GENERAL TERMS AND CONDITIONS Annexure -11. Rates/Quotations duly filled <strong>in</strong>, will be received upto the date and time mentioned<strong>in</strong> the letter.2. The Division of Central Excise, Shimla (here<strong>in</strong>after referred to as the Division)reserves the right to postpone and/or extend the date of receipt/open<strong>in</strong>g ofRates/Quotation or to withdraw the same, without assign<strong>in</strong>g any reason thereof.3. The Contractors are required to submit the complete Rates/Quotations only aftersatisfy<strong>in</strong>g each and every condition laid down <strong>in</strong> the Annexure enclosed.4. All the rates must be written both <strong>in</strong> figures and <strong>in</strong> words. Corrections, if any, areto be made by cross<strong>in</strong>g out, <strong>in</strong>itial<strong>in</strong>g, dat<strong>in</strong>g and rewrit<strong>in</strong>g. In case of discrepancybetween the words and figures the rates <strong>in</strong>dicated <strong>in</strong> figures shall prevail. Alloverwrit<strong>in</strong>g/cutt<strong>in</strong>g, <strong>in</strong>sertions shall be authenticated and attested.5. Rates/Quotations should be submitted and signed by the firm with its currentbus<strong>in</strong>ess address.6. The rates shall be valid <strong>for</strong> a period of at least three calendar months from the dateof open<strong>in</strong>g.7. The Contractors should satisfy themselves be<strong>for</strong>e submission of theRates/Quotations to the Division that they meet the qualify<strong>in</strong>g criteria andcapability as laid down <strong>in</strong> the Annexure.8. The Contractors must comply with the Rates/Quotations, specification and allterms and conditions of contract. No deviation <strong>in</strong> the Terms & Conditions of theContract shall be enterta<strong>in</strong>ed unless specifically mentioned by the contractor <strong>in</strong> theRates/Quotations and accepted by the Division.9. The Contract will be awarded <strong>for</strong> the period April 2012 to March 2013 i.e.01.04.2012 to 31.03.2013. However, extension will be considered keep<strong>in</strong>g <strong>in</strong> viewthe various factors such as prevail<strong>in</strong>g market price, satisfactory per<strong>for</strong>mance of thefirm.10. In case of any default by the contractor and <strong>in</strong> any of the Terms & Conditions(whether General or Special), the Division may, without prejudice to any otherright/remedy which shall have accrued or shall accrue thereafter, term<strong>in</strong>ate thecontract, <strong>in</strong> whole or part, by giv<strong>in</strong>g 15 days notice <strong>in</strong> writ<strong>in</strong>g to the Contractor.11. Notwithstand<strong>in</strong>g anyth<strong>in</strong>g conta<strong>in</strong>ed here<strong>in</strong>, the Division reserves the right toterm<strong>in</strong>ate the contract by giv<strong>in</strong>g 15 days notice <strong>in</strong> writ<strong>in</strong>g without assign<strong>in</strong>g anyreason and without <strong>in</strong>curr<strong>in</strong>g any f<strong>in</strong>ancial liability whatsoever to the Contractor.12. Insurance cover protect<strong>in</strong>g the agency aga<strong>in</strong>st all claims applicable under theWorkmen’s Compensation Act, 1948, shall be taken by the Contractor. TheContractor shall arrange necessary <strong>in</strong>surance cover <strong>for</strong> any persons deployed byhim even <strong>for</strong> short duration. The Division shall not enterta<strong>in</strong> any claim aris<strong>in</strong>g outor mishap, if any that may take place. In the event of any liability/claim fall<strong>in</strong>g onthis Division, the same shall be reimbursed/<strong>in</strong>demnified by the Contractor.13. Contractor shall <strong>in</strong> no case lease/transfer/sublet/appo<strong>in</strong>t care taker <strong>for</strong> services.


