I he<strong>re</strong>by ask you <strong>to</strong> instruct the security authorities <strong>to</strong> act in accordance with your declaration<strong>re</strong>garding the policy <strong>of</strong> allowing the entrance <strong>of</strong> goods in<strong>to</strong> the Gaza Strip, and order them <strong>to</strong>allow the unlimited entry <strong>of</strong> civilian goods in<strong>to</strong> the Gaza Strip.2. In your <strong>of</strong>ficial <strong>re</strong>action <strong>to</strong> the events <strong>of</strong> the flotilla <strong>to</strong> Gaza on May 31, 2010, you said thefollowing (as quoted in the Fo<strong>re</strong>ign Ministry news <strong>re</strong>lease <strong>of</strong> June 1, 2010-trans.): "Our policy issimple. We say: any goods, any humanitarian aid <strong>to</strong> Gaza, can enter. What we want <strong>to</strong>p<strong>re</strong>vent is their ability <strong>to</strong> bring in war materiel - missiles, rockets, the means for constructingcasing for missiles and rockets. This has been our policy and yesterday we <strong>to</strong>ld the flotilla -which was not a simple, innocent flotilla - <strong>to</strong> bring their goods in<strong>to</strong> Ashdod. We <strong>to</strong>ld them thatwe would examine their cargo and allow those goods that could not be used as weapons orshielding materials for Hamas in<strong>to</strong> Gaza." [Emphasis mine -- the undersigned]3. I am very sorry <strong>to</strong> say your words do not <strong>re</strong>flect the policy <strong>of</strong> the security <strong>of</strong>ficials on the groundnor a<strong>re</strong> they consistent with their declarations <strong>to</strong> the court.4. For mo<strong>re</strong> than a year, <strong>Gisha</strong> has been trying <strong>to</strong> clarify the criteria that guide the securityauthorities in determining which goods a<strong>re</strong> permitted and which a<strong>re</strong> banned from entering theGaza Strip. After failing <strong>to</strong> get an answer from the authorities, <strong>Gisha</strong> submitted a petition <strong>to</strong> thecourt under the F<strong>re</strong>edom <strong>of</strong> Information Act (Administrative Petition 2744/09 <strong>Gisha</strong> v. DefenseMinistry), which is still pending.5. In the security authorities' <strong>re</strong>sponses <strong>to</strong> <strong>Gisha</strong>'s <strong>re</strong>quests, they <strong>re</strong>peatedly decla<strong>re</strong>d that according<strong>to</strong> government policy, the authorities only allow the entrance <strong>of</strong> "humanitarian" goods, whicha<strong>re</strong> <strong>re</strong>qui<strong>re</strong>d <strong>to</strong> "maintain the vital humanitarian needs <strong>of</strong> the population" (section 6 <strong>of</strong> the state<strong>re</strong>sponse from April 25, 2010). Which is <strong>to</strong> say, not all goods with the exception <strong>of</strong> weapons,but rather only goods that maintain the "humanitarian minimum," as defined by Israel.6. Since the security authorities <strong>re</strong>fuse <strong>to</strong> <strong>re</strong>veal their procedu<strong>re</strong>s and the list <strong>of</strong> goods they permitin<strong>to</strong> Gaza, we do not know how Israel defines the "humanitarian minimum" or which goods itconsiders <strong>to</strong> be "humanitarian."


7. Nevertheless, we do know that the<strong>re</strong> a<strong>re</strong> civilian goods, including basic food products and vitalraw materials that Israel systematically forbids from entering the Gaza Strip. This is the case,for example, <strong>re</strong>garding sage, coriander, seeds and nuts, as well as industrial salt, industrialmargarine and packing containers for local manufactu<strong>re</strong>rs in Gaza.8. In light <strong>of</strong> your comments from yesterday, I would like <strong>to</strong> ask you the following questions: Dosage and coriander constitute weapons? How is banning industrial margarine going <strong>to</strong> help thefight against Hamas's armament? And how does the denial <strong>of</strong> plastic containers contribute <strong>to</strong> thedefense <strong>of</strong> Israel's security?9. If, as you say, any product can be brought in<strong>to</strong> Gaza as long as it is not a weapon, then theparties operating on the ground a<strong>re</strong> either unawa<strong>re</strong> awa<strong>re</strong> <strong>of</strong> the government policy or a<strong>re</strong> notacting according <strong>to</strong> the policy. Either way, you must take the necessary measu<strong>re</strong>s <strong>to</strong> achieve afull accordance between the government policy and the conduct <strong>of</strong> the operational authorities.10. Past experience shows that government decisions <strong>to</strong> ease the closu<strong>re</strong> policy a<strong>re</strong> not implemented<strong>to</strong> the letter, and the operational <strong>of</strong>ficials adopt particularly expansive interp<strong>re</strong>tations in order <strong>to</strong>avoid changing their practice. The<strong>re</strong>fo<strong>re</strong>, even though the cabinet decision from March 22,2009, stated explicitly that "the unlimited transfer <strong>of</strong> food products <strong>to</strong> the <strong>re</strong>sidents <strong>of</strong> Gaza fromall <strong>re</strong>levant sources should be allowed," the Coordina<strong>to</strong>r <strong>of</strong> Government Activities in theterri<strong>to</strong>ries did not diverge from his p<strong>re</strong>vious policy as a <strong>re</strong>sult <strong>of</strong> it. The entry <strong>of</strong> many foodproducts is still banned, and the <strong>re</strong>asons <strong>re</strong>main vague.11.
