Winter sports are limited to 17 days perpolicy year, where the appropriate additionalpremium has been paid.The cover under Section 1 – CancellationCancellation cover applies as soon as the premiumhas been paid or from commencement date and thepolicy wording is issued. We cannot therefore, refundyour premium after this date, except within the first14 days of the policy wording being received or beforeyou travel (whichever is sooner). For Annual Multitripinsurance, the cover under Section 1 starts at thetime you book the trip or the start date shown on theSchedule of Cover, whichever is later.The cover under remaining SectionsCover under all other sections apply for the duration ofthe booked trip including the period of travel from homedirectly to the departure point and back home directlyafterwards not exceeding 24 hours in each case. If youcome home earlier than planned then cover ends onreturn to your home country. If the return is unavoidablydelayed for an insured reason, cover will be extendedfree of charge for the period of that delay.Cancelling this <strong>Policy</strong>Insurer's right to cancelWe may cancel any cover under this policy by giving you14 days notice by recorded delivery letter to you at yourlast known address. In this event, we will refund in full ifit is a Single Trip policy. Checking Your Documents Are In OrderYou must check your <strong>Policy</strong> documents. The preexistingmedical conditions which you are coveredfor are set out in the enclosed schedule headed'Statement of Fact'. If they are not correct, pleasecontact the <strong>AllClear</strong> call-centre on 0845 250 5201.All Medical ConditionsWe will not cover you for any medical condition ordisability (pre-existing or otherwise) if:1) your state of health is significantly worse than youtold us;2) you know you have a terminal condition, but havenot told us;3) you know you will need medical treatment duringyour journey;4) one of the purposes of your journey is to obtainmedical treatment;5) you are travelling against the advice of a MedicalPractitioner;6) you are not fit to travel on your journey.We have the right from the date of issue up to the dateof travel to request a letter from your Medical Practitionerdetailing your pre-existing medical condition(s), andconfirming that your condition(s) have not changed orgot worse, along with agreeing that you are fit to travel.Waiting ListsIf you are on a waiting list for medical treatment orinvestigation which may mean you have to cancel orcurtail your journey, we will not cover these cancellationor curtailment costs unless you have paid the requiredadditional premium for waiting list cover. Refer toyour policy schedule for cover details. If you think youhave paid for this cover, please check your encloseddocuments to confirm this. This cover only applies toSingle Trip policies.Change In State Of HealthYou must tell us if your state of health changes at theearliest opportunity and consult with your MedicalPractitioner but in any case before you book orcommence your journey, or pay the balance or anyfurther instalments for your journey, i.e. if you developa new medical condition or an existing one deteriorates.Please call the <strong>AllClear</strong> call-centre 0845 250 5201. Wehave the right to amend, restrict or cancel your coverunder this policy.Non-<strong>Travel</strong>ling RelativesYou may have a close relative with a medicalcondition who is not travelling with you. In somecases, if their state of health deteriorates greatly,you may want to cancel or curtail your journey.Subject to all the other terms and conditions, suchclaims are covered if the relative’s doctor is preparedto state that at the date you booked your trip, he/shewould have seen no substantial likelihood of his/herpatient’s condition deteriorating to such a degreethat this would become necessary. If the doctorwill not confirm this, your claim is not covered. Inthe event of a claim the doctor must complete themedical certificate on the claim form.<strong>Travel</strong>ling Companion Cancellation Cover<strong>Travel</strong>ling companion cover offers cover fortravelling companions insured under another travelinsurance provider, for cancellation and curtailmentdue to your pre-existing medical condition thatwe have agreed to cover in writing, providing theadditional premium has been paid. This will beshown on your policy schedule.<strong>Travel</strong>ling When PregnantCover under this policy is provided for unforeseenevents. In particular, cover is provided under Sections 2and 6 for unforeseen bodily injury or illness. Childbirthis not considered to be either unforeseen, or an illnessor injury. Therefore there is no cover if at the start ofyour trip, during your trip or on your return date, youare more than 36 weeks and 6 days pregnant for a singlepregnancy, or more than 32 weeks and 6 days for amultiple pregnancy;Cover is only provided under sections 2 and 6 for claimsarising from complications of pregnancy and childbirthwhich are defined as:Toxaemia – toxins in the bloodGestational diabetes – diabetes arising as a resultof pregnancyGestational hypertension – high blood pressure arisingas a result of pregnancyPre-eclampsia – where you develop high blood pressure,carry abnormal fluid and have protein in your urineduring the second half of