第 一 章引 言背 景1.1 為 解 決 自 七 十 年 代 初 期 罪 案 出 現 上 升 趨 勢 的 問 題 , 政 府 在一 九 七 三 年 三 月 成 立 撲 滅 暴 力 罪 行 委 員 會 , 由 當 時 的 民 政 司 出 任 主席 , 成 員 均 為 政 府 人 員 。 委 員 會 的 職 權 範 圍 為 策 劃 、 組 織 及 統 籌 政 府與 市 民 合 力 協 助 警 方 撲 滅 暴 力 罪 行 的 活 動 。 一 九 七 五 年 , 撲 滅 暴 力 罪行 委 員 會 易 名 為 撲 滅 罪 行 委 員 會 ( 委 員 會 ) , 成 員 擴 大 至 包 括 非 政 府 人員 。1.2 一 九 八 三 年 五 月 , 委 員 會 改 組 , 由 當 時 的 布 政 司 出 任 主 席 。委 員 會 的 工 作 是 制 定 撲 滅 罪 行 計 劃 、 統 籌 滅 罪 工 作 和 查 察 所 得 成 果 ,並 向 當 時 的 港 督 報 告 工 作 進 展 。 一 九 八 三 年 十 二 月 , 改 組 後 的 委 員 會向 當 時 的 港 督 呈 交 第 一 號 報 告 書 。1.3 本 報 告 書 是 委 員 會 的 第 二 十 五 號 報 告 書 , 詳 述 撲 滅 罪 行 委員 會 在 二 零 零 五 年 的 工 作 。撲 滅 罪 行 委 員 會 及 屬 下 小 組 委 員 會1.4 委 員 會 由 十 六 名 成 員 組 成 , 其 中 八 名 是 公 眾 人 士 , 由 政 務司 司 長 委 任 , 另 外 八 名 則 是 政 府 有 關 決 策 局 及 部 門 的 首 長 。 委 員 會 的職 權 範 圍 和 成 員 名 單 詳 列 於 附 錄 I(a) 及 I(b)。 委 員 會 轄 下 設 有 兩 個 小組 委 員 會 :• 青 少 年 罪 犯 問 題 常 務 委 員 會• 宣 傳 小 組 委 員 會各 小 組 委 員 會 的 職 權 範 圍 和 成 員 名 單 詳 列 於 附 錄 II(a) 及 II(b)。主 要 研 究 事 項1.5 二 零 零 五 年 , 委 員 會 共 舉 行 了 五 次 會 議 , 除 了 探 討 整 體 罪案 和 商 業 罪 案 的 情 況 、 監 察 警 司 警 誡 計 劃 的 進 展 、 推 動 撲 滅 罪 行 的 宣傳 工 作 和 督 導 分 區 滅 罪 委 員 會 ( 分 區 滅 罪 會 ) 的 工 作 之 外 , 還 就 打 擊 毒 品問 題 及 清 洗 黑 錢 活 動 的 策 略 作 出 討 論 。 此 外 , 委 員 會 亦 曾 探 討 預 防 和處 理 家 庭 暴 力 罪 行 的 策 略 和 措 施 。分 區 撲 滅 罪 行 委 員 會1.6 全 港 十 八 區 均 設 有 分 區 滅 罪 會 , 成 員 包 括 政 府 和 非 政 府 人員 。 這 些 分 區 滅 罪 會 肩 負 重 任 , 致 力 推 廣 和 鼓 勵 居 民 參 與 區 內 的 滅 罪9

第 二 章二 零 零 五 年 罪 案 情 況整 體 罪 案 情 況2.1 二 零 零 五 年 , 向 警 方 舉 報 的 罪 案 共 有 77 437 宗 , 較 二 零 零四 年 的 81 315 宗 減 少 4.8%。 罪 案 率 ( 即 按 每 10 萬 名 人 口 計 算 的 報 案 數字 ) 為 1 116.5 宗 , 較 二 零 零 四 年 的 1 181.5 宗 減 少 5.5%。 二 零 零 五 年的 整 體 罪 案 破 案 率 為 44.3%, 二 零 零 四 年 則 為 43.6%。2.2 一 九 九 六 年 至 二 零 零 五 年 整 體 罪 案 舉 報 數 字 、 罪 案 率 和 破案 率 的 圖 表 載 於 附 錄 IV。暴 力 罪 案2.3 二 零 零 五 年 的 暴 力 罪 案 ( 包 括 兇 殺 、 強 姦 、 非 禮 、 傷 人 、 嚴重 毆 打 、 搶 劫 、 綁 架 、 勒 索 、 刑 事 恐 嚇 和 縱 火 等 ) 共 有 13 890 宗 , 與 二零 零 四 年 的 數 字 相 同 。 在 暴 力 罪 案 中 , 搶 劫 和 勒 索 案 有 所 減 少 , 但 嚴重 毆 打 和 刑 事 恐 嚇 案 則 有 所 增 加 。 年 內 的 暴 力 罪 案 率 為 按 每 10 萬 名 人口 計 算 有 200.3 宗 , 較 二 零 零 四 年 的 201.8 宗 減 少 0.7%。 二 零 零 五 年的 暴 力 罪 案 破 案 率 為 59.5%, 二 零 零 四 年 則 為 57.4%。2.4 一 九 九 六 年 至 二 零 零 五 年 暴 力 罪 案 舉 報 數 字 、 罪 案 率 和 破案 率 的 圖 表 載 於 附 錄 V。某 幾 類 罪 案 的 分 析行 劫2.5 二 零 零 五 年 的 行 劫 案 共 有 1 675 宗 , 較 二 零 零 四 年 的 2 237宗 減 少 25.1%( 見 附 錄 VI 的 圖 表 ) 。2.6 二 零 零 五 年 有 3 宗 使 用 真 槍 行 劫 的 案 件 , 與 二 零 零 四 年 的數 字 相 同 。 年 內 使 用 電 槍 行 劫 的 案 件 有 5 宗 , 而 使 用 類 似 手 槍 物 體 行劫 的 案 件 則 有 28 宗 。 上 述 兩 類 罪 案 在 二 零 零 四 年 分 別 有 7 宗 和 47 宗 ( 見附 錄 VII 的 圖 表 ) 。2.7 二 零 零 五 年 的 銀 行 劫 案 有 15 宗 , 而 二 零 零 四 年 則 有 16 宗 。至 於 金 舖 / 錶 行 劫 案 , 二 零 零 五 年 有 7 宗 , 而 二 零 零 四 年 則 有 6 宗 。一 九 九 六 年 至 二 零 零 五 年 銀 行 和 金 舖 / 錶 行 劫 案 的 舉 報 數 字 , 載 於 附錄 VIII。11

