Program Purpose and Intent(OMC Section 8.54.020)The purpose <strong>of</strong> this program isto promote the health, safety, and generalwelfare <strong>of</strong> the residents, workers, visitors,property owners, and business owners <strong>of</strong> the <strong>City</strong><strong>of</strong> <strong>Oakland</strong> and the economic stability andviability and livability <strong>of</strong> neighborhoods in the<strong>City</strong> by requiring the registration and monitoring<strong>of</strong> foreclosed and defaulted residentialproperties.This program protects and preservesthe livability, appearance, and social fabric <strong>of</strong>the <strong>City</strong> and also protects the public from healthand safety hazards and the impairment <strong>of</strong>property values resulting from the neglect anddeterioration <strong>of</strong> real property and improvements.The intent <strong>of</strong> this program is toestablish a mechanism to protect neighborhoodsfrom becoming blighted through the lack <strong>of</strong>maintenance and security <strong>of</strong> occupied and vacantforeclosed and vacant defaulted residentialproperties; to establish a foreclosed (REO) anddefaulted (NOD) residential property registrationand abatement program; and to set forthguidelines for the maintenance <strong>of</strong> occupied andvacant and/or distressed residential properties.In addition, this program provides for theregistration and inspection <strong>of</strong> occupied defaulted(NOD) residential properties to aid on foreclosureprevention efforts and because such propertieshave an increased potential to become vacant orblighted.Program Scope(OMC Section 8.54.030)1. However, when the NODoccupied property changes status to NODvacant/abandoned, then a registration fee isrequired. Changes in property status will requireupdates to the <strong>City</strong>’s registration program, butwithout triggering a new fee so long as the annualregistration fee has already been paid for thatproperty.Penalties and FinesFailure to register defaulted or foreclosedproperties timely may result in a citation penaltyup to $5,000 per property. Failure to inspect andmaintain NOD vacant and abandoned and REOoccupied or vacant properties may result in apenalty <strong>of</strong> $1,000 per day. An appeal hearing bya neutral hearing examiner is available to contestnotices <strong>of</strong> violations and assessment <strong>of</strong> fees,citations, and/or penalties assessed.
