The Journal of Modern African Studies, 32, 3 (I994), pp. 499-521Copyright ( I1994 Cambridge University Press<strong>Corruption</strong> <strong>and</strong> <strong>Mismanagement</strong><strong>in</strong> <strong>Botswana</strong>: a <strong>Best</strong>-CaseExample?by KENNETHGOOD*INDEPENDENT <strong>Botswana</strong> has developed on three ma<strong>in</strong> pillars: rapid<strong>and</strong> susta<strong>in</strong>ed economic growth (over the decade to 1992, for example,at 8-4 per cent a year, third-highest among all develop<strong>in</strong>g countries,<strong>and</strong> far <strong>in</strong> excess of any other <strong>in</strong> Africa);1 multi-party or liberaldemocracy; <strong>and</strong> an efficient central state, the ma<strong>in</strong> features of whichhave been identified <strong>and</strong> praised by observers.2 With growth, anaccompany<strong>in</strong>g build-up of a relatively strong governmental systemtook place, with activities especially focused on f<strong>in</strong>ance <strong>and</strong> plann<strong>in</strong>g.The civil service was ma<strong>in</strong>ta<strong>in</strong>ed at a high level, accord<strong>in</strong>g to RaviGulhati, by avoid<strong>in</strong>g rapid localization, by provid<strong>in</strong>g high compensationfor officials, <strong>and</strong> by keep<strong>in</strong>g well-def<strong>in</strong>ed l<strong>in</strong>es of authority<strong>and</strong> accountability. Able people were placed <strong>in</strong> key positions <strong>and</strong> keptthere for extended periods. The political elite fairly consistently soughtexpert advice from lead<strong>in</strong>g bureaucrats, <strong>and</strong> the two groups havedisplayed a closeness <strong>and</strong> mutuality of <strong>in</strong>terest built upon theircommon <strong>in</strong>volvement <strong>in</strong> cattle <strong>and</strong> commerce, <strong>and</strong> the not uncommontendency for cab<strong>in</strong>et m<strong>in</strong>isters to arise from the ranks of the seniorbureaucracy.Generally conservative fiscal <strong>and</strong> monetary policies were pursued bythe <strong>Botswana</strong> Democratic Party (BDP) Government, <strong>and</strong> an implementationcapacity was constructed which Gulhati described as'very good <strong>in</strong> most areas'. 500 KENNETH GOODidentified <strong>Botswana</strong>'s coherent <strong>and</strong> susta<strong>in</strong>ed development capabilities.The bureaucracy tried to anticipate problems <strong>and</strong> opportunities.Funds were early established to provide for stabilization reserves <strong>and</strong>for public-debt service, <strong>and</strong> such plann<strong>in</strong>g helped produce susta<strong>in</strong>eddevelopment through m<strong>in</strong>eral booms, <strong>and</strong> an exceptionally low debtserviceburden,3 while the drought relief programme has prevented thefam<strong>in</strong>es which have occurred elsewhere <strong>in</strong> Africa, even with<strong>in</strong> anenvironment of harsh <strong>and</strong> recurrent drought.Christopher Colclough <strong>and</strong> Stephen McCarthy summarised therole of the <strong>Botswana</strong> state as 'careful plann<strong>in</strong>g, economic management,<strong>and</strong> diplomacy', the latter <strong>in</strong>stanced <strong>in</strong> skilful negotiationswith De Beers <strong>and</strong> over-favourable beef export-quotas with theEuropean Union.4 The choos<strong>in</strong>g of appropriate priorities was theresponsibility of a political leadership which Harvey <strong>and</strong> Lewis saw asof' unusually high quality'. This elite holds constitutional responsibilityfor the management of the governmental system. Interventions <strong>in</strong> theeconomy have obviously been of great importance, but they have, justas significantly, been restricted <strong>and</strong> selective - <strong>in</strong> Gulhati's terms, theywere 'kept to a feasible set'. <strong>Mismanagement</strong> was thus generally low orabsent, <strong>and</strong> corruption too was deemed to have been limited; thecountry was outst<strong>and</strong><strong>in</strong>g, said Larry Diamond, for the creation ofeffective structures of control.THREE PRESIDENTIAL COMMISSIONS OF INQUIRYIt is this high reputation for good government that has crumbleds<strong>in</strong>ce I99I <strong>in</strong> the face of a series of sc<strong>and</strong>als highlighted by theInternational Project Managers consultancy, the Kgabo report onillegal l<strong>and</strong>-sales, the <strong>Botswana</strong> Hous<strong>in</strong>g Corporation debacle, <strong>and</strong> thenear ru<strong>in</strong>ation of the National Development Bank. Yet these nowmanifest malpractices might well have been latent earlier, overlookedby observers who were themselves once senior advisers <strong>in</strong> thebureaucracy, or who stressed the relative efficiency <strong>and</strong> democracy of<strong>Botswana</strong> <strong>in</strong> an Africa which varied economic decrepitude withdictatorship.5 Bad government was perhaps shielded by the hierarchies<strong>and</strong> <strong>in</strong>equalities that permeate the society, <strong>and</strong> authority's assumption3 Harvey <strong>and</strong> Lewis, op. cit., <strong>and</strong> Cather<strong>in</strong>e B. Aspects of the presentproblems over l<strong>and</strong>-sales, hous<strong>in</strong>g, <strong>and</strong> the abuse of loan-funds, havequite evidently germ<strong>in</strong>ated over a period of some IO-I5 years.I. Supply of Teach<strong>in</strong>g Materials for Primary SchoolsResponsibility for primary education <strong>in</strong> <strong>Botswana</strong> is shared betweenthe M<strong>in</strong>istry of Education, the professional <strong>and</strong> policy-formulat<strong>in</strong>gbody, <strong>and</strong> the M<strong>in</strong>istry of Local Government, L<strong>and</strong>s, <strong>and</strong> Hous<strong>in</strong>gwhich is concerned with the <strong>in</strong>frastructure <strong>and</strong> general management ofschools, <strong>in</strong>clud<strong>in</strong>g the provision of books <strong>and</strong> equipment. The contractfor the supply of teach<strong>in</strong>g materials for the country's primary schools<strong>in</strong> i990 was awarded to the International Project Managers (1PM)without any exam<strong>in</strong>ation of the company's employees or of theirqualifications. No tender competition was conducted, <strong>and</strong> no propersurvey of experienced agencies <strong>in</strong> the field of educational procurementwas made. The contract was not approved by the Central TenderBoard, <strong>and</strong> what the Presidential Commission of Inquiry described as' a series of breaches of Tender Board <strong>and</strong> F<strong>in</strong>ancial Regulations' soonfollowed.The consequence of several gross errors was that P27 million wasdissipated, largely unaudited, on the tender, of which P23 million hadbeen given to a locally-based company which was without f<strong>in</strong>ancialst<strong>and</strong><strong>in</strong>g <strong>and</strong> headed by an <strong>in</strong>solvent.6 Rather more than Pi millionwas lost <strong>in</strong> the mis-allocation <strong>and</strong> delivery of books. The IPM had <strong>in</strong>fact no experience of any k<strong>in</strong>d <strong>in</strong> the purchase <strong>and</strong> supply of schoolmaterials.The two M<strong>in</strong>istries had earlier established a Reference Group <strong>and</strong> aTender Panel supposedly to plan <strong>and</strong> co-ord<strong>in</strong>ate the procurementexercise, <strong>and</strong> it was on the Chairman of both these bodies, LeonardMukokomani, that the Presidential Commission placed 'the ma<strong>in</strong>responsibility for this debacle'. He had been <strong>in</strong>fluenced by the 'illconsideredadvice' of the Pr<strong>in</strong>cipal F<strong>in</strong>ance Officer <strong>in</strong> the M<strong>in</strong>istry ofLocal Government, Roger Bowyer, although 'ultimate responsibility'rested with the Permanent Secretary <strong>and</strong> Account<strong>in</strong>g Officer, MeshackMokone.76 The Pula was worth 0-53 US dollars <strong>in</strong> 1990, 0-50 <strong>in</strong> March I99I, 0 48 <strong>in</strong>June 1992, <strong>and</strong> 0-41<strong>in</strong> I993. Illegal L<strong>and</strong> Transactions <strong>in</strong> Peri- Urban VillagesLocal Government was the M<strong>in</strong>istry chiefly responsible for themismanagement <strong>and</strong> waste of the IPM, <strong>and</strong> it was <strong>also</strong> entirelyaccountable for the far greater malpractices which surfaced <strong>in</strong> I 99 I <strong>and</strong>I 992. Operat<strong>in</strong>g the gates through which all must pass <strong>in</strong> search of l<strong>and</strong><strong>and</strong> hous<strong>in</strong>g, its systemic <strong>and</strong> societal importance is outst<strong>and</strong><strong>in</strong>g. Thisis reflected <strong>in</strong> its size, the possession of two Assistant M<strong>in</strong>isterships, <strong>and</strong>its large f<strong>in</strong>ancial allocations. Under the I 994 budget it received I 8 percent of recurrent expenditure which, at P58i million, was the secondlargestoutlay. It <strong>also</strong> got an additional 2I per cent of developmentspend<strong>in</strong>g, P335 million, the largest share.' As the agency