爆 竊2.8 二 零 零 五 年 的 爆 竊 案 有 5 492 宗 , 較 二 零 零 四 年 的 7 002 宗減 少 21.6%( 見 附 錄 IX 的 圖 表 ) 。兇 殺2.9 二 零 零 五 年 的 兇 殺 案 有 34 宗 , 二 零 零 四 年 則 有 45 宗 ( 見 附錄 X 的 圖 表 )。 在 二 零 零 五 年 的 34 宗 案 件 中 , 有 9 宗 (26.5%) 是 和 家 庭問 題 有 關 , 同 類 的 案 件 在 二 零 零 四 年 則 有 20 宗 (44.4%)。 年 內 , 有 2宗 兇 殺 案 共 2 名 年 齡 在 12 歲 或 以 下 的 兒 童 被 父 母 殺 害 , 而 二 零 零 四年 , 這 類 案 件 有 9 宗 。傷 人 及 嚴 重 毆 打2.10 傷 人 及 嚴 重 毆 打 案 由 二 零 零 四 年 的 7 161 宗 增 加 4.9% 至 二零 零 五 年 的 7 509 宗 ( 見 附 錄 XI 的 圖 表 ) 。 在 二 零 零 五 年 , 上 述 案 件 中與 三 合 會 有 關 的 佔 7.7%, 二 零 零 四 年 則 佔 8.8%。嚴 重 毒 品 罪 行2.11 二 零 零 五 年 , 嚴 重 毒 品 罪 行 ( 例 如 販 運 、 製 造 和 藏 有 危 險 藥物 等 ) 有 1 780 宗 , 較 二 零 零 四 年 的 2 167 宗 減 少 17.9%。 年 內 因 干 犯嚴 重 毒 品 罪 行 被 捕 者 共 有 2 224 人 , 較 二 零 零 四 年 的 2 712 人 減 少18.0%。 此 外 , 年 內 被 捕 的 21 歲 以 下 青 少 年 有 282 人 , 較 二 零 零 四 年的 499 人 減 少 43.5%。 在 這 些 被 捕 的 青 少 年 中 , 有 254 人 (90.1%) 因 涉及 精 神 藥 物 而 被 拘 捕 。店 舖 盜 竊2.12 年 內 向 警 方 舉 報 的 店 舖 盜 竊 有 8 750 宗 , 較 二 零 零 四 年 的9 186 宗 減 少 4.7%( 見 附 錄 XII 的 圖 表 )。 在 這 些 盜 竊 案 中 , 有 7 169 宗案 件 (81.9%) 的 被 盜 財 物 , 價 值 在 港 幣 200 元 或 以 下 。報 失 車 輛2.13 年 內 報 失 的 車 輛 有 1 592 輛 , 較 二 零 零 四 年 的 1 740 輛 減 少8.5%( 見 附 錄 XIII 的 圖 表 )。2.14 涉 及 名 貴 汽 車 ( 平 治 、 寶 馬 、 豐 田 皇 冠 及 凌 志 ) 的 案 件 下 降 至26 宗 , 較 二 零 零 四 年 的 60 宗 減 少 56.7%。 涉 及 多 用 途 車 輛 的 案 件 由 二零 零 四 年 的 156 宗 增 加 3.8% 至 二 零 零 五 年 的 162 宗 。 涉 及 高 性 能 車 輛的 案 件 由 二 零 零 四 年 的 43 宗 減 少 30.2% 至 二 零 零 五 年 的 30 宗 。 偷 竊貨 櫃 車 拖 頭 的 案 件 上 升 至 73 宗 , 較 二 零 零 四 年 的 47 宗 增 加 55.3%。12

2.15 年 內 尋 回 失 車 的 整 體 百 分 率 為 46.2%, 二 零 零 四 年 則 為48.0%。街 頭 行 騙2.16 年 內 , 街 頭 騙 案 有 393 宗 , 較 二 零 零 四 年 的 479 宗 減 少18.0%。 其 中 “ 祈 福 黨 ” 和 “ 借 錢 / 手 提 電 話 黨 ” 是 最 為 常 見 的 行 騙 手法 , 分 別 佔 街 頭 騙 案 總 數 的 45.5%(179 宗 ) 和 25.2%(99 宗 ) 。與 三 合 會 有 關 的 罪 案2.17 二 零 零 五 年 , 與 三 合 會 活 動 有 關 的 罪 案 佔 3.0%(2 304 宗 ) ,二 零 零 四 年 則 佔 2.9%(2 346 宗 )。 年 內 , 涉 及 三 合 會 的 罪 案 大 部 分 是 非法 會 社 罪 行 (794 宗 , 佔 34.5%)、 傷 人 及 嚴 重 毆 打 (579 宗 , 佔 25.1%)、以 及 勒 索 (231 宗 , 佔 10.0%)。家 庭 暴 力2.18 二 零 零 五 年 警 方 共 處 理 2 628 宗 家 庭 暴 力 案 件 , 較 二 零 零 四年 的 2 289 宗 增 加 14.8%。 在 二 零 零 五 年 的 2 628 宗 案 件 中 ,1 274 宗(48.5%) 為 刑 事 案 件 ( 例 如 傷 人 及 嚴 重 毆 打 、 刑 事 恐 嚇 和 刑 事 毀 壞 等 ) 而1 354 宗 (51.5%) 為 雜 項 案 件 ( 例 如 糾 紛 和 求 警 協 助 / 調 查 等 )。 二 零 零 四年 則 有 903 宗 (39.4%) 刑 事 案 件 及 1 386 宗 (60.6%) 雜 項 案 件 。犯 罪 被 捕 的 青 少 年2.19 二 零 零 五 年 , 犯 罪 被 捕 的 少 年 ( 未 滿 16 歲 ) 有 4 531 人 , 較二 零 零 四 年 的 4 897 人 減 少 7.5%。 被 捕 少 年 干 犯 的 罪 行 大 多 為 店 舖 盜竊 (1 367 人 , 佔 30.2%)、 雜 項 盜 竊 (991 人 , 佔 21.9%)、 以 及 傷 人 及 嚴重 毆 打 (660 人 , 佔 14.6%)。2.20 二 零 零 五 年 , 犯 罪 被 捕 的 青 年 (16 至 20 歲 ) 有 4 780 人 , 較二 零 零 四 年 的 5 812 人 減 少 17.8%。 被 捕 青 年 干 犯 的 罪 行 大 多 為 雜 項 盜竊 (835 人 , 佔 17.5%)、 傷 人 及 嚴 重 毆 打 (826 人 , 佔 17.3%)、 以 及 店 舖盜 竊 (491 人 , 佔 10.3%)。2.21 一 九 九 六 年 至 二 零 零 五 年 青 少 年 犯 罪 被 捕 人 數 的 圖 表 載 於附 錄 XIV。*****13

第 三 章重 整 及 改 善 香 港 打 擊 毒 品 問 題 及清 洗 黑 錢 活 動 的 策 略背 景3.1 近 年 濫 用 藥 物 情 況 不 斷 轉 變 , 濫 用 精 神 藥 物 愈 趨 普 遍 , 有見 及 此 , 保 安 局 禁 毒 處 及 禁 毒 常 務 委 員 會 在 二 零 零 五 年 二 月 合 辦 打 擊濫 用 藥 物 國 際 會 議 , 希 望 透 過 這 次 會 議 , 與 海 外 司 法 管 轄 區 及 內 地 禁毒 機 關 就 濫 用 藥 物 的 最 新 趨 勢 交 流 資 訊 及 分 享 經 驗 , 並 且 參 考 各 地 的禁 毒 良 策 。3.2 清 洗 黑 錢 及 恐 怖 分 子 融 資 活 動 是 全 球 關 注 的 問 題 。 透 過 制訂 國 際 標 準 及 監 察 該 些 標 準 的 實 施 情 況 , 各 地 致 力 對 付 這 些 問 題 。 香港 作 為 國 際 金 融 中 心 , 有 需 要 採 納 最 新 標 準 , 以 符 合 國 際 間 採 用 的 最佳 模 式 。 此 外 , 亦 有 需 要 與 海 外 司 法 管 轄 區 交 流 經 驗 , 以 籌 劃 未 來 路向 。 為 此 , 禁 毒 處 及 禁 毒 常 務 委 員 會 在 二 零 零 五 年 二 月 合 辦 一 個 名 為“ 凝 聚 國 際 力 量 、 齊 打 擊 洗 黑 錢 ” 的 國 際 會 議 。重 整 及 改 善 香 港 打 擊 毒 品 問 題 的 政 策 及 策 略3.3 根 據 在 國 際 會 議 蒐 集 的 資 料 及 在 禁 毒 常 務 委 員 會 會 議 進 行的 討 論 , 所 得 結 論 認 為 , 政 府 以 五 管 齊 下 ( 從 立 法 和 執 法 、 預 防 教 育 和宣 傳 、 戒 毒 治 療 和 康 復 服 務 、 研 究 、 國 際 合 作 方 面 ) 打 擊 濫 用 藥 物 問 題 ,一 直 行 之 有 效 , 但 與 此 同 時 , 當 局 亦 應 優 先 處 理 下 述 範 疇 的 工 作 :(a) 投 放 更 多 資 源 於 高 危 組 別 , 例 如 待 業 待 學 青 少 年 、 少 數 族 裔人 士 及 弱 勢 青 少 年 等 ;(b) 採 用 全 人 治 療 方 式 為 濫 用 藥 物 者 提 供 戒 毒 治 療 及 康 復 服 務 ;(c) 改 善 及 加 強 為 禁 毒 工 作 者 提 供 的 訓 練 , 以 提 升 專 業 水 平 ;(d) 讓 有 關 人 士 , 例 如 家 長 、 教 師 、 社 工 、 司 法 機 構 及 其 他 政 府部 門 參 與 禁 毒 教 育 及 康 復 服 務 ;(e) 確 立 客 觀 評 估 準 則 , 評 估 教 育 、 宣 傳 及 戒 毒 治 療 / 康 復 計 劃的 成 效 ;(f) 加 強 國 際 及 區 域 合 作 , 尤 以 執 法 方 面 為 然 ; 以 及(g) 加 強 某 些 範 疇 的 研 究 , 以 蒐 集 科 學 證 據 , 有 助 制 訂 政 策 及 分配 資 源 。14