pregnancyEctopic pregnancy – a pregnancy that develops outsideof the uterusMolar pregnancy or Hydatidiform mole – a pregnancy inwhich a tumour develops from the placental tissuePost-partum haemorrhage – excessive bleedingfollowing childbirthRetained placenta membrane – part or all of theplacenta is left behind in the uterus after deliveryPlacental abruption – part or all of the placenta separatesfrom the wall of the uterusHyperemesis gravidarum – excessive vomiting as a resultof pregnancyPlacenta praevia – when the placenta is in the lower partof the uterus and covers part or all of the cervixStillbirthMiscarriageEmergency Caesarean sectionA termination needed for medical reasonsPremature birth more than 8 weeks (or 16 weeks if youknow you are having more than one baby) before theexpected delivery date.Please make sure that your doctor and midwifeare aware of your travel plans and that you are nottravelling against medical advice. Airlines and ferry/shipping companies including cruise liners have theirown restrictions due to health and safety requirements.You should check with them or any other mode oftransport you propose to take before you book. ConditionsGeographical LimitsAge CoverWinter sports cover is only available to persons aged 65years and under (at date of issue).Age Restrictions for Annual Multi Trip <strong>Insurance</strong>For travellers up to the age of 70 years, themaximum trip duration of any one trip is 45 days.For those aged 70 years and over, the maximum tripduration of any one trip is 31 days.Children <strong>Travel</strong>ling IndependentlyChildren under 18 years who travel on their own mustbe dropped off and picked up at the departure point bya responsible adult aged over 21.Conditions1) Cover is only available for the whole duration of thebooked trip. Cover cannot be effected once a journeyhas commenced.2) If your money, valuables or any items of personalbaggage, are lost or stolen, you must notify the localpolice within 48 hours of discovery. Please makesure you get a copy of the police report. Failure tocomply will result in your claim being turned down.3) No payment will be made under Sections 1, 2, 5, 6, 9,11 and 15 without appropriate medical certification.4) If we require any medical certificates, information,evidence and receipts, these must be obtained by you atyour expense.5) In the event of a claim, if we require a medicalexamination you must agree to this and in the event ofdeath we are entitled to a post-mortem examinationboth at our expense.6) You must take all reasonable steps to recover any lostor stolen article.7) If any claim is found to be fraudulent in any way thispolicy will not apply and all claims will be forfeited.8) You must not make any payment, admit liability,offer or promise to make any payment without writtenconsent from us.9) We are entitled to take over any rights in the defenceor settlement of any claim and to take proceedings inyour name for our benefit against any other party.10) We may at any time pay to you our full liabilityunder the policy after which no further payments willbe made in any respect.11) The terms of this insurance is based upon theinformation provided by you to us. The policy containsconditions relating to health of the people travelling.You must take reasonable care to answer all questionsput to you, about the health of the people travelling,honestly, accurately and to the best of your knowledge.If you do not understand the meaning of a questionput to you or if you do not know the answer it is vitalthat you tell us. Once cover has been arranged youmust immediately notify us of any changes to theinformation that has previously been provided. Failureto provide full and accurate information before youtake out the insurance or when circumstances changecould invalidate the cover and may mean any claim willbe rejected. If you are declaring on behalf of anotherperson you must ensure you are fully aware of theirmedical history.12) If at the time of making a claim there is any otherpolicy covering the same risk we are entitled to contactthat insurer for a contribution.13) A person or company who is not a party to this policyhas no right under the Contracts (Rights of Third Parties)Act 1999 to enforce any term of this policy but this doesnot affect any right or remedy of a third party whichexists or is available apart from that Act.14) You are required to take all reasonable care toprotect yourself and your property and to act as thoughyou are not insured.Geographical Limits – Single TripRegion 1 – Covers trips to, from, and within theUnited Kingdom.Region 2 – Covers trips by United Kingdom residents toand from Europe, west of the Ural Mountains includingthe Republic of Ireland and all countries, borderingthe Mediterranean Sea, as well as Madeira and TheAzores and trips to the Channel Islands by other UnitedKingdom residents. This region excludes countriesmentioned in Region 3.Region 3 – Covers Regions 1, 2 and Spain (including theBalearic Islands), The Canaries, Turkey, Cyprus and Malta.Region 4 – Covers anywhere in the world except USA,Canada, Caribbean, Hong Kong, Singapore, Mexico andChina.Region 5 – Covers anywhere in the world including USA,Canada and Caribbean.Region 6 – Covers anywhere in the world except USA,Canada and Caribbean.Region 7 – Covers Australia and