Section 2. Section 21.08, Permitted Uses, of the Woodinville Municipal Code, ishereby amended to read as set forth in Attachment B, which is attached hereto andincorporated herein by this reference as if set forth in full. New text is shown by underline.Section 3. Section 21.06, Technical Terms and Definitions, of the WoodinvilleMunicipal Code, is hereby amended to read as set forth below. New text is shown byunderline.21.06.088.0010 "Cannabis" means all parts of the plant Cannabis, whether growing or not; the seedsthereof; the resin extracted from any part of the plan; and every compound, manufacture, salt, derivative,mixture, or preparation of the plant, its seeds, or resin. For the purposes of this definition, "cannabis" doesnot include the mature stalks of the plant, fiber produced from the stalks, oil or cake made from the seedsof the plan, any other compound, manufacture, salt, derivative, mixture, or preparation of the maturestalks, except the resin extracted there from, fiber, oil, or cake, or the sterilized seed of the plant which isincapable of germination. The term "cannabis" includes cannabis products and useable cannabis.21.06.088.0020 Cannabis Collective Gardens"Cannabis collective garden" means a garden where "qualifying patients" as described in Sec. 403 ofEngrossed Second Substitute Senate Bill 5073 and Chapter 181, Laws (of the State of Washington) of2011 may engage in the production, processing, and/or delivery of cannabis for medical use .21.06.088.0030 Cannabis Dispensary."Cannabis Dispensary" means any facility or location where cannabis is grown, produced, manufacturedor made available to and/or distributed.Section 4. Severability. Should any section, paragraph, sentence, clause, or phrase ofthis ordinance be held invalid or unconstitutional by a court of competent jurisdiction, suchinvalidity or unconstitutionality shall not affect the validity or constitutionality of any other section,sentence, clause, or phrase of this ordinance. Provided, however, that if any section, sentence,clause, or phrase of this ordinance, or any change in a land use designation is held to be invalidby a court of competent jurisdiction, or by the Growth Management Hearings Board, then thesection, sentence, clause, phrase, or land use designation in effect prior to the effective date ofthis ordinance, shall be in full force and effect for that invalidated section, sentence, clause,phrase, or land use designation, as if this ordinance had never been adopted.Section 5. Copy to Commerce Department. Pursuant to RCW 36.70A.106(3), theCity Clerk is directed to send a copy of the amendments to the State Department of Commercefor its files within ten (10) days after adoption of this ordinance.Section 6. Effective Date. The adoption of this ordinance, which is a power specificallydelegated to the City legislative body, is not subject to referendum. This ordinance or asummary thereof shall be published in the official newspaper of the City, and shall take effectand be in full force five (5) days after the date of publication.ADOPTED BY THE CITY COUNCIL AND SIGNED IN AUTHENTICATION OF ITS PASSAGETHIS 21 st DAY OF FEBRUARY 2012.