第 四 章預 防 和 處 理 家 庭 暴 力 罪 行 的 策 略 和 措 施引 言4.1 鑑 於 與 家 庭 暴 力 有 關 的 罪 案 有 上 升 的 趨 勢 , 撲 滅 罪 行 委 員會 ( 委 員 會 ) 在 二 零 零 五 年 九 月 二 十 四 日 的 會 議 上 討 論 了 家 庭 暴 力 問題 , 以 及 如 何 更 有 效 預 防 和 處 理 有 關 問 題 。 委 員 會 得 悉 政 府 在 過 去 一年 已 採 取 多 項 措 施 , 加 強 預 防 和 處 理 家 庭 暴 力 。現 行 政 策 和 策 略4.2 政 府 的 一 貫 政 策 是 不 容 忍 家 庭 暴 力 , 社 會 福 利 署 ( 社 署 )、 警方 和 有 關 部 門 會 竭 盡 所 能 跟 進 每 一 宗 所 知 的 個 案 , 並 因 應 每 宗 個 案 的情 況 和 需 要 , 採 取 合 適 、 專 業 的 處 理 方 法 。 警 方 亦 迅 速 及 專 業 地 處 理任 何 涉 及 刑 事 罪 行 的 家 庭 暴 力 案 件 。 涉 及 毆 打 或 其 他 刑 事 罪 行 暴 力 個案 的 人 士 , 將 依 法 負 上 刑 事 責 任 , 而 檢 控 當 局 亦 會 根 據 《 檢 控 政 策 及常 規 》 作 出 跟 進 行 動 。 同 時 , 政 府 繼 續 採 取 三 管 齊 下 的 策 略 , 去 幫 助家 庭 暴 力 受 害 人 和 有 關 的 家 庭 , 為 他 們 提 供 一 系 列 的 預 防 、 支 援 和 輔導 服 務 , 同 時 亦 透 過 加 強 地 區 的 工 作 , 及 早 識 別 有 問 題 的 家 庭 , 盡 早介 入 。已 採 取 的 改 善 措 施4.3 自 二 零 零 四 年 以 來 , 政 府 採 取 積 極 措 施 和 投 放 更 多 資 源 ,支 援 及 強 化 家 庭 的 功 能 以 及 處 理 家 庭 危 機 問 題 。 委 員 會 備 悉 當 局 成 立的 「 天 水 圍 家 庭 服 務 檢 討 小 組 」 提 出 了 25 項 改 善 建 議 , 包 括 加 強 地 區層 面 及 社 區 建 設 方 面 的 協 調 、 加 強 為 受 虐 婦 女 提 供 庇 護 服 務 、 改 善 警方 與 社 署 之 間 的 協 調 、 加 強 專 業 訓 練 、 設 立 有 關 向 警 方 舉 報 的 家 庭 暴力 及 相 關 個 案 的 中 央 資 料 庫 , 以 及 研 究 虐 兒 死 亡 個 案 的 檢 討 機 制 。 社署 、 警 方 和 其 他 相 關 政 府 部 門 積 極 跟 進 檢 討 小 組 提 出 的 建 議 。 在 二 零零 五 年 八 月 發 表 的 進 度 報 告 中 , 檢 討 小 組 對 於 當 局 已 就 天 水 圍 報 告 的大 部 分 建 議 採 取 跟 進 措 施 表 示 讚 賞 , 認 為 當 中 多 項 跟 進 措 施 都 能 改 善社 區 的 家 庭 支 援 服 務 和 處 理 家 庭 暴 力 及 虐 待 兒 童 問 題 的 程 序 , 並 能 迅速 發 揮 成 效 。4.4 為 進 一 步 加 強 在 地 區 層 面 的 跨 界 別 、 跨 專 業 協 作 , 社 署 自二 零 零 五 年 三 月 開 始 , 在 全 港 召 開 十 三 個 「 地 區 聯 絡 小 組 」, 成 員 包括 保 護 家 庭 及 兒 童 服 務 課 、 綜 合 家 庭 服 務 中 心 、 警 方 及 其 他 有 關 機 構的 代 表 , 以 就 處 理 家 庭 暴 力 個 案 事 宜 加 強 溝 通 、 協 調 和 合 作 。 社 署 並就 地 區 福 利 規 劃 的 機 制 草 擬 指 引 , 制 訂 一 套 量 度 地 區 福 利 需 要 的 社 會指 標 , 藉 以 促 進 福 利 規 劃 的 工 作 。 警 方 和 社 署 自 二 零 零 四 年 十 二 月 起 ,16

