thousands of dollars in damage to books.For each of the next 4 years, moredamages developed each winter. Thefoundation is cracked in several places;the basement floor developed a lot ofcracks; the first floor walls developedcracks; the plate glass windows nearestthe bridge are sinking, causing water topour into the basement whenever it rains;every winter the front door gets out ofalignment with the door frame; and lotsof other little problems.I tried for almost 2 years to getthe city to do something about thedamage before I hired an attorney andwe filed suit against the city and theprimary contractor. The primarycontractor then brought in 3 subcontractorsas co-defendants. After 2years of dealing with the leaking roof, Ifinally replaced it (at a cost of around$55,000), but I didn’t have the money torepair all of the other problems.Before construction began, Ihad the building video-taped, especiallythe basement walls nearest the bridge,and the primary contractor also videotapedthe building, especially thebasement walls. About 4 years after thedamage was originally done, I lead acouple of “show and tell” tours of thebuilding for the 5 defendants and theirarmies of lawyers, pointing out thevarious cracks that were not there beforeconstruction began. With 5 sets ofdefendants and lawyers, I received alarge array of responses, including “thereis no new damage” to “there is newdamage, but you can’t prove we’reresponsible” to “this building is so oldthat it doesn’t matter how much newdamage was done” to “you destroyed theevidence by replacing the leaking roofafter only 2 years.”During the discovery process,we learned that the city had hired anexcellent bridge design firm, which haddrafted very detailed instructions on howto protect the building duringconstruction. These instructions werepart of the contract the primarycontractor had signed, but the primarycontractor repeatedly violated thecontract, and the city let him get awaywith it, resulting in the damage to thebuilding. get the damage repaired, but he failed totake out the policy and the city let himget away with it. If he had taken out therequired insurance policy, I would haveavoided the expense and hassle of thelaw suit, and the insurance companywould have paid for repairing thedamage.We hired an engineering firm tostudy the damage, determine how it wasdone, how much more severe thedamage was likely to become over theyears, and what would need to be doneto repair the damage. Including billsfrom sub-contractors who ran varioustests, the cost of the engineering studiescame to about $24,000. They told usthat the building would fall down within10 years unless we made major repairs,and came up with a bid around $900,000for the largest single piece of the repairprocess (new foundations and basementwalls in the area damaged by the bridgeconstruction). Since that was alreadysubstantially more than the building wasworth, they didn’t bother to get bids forany of the other repairs. The engineeringfirm provided a written report on all this,for my lawyer to pass along to the courtand the defendants. After seeing thisreport, I spent at least 100 hoursinvestigating places either for sale orrent that we could move the store to,interviewing real estate agents, fillingout paperwork for the bank to find outhow much of a mortgage I could get fora new building, pricing different kinds ofnew bookshelves (since our currentlayout allows us to use a lot more wallshelves than a more square space wouldallow us to use), getting an estimate ofmoving expenses, hiring a buildingappraisal firm to determine how muchthe building was worth, etc.At a pre-trial mediation session,the head of the engineering firmsuddenly changed his story. He told themediator that the foundation wascracked, but was doing a fine jobholding up the building and only minorrepairs were needed. My attorney toldme that if we went to trial, it wouldprobably cost an additional $100,000 bythe time our expert witnesses got donebeing cross-examined by 5 sets ofdefense attorneys–and that he wouldn’tdare put our engineering expert on thestand, because there was no telling whatthe guy would say–the version he putinto the documents for the court, or theversion he had just told the mediator, orMacHale, D.J.
