Barnes, Ph.D., Secretary <strong>of</strong> Educationfor the Commonwealth <strong>of</strong> PennsylvaniaAt the time the <strong>Settlement</strong> Agreement was entered into,Dr. Barnes served as the Secretary <strong>of</strong> Education for theCommonwealth. In that capacity, he was the highest educational<strong>of</strong>ficial in Pennsylvania. At the Fairness Hearing, Dr. Barnestestified that he was familiar with the <strong>Settlement</strong> Agreement,that the Pennsylvania Department <strong>of</strong> Education was entering intothe <strong>Settlement</strong> Agreement willingly and voluntarily, and that theterms <strong>of</strong> the <strong>Settlement</strong> Agreement would be implementedfaithfully. (Id. at 12-14.) Additionally, Dr. Barnes statedthat the Commonwealth had both the staff support and financialsupport to implement the terms <strong>of</strong> the <strong>Settlement</strong> Agreement. (Id.at 13.) Although Dr. Barnes acknowledged that he planned toleave his position as Secretary <strong>of</strong> Education within a few months<strong>of</strong> the Fairness Hearing, he stressed that his departure would“absolutely not” impact the commitment <strong>of</strong> the Commonwealth tocarry out the terms <strong>of</strong> the <strong>Settlement</strong> Agreement. (Id.) Dr.Barnes indicated that the <strong>Settlement</strong> Agreement would not onlyserve the best interests <strong>of</strong> special education children in theCommonwealth, but also those children receiving a generaleducation. (Id.)27