採 用 更 新 的 回 覆 機 制 , 以 加 強 前 線 警 務 人 員 和 社 署 人 員 在 轉 介 個 案 過程 中 的 溝 通 。4.5 此 外 , 在 加 強 服 務 和 危 機 介 入 方 面 , 社 署 增 加 保 護 家 庭 及兒 童 服 務 課 的 人 手 , 亦 增 撥 資 源 予 臨 床 心 理 服 務 課 、 綜 合 家 庭 服 務 中心 / 綜 合 服 務 中 心 及 醫 務 社 會 服 務 部 , 以 加 強 人 手 支 援 受 家 庭 暴 力 影響 及 面 對 危 機 的 家 庭 及 個 人 。 又 透 過 增 撥 額 外 資 源 及 服 務 重 整 , 增 加兒 童 住 宿 照 顧 服 務 名 額 。 社 署 向 婦 女 庇 護 中 心 增 撥 資 助 , 加 強 對 入 住的 婦 女 和 兒 童 的 支 援 服 務 , 另 外 亦 增 撥 資 源 加 強 夜 間 的 緊 急 熱 線 服務 。 社 署 推 行 施 虐 者 輔 導 先 導 計 劃 , 協 助 施 虐 者 改 變 暴 力 的 行 為 。4.6 在 公 眾 教 育 方 面 , 社 署 繼 續 在 全 港 舉 辦 「 凝 聚 家 庭 、 齊 抗暴 力 」 的 宣 傳 運 動 , 宣 揚 加 強 家 庭 凝 聚 力 及 打 擊 暴 力 。 另 外 , 除 了 恆常 進 行 的 培 訓 課 程 外 , 社 署 亦 委 託 一 所 大 學 在 全 港 舉 行 八 場 「 社 區 同心 、 齊 抗 暴 力 」 認 識 家 庭 暴 力 的 大 型 基 本 培 訓 , 並 繼 續 加 強 為 社 工 和相 關 專 業 人 員 提 供 以 虐 待 兒 童 、 配 偶 、 長 者 及 性 暴 力 等 為 核 心 課 題 的訓 練 。 而 警 方 亦 一 直 重 視 加 強 前 線 人 員 的 培 訓 , 加 強 他 們 對 處 理 家 庭暴 力 案 件 的 技 巧 和 敏 感 度 。 除 了 在 訓 練 日 提 供 訓 練 外 , 各 警 區 指 揮 官亦 會 因 應 有 關 警 區 的 需 要 , 特 別 在 一 些 錄 得 較 多 家 庭 暴 力 案 件 的 警 區安 排 相 關 的 復 修 及 特 別 訓 練 。4.7 政 府 亦 就 《 家 庭 暴 力 條 例 》 進 行 檢 討 , 以 期 加 強 對 家 庭 暴力 受 害 人 的 保 護 。 修 訂 建 議 包 括 把 《 條 例 》 的 範 圍 擴 大 , 涵 蓋 前 配 偶或 前 同 居 者 ; 讓 未 滿 18 歲 的 兒 童 的 起 訴 監 護 人 可 作 為 申 請 人 , 為 該 名兒 童 向 法 院 申 請 強 制 令 ; 刪 除 申 請 人 須 與 該 相 關 兒 童 同 住 的 規 定 ; 延長 強 制 令 的 有 效 期 ; 以 及 讓 法 院 在 合 理 地 信 納 答 辯 人 有 可 能 導 致 申 請人 或 有 關 的 兒 童 身 體 受 傷 害 的 情 況 下 , 可 在 發 出 強 制 令 時 附 上 逮 捕 權書 等 。4.8 另 外 , 為 加 強 預 防 和 及 早 為 有 需 要 的 家 庭 提 供 服 務 , 政 府在 二 零 零 五 年 七 月 在 深 水 埗 區 試 辦 兒 童 身 心 全 面 發 展 服 務 (0 至 5歲 ), 並 已 於 二 零 零 六 年 一 月 把 服 務 範 圍 擴 展 至 天 水 圍 、 屯 門 及 將 軍澳 區 , 稍 後 更 會 分 階 段 把 服 務 範 圍 進 一 步 擴 展 至 全 港 其 他 地 區 。 當 局亦 在 二 零 零 六 至 零 七 年 度 額 外 撥 出 約 2,200 萬 元 的 經 常 費 用 ( 以 全 年 計為 3,000 萬 元 ) , 在 綜 合 家 庭 服 務 中 心 / 綜 合 服 務 中 心 、 保 護 家 庭 及 兒童 服 務 課 及 精 神 科 醫 務 社 會 服 務 部 展 開 一 項 家 庭 支 援 計 劃 , 加 強 接 觸一 些 亟 需 援 助 但 又 不 願 接 受 服 務 的 家 庭 , 以 便 及 早 處 理 他 們 所 面 對 的問 題 。未 來 路 向4.9 委 員 會 明 瞭 家 庭 暴 力 是 一 個 涉 及 多 範 疇 的 問 題 , 需 要 所 有相 關 人 士 共 同 努 力 來 解 決 。 因 此 , 繼 續 加 強 在 不 同 層 次 的 跨 界 別 協 作和 聯 繫 以 打 擊 和 預 防 家 庭 暴 力 , 是 至 為 重 要 的 。 暴 力 只 是 連 串 問 題 的17

第 五 章商 業 罪 案引 言5.1 「 商 業 罪 案 」 並 非 單 一 及 有 法 律 定 義 的 罪 行 , 而 是 概 括 了欺 詐 、 商 業 行 騙 、 偽 造 帳 目 、 偽 造 工 具 、 科 技 罪 案 和 其 他 性 質 類 似 的罪 行 。5.2 下 文 概 述 二 零 零 五 年 錄 得 的 商 業 罪 案 全 年 數 字 , 並 作 出 比較 評 估 。商 業 及 集 團 訛 騙 案5.3 與 二 零 零 四 年 相 比 , 二 零 零 五 年 的 嚴 重 及 集 團 訛 騙 案 在 舉報 數 目 方 面 由 69 宗 下 降 至 62 宗 , 跌 幅 為 10.1%, 但 報 稱 涉 及 的 損 失金 額 由 港 幣 14.85 億 元 大 幅 上 升 至 港 幣 32.9 億 元 , 升 幅 為 121.5%。 年內 報 稱 損 失 總 金 額 的 49% ( 港 幣 16 億 元 ) 來 自 警 方 對 一 間 上 市 眼 鏡 製 造公 司 的 調 查 , 案 中 銀 行 被 騙 批 出 貸 款 為 虛 假 交 易 提 供 融 資 。 有 關 的 數字 如 下 :2004 2005 變 動 百 分 率舉 報 數 目 69 62 10.1%↓報 稱 損 失 總 金 額( 港 幣 億 元 計 )14.85 32.90 121.5%↑5.4 下 文 重 點 闡 述 五 類 對 社 會 造 成 重 大 影 響 的 商 業 及 集 團 訛 騙案 , 分 別 為 信 用 證 騙 案 、 層 壓 式 推 銷 騙 案 、 模 特 兒 公 司 騙 案 、 西 非 人騙 案 , 以 及 破 產 騙 案 。信 用 證 騙 案5.5 二 零 零 五 年 , 信 用 證 騙 案 的 舉 報 有 4 宗 , 即 較 二 零 零 四 年減 少 42.9%。 這 4 宗 舉 報 當 中 , 只 有 兩 宗 真 正 在 二 零 零 五 年 發 生 , 其餘 則 在 二 零 零 四 年 或 之 前 發 生 。5.6 與 二 零 零 四 年 相 比 , 報 稱 損 失 金 額 增 加 62.4%, 主 要 是 發 生於 一 九 九 六 年 其 中 一 案 的 損 失 已 達 港 幣 2.8 億 元 。 在 二 零 零 四 年 , 警方 高 調 向 原 訟 庭 就 一 宗 涉 及 港 幣 4 800 萬 元 的 虚 構 信 用 證 交 易 案 件 提出 檢 控 。 該 案 件 在 二 零 零 五 年 被 上 訴 庭 維 持 原 判 。 有 關 的 數 字 如 下 :19