New Zealand only.Annual Multi-TripRegion 8 – Covers trips by United Kingdom residents toand from Europe, west of the Ural Mountains includingthe Republic of Ireland and all countries bordering theMediterranean Sea, as well as Madeira and The Azores andtrips to the Channel islands by other United Kingdomresidents. DefinitionsDefinitionsWherever the following words and phrases appear in thispolicy they will always have these meanings:Close Relative – see Immediate Relative.Close Business Associate – Any person whose absencefrom business for one or more complete days at thesame time as your absence prevents the effectivecontinuation of that business.Complications of pregnancy and childbirth –see <strong>Travel</strong>ling When Pregnant on page 9.Curtail/Curtailment – Return early to home in theUnited Kingdom or Republic of Ireland.Excesses – An excess means that you are responsiblefor the first sum per person per incident when youclaim. Claims under mostsections of the policy will be subject to an excess, whichapplies to each insured person involved in an incident, asdo the sums insured under each section.Fitness to travel – is defined as taking into accountdestination, duration and mode of travel, the insured arenot likely to need medical intervention during their trip.Golf Equipment – golf clubs, golf balls, golf bag, golftrolley and golf shoes.Home – Your residential address in the United Kingdomor Republic of Ireland.Home Country – is the United Kingdom or the Republicof Ireland if this is your usual country of residence.Immediate Relative – Mother, father, sister, brother,wife, husband, partner (same or different sex), son,daughter (including fostered/adopted son or daughter),grandparent, grandchild, parent-in-law, son-in-law,daughter-in-law, sister-in-law, brother-in-law, stepparent,step-child, step-brother, step-sister, or legalguardian.Medical Practitioner – A registered practising memberof the medical profession who is not related to you orto any person you are travelling with, or intending tostay with.Money – Cash, postal and money orders, travel tickets,lift passes (in respect of winter sports trips wherethe appropriate premium has been paid), passports,petrol coupons and green cards held by you for social,domestic and pleasure purposes.Mobility Aids – Wheelchair, motorised wheelchair,prosthetic limb, walking frame, walking stick or crutches.Personal Accident – Accidental bodily injury causedsolely and directly by outward violent and visible means.Personal Baggage – Your suitcases (or similar luggagecarriers) and their contents usually taken on a trip,together with articles worn or carried by you for yourindividual use during your trip.Permanent Total Disablement – Disablement as aresult of which you are unable to carry on or performany business or occupation, and which, having lastedfor a period of 12 months is, at the end of that periodbeyond hope of improvement.Pre-existing medical condition – any disease, illness orinjury which:• you have received medication, advice or treatment; or• you have experienced symptoms whether thecondition has been diagnosed or not.Preventative Medication – Any medication prescribedor otherwise which is taken purely to prevent an illness ormedical condition occurring. Section 1CancellationSection 2CurtailmentYou are coveredUp to the amount shown in the summary of cover onpage 6 if your travel and accommodation arrangements,excursions, tours and activities are cancelled before yourdeparture from your Home Country if this is your usualcountry of residence (including ski hire, ski school andlift passes for winter sports trips where the appropriatepremium has been paid), which have not been usedand which you have paid for or contracted to pay for,providing the cancellation is necessary and unavoidable(and is not a result of mere disinclination to commenceyour trip as arranged) due to:1) the death or disablement by bodily injury, illness,pregnancy or being subject to quarantine of a) you, b)any person you are intending to travel or stay with, c)an immediate relative or yours or of any person you areintending to travel with or d) a close business associateof yours;2) you being called for jury service or as a witness (butnot as an expert witness or where your employmentwould normally require you to attend court) in a Courtof Law;3) your redundancy or the redundancy of any personyou are intending to travel with, provided that we areinformed in writing immediately notification of redundancyis received and that you were not aware of any impendingredundancy at the time this policy was issued;4) your home being made uninhabitable or place ofbusiness being made unusable, up to 14 days beforethe commencement of your trip, due to fire, lightning,explosion, earthquake, subsidence, storm, flood, fallingtrees, riot or civil commotion, malicious damage, burstpipes, impact by aircraft, the police requesting yourpresence following burglary or attempted burglary atyour home or place of business;5) your passport, or the passport of any person you areintending to travel with being stolen during the sevendays before your departure date;6) your carer (who is insured on this policy) having tocancel their journey with you due to one of the reasonsstated above. Section 11Ski PackSection 13Legal Costs andexpensesYOU ARE COVEREDYOU