forgovernment policy <strong>in</strong> key areas, it might well be termed 'a flagshipM<strong>in</strong>istry'.9The Presidential Commission of Inquiry <strong>in</strong>to illegal l<strong>and</strong> transactions<strong>in</strong> peri-urban villages near Gaborone concluded its work <strong>in</strong> Decemberi99i. The Chairman, Englishman Kgabo, was explicit regard<strong>in</strong>g theorig<strong>in</strong>s of an acute public problem which had steadily worsened overa decade. People had moved to the Kweneng District, <strong>and</strong> moreparticularly <strong>in</strong>to Mogoditshane, because of the critical shortage ofaccommodation <strong>in</strong> Gaborone; <strong>and</strong> this was 'a serious <strong>in</strong>dictment ofGovernment itself s<strong>in</strong>ce it failed to provide shelter to its people.' Thedifficulties faced were <strong>in</strong>deed exacerbated by the relevant agenciesoperat<strong>in</strong>g under the purview of the M<strong>in</strong>istry of Local Government.L<strong>and</strong> allocations had rema<strong>in</strong>ed frozen <strong>in</strong> Mogoditshane s<strong>in</strong>ce the mid-I 980s, <strong>and</strong> the <strong>Botswana</strong> Hous<strong>in</strong>g Corporation had virtually suspendedthe construction of houses, while the servic<strong>in</strong>g of plots had <strong>also</strong> sloweddown. The Commission managed to identify as many as 84I plots thatwere illegally acquired, but felt that the actual figure was higher. 'Itwas a grave mistake' to suspend allocations for so long a time, Kgaboconcluded, without any alternative be<strong>in</strong>g provided by the Government.While many residents were well-nigh forced <strong>in</strong>to unlawful l<strong>and</strong>transactions, they were <strong>also</strong> encouraged to act illegally by theparticipation of certa<strong>in</strong> parliamentarians <strong>and</strong> lead<strong>in</strong>g m<strong>in</strong>isters <strong>in</strong> suchactivities. The Commission found evidence of the use of high office forpersonal ga<strong>in</strong>, <strong>and</strong> named the Vice-President <strong>and</strong> M<strong>in</strong>ister for LocalGovernment, P. S. Mmusi, <strong>and</strong> the M<strong>in</strong>ister of Agriculture, D. K.Kwelagobe. CORRUPTION AND MISMANAGEMENT 503by a generous friend, but the L<strong>and</strong> Board had refused to give legaleffect to this transfer: 'On appeal to the M<strong>in</strong>ister [of LocalGovernment] by Mr Kwelagobe ... the L<strong>and</strong> Board was ... directed toeffect the transfer'. This <strong>in</strong>tervention by the M<strong>in</strong>ister on behalf of afriend <strong>and</strong> colleague was, said Kgabo, 'deeply regrettable'. BothMmusi <strong>and</strong> Kwelagobe were develop<strong>in</strong>g l<strong>and</strong> <strong>in</strong> the area, <strong>and</strong> a plothad been transferred to the Vice-President's son <strong>and</strong> consolidated withadjacent l<strong>and</strong> owned by a senior bureaucrat; both the transfer <strong>and</strong> theconsolidation 'were done dur<strong>in</strong>g the freeze' on allocations by the L<strong>and</strong>Board. Residents <strong>in</strong>formed the Commission that Mmusi had 'told them<strong>in</strong> the kgotla that the freeze affected non-Bakwena only'.Several of those who were themselves engaged <strong>in</strong> illegal l<strong>and</strong> salesclaimed that they had done no wrong s<strong>in</strong>ce ' responsible peopleaccumulate large chunks of l<strong>and</strong> <strong>and</strong> enrich themselves'. InMogoditshane, the name of Mmusi <strong>and</strong> Kwelagobe had 'cropped upvery frequently' before the Commission, <strong>and</strong> 'the public does not referto them with any compliments'. Kgabo concluded that 'governmentcredibility <strong>and</strong> <strong>in</strong>tegrity are at stake' <strong>in</strong> the peri-urban areas.10 Mmusiwas <strong>also</strong> the National Chairman of the BDP, <strong>and</strong> Kwelagobe was itsSecretary-General; respectively numbers two <strong>and</strong> three after PresidentKetumile Masire <strong>in</strong> the hierarchy of the rul<strong>in</strong>g party. Although bothresigned from the Government <strong>in</strong> March I992, three months after thesubmission of the report, they were most reluctant to admit theseriousness of their actions. Only <strong>in</strong> June I992 was their suspensionfrom party office <strong>also</strong> announced.3. Operations of the <strong>Botswana</strong> Hous<strong>in</strong>g Corporation (BHC)The Presidential Commission of Inquiry <strong>in</strong>to the operations of theBHC, chaired by Richard Christie, presented its report <strong>in</strong> NovemberI992, amid exist<strong>in</strong>g public furore as events unfolded concern<strong>in</strong>g thatparastatal <strong>and</strong> its associated M<strong>in</strong>istry. In the previous December,Spectra <strong>Botswana</strong> had granted an unsecured loan of P5oo,ooo to oneof its three directors, the Assistant M<strong>in</strong>ister of Local Government,Michael Tship<strong>in</strong>are, <strong>and</strong> thereafter its parent company, the PremierGroup of South Africa, made a successful tender-bid to construct a newheadquarters for the BHC, at a planned allocation of P53 million. InFebruary I992 the Corporation's ambitious general manager, JosephLetsholo, met a violent death. 504 KENNETH GOODwhen Christie identified 'gross mismanagement <strong>and</strong> dishonesty' <strong>in</strong> theBHC 'result<strong>in</strong>g <strong>in</strong> the loss of tens of millions of Pula'.Inefficiencies <strong>and</strong> wrong-do<strong>in</strong>g appeared throughout the Corporation,<strong>and</strong> existed too with<strong>in</strong> the supervis<strong>in</strong>g M<strong>in</strong>istry. The otherAssistant M<strong>in</strong>ister of Local Government, Ronald Sebego, was found tohave used his position for the benefit of friends. The construction of 407high-cost houses had been planned on a hillside at Lobatse, thoughlittle or no market existed there for such accommodation, <strong>and</strong> the BHChad paid out P8-5 million for professional services <strong>in</strong> their design.Spectra <strong>Botswana</strong> received PI2 million to build the new BHCheadquarters before the contract was f<strong>in</strong>ally cancelled <strong>in</strong> June I992.Christie found that 'ultimate adm<strong>in</strong>istrative responsibility' was borneby the Permanent Secretary <strong>in</strong> the M<strong>in</strong>istry who was <strong>also</strong> Chairman ofthe BHC, Pelonomi Venson, while Mmusi carried 'the politicalresponsibility' for the massive corruption.11The subjects of the Kgabo <strong>and</strong> Christie reports were closely<strong>in</strong>terrelated, <strong>and</strong> the identified problems stemmed from hous<strong>in</strong>g <strong>and</strong>l<strong>and</strong> shortages which had been unreasonably prolonged by those <strong>in</strong>power. M<strong>in</strong>isters <strong>and</strong> senior civil servants had manipulated thecircumstances for personal advantage, <strong>and</strong> irresponsible, wrongdecisions had been taken. The spend<strong>in</strong>g of P53 million on a redundantoffice-build<strong>in</strong>g for the BHC was without justification, <strong>and</strong> it was at leastquestionable if the contract <strong>in</strong> any case should have gone to the PremierGroup, a company whose operations <strong>in</strong> Africa, perhaps especially so <strong>in</strong>Zaire, were surrounded by notoriety.12 The Corporation, under theday-to-day control of a maverick manager, had acted out of publiccontrol. The IPM consultancy <strong>also</strong> resulted from the near total<strong>in</strong>effectiveness of the supposed controls, <strong>and</strong> almost P30 million hadbeen wasted, to the presumed private ga<strong>in</strong> of some of those <strong>in</strong>volved.The events <strong>in</strong> Mogoditshane <strong>and</strong> the mismanagement <strong>in</strong> the BHC <strong>and</strong>the M<strong>in</strong>istry of Local Government, moreover, came to light throughpublic controversy - fuelled by able <strong>in</strong>vestigative report<strong>in</strong>g <strong>in</strong> the<strong>in</strong>dependent newspapers - <strong>and</strong> not as a result of <strong>in</strong>ternal, governmental" Republic of <strong>Botswana</strong>, Report of the Presidential Commission of Inquiry Into the Operations of the<strong>Botswana</strong> Hous<strong>in</strong>g Corporation (Gaborone, 30 November I992), pp. 6-8, 79-89, 99, <strong>and</strong> 203-5.12 Accord<strong>in</strong>g to Sebastian Mallaby, After Apartheid (London, I992), pp. i60-3, 'Premier wentto great lengths to w<strong>in</strong> the loyalty of senior politicians' <strong>in</strong> Africa, <strong>and</strong> the Belgian chairman of its<strong>in</strong>ternational division, Albert Nelissen, 'had a way of charm<strong>in</strong>g presidents'. Where speed was the criterion, <strong>and</strong> not costs, Premier got th<strong>in</strong>gs done wherever theywere called. As Nelissen himself expla<strong>in</strong>ed: 'Us establish <strong>in</strong> Africa. Pay<strong>in</strong>g tax, employ<strong>in</strong>g locals,tra<strong>in</strong><strong>in</strong>g locals. Us give them a complete package.'