5.10 舉 報 的 案 件 大 部 分 涉 及 受 害 人 在 自 願 情 況 下 簽 署 法 律 合約 , 且 被 慫 恿 預 付 款 項 , 以 確 保 得 到 模 特 兒 工 作 。 騙 徒 找 到 行 騙 對 象後 , 便 以 展 現 更 美 的 一 面 為 藉 口 , 要 求 他 們 到 指 定 的 美 容 院 參 加 面 部護 理 課 程 或 療 程 , 繼 而 安 排 他 們 接 下 一 些 數 百 元 報 酬 的 拍 照 工 作 , 但騙 徒 聲 稱 的 報 酬 只 佔 受 害 人 預 付 款 項 的 一 小 部 分 。 其 後 , 受 害 人 再 沒有 獲 得 答 允 會 被 提 供 聘 用 機 會 。 在 此 情 況 下 , 要 證 明 當 中 的 刑 事 成 分便 有 困 難 , 因 為 案 件 已 變 為 民 事 性 質 。5.11 警 方 以 跨 部 門 方 式 , 與 消 費 者 委 員 會 、 勞 工 處 和 香 港 電 台合 作 , 透 過 宣 傳 活 動 教 育 大 眾 認 識 騙 徒 在 模 特 兒 公 司 騙 案 中 常 用 的 技倆 。西 非 人 騙 案15.12 在 二 零 零 五 年 共 有 5 人 成 為 西 非 人 騙 案 的 受 害 人 。 因 受 害人 被 誘 騙 預 先 支 付 一 項 高 回 報 投 資 的 行 政 費 用 , 所 以 該 5 宗 案 件 最 後被 分 類 為 墊 支 騙 案 。 有 關 的 數 字 如 下 :2004 2005 變 動 百 分 率舉 報 數 目 4 5 25.0%↑報 稱 損 失 總 金 額( 港 幣 萬 元 計 )被 捕 人 數( 被 檢 控 人 數 )241 134 44.4%↓5(4) 4(3)20.0%↓(25.0%)收 到 的 行 騙 電 郵 數 目 3 899 3 339 14.4%↓收 到 的 行 騙 信 件 數 目 184 185 0.5%↑5.13 這 類 騙 案 的 舉 報 數 目 維 持 在 低 水 平 。 出 現 下 降 趨 勢 主 要 是由 於 大 眾 透 過 傳 媒 報 道 有 關 案 件 而 增 加 認 識 、 警 方 的 行 動 奏 效 , 以 及警 方 經 常 舉 行 宣 傳 教 育 活 動 。 在 二 零 零 五 年 三 月 及 四 月 傳 媒 廣 泛 報 導警 方 成 功 檢 控 兩 名 分 別 涉 及 「4-1-9」 騙 案 的 尼 日 利 亞 籍 男 子 , 並 分 別判 監 4 年 及 3 年 3 個 月 。 後 者 的 上 訴 申 請 在 二 零 零 五 年 十 二 月 被 駁 回 。1這 類 騙 案 最 初 主 要 為 西 非 人 所 犯 , 案 件 涉 及 典 型 的 ‘4-1-9’( 根 據 尼 日 利 亞 刑 事 法 典訂 明 的 相 應 罪 行 而 命 名 ) 電 郵 。 對 方 聲 稱 其 受 託 保 管 一 筆 未 有 遺 囑 的 巨 款 , 如 目 標 受 害人 預 先 支 付 手 續 費 , 並 將 手 續 費 存 入 設 於 香 港 的 銀 行 帳 戶 , 便 可 繼 承 若 干 的 巨 款 。 近年 漸 趨 明 顯 的 情 況 是 , 愈 來 愈 多 非 西 非 人 使 用 這 類 手 法 行 騙 。21

破 產 騙 案5.14 與 二 零 零 四 年 相 比 , 警 方 在 二 零 零 五 年 接 報 的 破 產 騙 案 宗數 大 幅 減 少 59.6%。 同 時 , 損 失 總 金 額 亦 下 跌 95.4%。5.15 二 零 零 五 年 , 警 方 檢 控 一 宗 與 這 類 詐 騙 有 關 的 案 件 , 但 被告 最 終 獲 無 罪 釋 放 。 警 方 相 信 , 破 產 騙 案 大 幅 下 跌 有 多 種 原 因 , 包 括經 濟 持 續 改 善 、 警 方 嚴 厲 執 法 、 財 務 機 構 與 銀 行 之 間 因 互 通 正 面 信 貸資 料 而 受 惠 , 以 及 政 府 多 個 部 門 統 籌 以 宣 傳 為 本 的 策 略 。 這 些 因 素 相結 合 , 破 產 騙 案 得 以 出 現 這 個 令 人 至 感 欣 慰 的 轉 變 。 有 關 的 數 字 如 下 :2004 2005 變 動 百 分 率舉 報 數 目 109 44 59.6%↓報 稱 損 失 總 金 額( 港 幣 萬 元 計 )3,480 158 95.4%↓破 產 數 目 11 516 9 213 20.0%↓其 他 種 類 的 騙 案求 職 騙 案5.16 這 類 騙 案 以 求 職 者 為 對 象 。 騙 徒 開 設 空 殼 貿 易 公 司 , 以 僱 用受 害 人 為 名 , 誘 騙 他 們 投 資 於 貨 品 買 賣 , 聲 稱 可 以 帶 來 厚 利 。 騙 徒 其後 卻 訛 稱 受 害 人 投 資 失 利 , 並 反 指 他 們 令 公 司 業 務 受 損 。 因 此 , 大 部分 受 害 人 沒 有 向 警 方 舉 報 。5.17 警 方 現 正 調 查 7 宗 涉 及 15 間 公 司 的 求 職 騙 案 。 自 二 零 零 三年 起 警 方 採 取 了 多 次 行 動 搜 查 該 15 間 公 司 , 拘 捕 96 人 。 其 後 該 等 公司 全 部 倒 閉 。 警 方 亦 監 視 11 宗 非 集 團 性 的 懷 疑 求 職 騙 案 , 涉 及 金 額 港幣 63,011 元 及 12 名 受 害 人 , 所 有 受 害 人 均 受 報 章 廣 告 所 騙 。 由 於 警方 採 取 執 法 行 動 和 成 功 推 行 有 效 的 宣 傳 活 動 , 類 似 的 集 團 式 求 職 騙 案已 漸 被 遏 止 。保 險 騙 案5.18 與 二 零 零 四 年 相 比 , 二 零 零 五 年 的 保 險 相 關 騙 案 在 舉 報 數目 方 面 由 68 宗 下 降 至 42 宗 , 跌 幅 達 38.2%。 報 稱 涉 及 的 損 失 金 額 由二 零 零 四 年 的 港 幣 6,015 萬 元 大 幅 下 降 至 二 零 零 五 年 的 港 幣 1,970 萬元 。 有 關 統 計 數 字 下 降 , 顯 示 這 類 案 件 並 不 普 遍 , 並 且 已 受 到 控 制 。有 關 的 數 字 如 下 :22

