MUNICIPAL CODE ARTICLE IX – LAND USE9824.06 9824.06(3) The periods of time set forth in Sections 9824.04(J)(1) and 9824.04(J)(2) havebeen extended by the Commission upon a written request by the applicantshowing cause why such extension is necessary. In no case shall the extensionexceed one (1) year.(K)RevocationThe provisions of Section 9828 of this chapter shall apply.(L)Administration(1) All acts of the Commission under this section shall be construed as administrativeacts performed for the purpose of ensuring that the intent and purpose of thischapter shall apply in special cases, as provided in this section, and shall not beconstrued as amendments to the provisions of this article or to the Zoning Map.(2) Where there is a substantial change from the original site plan, such plan shall bereferred to the Commission for action under the procedures of Section 9820 ofthis chapter. No modification to the conditions of the original approval grantingthe Conditional Use Permit shall be permitted without the approval of theCommission.(M)ReapplicationReapplication procedures shall be in accordance with Section 9808 of this chapter.(N)Application WithdrawalApplication withdrawal procedures shall be in accordance with Section 9810 of thischapter.Section 9824.06. Findings.Before a Conditional Use Permit may be granted, the Commission, or the Council on appeal,shall make a finding from the evidence as submitted that all four (4) of the following conditionsexist in reference to the property being considered:(A)(B)That the requested Conditional Use Permit will not adversely affect the intent andpurpose of this article or the City’s General Plan or the public convenience or generalwelfare of persons residing or working in the neighborhood thereof;That the requested use will not adversely affect the adjoining land uses and the growthand development of the area in which it is proposed to be located;9.8-37