These throughout were either absent or<strong>in</strong>effective.Kgabo made clear the long-runn<strong>in</strong>g nature of the problems he<strong>in</strong>vestigated, <strong>and</strong> much the same applied to the operations consideredby Christie. As noted, lead<strong>in</strong>g politicians <strong>and</strong> bureaucrats wereidentified <strong>in</strong> both reports; Mmusi was particularly prom<strong>in</strong>ent, rank<strong>in</strong>gnext only to President Masire <strong>in</strong> both the Cab<strong>in</strong>et <strong>and</strong> the rul<strong>in</strong>g BDP.S<strong>and</strong>y Grant exam<strong>in</strong>ed the possibility that 'key members of thegovernment knew very well what was happen<strong>in</strong>g but hoped somehowto keep matters quiet.' Chance events, like the death by car accidentof the BHC's General Manager, made this impossible. When, as Grantnoted, Joseph Letsholo's personal safe was opened, 'so many of the toppeople <strong>in</strong> government were sufficiently concerned about what was <strong>in</strong>[it] that they had all to be present'."3 Rather as Kgabo seemed tosuspect, the BHC sc<strong>and</strong>als implied a failure <strong>in</strong> the entire governmentsystem, precisely <strong>in</strong> its highest echelons.The Immediate Reactions of the M<strong>in</strong>isters InvolvedThose accused <strong>and</strong> named <strong>in</strong> the Kgabo <strong>and</strong> Christie reports have <strong>in</strong>general <strong>in</strong>sisted, sometimes belligerently, that no personal wrong-do<strong>in</strong>ghad occurred, <strong>and</strong> that they held no responsibility for the consequences.These denials have been persisted with even after the Commissions hadreported <strong>and</strong> their f<strong>in</strong>d<strong>in</strong>gs accepted by both Parliament <strong>and</strong>Government. Segebo allowed that he had <strong>in</strong>deed allocated BHC housesto friends as Assistant M<strong>in</strong>ister of Local Government while there weresome 20,000 on the formal wait<strong>in</strong>g-list for hous<strong>in</strong>g. He was subsequentlymoved, with no demotion, to a similar post <strong>in</strong> the M<strong>in</strong>istry of F<strong>in</strong>ance<strong>and</strong> Development Plann<strong>in</strong>g, <strong>and</strong> cont<strong>in</strong>ued to ma<strong>in</strong>ta<strong>in</strong>, at least untilhis resignation from the Cab<strong>in</strong>et <strong>in</strong> February I993, that 'I don't th<strong>in</strong>kI did anyth<strong>in</strong>g wrong', <strong>and</strong> 'I don't take the blame for not detect<strong>in</strong>gproblems at the BHC '.14 Quasi-judicial judgements, society's op<strong>in</strong>ions,<strong>and</strong> the norms of responsible government were <strong>in</strong>transigently ignored.After be<strong>in</strong>g dropped from the Cab<strong>in</strong>et, Mmusi <strong>and</strong> Kwelagobeorganised vociferous public rallies at which they vehemently proclaimedtheir <strong>in</strong>nocence. 506 KENNETH GOODGovernment's white paper on the report came to be debated <strong>in</strong> AprilI992, backbench MPs, some of whom had been named by Kgabo, weresaid to have described the commissioners as liars, <strong>and</strong> as vicious <strong>and</strong>wicked."6 After the report was approved by Parliament, Mmusi <strong>and</strong>Kwelagobe announced that they were su<strong>in</strong>g the Government over thematter.Such strong denials of responsibility constitute an apparent claimthat members of the rul<strong>in</strong>g elite are above the law, or that they arecapable of <strong>in</strong>terpret<strong>in</strong>g the laws to their own advantage. Democraticnorms of accountability have been flouted, <strong>and</strong> the absence of anymoral code of exemplary leadership <strong>in</strong>dicated. The conclusion seemsunavoidable that, if these attitudes rema<strong>in</strong> unchanged with<strong>in</strong> the ranksof the top leadership, corruption <strong>and</strong> mismanagement are unlikely toend. This became more probable when the BDP congress, <strong>in</strong> July I993,re-elected Kwelagobe <strong>and</strong> Mmusi to their former positions on thecentral committee, with comm<strong>and</strong><strong>in</strong>g majorities. The rul<strong>in</strong>g partyhad by direct implication sanctioned their previous wrongdo<strong>in</strong>gs.Kwelagobe described his re-election as a sign that he was <strong>in</strong>nocent,add<strong>in</strong>g for full measure that 'the BDP was conv<strong>in</strong>ced that I havecommitted no offence whatsoever'.17NEWSLINK AND PROJECT EAGLEOther questionable, seem<strong>in</strong>gly unsound decisions have occurred orare <strong>in</strong> process. While these may not be of the same sc<strong>and</strong>alousproportions as the BHC/Local Government embroglio, they <strong>in</strong>volvethe diversion of large f<strong>in</strong>ancial resources, <strong>and</strong> jeopardise nationalsecurity. They too cast doubts on the old reputation for efficient,prudent adm<strong>in</strong>istration.In August i990, the South African Defence Force (SADF) was ableto establish the weekly Newsl<strong>in</strong>k Africa <strong>in</strong> Gaborone as an organ of itsmilitary <strong>in</strong>telligence. <strong>Botswana</strong>'s capital had been chosen as a morefavourable location than alternative regional sites such as W<strong>in</strong>dhoek orHarare. It was later reported <strong>in</strong> the then Weekly Mail ofJohannesburgthat the SADF's front men 'succeeded completely <strong>in</strong> persuad<strong>in</strong>g the<strong>Botswana</strong> government of the operation's bonafides', <strong>and</strong> that the guestspeaker at the official launch<strong>in</strong>g of the paper was the M<strong>in</strong>ister ofCommerce <strong>and</strong> Industry.18 It closed <strong>in</strong> December i99i, some fourmonths after President F. CORRUPTION AND MISMANAGEMENT 507restrictions meant the curtailment of such covert projects, <strong>and</strong> after theWeekly Mail <strong>and</strong> Mmegi had begun to expose the true nature of theSADF's publication.The M<strong>in</strong>ister for Presidential Affairs <strong>and</strong> Public Adm<strong>in</strong>istration,Lieutenant-General Mompati Merafhe, had stated <strong>in</strong> August I 99I that<strong>Botswana</strong> viewed the media reports seriously; if they proved true, 'thepresence of Newsl<strong>in</strong>k <strong>in</strong> <strong>Botswana</strong>... would therefore be most unacceptable'."9The exposure steadily <strong>in</strong>creased, <strong>and</strong> Newsl<strong>in</strong>k wasallowed <strong>in</strong> mid-December to withdraw large truckloads of equipmentover the <strong>Botswana</strong> border. How <strong>and</strong> why this was done, as locallybasedemployees clamoured for unpaid wages <strong>and</strong> suppliers foroutst<strong>and</strong><strong>in</strong>g payments, has not been fully expla<strong>in</strong>ed.20 Later still, <strong>in</strong>November I992, Merafhe announced that <strong>Botswana</strong> was to lodge aprotest with South Africa, add<strong>in</strong>g to a Mmegi <strong>in</strong>terviewer: 'We feltthere was someth<strong>in</strong>g s<strong>in</strong>ister about the whole matter', although notdeny<strong>in</strong>g the suggestion that a brother of President Masire had been<strong>in</strong>volved with the Newsl<strong>in</strong>k management.21 The whole <strong>in</strong>cident was themore strange s<strong>in</strong>ce the Government had previously adopted aconsistently strong stance on issues of national security.The decision-mak<strong>in</strong>g which has led to the construction of 'ProjectEagle', the new military airbase near Molepolole west of the capital, ishighly questionable. There was a perceived need to move <strong>Botswana</strong>'sAir-Arm from its exist<strong>in</strong>g location <strong>in</strong> the middle of Gaborone, but itmight well have been re-located at Sir Seretse Khama InternationalAirport - which is not an over-utilised facility - rather as the largerZambian Air Force is based <strong>in</strong> Lusaka. The Air-Arm as constituted isa very small force: as of I99I-2, it consisted of I3 obsolescent groundattackaircraft (8 BAC-I67, 5 BN2), one transport squadron (2Defenders, 2 CN-235, 2 Skyvans, I BAe 125-800), <strong>and</strong> 7 unarmedhelicopters (2 AS-35oL, 5 Bell 4I2).22In November I992, the Government released a document, datedMarch i99i, stat<strong>in</strong>g that Project Eagle had been conceived much1" Quoted <strong>in</strong> Mmegi, 30 August i99i.20 Accord<strong>in</strong>g to the Midweek Sun, i8 December iggi, three truckloads of pr<strong>in</strong>t<strong>in</strong>g equipmenthad been allowed to pass through the Tlokweng border-gate with South Africa on the morn<strong>in</strong>gof Sunday, I 5 December, 'leav<strong>in</strong>g creditors at a loss about how to pursue their claims aga<strong>in</strong>st thepaper', while the <strong>Botswana</strong> Gazette of the same day spoke about the workers hav<strong>in</strong>g been 'left high<strong>and</strong> dry' by the sudden departure.21 Mmegi, 6 November I992, reported Mompati Merafhe as hav<strong>in</strong>g said: 'Certa<strong>in</strong>ly I don'tth<strong>in</strong>k there is any conclusive evidence that Basimanyana [Masire] knew about the mach<strong>in</strong>ationsof N~ewsl<strong>in</strong>k<strong>Botswana</strong>.22 The International Institute for Strategic Studies, The Military Balance, 9ggz-93 (London,1992), estimated the total personnel of <strong>Botswana</strong>'s Air-Arm as 'ioo+', while Bus<strong>in</strong>ess Day(Johannesburg) has suggested 300.


