C h a p t e r 4CULTURAL DIFFERENCES BETWEEN THE US AND CHINARELATING TO THE USE OF ADVERTISINGLegal Issues in <strong>Advertising</strong>Long considered a "corrupt capitalist practice", China first permittedadvertising in 1979 (Glasser, 1997, pg. 86).Since China was such a largemarket, companies worldwide were interested in how to tap in to <strong>the</strong> potentialpr<strong>of</strong>its.Companies were concerned about <strong>the</strong> best way to advertise to acountry that was restricted for so long.Just fifteen years later, <strong>the</strong> finaldocument from <strong>the</strong> U.N. World Conference on Women in Beijing stated, "it'stime for governments <strong>and</strong> o<strong>the</strong>rs to make <strong>the</strong> media straighten up <strong>and</strong> stopexploiting women <strong>and</strong> stop pornography" (Hern<strong>and</strong>ez, 1995, pg. 22).According to Dana Bullen, Executive Director <strong>of</strong> <strong>the</strong> World Press FreedomCommittee, this suggestion was intimidating to advertisers because "in acountry where a free press does not really exist, suggestions by government takeon a much more coercive meaning" (Hern<strong>and</strong>ez, 1995, pg. 23).The United States did not have <strong>the</strong> legal restrictions like that <strong>of</strong> China;however, <strong>the</strong> Women's Rights Movement in <strong>the</strong> 1970's <strong>and</strong> 80s did affect <strong>the</strong>advertising industry.For example, in 1971, Levi-Strauss "published anadvertising poster depicting firm, curvaceous, <strong>and</strong> naked female buttocks with<strong>the</strong> outline <strong>of</strong> <strong>the</strong> company's trademark double-stitched pocket drawn on <strong>the</strong>right cheek <strong>and</strong> adorned with <strong>the</strong> Levi's logo" (Heller, 1999, pg. 16).This ad11
