted FedEx andUnited Parcel Service approval to provide express courierservice in a handful of Chinese cities. While the approval fellshort of what both companies had sought, the developmentis welcome for helping to open the express courier market toforeign firms, which previously had been off-limits. At theend of October, FedEx Express announced it would establisha new International Express and Cargo Hub in Shanghai,citing expectations that Pudong International Airport willbecome the world’s top air cargo hub by 2015. WhileShanghai’s goal of increasing the number of patents andtrademarks applied for in the city is in the right direction,we hope to see an environment that not only protects andenforces IPR, but also encourages IP development. There are many unresolved barriers thatcan slow the momentum of the “Four Centers” initiatives,but they are not insurmountable. The Shanghai MunicipalGovernment is mindful of this and has actively engagedbusiness associations such as AmCham Shanghai, and hastaken practical policy approaches to address these challenges.However, more work remains to be done to openShanghai’s capital markets, strengthen IPR protection andenforcement and address human resource limitations andcustoms challenges, among other issues. The continuedintegration of resources surrounding the YRD region offerstremendous opportunities and will be a key factor in determiningthe success of the 2020 initiatives.Regional IssuesThrough these efforts, Shanghai will not only continueto have a thriving economy, but will also invite greaterforeign investment in the city and facilitate its drive towardbecoming an international financial center and shippinghub.