508 KENNETH GOODearlier when regional conflict was rife, <strong>and</strong> when Seretse KhamaAirport could have been vulnerable to attack (as presumably the cityairport or Molepolole might <strong>also</strong> have been). It claimed that the costswould not exceed P624 million, but no reference was made toadditional expenditures on new equipment, spare parts, <strong>and</strong> tra<strong>in</strong><strong>in</strong>g.It is only through the expansion, <strong>in</strong>deed the transformation of theairw<strong>in</strong>g, necessitat<strong>in</strong>g larger outlays on costly mach<strong>in</strong>es <strong>and</strong> ancillarymaterials <strong>and</strong> services, that <strong>Botswana</strong>'s utilization of Project Eaglecould be understood <strong>and</strong> rationalized. The Midweek Sun commented atthe time that the document served to confirm the existence of'unwarranted <strong>and</strong> excessive secrecy with<strong>in</strong> the government'.23In the I 992-3 f<strong>in</strong>ancial year, defence claimed 9-4 per cent of<strong>Botswana</strong>'s total expenditure, largely represented by the costs of thenew airbase, <strong>and</strong> over the current plann<strong>in</strong>g period the military wasexpected to consume almost I3 per cent of development outlays.Confusion appeared to exist with<strong>in</strong> the Government itself over thewisdom of such expenditures. Deliver<strong>in</strong>g his I 992 budget speech, theM<strong>in</strong>ister of F<strong>in</strong>ance <strong>and</strong> Development Plann<strong>in</strong>g, Festus Mogae, saidthatthe less threaten<strong>in</strong>g environment that is gradually emerg<strong>in</strong>g <strong>in</strong> theregion... should serve to reduce <strong>Botswana</strong>'s expenditure on defence, <strong>and</strong>enable resources to be re-directed towards productive developmentobjectives. 24While the regional environment has cont<strong>in</strong>ued gradually to improve,despite conflict <strong>in</strong> Angola, the construction of the Molepolole base hasgone ahead. The South African correspondent of lane's Defence Weekly(London), Helmoed Heitman, estimated <strong>in</strong> I993 that the f<strong>in</strong>al cost ofProject Eagle, when completed <strong>in</strong> I 995, would be US$6oo million,25 orabout PI ,500 million at present prices, roughly 20 per cent of currentannual GDP. Such non-productive military expenditures - for otherthan their employment-generat<strong>in</strong>g benefits - are extremely difficult tojustify <strong>in</strong> themselves, <strong>and</strong> even more so <strong>in</strong> relation to the alreadyexist<strong>in</strong>g problems of <strong>Botswana</strong>: notably, acute rural poverty, urbancrime which is worsened by an under-funded police force, <strong>and</strong> of coursethe serious lack of public hous<strong>in</strong>g.The construction of this new military complex has further createdbafflement <strong>and</strong> unease among neighbour<strong>in</strong>g states. CORRUPTION AND MISMANAGEMENT 509Congress (ANC), <strong>and</strong> subsequently the Premier of that Prov<strong>in</strong>ce, haspublicly stated that his organisation had <strong>in</strong>vestigated potential threatsto South Africa <strong>and</strong>, apart from the <strong>Botswana</strong> airbase, had found thatthese were non-existent. He believed that the United States must be<strong>in</strong>volved <strong>in</strong> the projected utilization of so large a facility, though he <strong>also</strong>noted that Wash<strong>in</strong>gton had denied such claims. Sexwale reportedlysaid that the base had affected the ANC's strategic th<strong>in</strong>k<strong>in</strong>g on militarythreats <strong>in</strong> the region.26 The rationality <strong>and</strong> prudence which oncecharacterized the choice <strong>and</strong> implementation of policy <strong>in</strong> <strong>Botswana</strong>seem absent from Project Eagle.THE NATIONAL DEVELOPMENT BANK (NDB)The NDB was established 'for the purpose of promot<strong>in</strong>g theeconomic development of <strong>Botswana</strong>', <strong>and</strong> to this end was meant 'toprovide f<strong>in</strong>ancial assistance', <strong>and</strong> to conduct its bus<strong>in</strong>ess '<strong>in</strong> the mannerbest suited for the efficient <strong>and</strong> economical utilization of its funds'.27 Itwas, <strong>in</strong> the words of the M<strong>in</strong>ister of F<strong>in</strong>ance <strong>in</strong> i99i, 'an essentialvehicle for channell<strong>in</strong>g loan f<strong>in</strong>anc<strong>in</strong>g from Government <strong>and</strong> extern<strong>also</strong>urces to the agricultural sector <strong>and</strong> other development activities ofhigh priority'. It had long been, Mogae emphasized, 'a pillar of ourf<strong>in</strong>ancial system'. 28By late I 993, however, its near bankruptcy was obvious. The NDB'saccumulated losses had by March totalled P4 I I million. Outst<strong>and</strong><strong>in</strong>gloans amounted to P9I-3 million, of which over one-third were <strong>in</strong>arrears, most for more than six months. The Government's equityposition was a negative PI 56 million. In addition, the Small BorrowersFund, adm<strong>in</strong>istered by the NDB for the Government, had at the sametime accumulated losses of P32-4 million; 70 per cent of its accountswere <strong>in</strong> arrears, almost all <strong>in</strong> excess of six months.29 By November, theNDB was los<strong>in</strong>g P450,ooo a month. At a press conference, Mogae saidthat the NDB was owed more than P6o million <strong>in</strong> arrears, <strong>and</strong> that theessential problem entangl<strong>in</strong>g the Bank was the near refusal of borrowerseven to service their loans.30The NDB's collapse was neither sudden nor accidental. 5IO KENNETH GOODrapid expansion of lend<strong>in</strong>g dur<strong>in</strong>g the I 980s', when loans <strong>and</strong><strong>in</strong>vestments <strong>in</strong>creased ten-fold from i980 to reach P47p2 million <strong>in</strong>I 988. The Government had <strong>in</strong>jected a total of P36 million to cover thewrite-offs of bad debts by the NDB on a number of occasions after I 982,with P3 I million be<strong>in</strong>g outlaid for this purpose <strong>in</strong> i988 alone.31 It had<strong>also</strong> sanctioned the reschedul<strong>in</strong>g of loans simply on an across-the-boardbasis, without regard for an <strong>in</strong>dividual's possible capacity to repaywhat was still owed. The effect, accord<strong>in</strong>g to some employees of theNDB after the events, was to send the wrong signals to farmers <strong>and</strong>other borrowers - that loans need not be repaid because their eventualcancellation could be safely anticipated.32Part of the weaknesses of the Bank, especially its heavy accumulationof debt, seem<strong>in</strong>gly related to the composition of the NDB Board. Here<strong>in</strong>civil servants tended to predom<strong>in</strong>ate, as at the start of I994, <strong>and</strong> whilethey were men <strong>and</strong> women of likely capacity, their collective strength,<strong>in</strong>dependence, <strong>and</strong> autonomy vis-a'-vis M<strong>in</strong>isters, was not obvious.33On the testament of employees of the Bank, <strong>in</strong>terest rates on NDBloans were not set by the Board, but by the Government.34 Variousrestructur<strong>in</strong>g programmes were announced, but all to no avail. A consultancywas commissioned by the NDB <strong>in</strong> i989-90, at a cost of Pimillion, but its recommendations were never implemented.35 TheM<strong>in</strong>ister of F<strong>in</strong>ance, <strong>in</strong> his budget speech of January i99i, <strong>and</strong> aga<strong>in</strong><strong>in</strong> January I992, specifically stated that 'a sharply curtailed level ofnew lend<strong>in</strong>g <strong>and</strong> an <strong>in</strong>tensive debt collection campaign' had 'been<strong>in</strong>itiated .36 A year later, <strong>in</strong> January I 993, the M<strong>in</strong>ister referred aga<strong>in</strong>to an '<strong>in</strong>tensive arrears collection programme', add<strong>in</strong>g illum<strong>in</strong>at<strong>in</strong>glythat new loans were 'restricted to creditworthy borrowers '37 _seem<strong>in</strong>gly, such st<strong>and</strong>ard bank<strong>in</strong>g