ARE NOT COVEREDYOU ARE COVEREDYOU ARE NOT COVERED FORUp to a maximum of £400 in all for the unused portion ofyour ski pack costs paid for or contracted to be paid forbefore your trip commenced, where you do not curtailthe trip, but are certified by a Medical Practitioner in theresort as being unable to ski and unable to use the skipack facilities because of serious injury or illness occurringduring the trip and where there is confirmation that norefund is available for the unused items.This section of cover is only applicable if theappropriate winter sports premium has been paid.Section 12Piste ClosureCover is only available under this Section between1st December to 30th April in the Northern Hemisphere,and between 1st April and 31st October in the SouthernHemisphere.If there is a lack of snow in your resort and it closes,which prevents you from skiing.YOU ARE COVERED1) for a benefit of £35 per day towards the costs youhave to pay to travel to another resort or2) for the amount shown in the Summary of Cover foreach full day you are unable to ski, up to a maximumof £350 if your resort stays closed and there is no otherresort available, for as long as these conditions exist atthe resort, but not exceeding the pre-booked period ofinsurance of your trip.This section of cover is only applicable if theappropriate winter sports premium has been paid.1) for the excess as shown in the summary of cover onpage 6. The excess will apply for each trip that you havebooked, for each and every incident and for each insuredperson;2) for claims that are not confirmed as medically necessaryby MAPFRE Assistance and where a medical certificatehas not been obtained from the attending MedicalPractitioner abroad confirming that you are unable to skiand unable to use the ski pack facilities;3) for anything mentioned under YOU ARE NOTCOVERED of Section 6 – Medical Emergency Expenses;4) for anything mentioned under the General Exclusions.YOU ARE NOT COVERED1) for claims where you have not obtained confirmationof resort closure from the local representative;2) for claims where not all skiing facilities are totallyclosed;3) for claims where the lack of snow conditions areknown or are public knowledge at the time of effectingthis insurance;4) for anything mentioned in the General Exclusions.If you die or are injured as a result of an accident whichoccurs during your trip during the period of insurance,and you or your legal representative take legal actionto get compensation, we will do the following in anattempt to get compensation for the death or injury:1) up to a maximum of £25,000 for each insuredperson (but not more than £50,000 in total for allinsured persons) for any fees and other disbursementsreasonably incurred by your legal representativesin connection with any claim or legal proceedings,including costs and expenses of expert witnesses andcosts incurred by us;2) any costs payable by you following an award of costsby any court or tribunal and any costs payable followingan out of court settlement made in connection with anyclaim or legal proceedings;3) any fees, expenses and other disbursementsreasonably incurred in appealing or resisting an appealagainst the judgement of a court, tribunal or arbitrator;4) provide up to £1,000 for each insured person, fortravel costs that have to be paid to go to a foreign courtin connection with any legal action under 1) above;5) if no compensation is received either as a result of theclaim being abandoned or failing, then subject to thelimits of cover stated in the policy and policy schedulewe will pay the costs incurred;6) if compensation is recovered for you then the usualcosts rules of the relevant jurisdiction will apply. In somejurisdictions you will recover your costs, in others youwill not. Any costs not recovered must first be met fromthe compensation. If the value of the costs not recoveredexceeds the compensation then we will pay the balanceof costs after the application of the compensation,subject to the limits of the cover in the policy andpolicy schedule.1) legal costs and expenses incurred in pursuit of anyclaim against a travel agent, tour operator, carrier,MAPFRE Assistance or their agents, someone you weretravelling with or another insured person;2) legal costs and expenses incurred prior to thegranting of support by us in writing;3) any claims notified to us more than 180 days after thedate of the incident giving rise to such claim;4) any claim where the legal costs and expenses arelikely to be greater than the anticipated amount ofcompensation;5) any claim where you are insured for legal costs andexpenses under any other insurance policy;6) any claim where legal costs and expenses are baseddirectly or indirectly on the amount of compensationaward (Contingency Fee Agreement);7) legal costs and expenses incurred if an action isbrought in more than one country;8) any claim where in our opinion there is insufficientprospect of success in obtaining a reasonable benefit;9) anything detailed in the General Exclusions.CONDITIONS1) We shall have complete control over the legalproceedings and the appointment and control ofa lawyer. We shall appoint a lawyer on your behalfwith the expertise necessary to pursue your claim.2) You must follow the lawyer's advice and provideany information and assistance required.
