Rates/ Quotations duly filled in will be received upto the date and time mentioned inthe Limited Tender Notice. Rates/quotations should be for the specified area for therespective formations and Rate quoted on per Square feet basis, duly indicatingNo. of persons proposed to be engaged by the Service Providers.2. The Central Excise Division, Chandigarh (hereinafter referred to as theCommissionerate) reserve the right to postpone and/ or extend the date of receipt/opening of Rates/Quotation or to withdraw the same, without assigning any reasonthereof.3. The Service Providers are required to submit the complete Rates/ Quotations onlyafter satisfying each and every condition laid down in the Annexure enclosed.4. All the rates must be written both in figures and in words. Corrections, if any, are tobe made by crossing out, initialing dating and rewriting. In case of discrepancybetween the words and figures the rates indicated in figures shall prevail. Alloverwriting/ cutting, insertions shall be authenticated and attested.5. Rates/Quotations should be submitted and signed by the firm with its currentbusiness address and contact number.6. The rates shall be valid for a period from the date of contract to the end of nextfinancial year i.e. 03/2014 .7. The Service Providers should satisfy themselves before submission of the Rates/Quotations to the Cnetral Excise Division, Chandigarh that they meet the qualifyingcriteria and capability as laid down in the Annexure.8. The Service Providers must comply with the Rates/ Quotations, specification and allterms and conditions of contract. No deviation in the terms & Conditions of theContract shall be entertained unless specifically mentioned by the contractor in theRates/ Quotations and accepted by the Central Excise Division, Chandigarh.9. The contract will be awarded for a period from the date of contract to the end of nextfinancial year i.e. 31.03.2014.4

In case of any of any default by the Contractor and in any of the terms & conditions(whether General or Special), the Central Excise Division, Chandigarh may, withoutprejudice to any other right / remedy which shall have accrue or shall accruethereafter, terminate the contract, in whole or part, by giving 15 days notice in writingto the Contractor.11. Notwithstanding anything contained herein, the Division/Commissionerate reservesthe right to terminate the contract by giving 15 days notice in writing withoutassigning any reason and without incurring any financial liability whatsoever to theContractor.12. Insurance cover protecting the agency against all claims applicable under theWorkmen’s Compensation Act, 1948 shall he taken by the contractor. The contractorshall arrange necessary insurance cover for any persons deployed by him even forshort duration. The Central Excise Division, Chandigarh shall not entertain any claimarising out or mishap, if any that may take place. In the event of any liability/ claimfalling on this Central Excise Division, Chandigarh the same shall be reimbursed/indemnified by the Contractor.13. The Service Provider shall in no case lease/ transfer/sublet/appoint care taker forservices.14. No other person except Service Provider’s authorized representative shall beallowed to enter the office premise of Chandigarh-I.15. Within the premises of the Central Excise Division, Chandigarh, the ServiceProvider’s personnel shall not do any private work other than their normal duties.16. The Service Provider shall be directly responsible for any/all disputes arisingbetween him and his personnel and keep the Central Excise Chandigarh indemnifiedagainst all actions, looses, damages, expenses and claims whatsoever arisingthereof.17. The Service Providers shall be solely responsible for payment of wages/salaries other benefits and allowances to his personnel that might becomeapplicable under any Act or Order of the Govt. The Central Excise Division,Chandigarh shall have no liability whatsoever in this regard and the Contractorshall indemnify this Central Excise Division, Chandigarh against any/ all claimswhich may arise under the provisions of various Acts, govt. Orders etc.5

