• that the negligence was of a very high degree;• that the negligence involved a high degree of risk or likelihood ofsubstantial personal injury to others;●that the accused was capable of appreciating the risk or meeting theexpected st<strong>and</strong>ard at the time of the alleged gross negligence.[Paragraphs 5.68-5.69]6.13 The <strong>Commission</strong> recommends that both the statutory offence ofdangerous driving causing death <strong>and</strong> that of careless driving should continueto exist alongside the more serious offence of <strong>manslaughter</strong>. [Paragraph5.80]6.14 The <strong>Commission</strong> recommends that a new offence of “carelessdriving causing death” be created in order to mark the occurrence of death.The <strong>Commission</strong> suggests that section 52 of the Road Traffic Act 1961 beamended by the insertion of the following subsections after subsection (2).(3) A person commits the offence of careless driving causingdeath if he or she causes the death of another person by driving avehicle in a public place without due care <strong>and</strong> attention.(3) Prosecutions for the offence of careless driving causing deathshall be on indictment.
