CHAPTER 10 <strong>Costing</strong> & <strong>Contracting</strong>- A statement of any guarantees or warranties respecting the quality of workand material.- How changes are to be handled. Any deviation from the written description,plans or specifications should be documented and approved.- A statement whereby the contractor agrees to respect the norms ofmunicipal and provincial building codes as well as established nationalresidential construction standards. This should include the obtaining of allnecessary permits and compliance with all local by-laws and workingregulations.- What happens in the event one party breaches the contract (i.e. interestpenalties, forfeiture of deposit, etc.).- Signature of both parties: you and the contractor.It is also a good idea to include statements to the effect that:- The contractor will obtain insurance to protect the homeowner (yourself)from any liability resulting from the work.- The contractor will clean up and remove debris from the site aftercompletion of the work.- The contractor will repair or replace property damaged by him in the courseof his work.You may decide to seek the services of a competent construction lawyer to assistwith the preparation of a contract or to review your contract. Often an attorneywill, for a small fee, review a contract for the essential terms of coverage and protectionprior to signing. You should consider this cost of legal services as justanother element of construction, like building permits or insurance.A deposit is a commitment and is not refundable unless the contract clearly andunequivocally states that it will be. If you need to make a deposit, keep it as smallas possible.