Office.20. The rates will be valid upto 31 March-2014.21. It is made clear that number of man power is to be decided by the contractor.22. The service provider must have minimum number of persons in his payroll to ensurecontinuous service.23. The service provider must have Service Tax Number, PAN Number and minimumthree years of past experience in the same field a proof of which must be enclosed atthe time of submitting Technical Bid.24. The service provider must ensure proper dress code for its workers.25. SCOPE OF WORK(i)The prime object of house-keeping services is to maintain the entire premises in tip topcondition. The premise is to be maintained from hygienic point of view.(ii)The broad details of work covered under the scope is enumerated as follow:(a) Cleaning, sweeping and wiping of floors twice a day.(b) Through cleaning of toilets/urinals using required detergents, by putting naphthaleneballs in all the urinals and air purifiers in the toilets.(c) Shifting of furniture and other items/stores from one place to another as required bythe administration.2. JOBS TO BE CARRIED OUT DAILYi. Cleaning of toilets, windows, wash basin & other fittings and water Coolers, removing of alldust, unwanted materials, cleaning to be done with phenyl/lyzol twice a day.ii.Cleaning of corridors, staircase and common area once with disinfectant in the morning andin the afternoon.iii.Removing dust form floors, windows, doors, books, journals, furniture, fixtures, telephone,cupboard, air conditioners, almirah, filling cabinets, glass panes, collecting waste paper,unwanted material and its disposal at indicated locations, disposing of paper/trash.iv.Cleaning of rooms by mopping floor with cloth soaked in water and disinfectant of ISI mark.v. Providing toilets with liquid soap, naphthalene balls and deodorant blocks, Liquid soap is tobe kept in turn it upside down and pour type steel or plastic containers.7

Washing of floors with surf/vim/soap and water or any other cleaning operation.ii.If the labour is required on Sunday/Gazetted holiday, no extra charge will be paid to theService Provider.iii.Cleaning of, ceiling window panels and ventilation blinds, washing of water coolers,cleaning of office equipment, dusting of computer and other fixture.4. MISCELLANEOUS CONDITONSSweeping, cleaning dusting etc. shall be completed before 9.00 AM every day.To refill the sanitary cubes, cakes, odonil, air purifier, naphthalene balls, chemicals,disinfectants, detergents, liquid soap, acid etc. from time to time and as and when required.Manpower require for execution of the entire work including transport shall be arranged bythe contractor. In case a particular workman remains absent due to one reason or other, itwould be the responsibility of the contractor to provide another workman in his place.The contractor shall, on award of the contract furnish the list containing names andaddresses of the workman sent to the Division/Commissionerate for housekeeping services.The Services provided by the contractor shall be to the satisfaction of theDivision/Commissionerate.The contract rates shall includes cost for all essential and contingent works, which althoughnot specially mentioned in this contract, are necessary for completion of the work to thesatisfaction of the Divisions/Commissionerate.The contractor shall have no claim against the Division/Commissionerate in respect of anywork which may be withdrawn.8

The above register ofpersonnel shall be subject to check by the concerned officer of theDivision/Commissionerate. The personnel will render services every day includingSATURDAYS except on NATIONAL HOLIDAYS (i.e. 26 th Jan, 15 th Aug, 2 nd Oct, Holi, Diwali andSUNDAYS and any other holidays/publish holidays which are mandatory under labour laws).They will maintain cleanliness of toilets, lavatories, pantry, floors etc. and will attend to anyunforeseen jobs as well as exigency of work. NO extra payment of this shall be made. Therate of items of schedule of work include the cost of this provision as well.5. TERMS OF PAYMENT1. The contractor will submit the monthly bill for reimbursement in duplicate enclosingcertificates as indicated below, which shall be got duly certified by the officer-in-charge andthe same shall be paid thereof after making recovery, if any.2. The contractor shall make regular and full payment of labour charges, salaries and otherpayment as je, as per the labour laws to its personnel deputed under service contract andfurnish necessary proof whenever required.3. Actual deployment of personnel & their attendance.4. Proof of payment made to your personnel for previous months.i. Proof of challan/ receipt issued by Regional Provident Fund Commissioner (RPFC) etc. forthe payment made towards applicable provident fund. ESI & EDLI for the previous monthand proof of payment towards compliance of other statutory provision like Bonus for theprevious month.ii.The Division/Commissionerate shall release due amount after making recoveries, if any,through crossed account payee cheque in favour of contractor.iii.The contractor shall promptly make payment to Regional Provident Fund Commissioner inrespect of Provident Fund Contribution by Contractor and amount deducted fromsalary/wages of deployed personnel towards their contribution to provident fund.iv.In case, the Divisions/Commissionerate receive any complaint regarding non-payment ofwages to your personnel the amount payable to these personnel will be recovered fromyour bill and paid to such personnel.9

