Case 2:94-cv-04048-ER Document 330 Filed 09/19/2005 Page 19 <strong>of</strong> 51Those school districts failing to comply with PDE’scorrective action plans--created to rectify deficienciesidentified through any type <strong>of</strong> compliance monitoring--will besubject to sanctions and enforcement powers, including:(Id. at Provision IV.4(I).)(1) A mandatory meeting with PDEin Harrisburg in which thesuperintendent and chair <strong>of</strong>the school board will beobligated to participate.(2) Appropriate sanctions as setforth in PDE’s “BasicEducation Circular” onenforcement, including thewithholding <strong>of</strong> funds from theschool district andredirecting those funds to theappropriate body to supportspecific expenditures (e.g.,hiring personnel) to implementthe action required.(3) If appropriate, the initiation<strong>of</strong> pr<strong>of</strong>essional disciplinaryaction against thesuperintendent or others whoseconduct is found to haveresulted in the schooldistrict’s failure to meet itsobligations under the CAP.E. Complaint ResolutionUnder the <strong>Settlement</strong> Agreement, PDE will modify andexpand its present system <strong>of</strong> complaint investigation andresolution. (Id. at Provision IV.5.) First, the Bureau willinvestigate all complaints filed by parents or students. (Id. at19