5.24 在 二 零 零 五 年 偵 破 的 30 宗 案 件 中 ,93.0% 的 被 捕 人 士 為 內地 旅 客 (57 名 被 捕 人 士 中 有 53 人 為 內 地 旅 客 ), 當 中 又 以 來 自 海 南 和湖 南 省 者 居 多 。 他 們 往 往 利 用 “ 祈 福 ” 和 “ 跌 錢 ” 的 手 法 行 騙 。5.25 商 業 罪 案 調 查 科 透 過 「 勾 蟲 」 行 動 , 協 調 整 個 警 隊 採 取 行 動 ,以 打 擊 街 頭 行 騙 罪 行 。 二 零 零 五 年 , 警 方 透 過 防 止 罪 案 科 和 各 總 區 的防 止 罪 案 辦 公 室 , 展 開 超 過 800 項 以 長 者 為 對 象 的 宣 傳 活 動 。 透 過 警方 與 香 港 銀 行 公 會 的 安 排 , 銀 行 分 行 一 旦 發 現 懷 疑 行 騙 案 ( 二 零 零 五年 有 25 宗 ), 便 會 直 接 通 知 有 關 警 區 的 應 變 小 隊 , 結 果 , 雙 方 在 年 內先 後 9 次 成 功 阻 止 騙 案 發 生 , 避 免 了 港 幣 981,000 元 的 損 失 。5.26 警 方 根 據 香 港 法 例 第 455 章 《 有 組 織 及 嚴 重 罪 行 條 例 》 向 法院 申 請 加 重 判 刑 , 依 然 是 遏 止 這 類 罪 行 增 長 的 有 效 措 施 之 一 。 二 零 零五 年 , 警 方 曾 7 次 成 功 向 主 審 法 庭 申 請 加 重 判 刑 , 刑 期 平 均 延 長 25%至 50%, 即 多 判 監 12 個 月 。網 上 銀 行 盜 竊5.27 二 零 零 五 年 , 警 方 只 接 獲 3 宗 與 網 上 銀 行 有 關 的 舉 報 , 涉及 兩 間 主 要 本 地 銀 行 , 涉 及 損 失 總 金 額 為 港 幣 178,893 元 。 年 內 最 後接 到 的 舉 報 是 在 二 零 零 五 年 四 月 。5.28 二 零 零 五 年 五 月 三 十 日 , 香 港 金 融 管 理 局 、 香 港 銀 行 公 會及 香 港 警 方 聯 合 宣 布 就 網 上 銀 行 交 易 推 出 「 雙 重 認 證 」 措 施 。 自 該 措施 實 行 以 來 , 未 有 再 接 到 與 網 上 銀 行 盜 竊 有 關 之 舉 報 。 商 業 罪 案 調 查科 將 繼 續 透 過 電 子 銀 行 工 作 小 組 和 電 子 財 務 及 銀 行 事 故 應 變 策 略 專 責小 組 (e-FIRST) 2 , 與 香 港 金 融 管 理 局 、 銀 行 業 界 和 香 港 銀 行 公 會 保 持 緊密 合 作 。兒 童 色 情 物 品 罪 行5.29 干 犯 兒 童 色 情 物 品 罪 行 很 多 時 都 涉 及 電 腦 科 技 的 應 用 。 隨 著《 防 止 兒 童 色 情 物 品 條 例 》 於 二 零 零 三 年 十 二 月 十 九 日 正 式 生 效 , 警方 開 始 致 力 打 擊 這 類 科 技 罪 行 。5.30 自 二 零 零 四 年 三 月 起 , 商 業 罪 案 調 查 科 展 開 一 項 代 號 「 乘 風 」的 行 動 。 在 行 動 中 共 拘 捕 24 名 男 子 , 並 檢 獲 大 量 數 碼 形 式 的 兒 童 色 情物 品 。 最 後 ,16 名 男 子 以 「 管 有 兒 童 色 情 物 品 」 罪 名 被 檢 控 , 其 中 14名 被 告 人 已 被 定 罪 , 及 被 判 處 罰 款 、 社 會 服 務 令 或 即 時 入 獄 。2電 子 財 務 及 銀 行 事 故 應 變 策 略 (e-FIRST) 是 於 二 零 零 四 年 十 月 成 立 的 專 責 小組 , 作 為 銀 行 業 界 、 香 港 金 融 管 理 局 和 商 業 罪 案 調 查 科 有 關 網 上 銀 行 罪 行 的 舉報 及 交 換 情 報 之 聯 絡 渠 道 。24

5.31 二 零 零 五 年 , 警 方 共 接 獲 6 宗 涉 及 兒 童 色 情 物 品 的 案 件 。 其中 3 宗 案 件 已 被 偵 破 , 共 拘 捕 3 人 。 由 於 本 地 拘 捕 數 字 偏 低 以 及 海 外亦 很 少 發 現 香 港 人 參 與 類 似 罪 案 , 故 此 並 無 證 據 顯 示 兒 童 色 情 物 品 的罪 行 在 香 港 構 成 嚴 重 問 題 。假 貨 幣5.32 與 二 零 零 四 年 相 比 , 二 零 零 五 年 在 本 港 撿 獲 的 港 幣 偽 鈔 數目 減 少 了 54.9%。 其 中 以 港 幣 500 元 偽 鈔 撿 獲 量 的 上 升 最 值 得 注 意 ,數 目 由 二 零 零 四 年 的 4 473 張 增 至 二 零 零 五 年 的 5 060 張 。 被 撿 獲 的 所有 港 幣 500 元 偽 鈔 中 , 有 547 張 (10.8%) 是 在 警 方 行 動 中 被 發 現 。5.33 分 析 顯 示 在 二 零 零 五 年 撿 獲 的 547 張 港 幣 500 元 偽 鈔 中 ,其 中 535(97.8%) 張 是 由 鐳 射 打 印 機 印 製 。 此 種 偽 鈔 在 二 零 零 四 年 十 一月 首 次 被 發 現 , 現 時 是 警 方 的 重 點 打 擊 目 標 。 根 據 警 方 調 查 及 情 報 顯示 , 內 地 人 士 和 南 亞 少 數 族 裔 人 士 在 分 銷 及 行 使 港 幣 500 元 偽 鈔 方 面擔 當 重 要 角 色 。5.34 二 零 零 五 年 , 於 本 港 撿 獲 的 假 香 港 10 元 硬 幣 數 目 由 二 零 零四 年 的 281 384 枚 減 至 147 169 枚 , 減 少 了 47.7%。 期 內 , 雖 然 5 元 假硬 幣 撿 獲 量 對 比 二 零 零 四 年 大 幅 增 加 了 580%, 由 2 731 枚 增 至 18 574枚 , 但 是 佔 整 體 的 流 通 量 仍 屬 少 數 。 而 差 不 多 所 有 的 5 元 假 硬 幣 都 是由 公 共 交 通 機 構 發 現 。 情 報 指 出 10 元 假 硬 幣 製 造 集 團 已 轉 趨 製 造 5 元假 硬 幣 , 而 相 信 內 地 是 假 硬 幣 的 來 源 地 之 一 。5.35 假 人 民 幣 方 面 , 二 零 零 五 年 內 的 撿 獲 量 有 輕 微 下 降 , 原 因相 信 是 公 眾 的 警 覺 意 識 有 所 加 強 , 以 及 電 子 繳 費 方 式 在 人 民 幣 市 場 愈趨 普 及 所 致 。5.36 有 關 的 數 字 如 下 :2004 2005 變 動 百 分 率假 香 港 鈔 票 撿 獲 量 21 518 9 694 54.9%↓假 港 幣 10 元 硬 幣 撿 獲 量 281 384 147 169 47.7%↓假 港 幣 5 元 硬 幣 撿 獲 量 2 731 18 574 579.1%↑假 人 民 幣 撿 獲 量 5 315 5 101 4.0%↓25