Contractor will attract a penalty proportionately, per person, in case the person failsto carry out the house keeping services due to his absence or any other reason.II.In the event of failure in maintaining the house keeping services on any day upto thedesired standard, in part or full, the contractor is liable to penalty proportionatelyper day, which shall be recovered from the bills or otherwise. For the purpose ofimposing penalty, the decision of the Divisions/Commissionerate will be final andbinding on the contractor and shall not be subject to dispute or arbitration.III.Contractor shall ensure that peace and order is maintained in the premises.7. Other C o n di ti o ns of ContractAll the equipment/consumables material for cleaning will be supplied by the office.( i ) The brief regarding providing of Housekeeping Services will have be tosupplied by the Service Provider on award of contract.(ii)All services shall be performed by the persons qualified and skilled in pe rf orm ings u ch ser v ic e s.(iii) Cleaning should be completed in office cited premises (except commonplaces) prior to opening of office hours so that work in office does not get interrupted inthemiddle for cleaning purpose.(iv)The persons supplied by the Service Provider should not have any Policer e c o r d s / c r i m i n a l c a s e s a g a i n s t t h e m . T h e c h a r a c t e r a n d a n t e c e d e n t s o fpersons will be verified by the Service Provider before their deployment t hr o u g h localp o lice, collecting proofs of r e s idence, d r iving licen s e , b a n k a c c o u n t d e t a i l s ,p r e v i o u s w o r k e x p e r i e n c e a n d r e c e n t p h o t o g r a p h a n d a certificated to this effect bepolice, collecting proofs of residence, driving license, bank account details, previous workexperience and recent photograph and a certificated to this effect be submitted to this office. U n d e r t a k i n g f r o m t h e p e r s o n s t o t h i s e f f e c ts h a l l be submitted by the service provider to this office.(vii)The service provider's personnel shall not divulge or disclose to any person, any details of office,operational process, technical know —how, security a r r a n g e m e n t s , a d m in i s t r a t i v e / o r g a n i z a t i o n a lm a t t e r s a s a l l a r e o f confidential /secret nature.(viii) T h e s e r v ice pr o v ider's p er s o n n e l s h o u ld b e po lite, c o r d ial, p o s itive a n d efficient, while handlingthe assigned work. The services provider shall be r e sp ons ible for an y ac t of in discipline on t he par to f p er so n s de p lo ye d him. The Service Provider shall be bound to prohibit and prevent any oft h e i r e m p l o y e e s f r o m b e i n g i n t o x i c a t e d w h i l e o n d u t y , t r e s p a s s i n g o r acting in any detrimentalor prejudicial to the interest of this office. The decision of the officer in charge upon any matterarising under the clau se shall be final and binding on the Service Provider.(ix) T h a t t h e p e r s o n s e n ga g e d s h a ll n o t b e b e low t h e a g e o f 1 8 y e a r s a n d(x)they shall not interfere with the duties of the employees of these offices.Th is of f ic e m ay r eq u ire t he se rvice pro v id er t o dismiss or rem o ve fro m the site of work, anyperson or persons, employed by the service provider, who may be incompetent or for his/her/theirmisconduct and the service provider shall forthwith comply with such requirements. The Service providershall immediately withdraw anysuch personnel, if they are unacceptable to this offices because of security risk,incompetence,conflict interest and breach of confidentiality or improper conduct upon receiving written notice from office.(xii) The service provider has to provide Photo Identity Cards to the persons employed by him/her for carrying out thework. These cards are to be constantly displayed &their loss reported immediately.(xiii) The transportation, food, medical and other statutory requirements in respect of each personnel of the serviceprovider shall be the responsibility of the service provider.(xiv) That the Service Provider will be wholly and exclusively responsible forpayment of wages to the persons engaged by it in compliance of all the statutory obligations under11