14. No other person except Contractor’s authorized representative shall be allowed toenter the Division .15. With<strong>in</strong> the premises of the Division , the Contractor’s personnel shall not do nayprivate work other than their normal duties.16. Contractor shall be directly responsible <strong>for</strong> any/all dispute aris<strong>in</strong>g between himand his personnel and keep the Division <strong>in</strong>demnified aga<strong>in</strong>st all actions, losses,damages, expenses and claims whatsoever aris<strong>in</strong>g thereof.17. Contractor shall be solely responsible <strong>for</strong> payment of wages/salaries other benefitsand allowances to his personnel that might become applicable under any Act orOrder of the Govt. The Division shall have no liability whatsoever <strong>in</strong> this regardand the Contractor shall <strong>in</strong>demnify this Division aga<strong>in</strong>st any/all claims which mayarise under the provisions of various Acts, Govt. Orders. etc.18. Contractor shall be fully responsible <strong>for</strong> theft, burglary, fire or any mischievousdeeds by his staff.19. All consumables and material used by the Contractor shall be provided by thisDivision .20. It is made clear that he engagement of the service provider does not <strong>in</strong> any wayconfer any right to the service provider or the persons that may be deployed byhim t<strong>in</strong> this office <strong>for</strong> any other Govt. SPECIAL TERMS AND CONDITIONS FOR HOUSEKEEPINGANNEXURE – II1. SCOPE OF WORK(I)(II)The prime object of housekeep<strong>in</strong>g services is to ma<strong>in</strong>ta<strong>in</strong> the entire premises <strong>in</strong>a tip top condition. The premise is to be ma<strong>in</strong>ta<strong>in</strong>ed from hygienic po<strong>in</strong>t ofview.The broad details of work covered under the scope is enumerated as follows:a) Clean<strong>in</strong>g, sweep<strong>in</strong>g and wip<strong>in</strong>g of floors.b) Thorough clean<strong>in</strong>g of toilet/ur<strong>in</strong>als us<strong>in</strong>g required detergenets, by putt<strong>in</strong>gnaphthalene balls <strong>in</strong> all the ur<strong>in</strong>als and air purifiers <strong>in</strong> the toilets.c) Shift<strong>in</strong>g of furniture and other items/stores from one place to another asrequired by the adm<strong>in</strong>istration.2. JOB TO BE CARRIED OUT DAILY(i)(ii)(iii)(iv)(v)Clean<strong>in</strong>g of toilets, w<strong>in</strong>dows, wash bas<strong>in</strong> & other fitt<strong>in</strong>gs and waterCoolers, remov<strong>in</strong>g of all dust, unwanted materials, clean<strong>in</strong>g to be done withphenyl/lyzol twice a day.Clean<strong>in</strong>g of corridors, staircase and common area once with dis<strong>in</strong>fectants <strong>in</strong>the morn<strong>in</strong>g and with pla<strong>in</strong> water <strong>in</strong> the afternoon.Remov<strong>in</strong>g dust from floors, w<strong>in</strong>dows, doors, books, journals, furniture,fixtures, telephone, cupboard, air-conditioners, almirah, fill<strong>in</strong>g cab<strong>in</strong>ets,glass panes, collect<strong>in</strong>g waste paper, unwanted material and its disposal at<strong>in</strong>dicated locations.Clean<strong>in</strong>g of rooms by mopp<strong>in</strong>g floor with cloth soaked <strong>in</strong> water anddis<strong>in</strong>fectant of ISI mark.Provid<strong>in</strong>g toilets with liquid soap, naphthalene balls and deodorant blocks,liquid soaps is to be kept and turn it upside down and pour type steel orplastic conta<strong>in</strong>ers.3. JOBS TO BE CARRIED OUT WEEKLY(i)(ii)Wash<strong>in</strong>g of floors with Surf/Vim/Soap and water or any other clean<strong>in</strong>goperation.If the labour is required on Sunday/Gazetted Holiday, no extra charge will bepaid to the Contractor.4. MISCELLANEOUS CONDITIONSSweep<strong>in</strong>g, clean<strong>in</strong>g, dust<strong>in</strong>g etc. shall be completed be<strong>for</strong>e 9:00AM everyday.The Contractor shall refill the sanitary cubes, cakes, odonil, air purifier, naphthaleneballs, chemicals, dis<strong>in</strong>fectants, detergents, liquid soap, acid etc. from time to time and asand when required.


(ii)(iii)(iv)The Division shall release due amount after mak<strong>in</strong>g recoveries, if any,through crossed account payee cheque <strong>in</strong> favour of Contractor.The Contractor shall promptly make payment to Regional Provident FundCommissioner <strong>in</strong> respect of Provident Fund contribution by Contractor andamount deducted from salary/wages of deployed personnel towards theircontribution to provident fund.In case, the Division receives any compla<strong>in</strong>t regard<strong>in</strong>g non-payment ofwages to your personnel the amount payable to these personnel will berecovered from your bill and paid to such personnel.6. PENALTIES(i)(ii)(iii)(iv)Contractor will attract a penalty of Rs.108/- (Rupees One hundred and Eightonly) per day, per person, <strong>in</strong> case the person fails to carry out the housekeep<strong>in</strong>g services due to his absence or any other reason.In the event of failure <strong>in</strong> ma<strong>in</strong>ta<strong>in</strong><strong>in</strong>g the housekeep<strong>in</strong>g services on any dayupto the desired standard, <strong>in</strong> part or full, the contractor is liable to penalty @Rs.250 (Rupees Two Hundred fifty only) per day, which shall be recoveredfrom the bills or otherwise. For the purpose of impos<strong>in</strong>g penalty, the decisionof the Division will be f<strong>in</strong>al and b<strong>in</strong>d<strong>in</strong>g on the Contractor and shall not besubject to dispute or arbitration.Contractor shall ensure that peace and order is ma<strong>in</strong>ta<strong>in</strong>ed <strong>in</strong> the premises.Contractor would ensure that all its personnel would behave courteously anddecently with employees of the Division and also ensure good manners.7. CHARGES AND PAYMENTSBills chargeable to the Division shall be paid after every month of services rendered, iffound <strong>in</strong> order.