requirements had not always beenupheld previously.The futility of the various remedial measures was f<strong>in</strong>ally clarified atthe beg<strong>in</strong>n<strong>in</strong>g of I 994. CORRUPTION AND MISMANAGEMENT 5IIsources revealed that many of <strong>Botswana</strong>'s leaders were heavily <strong>in</strong>debtedto the Bank, some <strong>in</strong> default for over six months. Among them, theAssistant M<strong>in</strong>ister of F<strong>in</strong>ance, Edison Masisi, had himself acquired aloan of P42,ooo, as of September I993, <strong>and</strong> the M<strong>in</strong>ister of M<strong>in</strong>eralResources <strong>and</strong> Water Affairs, Archie Mogwe, had borrowed P26,ooo,of which PI5,000 was more than six months <strong>in</strong> arrears. The M<strong>in</strong>isterof Presidential Affairs, Lieutenant-General Merafhe, owed P47,ooo,while his colleagues at Commerce <strong>and</strong> Industry, P. H. K. Kedikilwe,held a balance outst<strong>and</strong><strong>in</strong>g of P640,ooo, of which P26o,ooo was <strong>in</strong>arrears. Johnny Swart, a prom<strong>in</strong>ent BDP backbencher from theGhanzi district, owed as much as PiI20,000.The M<strong>in</strong>ister of Labour <strong>and</strong> Home Affairs, Patrick Balopi, was<strong>in</strong>debted via his company Phuramarapo Investment P/L to the extentof PI,IOOooo, with arrears of P400,00. The NDB was <strong>also</strong> allegedlyowed P546,ooo by President Masire, P6oo,ooo by Tship<strong>in</strong>are, <strong>and</strong> Piv5million by Sebego, with both ex-M<strong>in</strong>ister be<strong>in</strong>g similarly lax <strong>in</strong> theirrepayments. As well, the President's brother, Basimane Masire, figured<strong>in</strong> the top I5 of the Bank's debtors near the end of I993, with a loanoutst<strong>and</strong><strong>in</strong>g of PI 2 million that had never been serviced.38Although the M<strong>in</strong>ister of F<strong>in</strong>ance had said <strong>in</strong> January I992 that theNDB was '<strong>in</strong>creas<strong>in</strong>gly dependent on Government for its survival',39several of its lead<strong>in</strong>g members seem to have been responsible for itsdecl<strong>in</strong>e <strong>and</strong> downfall. They had borrowed heavily from this proclaimed'pillar of our f<strong>in</strong>ancial system', <strong>and</strong> had not bothered to repay theirloans even as the Bank collapsed under the burden of its accumulateddebts. This govern<strong>in</strong>g elite <strong>in</strong>cluded those, as NDB employees plausiblyclaimed, who determ<strong>in</strong>ed the <strong>in</strong>terest rates charged on bank loans.They <strong>also</strong> had sanctioned at least two generous debt write-offs <strong>in</strong> theI 980s, from which presumably some of them had personally ga<strong>in</strong>ed,thereby undoubtedly send<strong>in</strong>g 'the wrong signals' to other borrowers,actual <strong>and</strong> potential.Unnamed sources <strong>in</strong>side the NDB stated, <strong>in</strong> February I994, thatCab<strong>in</strong>et M<strong>in</strong>isters <strong>and</strong> other parliamentarians had repeatedly soughtloans for which they did not quality.40 Indeed, the size of those later38 An unsigned document list<strong>in</strong>g NDB loans to M<strong>in</strong>isters <strong>and</strong> MPs of more than P2o,ooo each,<strong>and</strong> the names of the top I5 debtors <strong>in</strong> September 1993, was apparently faxed to variousrecipients, <strong>and</strong> the <strong>in</strong>formation so presented eventually appeared <strong>in</strong> the <strong>in</strong>dependent press,notably the <strong>Botswana</strong> Gazette, 9 February I994.3 'Budget Speech, I 992', p. 8.40 <strong>Botswana</strong> Gazette, 9 February 1994. 5I2 KENNETH GOODknown to have rema<strong>in</strong>ed outst<strong>and</strong><strong>in</strong>g <strong>and</strong> unserviced for over half ayear says noth<strong>in</strong>g for the strength <strong>and</strong> autonomy of the NDB Board.The M<strong>in</strong>ister of F<strong>in</strong>ance had implied that creditworth<strong>in</strong>ess had notbeen a requisite for all borrowers, <strong>and</strong> the Bank's new <strong>in</strong>terim generalmanager, John Rohan, admitted <strong>in</strong> an <strong>in</strong>terview that some loans mighthave been approved through political <strong>in</strong>fluence.41The fate of the Small Borrowers Fund (SBF), with outst<strong>and</strong><strong>in</strong>g loansof P32 million, as already noted, was further <strong>in</strong>dicative of prevail<strong>in</strong>gpractices among the rul<strong>in</strong>g elite. The Fund, accord<strong>in</strong>g to Mogae at apress conference <strong>in</strong> January I 994, had been grossly misunderstood: 'Itshould have been called small loans fund not the SBF s<strong>in</strong>ce there isnoth<strong>in</strong>g small about those who utilise it'. The Fund had orig<strong>in</strong>ally been<strong>in</strong>tended for the poor, but <strong>in</strong> the absence of any clear-cut policy as towho exactly should be regarded as small borrowers, most of those whomade use of the facility were actually, he reportedly said, 'big guns'. 42Both the Bank <strong>and</strong> the Fund had been exploited, extensively <strong>and</strong>over many years, by those who were responsible for the good operationsof these crucial sources of f<strong>in</strong>ance. The govern<strong>in</strong>g elite's manifest ethoswas <strong>in</strong>dividual self-enrichment. Dur<strong>in</strong>g the budget debate <strong>in</strong> I992,when the MP for Kgalagadi, Lesedi Mothibamele, called onparliamentarians <strong>and</strong> top officials to settle their NDB debts, he wasreportedly heckled, <strong>and</strong> some members dem<strong>and</strong>ed to know 'who hasshown you our accounts?'43 It was specifically from the spectacle ofgreed <strong>and</strong> negligence among the leadership that the 'wrong signals'had emanated, <strong>and</strong> these undoubtedly <strong>in</strong>dicated that close associates ofthe elite might <strong>also</strong> be the beneficiaries of debt cancellations <strong>and</strong> other<strong>in</strong>equitable policies <strong>and</strong> procedures. While M<strong>in</strong>isters were able toma<strong>in</strong>ta<strong>in</strong> unpaid debts for long periods, other borrowers were treatedquite differently - the owner of a small cement-block manufactur<strong>in</strong>gbus<strong>in</strong>ess be<strong>in</strong>g threatened with foreclosure by the Bank when his debtstood at just Pi 66. The NDB's employees were obviously well placedto observe how the credit system actually worked, <strong>and</strong> <strong>in</strong> fact theyobta<strong>in</strong>ed staff-loans which eventually totalled over P7 million.4541 Interview with the Guardian, i8 February 1994. CORRUPTION AND MISMANAGEMENT 5I3Reactions to ExposuresThe immediate response of several M<strong>in</strong>ister was to assert that theirlarge loans <strong>and</strong> <strong>in</strong>debtedness were actually all the fault of the NDB.Sebego said that 'my arrears [of P730,ooo] are not that high. They areprobably half that figure written on the [debtors] list'.46 Merafheclaimed that 'it is just that accounts at NDB are <strong>in</strong> a mess'.47 Althoughthis might have been wholly or partially true by early I 994, it ignoredthe related question of m<strong>in</strong>isterial responsibility <strong>in</strong> the mak<strong>in</strong>g of themess <strong>in</strong> the first place. His colleague, Mogwe, nevertheless agreed,expla<strong>in</strong><strong>in</strong>g that 'The th<strong>in</strong>g is the NDB never rem<strong>in</strong>ds us to pay <strong>and</strong> weforget.' He <strong>also</strong> suggested that his debts were only normal, add<strong>in</strong>gdisarm<strong>in</strong>gly, 'We are human too.'48 President Masire reportedly paidthe Bank what was outst<strong>and</strong><strong>in</strong>g on his debt shortly before say<strong>in</strong>g that'I had a problem like all farmers of sometimes be<strong>in</strong>g <strong>in</strong> arrears. '49 Theeffectiveness of this Everyman argument suffered from the patent factthat by no means all farmers, for example, enjoyed any such access toNDB funds. It might be normal to want a loan, but it was decidedlyabnormal to receive one of hundreds of thous<strong>and</strong>s of Pula <strong>and</strong> not beobliged to repay.A third reaction was to criticise the exposure, <strong>and</strong> to attack thosewho sought to <strong>in</strong>vestigate the role of the rul<strong>in</strong>g elite <strong>in</strong> the NDB'scollapse. President Masire declared that it was all 'unethical', <strong>and</strong> that'the media should refra<strong>in</strong> from this witch hunt'."5 The M<strong>in</strong>ister ofForeign Affairs, Dr Gaositwe Chiepe, <strong>also</strong> attacked the press, claim<strong>in</strong>g:'We are breed<strong>in</strong>g ... a culture of mistrust <strong>and</strong> abuse where you bundleeveryone <strong>in</strong>to one group without verify<strong>in</strong>g the facts'.51 Notably,however, no serious rebuttal or revision of the released figures wasforthcom<strong>in</strong>g throughout the considerable commotion that extended forsome weeks. 