第 六 章二 零 零 五 至 零 六 年 度 助 更 生 宣 傳 運 動背 景6.1 更 生 人 士 能 否 重 新 融 入 社 會 , 成 為 奉 公 守 法 的 市 民 , 繫 於社 會 大 眾 的 接 納 與 支 持 。 為 此 , 懲 教 署 自 一 九 九 九 年 以 來 舉 辦 了 多 項宣 傳 活 動 , 讓 社 會 人 士 加 深 了 解 更 生 人 士 的 需 要 及 通 常 面 對 的 困 難 ,以 及 呼 籲 市 民 大 眾 給 予 支 持 。6.2 為 助 更 生 而 舉 辦 的 宣 傳 活 動 主 要 包 括 三 輯 電 視 實 況 劇 “ 鐵窗 邊 緣 ”、 電 台 宣 傳 聲 帶 和 電 視 宣 傳 短 片 、 更 生 人 士 就 業 研 討 會 、 電視 特 備 節 目 、 在 囚 人 士 文 娛 康 樂 才 藝 比 賽 、 綜 合 表 演 , 以 及 與 各 分 區撲 滅 罪 行 委 員 會 ( 分 區 滅 罪 會 ) 合 辦 的 社 區 參 與 活 動 。宣 傳 活 動 成 效 調 查6.3 懲 教 署 在 二 零 零 二 年 年 中 及 二 零 零 四 年 年 底 先 後 進 行 了 兩次 意 見 調 查 , 以 評 估 在 市 民 眼 中 該 署 舉 辦 的 宣 傳 活 動 的 成 效 。 調 查 結果 顯 示 :(a) 在 二 零 零 四 年 ,59.5% 的 受 訪 市 民 同 意 之 前 的 12 個 月 有 一項 或 以 上 的 宣 傳 活 動 能 加 深 他 們 對 更 生 人 士 的 了 解 。 在 二零 零 二 年 的 調 查 , 平 均 有 43% 的 受 訪 者 認 為 這 些 宣 傳 活 動有 助 他 們 了 解 在 囚 人 士 / 釋 囚 的 情 況 及 有 關 支 持 這 些 人 士重 新 融 入 社 會 的 訊 息 ; 以 及(b) 在 二 零 零 四 年 ,91.9% 的 受 訪 市 民 認 為 政 府 值 得 繼 續 舉 辦宣 傳 活 動 呼 籲 大 眾 支 持 更 生 人 士 。 在 二 零 零 二 年 的 調 查 ,持 相 同 意 見 的 受 訪 者 有 83.6%。6.4 考 慮 到 這 些 調 查 結 果 , 特 別 是 公 眾 對 宣 傳 活 動 的 認 同 , 懲教 署 認 為 有 強 烈 和 充 分 理 由 繼 續 舉 辦 助 更 生 宣 傳 運 動 , 以 期 爭 取 更 多市 民 支 持 和 擴 大 社 區 網 絡 , 推 動 市 民 參 與 有 關 工 作 。二 零 零 五 至 零 六 年 度 宣 傳 運 動6.5 自 一 九 九 九 至 二 零 零 零 年 度 起 , 懲 教 署 每 年 都 有 系 統 地 規3劃 和 推 展 合 適 的 公 眾 活 動 。 該 署 根 據 社 區 參 與 助 更 生 委 員 會 的 意 見 、3社 區 參 與 助 更 生 委 員 會 成 員 來 自 社 會 各 界 , 就 更 生 計 劃 及 協 助 更 生 人 士 重 新 融入 社 會 的 策 略 向 懲 教 署 署 長 提 供 意 見 。27

第 七 章警 司 警 誡 計 劃 的 進 展背 景7.1 根 據 警 司 警 誡 計 劃 , 警 司 或 以 上 職 級 的 警 務 人 員 可 以 酌 情警 誡 青 少 年 罪 犯 , 代 替 提 出 刑 事 檢 控 。 自 一 九 九 五 年 九 月 一 日 起 , 合資 格 接 受 警 誡 的 青 少 年 罪 犯 的 年 齡 上 限 由 未 滿 17 歲 提 高 至 未 滿 18歲 , 使 更 多 青 少 年 罪 犯 可 以 得 到 接 受 警 誡 的 機 會 。 撲 滅 罪 行 委 員 會 ( 委員 會 ) 透 過 警 務 處 處 長 每 半 年 提 交 的 進 度 報 告 , 監 察 這 項 計 劃 的 進 展 。整 體 情 況7.2 二 零 零 五 年 , 因 觸 犯 各 種 刑 事 罪 行 而 被 捕 的 青 少 年 ( 在 本 報告 內 , 青 少 年 指 未 滿 18 歲 的 人 士 ) 共 有 6 821 人 , 較 二 零 零 三 年4 (7 918人 ) 及 二 零 零 四 年 (7 566 人 ) 分 別 減 少 13.9% 及 9.8%。 年 內 青 少 年 罪 犯最 常 觸 犯 的 五 種 刑 事 罪 行 是 店 舖 盜 竊 、 雜 項 盜 竊 、 傷 人 及 嚴 重 毆 打 、搶 劫 , 以 及 非 法 會 社 罪 行 ( 見 附 錄 XV 圖 表 ) 。7.3 並 非 所 有 被 捕 的 青 少 年 均 可 接 受 警 誡 。 二 零 零 五 年 , 被 捕的 青 少 年 中 只 有 55.6% 合 資 格 接 受 警 誡 , 二 零 零 三 年 及 二 零 零 四 年 則分 別 有 50.4% 及 51.9%。 在 評 核 青 少 年 罪 犯 是 否 合 資 格 接 受 警 誡 時 , 仍沿 用 以 下 指 引 -(a) 罪 犯 在 接 受 警 誡 時 必 須 未 滿 18 歲 ;(b) 罪 犯 以 往 並 無 刑 事 犯 罪 紀 錄 ;(c) 所 掌 握 的 證 據 足 以 提 出 起 訴 ;(d) 罪 犯 自 願 而 明 確 地 承 認 控 罪 ; 以 及(e) 罪 犯 及 其 家 長 或 監 護 人 同 意 罪 犯 接 受 警 誡 。7.4 二 零 零 五 年 , 共 有 3 026 名 青 少 年 罪 犯 接 受 警 誡 , 較 二 零 零三 年 (3 012 人 ) 及 二 零 零 四 年 (2 929 人 ) 分 別 增 加 0.5% 和 3.3%。 年 內 接受 警 誡 的 人 數 佔 被 捕 青 少 年 罪 犯 的 44.4%, 二 零 零 三 年 及 二 零 零 四 年則 分 別 佔 38.0% 及 38.7%。 二 零 零 三 至 二 零 零 五 年 期 間 接 受 警 誡 的 青 少年 罪 犯 人 數 比 較 如 下 -4由 二 零 零 三 年 七 月 一 日 起 , 刑 事 責 任 的 最 低 年 齡 由 七 歲 提 高 至 十 歲 。31

7.9 保 護 組 與 社 會 福 利 署 和 教 育 統 籌 局 經 常 保 持 聯 繫 , 並 就 青少 年 的 家 庭 問 題 徵 詢 該 兩 個 部 門 / 局 的 意 見 。 保 護 組 也 會 視 乎 情 況 ,轉 介 受 監 管 的 青 少 年 參 加 社 區 支 援 服 務 計 劃 、 少 年 警 訊 、 香 港 青 年 獎勵 計 劃 或 其 他 機 構 接 受 跟 進 服 務 。7.10 自 一 九 九 七 年 年 中 以 來 , 經 警 方 轉 介 參 加 社 區 支 援 服 務 計劃 的 青 少 年 , 人 數 不 斷 上 升 。 警 方 有 時 會 安 排 青 少 年 參 與 計 劃 而 毋 須接 受 保 護 組 監 管 , 有 時 則 會 安 排 青 少 年 同 時 接 受 監 管 及 參 與 計 劃 。 社區 支 援 服 務 計 劃 的 目 的 , 是 引 導 曾 犯 法 的 青 少 年 走 上 正 途 , 過 循 規 蹈矩 的 生 活 。 計 劃 內 容 包 括 :再 次 犯 案(a) 輔 導 或 支 援 小 組 ;(b) 職 業 訓 練 和 就 業 輔 導 ;(c) 技 巧 學 習 班 ;(d) 野 外 探 險 活 動 ;(e) 志 願 及 社 區 服 務 計 劃 ; 以 及(f) 為 家 長 或 監 護 人 舉 辦 的 活 動 。7.11 罪 犯 如 在 接 受 警 誡 之 日 起 計 兩 年 內 或 在 年 滿 18 歲 之 前 ( 兩者 以 較 早 者 為 準 ) 因 犯 罪 而 再 次 被 捕 , 即 被 視 為 再 次 犯 案 。 二 零 零 三 年接 受 警 誡 的 青 少 年 再 次 犯 案 的 比 率 是 19.6%, 而 二 零 零 一 年 及 二 零 零二 年 的 比 率 分 別 是 18.9% 及 17.7%。 鑑 於 計 算 期 為 兩 年 , 故 暫 時 未 有 二零 零 四 年 及 以 後 的 數 字 。未 來 路 向7.12 委 員 會 會 繼 續 透 過 警 務 處 處 長 每 半 年 提 交 的 進 度 報 告 , 監察 警 司 警 誡 計 劃 的 進 展 , 並 會 就 報 告 內 容 提 問 , 以 便 當 局 採 取 適 當 的跟 進 行 動 。*****33

