-ll-'Inspection officers(7) The provisions of sections 49 to 51.3 relating to inspection officers apply for the purpose ofensuring compliance with orders and regulations made under subsection (5).Offence(8) Every person who contravenes subsection (1) or (2), a direction made under subsection (4)or an order or regulation made under subsection (5) is guilty of an offence and liable(a) on summary conviction, to a .fine not exceeding one hundred thousand dollars orto imprisonment for a term not exceeding one year or to both; or(b) on conviction on indictment, to a .fine not exceeding one million dollars or toimprisonment for a term not exceeding five years or to both.Application of subsections 121(2) to (5)(9) Subsections 121(2) to (5) apply, with any modifications that the circumstances require, toan offence under subsection (8).Request:Present and future costs arising as a consequence ofthe pipeline occupying orcrossing highways/roadsa) Please confirm whether or not Trans Mountain will agree to pay all_present andfuture costs that will be incurred by the City of Surrey, other municipalities andthe Province as a result of the location of: (i) the proposed Line 2 pipeline inhighways or roads under their respective jurisdiction, or (ii) as a result of anyfuture highway/road construction, widening or improvement project that occursover or in the vicinity of the pipeline that might disturb the pipeline and thatoccurs within the existing or future boundaries of said highway/road, including,but not limited to:(i}(ii)(iii)(iv)costs to realign, raise or lower the pipeline;costs to excavate material from around the pipeline;costs to add casing or other appurtenances for the protection of thepipeline;costs of all pipeline work required as a result of the construction,widening or carrying of highway or road across the pipeline whichmight disturb the pipeline or which necessitates realigning, raisingor lowering the pipeline or excavating material from, over or aroundit, or adding casings or other appurtenances deemed necessary byTrans Mountain for the protection of the pipeline; and
- 12-(v)costs necessary to accommodate any future widening orimprovement of the highway or road that occurs over or in thevicinity of the pipeline;b) ifTrans Mountain is not prepared to agree to pay all or some of the present andfuture costs described in paragraph a) above, then please identify which costsTrans Mountain is not prepared to pay and explain in detail why not. Please alsoidentify and describe in detail which of the present and future costs described inparagraph a) Trans Mountain is prepared to agree to pay and under whatcircumstances it would agree to pay them;c) having regard to section 108 of the National Energy Board Act and the jurisdictionof the NEB, please confirm whether or not Trans Mountain is prepared to consentto including as a condition or term of any certificate or CPCN issued approvingTrans Mountain's Application that l'rans Mountain shall pay all or some of thecosts described in paragraph (a) above, and if not, please provide a detailedexplanation as to why not;Necessary consent from Trans Mountain and other interest holders in TransMountain's statutory right of way/easement to enable municipalities and theProvince to dedicate required land for hishway/road.d) in respect of future widenings, expansions or improvements of the existinghighways and roads that are proposed to be occupied by the pipeline, pleaseconfirm whether Trans Mountain is prepared to:(i){ii)(iii)consent (without conditions and without compensation) to theextinguishment of any statutory right of way or easement in favour of TransMountain over those portions of land required by the municipality or theProvince to be dedicated as highway or road in order that those portions ofland may be incorporated into and form part of the existing highway orroad that is occupied by the pipeline;obtain the consent (without conditions and without compensation) of anymortgagee or other person having an interest in the statutory right of wayor easement to be extinguished over that portion ofland to be dedicated ashighway or road in order that those portions ofland may be incorporatedinto and form part of the existing highway or road that is occupied by thepipeline; andif Trans Mountain is not prepared to consent or obtain the consentdescribed in paragraphs (d)(i) and (ii) without conditions and withoutcompensation, then please provide a detailed explanation as to why not.Please also describe in detail under what circumstances Trans Mountain