514 KENNETH GOODWhile the leadership concentrated on a few <strong>in</strong>adequate counterarguments,what they conspicuously did not offer to the public was adetailed explanation of either the extent of their loans <strong>and</strong> accumulated<strong>in</strong>debtedness, or the circumstances <strong>in</strong> which they were acquired <strong>and</strong>ma<strong>in</strong>ta<strong>in</strong>ed. For example: who had <strong>in</strong>itially authorised the loans <strong>and</strong>on what basis <strong>and</strong> collateral? who had approved the cancellations ofvarious debts, <strong>and</strong> had the M<strong>in</strong>isters themselves been beneficiaries?how had many rema<strong>in</strong>ed <strong>in</strong> arrears on repayments for so long, <strong>and</strong> onwhose authority? Although unethical behaviour was alluded to bymore than one M<strong>in</strong>ister, their accountability on this crucial matterrema<strong>in</strong>ed entirely absent.53 No resignations resulted.Instead, it was certa<strong>in</strong> subord<strong>in</strong>ate though participant elements <strong>in</strong>the problem who have implicitly, <strong>in</strong> the context of the time, borne theresponsibility; at least I29 of those work<strong>in</strong>g for the NDB, some 50 percent of the Bank's staff, were declared to be redundant <strong>in</strong> JanuaryI994.54 When angry students demonstrated outside the House ofAssembly the follow<strong>in</strong>g month, they said that 'because of the failure ofthe Members of Parliament <strong>and</strong> M<strong>in</strong>isters to pay the NDB its money,<strong>in</strong>nocent workers are hav<strong>in</strong>g to pay by los<strong>in</strong>g their jobs '.55 It rema<strong>in</strong>edpossible that not even full repayment of debts might be required of theleadership,56 but although the M<strong>in</strong>ister of F<strong>in</strong>ance was aga<strong>in</strong> be<strong>in</strong>gcriticised by some government MPs for not writ<strong>in</strong>g off more NDBloans, Mogae had publicly listed reasons dur<strong>in</strong>g his press conference <strong>in</strong>January why any further cancellations would be unfair.57 For its part,the Bank's new management did not aim at the full recovery of alldebts. Rohan's position <strong>in</strong> February I994 was described as be<strong>in</strong>g oneof optimism for the recovery of either some, or a substantial amount, ofthe millions of Pula owed to the NDB, <strong>and</strong> this over an unspecifiedperiod.5853 Some recognition of the matter's seriousness, at least, did come from with<strong>in</strong> the rul<strong>in</strong>g party'sorganisation, when the BDP's Adm<strong>in</strong>istration Secretary, Aobakwe Sekgwa, reportedly said thatthe unpaid loans did 'not augur well for the NDB <strong>and</strong> it is an embarrassment to the government<strong>and</strong> BDP'. CORRUPTION AND MISMANAGEMENT 5I5President Masire had <strong>also</strong> offered what represented the elite's fourthargument aga<strong>in</strong>st the exposures, one which did not lack for cogency.The NDB issue, he said, 'has to be looked at <strong>in</strong> its context'. <strong>Botswana</strong>was 'a highly risky area, especially <strong>in</strong> agricultural pursuits'. But the'people who venture' were 'the hope of our society'." Sebego hadearlier been described <strong>in</strong> the <strong>Botswana</strong> Gazette as 'a farmer [who] hasbeen lead<strong>in</strong>g the onslaught aga<strong>in</strong>st Mogae', <strong>and</strong> was said to blamethe M<strong>in</strong>ister of F<strong>in</strong>ance for the 'imm<strong>in</strong>ent collapse of the farm<strong>in</strong>g<strong>in</strong>dustry'.60 A crude exaggeration, no doubt, but much the same notionthat access to bank-lend<strong>in</strong>g was a prerequisite for the <strong>in</strong>tensification ofagricultural production occurr<strong>in</strong>g <strong>in</strong> <strong>Botswana</strong>. It was echoed too byanother former M<strong>in</strong>ister, Daniel Kwelagobe, when he called <strong>in</strong>Parliament for the provision of what was termed a period of grace forthose with bank-loans for new agricultural projects.6" Entrepreneurship,<strong>in</strong> this view, should be accorded a free re<strong>in</strong>.The relevant ' context' was, however, even murkier than thePresident probably wished to imply. The NDB was the biggest but notthe only public lend<strong>in</strong>g-<strong>in</strong>stitution plundered <strong>in</strong> the boom economy.The <strong>Botswana</strong> Cooperative Bank was practically bankrupt, accord<strong>in</strong>gto the M<strong>in</strong>ister of F<strong>in</strong>ance, <strong>in</strong> early I 992. Accounts were overdrawn byhuge amounts - <strong>in</strong> the case of one bus<strong>in</strong>ess client by more than P5million. Insider-lend<strong>in</strong>g embraced both staff <strong>and</strong> the board of directors,<strong>and</strong> one senior bank official had several loans totall<strong>in</strong>g some P70o,ooo.62Meanwhile, at the <strong>Botswana</strong> Agricultural Market<strong>in</strong>g Board, accumulatedlosses were reported to have jumped from some P3 million <strong>in</strong> I 989to over P2Iv5 million <strong>in</strong> I992. Mmegi claimed to be reliably <strong>in</strong>formedthat top law-makers <strong>and</strong> civil servants were known to have takenfertilisers <strong>and</strong> various agricultural <strong>in</strong>puts on credit, which they failedto repay. Losses that <strong>in</strong>corporated bad debts exceeded Pio million.A company with which President Masire was associated, G.M. 5i6 KENNETH GOODCOALESCENCE OF ECONOMIC AND POLITICAL POWER<strong>Corruption</strong> <strong>and</strong> mismanagement <strong>in</strong> <strong>Botswana</strong> is relatively pale <strong>and</strong>restricted. It is almost entirely an elite phenomenon, <strong>and</strong> when itextends to others, as <strong>in</strong> state-run f<strong>in</strong>ancial organizations <strong>and</strong> over l<strong>and</strong><strong>in</strong> Mogoditshane, it is under conditions seem<strong>in</strong>gly sanctioned by someparticipat<strong>in</strong>g government leaders <strong>and</strong> officials. It is not systemic to thewhole of the political economy as <strong>in</strong> Zaire, where <strong>in</strong> measuredgradations it has served to reta<strong>in</strong> the loyalty of officials to PresidentMobutu, one of the richest men <strong>in</strong> the world.64 Nor is it epidemic,afflict<strong>in</strong>g the whole society, as <strong>in</strong> Nigeria, <strong>and</strong> there is decidedly no'culture of corruption' as exists <strong>in</strong> Brazil. It significance lies <strong>in</strong> contrastwith the generally reputable <strong>and</strong> efficient governmental performancepreced<strong>in</strong>g the I 98os, <strong>and</strong> <strong>in</strong> what the cases noted here might presage forthe future. Responsibility <strong>and</strong> accountability have been seriouslyreduced with<strong>in</strong> the top-most levels of the Government, but to-datemany state <strong>in</strong>stitutions <strong>and</strong> most citizens rema<strong>in</strong> untarnished.The rul<strong>in</strong>g elite <strong>in</strong> <strong>Botswana</strong> is dist<strong>in</strong>ctive <strong>in</strong> orig<strong>in</strong>at<strong>in</strong>g from anactive <strong>and</strong> direct engagement <strong>in</strong> production - <strong>in</strong> cattle, which rema<strong>in</strong>sthe basis of the rural economy. This <strong>in</strong>volvement was sanctioned <strong>in</strong>Tswana history, as was the private accumulation of a ruler.65 Thosewho acquired power <strong>in</strong> the nation-state at <strong>in</strong>dependence had a grow<strong>in</strong>gstake <strong>in</strong> the economy. Ketumile Masire, for example, decided to giveup full-time teach<strong>in</strong>g <strong>in</strong> I955, <strong>in</strong> order to devote himself, as recentbiographers say, to 'his one great passion: farm<strong>in</strong>g'. He bought abr<strong>and</strong> new tractor about this time - only the second-such acquired bya Motswana - <strong>and</strong> asked for 'a greatly <strong>in</strong>creased l<strong>and</strong> allocation for hisplough<strong>in</strong>g needs'. Shortly afterwards the Department of Agricultureawarded him the Master Farmer's Certificate, the first given to anAfrican <strong>in</strong> <strong>Botswana</strong>.66 As early as I970, the BDP was not only a partyof the educated <strong>and</strong> middle-aged, but <strong>also</strong> of 'the wealthy'.67In a significant step <strong>in</strong> the early I 98os, the private bus<strong>in</strong>ess activitiesof public servants were accorded official, legal recognition. CORRUPTION AND MISMANAGEMENT 5I7l<strong>and</strong> <strong>and</strong> other property' provided this was done on an un<strong>in</strong>corporatedbasis <strong>and</strong> outside normal office-hours. Supposedly those concernedcould not be a director or manager <strong>in</strong> a public or private company,but could 'hold a m<strong>in</strong>ority of shares' provided that the officer hadfully paid for them. In the Government's white paper approved byParliament <strong>in</strong> December I982, it was declared that 'M<strong>in</strong>isters shouldregister their <strong>in</strong>terests <strong>in</strong> the same way as members of the publicservice'. Responsibility for the implementation of this importantregister was vested <strong>in</strong> the President. Forms for an officer's annualdeclaration of property, assets, <strong>and</strong> liabilities, under General Order No.2IO, were prepared, but the register was either never <strong>in</strong>troduced or fellquickly <strong>in</strong>to abeyance.68The long <strong>in</strong>volvement of the rul<strong>in</strong>g elite <strong>in</strong> agricultural productionarguably promoted economic rationality <strong>and</strong> fuelled growth. But thedist<strong>in</strong>ction between public resources <strong>and</strong> private wealth, between the<strong>in</strong>terests of the people <strong>and</strong> those of an <strong>in</strong>fluential few, rema<strong>in</strong>ed<strong>in</strong>herently fraught. The amendments to General Orders were made <strong>in</strong>a time of economic boom, represented <strong>in</strong> a fashion commercial sense,<strong>and</strong> accorded with the ways of Tswana rulers. But the openness <strong>and</strong>weaknesses of the new regulations, <strong>and</strong> the non-existence of any registerof assets <strong>and</strong> liabilities, may have unfolded the way to an ab<strong>and</strong>onmentof the dist<strong>in</strong>ction between public <strong>and</strong> private assets, notably as regardsl<strong>and</strong>, farm<strong>in</strong>g, hous<strong>in</strong>g, <strong>and</strong> the borrow<strong>in</strong>g of funds. In the prevail<strong>in</strong>geconomic <strong>and</strong> political conditions, a Rubicon seems to have beencrossed. Many <strong>in</strong> the rul<strong>in</strong>g elite, as the cases here <strong>in</strong>dicate, are now theowners <strong>and</strong>/or directors of commercial companies; some, as bothm<strong>in</strong>isters <strong>and</strong> directors, have acquired advantageous loans for theirfirms from state-owned f<strong>in</strong>ancial <strong>in</strong>stitutions which they have beenreluctant to repay, lead<strong>in</strong>g to the bankruptcy of the public bodies. Thishas proceeded <strong>in</strong> a hidden <strong>and</strong> secretive way, with little or noaccountability, despite high f<strong>in</strong>ancial <strong>and</strong> other costs to the nation.PREDOMINANCE OF THE RULING ELITEEconomically engaged leaders emerged <strong>in</strong> the hierarchical society ofn<strong>in</strong>eteenth/twentieth-century <strong>Botswana</strong>. Rapid growth has deepenedthe <strong>in</strong>equalities of property <strong>and</strong> <strong>in</strong>comes. 5i8 KENNETH GOODto Richard White, 58 per cent of rural households neither owned norcontrolled cattle, as aga<strong>in</strong>st 74 per cent ten years later."9 At the end ofI992, the gap between the top public service salary (P8,2i6 a monthplus sizeable allowances) <strong>and</strong> the statutory m<strong>in</strong>imum wage (P327 amonth) reached 34-7: i, as H. K. Siphambe <strong>in</strong>dicates.70 If the averageearn<strong>in</strong>gs of domestic servants <strong>and</strong> farm labourers - not covered bym<strong>in</strong>imum-wage legislation - are <strong>also</strong> brought <strong>in</strong>to the equation, thedifferential is far greater. Some were still worse off.71 The monthly<strong>in</strong>comes of San <strong>in</strong> the Western S<strong>and</strong>veld <strong>in</strong> 199I averaged about P25,but a number worked 'only for milk', while others went unpaid.72The legitimate operations of <strong>Botswana</strong>'s system of governmentfurther separates the rul<strong>in</strong>g group from the bulk of the population.Citizens participate as voters once every five years, not usuallyotherwise. The 'first-past-the-post' electoral system makes it difficultfor small opposition parties to translate votes cast for them <strong>in</strong>to seatswon <strong>in</strong> Parliament. <strong>Botswana</strong>'s elite democracy takes the particularform of a dom<strong>in</strong>ant-party system.73 Patrick Molutsi has po<strong>in</strong>ted to thenon-engagement of the masses <strong>in</strong> politics, <strong>and</strong> to the failure or <strong>in</strong>abilityof citizens to make dem<strong>and</strong>s on their leaders.74 This <strong>in</strong>capacity evenextends to the organisations <strong>in</strong>vested with the task of mak<strong>in</strong>g dem<strong>and</strong>son the Government. Although the opposition parties together obta<strong>in</strong>ed33 per cent of votes at the i989 elections, they appeared reluctant tomount an electoral challenge to build upon this sizeable vote dur<strong>in</strong>gI 994. The <strong>Botswana</strong> National Front called a press conference <strong>in</strong>February to announce that it would <strong>in</strong>form 'the <strong>in</strong>ternationalcommunity' of the f<strong>in</strong>ancial improprieties of the BDP leadership,75 butfailed to press the Government for the details of m<strong>in</strong>isterial loans. CORRUPTION AND MISMANAGEMENT 5I9rul<strong>in</strong>g <strong>and</strong> compet<strong>in</strong>g elites; but the cost of <strong>in</strong>effective opposition is thefurther enfeeblement of some one-third of the electorate, <strong>and</strong> of coursethe greater likelihood of maladm<strong>in</strong>istration <strong>and</strong> corruption.The elite's preference for secrecy was seen throughout the Newsl<strong>in</strong>kaffair <strong>and</strong> currently with Project Eagle. President Masire <strong>and</strong> hiscolleagues have proffered no <strong>in</strong>formation concern<strong>in</strong>g their <strong>in</strong>debtednessto the NDB, <strong>and</strong> attacked the public's right to know. Instead, theresponse to such exposures is apparently to tighten secrecy evenfurther.7" Accord<strong>in</strong>g to the <strong>Botswana</strong> Hous<strong>in</strong>g Corporation (Amendment)Bill that was <strong>in</strong>troduced <strong>in</strong> early I994, all employees as well asmembers of the Board must take an oath of secrecy, <strong>and</strong> contraventionwill render an official liable to a f<strong>in</strong>e of P5,ooo <strong>and</strong> imprisonment forfive years. Described by Douglas Tsiako as 'a formula for mediocrity,<strong>in</strong>competence <strong>and</strong> corruption',77 this legislation was enacted <strong>in</strong> theabsence of significant parliamentary opposition, not surpris<strong>in</strong>gly s<strong>in</strong>ceKwelagobe, the Secretary-General of the BDP, had called for thepunishment of those who revealed confidential matters to the press, <strong>and</strong>attacked the NDB management for permitt<strong>in</strong>g recent leakages, say<strong>in</strong>g:'I deplore such th<strong>in</strong>gs because it will never stop there. 