Remuneration of re-employed - Finance Department

Government of West BengalFinance DepartmentAudit BranchNo. : 3951-F Kolkata, the 27 th May, 2009.Consequent upon the introduction of the revised pay structure all State Governmentemployees who opted to come under the WBS (ROPA) Rules, 2009, are getting their revisedpay and allowances with effect from 01.04.2009.A question has now been raised as regards fixation of pay and drawal of remuneration ofre-employed State Government pensioners in the revised pay structure and on the drawal ofrelief on pension during the period of re-employment.2. After careful consideration of the matter, the undersigned is directed by order of theGovernor to state that a re-employed pensioner may draw an amount of remuneration with effectfrom 1 st April, 2009 in the following manner :-(i) For those who retired before 01.01.2006:-Basic pay last drawn by him on the date of superannuation will have to be revisednotionally under rule 7 of WBS (ROPA) Rules, 2009 as if he had been in service on01.04.09.After such fixation of basic pay under the revised pay structure he will draw w.e.f.01.04.2009 that amount of notionally revised last basic pay (Pay in the Pay Band plusGrade Pay) plus dearness allowance admissible on that basic pay from time to time plushouse rent allowance, if any, as admissible as per existing orders on that notional lastbasic pay minus revised basic pension as per Finance Department’s Memo No.200-(Pen) dated 25.02.2009 before commutation, plus relief on pension as admissible fromtime to time.He will get pension, relief on pension and medical allowances as usual as apensioner.(ii) For those who retired on or after 01.01.2006:-Revised basic pay (Pay in the Pay Band plus Grade Pay) plus dearness allowanceas admissible from time to time plus house rent allowance, if any, as admissible interms of revised orders minus revised basic pension before commutation plus relief onpension as admissible from time to time.Contd…..P/2

: 2 :He will draw pension, relief on pension and medical allowances as usual as a pensioner.If pension under revised pay structure has not yet been settled in respect of a reemployedpensioner, he may be allowed to draw re-employment pay on the basis ofproposed revised pension provisionally. After settlement of pension, overdrawal, if any,may be accordingly adjusted.3. In both the cases of fixation of remuneration during the period of re-employment asdetailed above, house rent allowance will be admissible on the revised basic pay, if thesame was admissible before the date of superannuation, and shall be drawn subject tofulfillment of usual terms and conditions of drawal of this allowance.4. The guidelines mentioned herein above, however, will not be applicable in case of AISofficers serving in the affairs of the State and State Government officers who are reemployedto a post, the pay of which is guided by any act / rule / regulation.5. No arrear pay and allowances will be admissible for any period beyond 01.04.2009. Thisorder is issued in partial modification of para 5 of Finance Department’s memo. No. 200-F(Pen) dated 25.02.2009 and cancellation of Finance Department Memo. No. 8527-Fdated 07.10.2005 with effect from 1 st April, 2009.Sd/- S.K.