TheService Provider will require to provide particulars of EPF, ESI of its - employees engaged in thisoffice. The Agency will comply all statutory provisions of law, rules and regulations of Act and keepthis office informed about any amendment in the law from time to time.(xv)Payments to the Service Provider would be made only after the receipt of Satisfactory certificate from Head ofOffice of respective formation/premises. In case of unsatisfactory performance of work or partialcompletion of work on any day/period, no charges would be paid for that day /period.(xvi) The Service Provider shall be contactable at all time and messages sentb y p h o n e / e - m a i l/f a x / s p e c ial m e s s e n g e r f r o m t h i s o f f i c e s h a ll b e acknowledged immediately onreceipt on the same day. The Service Provider shall strictly observe the instructions issued by the Departmentin fulfillment of the contract from time to time.(xvii) This office shall not be liable for any loss, damage, theft, burglary or r o b b ery o f a ny pe rson alb e lo ng in g s, e qu ip me nt o r ve h ic les o f th e personnel of the Service Provider.(xviii) That the Service Provider on its part and through its own resources shall ensure that the goods material s andequipment etc. are not damaged in the process of carrying out the s of negligence, default or theft on thepart of the employees/agents of the Service Provider, then the Service Provider shall be liable to reimburse tothis office for the same. The Service Provider shall keep this office fully indemnified against any such loss ordamage. Any accident/casualty occurred during the course of working to any staff engaged by the ServiceProvider shall be borne by firm and this office will no way be responsible for it or any other clause mentionedabove.(xx) The successful bidder will enter into an agreement with this office for providing of suitable serviceas per requirement of this office on these terms and conditions on non-judicial Rs.100/ -stamppaper. The above stamp paper will be arranged by the bidder for execution of agreement. Theagreement will be valid for a period of contract period. The service charges/ rates quoted by theService Provider shall be fixed for contract period and no request for any change /modification shall beentertained before expiry of the period of contract. Any statutory increase inwages/DA etc. is to be absorbed by the service provider.(xxi)The service provider shall not assign, transfer, pledge or sub contract the performance of services.(xxii) The agreement can be terminated by either party by giving one month's notice in advance. Ifthe Service Provider fails to give one month's notice in writing for termination of theAgreement then one month's amount due to the Service Provider from the office shall be forfeited.(xxiii) That on the expiry of the agreement as mentioned above, the Service Provider will withdraw all itspersonnel and clear their accounts by paying them all their legal dues. In case of any dispute on12

OFFICE OF THE DEPUTY COMMISSIONER, CENTRAL EXCISE DIVISION, CHANDIGARH-I,PLOT NO.19, SECTOR-17-C, 5TH FLOOR, CHANDIGARH.account of the termination of employment or non-employment by the personnel of the ServiceProvider, it shall be the entire responsibility of the Service Provider to pay and settle the same.(xxiv) In the event, if any dispute arises touching any of the clauses of the agreement, the matter will bereferred to The Commissioner of Central Excise, Chandigarh-I, whose decision shall be binding on boththe parties.(xxv) That if any amount is found payable by the bidders towards, any liability in connection with housekeeping services orany loss to this office property, the same shall be adjusted from monthly bill to the extent of the amount sodetermined reserving right to recover the deficit amount through other modes of recovery including theright to terminate the agreement without notice(xxvi) This office reserves the right to reject any or all the tenders without assigning any reason whatsoever andthe decision of the management shall be final and binding on all the bidders.NB. 1.