78 The BDP eliteconceives of itself as the natural party of government, for whomconfidentiality is an overrid<strong>in</strong>g concern.Tom Nairn sees corruption as 'l<strong>in</strong>ked' to one-party dom<strong>in</strong>ance, assc<strong>and</strong>als <strong>in</strong> Japan under the Liberal Democrats <strong>and</strong> <strong>in</strong> Italy under thesway of the Christian Democrats have suggested.79 <strong>Corruption</strong> <strong>and</strong>mismanagement are certa<strong>in</strong>ly likely to cont<strong>in</strong>ue <strong>in</strong> <strong>Botswana</strong> unlessall transgressors face effective punishment. Common crim<strong>in</strong>ality issometimes severely dealt with. In January I 993, a self-employed taxidriver, found <strong>in</strong> possession of a stolen motor vehicle (which he was notalleged to have actually stolen), received four years imprisonment, with76 Under Section 5 of the exist<strong>in</strong>g National Security Act it is a crim<strong>in</strong>al offence to publish any<strong>in</strong>formation which the state decides is 'classified' - def<strong>in</strong>ed as any matter declared to beconfidential by the Government. 520 KENNETH GOODtwo years suspended, although it was his first offence.80 By way ofcontrast, <strong>in</strong> July, Tship<strong>in</strong>are was found guilty by the Chief Magistrateof corruptly obta<strong>in</strong><strong>in</strong>g a P5oo,ooo loan from Spectra <strong>Botswana</strong> <strong>and</strong>given an actual one year's jail sentence (four with three suspended)."8Not four months later he was completely free, hav<strong>in</strong>g been found notguilty on appeal to the High Court.Justice K. Gyeke-Dako's reason<strong>in</strong>g threw strong light on theaccepted bus<strong>in</strong>ess practices of M<strong>in</strong>isters. He ruled that when AlexGoldman (manag<strong>in</strong>g <strong>and</strong> fellow director of Spectra) released theP5oo,ooo to Tship<strong>in</strong>are, the former had 'already calculated' that s<strong>in</strong>ceSpectra was go<strong>in</strong>g to make a profit of about P4 million, 'the accused'sshare [would be] about PI 3 million when the contract was completed'.The evidence showed that the Assistant M<strong>in</strong>ister of Local Governmenturgently needed the new loan - he was 'hard-pressed ' <strong>in</strong> thesympathetic words of the Judge - <strong>in</strong> order to pay off his old loan ofPI99,ooo to the NDB by I3 December I99I. Gyeke-Dako determ<strong>in</strong>edthat Spectra had 'a clear expectancy to deduct [the P5oo,ooo, plus<strong>in</strong>terest] from [Tship<strong>in</strong>are's] share of profits'. Both Goldman <strong>and</strong> theAssistant M<strong>in</strong>ister, he concluded, were engaged <strong>in</strong> noth<strong>in</strong>g other thana perfectly normal bus<strong>in</strong>ess transaction. Not only was the charge of<strong>in</strong>fluence-peddl<strong>in</strong>g unproven, but declared the Judge:Surely, the accused as a director [of Spectra], was entitled to promote the<strong>in</strong>terests of his company, <strong>and</strong> stricto sensu, there should be noth<strong>in</strong>g wrong <strong>in</strong> theaccused, qua director, purposely go<strong>in</strong>g to Johannesburg <strong>in</strong> August i 99i to jo<strong>in</strong>the Spectra group <strong>in</strong> conduct<strong>in</strong>g the BHC Management to <strong>in</strong>spect theh<strong>and</strong>iwork of Spectra.Although the Chief Magistrate earlier found that Tship<strong>in</strong>are had failedto declare his bus<strong>in</strong>ess <strong>in</strong>terests <strong>in</strong> Spectra to his supervisor, thePresident, for Gyeke-Dako this constituted a mere 'breach ofadm<strong>in</strong>istrative <strong>in</strong>struction', irrelevant to the appeal.82 In other words,it was acceptable that a heavily <strong>in</strong>debted Assistant M<strong>in</strong>ister shouldacquire PI 3 million through the award of a government contract, fromwith<strong>in</strong> his own M<strong>in</strong>istry, to the parent organisation of a company of80 Guardian, 28 January I993.81 The Chief Magistrate declared: 'I am satisfied that the accused has been validly accused of<strong>in</strong>fluence-peddl<strong>in</strong>g with<strong>in</strong> the management of BHC <strong>in</strong> the award of the Spectra contract, <strong>and</strong> theonus is placed on him to prove albeit on balance of probabilities that he did not obta<strong>in</strong> the [socalled]loan corruptly.' <strong>See</strong> Mmegi, 6 August I993, for 'State v Tship<strong>in</strong>are, Judgement'.82 'Michael Rabereng Tship<strong>in</strong>are v the State, Judgement', High Court, Lobatse, NovemberI993, pp. 25-6, 30, <strong>and</strong> 35-7-

The state has not appealedaga<strong>in</strong>st the judgement.3With <strong>Botswana</strong>'s culture <strong>and</strong> politics of elite predom<strong>in</strong>ance, <strong>and</strong>with the ma<strong>in</strong>tenance of a growth economy, corruption <strong>and</strong> mismanagementare unlikely to be elim<strong>in</strong>ated. They might be controlled<strong>and</strong> limited, but only if serious steps are taken to strengthen themorality <strong>and</strong> heighten the fiscal <strong>and</strong> adm<strong>in</strong>istrative discipl<strong>in</strong>e of therulers.84 The above litany of transgression by the elite is daunt<strong>in</strong>g.Kwelagobe <strong>and</strong> Mmusi triumphantly rega<strong>in</strong>ed top party office <strong>and</strong>present themselves v<strong>in</strong>dicated, Kwelagobe is considered a lead<strong>in</strong>gcontender to succeed President Masire, <strong>and</strong> like Tship<strong>in</strong>are <strong>and</strong> Sebegothey all rema<strong>in</strong> honourable parliamentarians. Many <strong>in</strong> the leadershipstrongly contributed to the pillag<strong>in</strong>g of f<strong>in</strong>ancial <strong>in</strong>stitutions, <strong>and</strong> to theassociated diversion <strong>and</strong> wastage of public resources. The nation haspaid a large price for the growth that has been achieved, not least s<strong>in</strong>cethe dist<strong>in</strong>ction between private profit-mak<strong>in</strong>g <strong>and</strong> the responsibility ofpublic office has throughout been obscured if not obliterated.83 One of the central issues <strong>in</strong> the case was whether a government M<strong>in</strong>ister was or could beviewed as an agent of a statutory body fall<strong>in</strong>g under his M<strong>in</strong>istry, <strong>and</strong> this was resolved <strong>in</strong>Tship<strong>in</strong>are's favour. Under law an acquittal cannot be reversed. But a court can declare that aperson has been wrongly acquitted, <strong>and</strong> a retrial could be obta<strong>in</strong>ed due to irregularities <strong>in</strong>proceed<strong>in</strong>gs. Personal communication, Bojosi Otlhogile, June I994.The Assistant M<strong>in</strong>ister's proceed<strong>in</strong>gs had been completed with particular speed. Hillary Nalediof Segaetsho <strong>and</strong> Associates noted that other appeal cases filed long before were still pend<strong>in</strong>g, <strong>and</strong>wondered 'whether there is a special treatment for people like Mr Tship<strong>in</strong>are' Gazette, IONovember 1993.84 The establishment of someth<strong>in</strong>g like an Economic Crime Unit with<strong>in</strong> the Office of thePresident was mooted over several months <strong>in</strong> I994, <strong>and</strong> the creation of an Ombudsman has beentalked about for more than a decade. But it is very doubtful that such bodies - <strong>in</strong> the abstract, <strong>and</strong><strong>in</strong> <strong>and</strong> of themselves worthy reforms - could be capable of confront<strong>in</strong>g the type of elite corruptionexperienced <strong>in</strong> <strong>Botswana</strong>.