第 八 章撲 滅 罪 行 宣 傳 策 略背 景8.1 宣 傳 小 組 委 員 會 ( 小 組 委 員 會 ) 為 每 年 初 夏 展 開 的 撲 滅 罪行 宣 傳 運 動 制 定 策 略 。 宣 傳 運 動 通 常 設 有 一 至 數 個 主 題 , 針 對 常 見 的罪 案 及 / 或 公 眾 關 注 的 問 題 。 有 關 策 略 獲 得 撲 滅 罪 行 委 員 會 通 過 後 ,即 由 小 組 委 員 會 負 責 推 行 。二 零 零 四 至 零 五 年 度 宣 傳 運 動 檢 討8.2 二 零 零 四 至 零 五 年 度 撲 滅 罪 行 宣 傳 運 動 是 重 點 宣 傳 項 目 ,獲 撥 經 費 一 百 六 十 萬 港 元 。8.3 委 員 會 採 納 以 「 協 助 警 方 撲 滅 罪 行 」 為 主 題 , 提 醒 市 民 他們 在 打 撃 罪 行 方 面 扮 演 十 分 重 要 的 角 色 。 市 民 所 給 予 警 方 的 支 持 和 合作 , 簡 單 如 打 電 話 向 警 方 提 供 資 料 , 有 助 防 止 及 偵 破 罪 案 。8.4 宣 傳 運 動 第 一 期 在 二 零 零 四 年 六 月 開 展 。 透 過 一 系 列 宣 傳活 動 , 提 醒 市 民 要 保 持 警 覺 , 提 防 罪 案 , 並 且 善 用 自 己 的 裝 備 - 就是 眼 、 耳 、 口 和 手 , 向 警 方 舉 報 罪 案 , 合 力 打 撃 罪 惡 。8.5 第 二 期 的 宣 傳 運 動 則 在 二 零 零 四 年 十 二 月 推 出 , 沿 用 第 一期 宣 傳 運 動 的 主 題 , 提 醒 市 民 利 用 本 身 的 裝 備 , 令 罪 案 曝 光 。8.6 整 個 宣 傳 運 動 共 製 作 了 兩 套 電 視 宣 傳 短 片 , 以 及 兩 套 電 台宣 傳 聲 帶 、 海 報 、 巴 士 車 身 廣 告 及 其 他 戶 外 電 子 媒 體 廣 告 。 兩 套 電 視宣 傳 短 片 更 上 載 至 香 港 特 別 行 政 區 政 府 網 頁 - 政 府 資 訊 中 心 。二 零 零 五 至 零 六 年 度 宣 傳 運 動 策 略8.7 二 零 零 五 至 零 六 年 度 撲 滅 罪 行 宣 傳 運 動 繼 續 備 受 重 視 , 獲撥 經 費 一 百 六 十 萬 港 元 。8.8 二 零 零 四 年 的 總 體 罪 案 數 字 為 81 315 宗 , 較 二 零 零 三 年88 373 宗 下 跌 8.0%, 然 而 打 荷 包 及 雜 項 盜 竊 仍 較 其 他 罪 案 數 目 為 高 ,分 別 為 1 623 及 19 409 宗 。8.9 有 見 及 此 , 委 員 會 採 納 以 「 小 心 個 人 財 物 」 為 主 題 , 繼 續提 醒 市 民 他 們 要 善 用 自 己 的 裝 備 - 眼 、 耳 、 口 和 手 , 保 護 個 人 財 物 ,並 且 強 調 扒 手 及 竊 匪 並 不 容 易 辨 識 。8.10 宣 傳 運 動 在 二 零 零 五 年 六 月 開 展 , 其 中 包 括 製 作 了 一 套 電視 宣 傳 短 片 , 以 及 電 台 宣 傳 聲 帶 , 在 電 視 台 及 電 台 播 放 。 該 套 電 視 宣34

傳 短 片 更 分 別 上 載 至 香 港 特 別 行 政 區 政 府 及 香 港 警 務 處 的 網 頁 , 以 及在 其 他 戶 外 電 子 媒 體 上 播 放 。8.11 整 個 運 動 並 且 製 作 了 三 張 載 有 相 關 宣 傳 信 息 的 海 報 、 巴 士車 身 廣 告 及 八 達 通 卡 套 。8.12 在 地 區 層 面 上 , 各 分 區 撲 滅 罪 行 委 員 會 、 少 年 警 訊 以 及 警方 亦 在 年 內 繼 續 緊 密 合 作 , 舉 辦 各 種 配 合 宣 傳 運 動 主 題 的 活 動 , 將 有關 信 息 傳 遞 予 社 會 各 階 層 人 士 。*****35

第 九 章分 區 撲 滅 罪 行 委 員 會 的 工 作引 言9.1 分 區 撲 滅 罪 行 委 員 會 ( 分 區 滅 罪 會 ) 最 初 在 一 九 七 六 年 九 月成 立 , 主 要 目 的 是 透 過 籌 辦 地 區 活 動 , 加 深 市 民 對 撲 滅 罪 行 運 動 的 認識 。 其 後 , 分 區 滅 罪 會 發 展 為 撲 滅 罪 行 地 區 力 量 的 中 心 , 其 職 權 範 圍 [ 載於 附 錄 III(a)] 亦 擴 大 至 包 括 :(a)(b)(c)(d)監 察 區 內 罪 案 及 執 法 情 況 ;統 籌 區 內 滅 罪 活 動 ;促 進 區 內 警 民 關 係 ; 以 及就 一 般 治 安 問 題 向 撲 滅 罪 行 委 員 會 ( 委 員 會 ) 提 供 意見 。9.2 18 個 分 區 滅 罪 會 是 根 據 區 議 會 的 地 區 分 界 劃 分 的 。 分 區 滅罪 會 獨 立 於 區 議 會 , 但 兩 者 的 成 員 和 經 費 安 排 均 有 密 切 關 連 。成 員9.3 各 分 區 滅 罪 會 平 均 有 34 名 成 員 , 主 席 由 地 區 領 袖 擔 任 , 成員 大 多 數 是 來 自 地 區 各 界 的 非 官 方 委 員 , 和 少 數 區 內 主 要 政 府 部 門 代表 。 在 二 零 零 五 至 零 六 年 度 ,18 個 分 區 滅 罪 會 共 有 525 名 非 官 方 委 員 ,當 中 許 多 是 區 議 員 。18 個 分 區 滅 罪 會 的 成 員 名 單 載 於 附 錄 III(b)。監 察 區 內 罪 案 情 況9.4 分 區 滅 罪 會 每 兩 至 三 個 月 舉 行 會 議 一 次 , 治 安 問 題 是 每 次會 議 的 常 設 議 程 。 他 們 經 常 檢 討 區 內 罪 案 情 況 和 罪 案 統 計 數 字 的 明 顯趨 勢 。 會 議 為 區 內 人 士 提 供 討 論 該 區 罪 案 問 題 的 機 會 。9.5 由 於 各 區 的 地 理 、 人 口 和 發 展 有 異 , 區 內 的 罪 案 特 徵 亦 各不 相 同 。 在 報 告 期 內 , 分 區 滅 罪 會 關 注 的 罪 行 包 括 :• 搶 劫 、 爆 竊 和 樓 宇 保 安 問 題 ;• 青 少 年 罪 案 和 濫 用 藥 物 問 題 ;• 黑 社 會 和 色 情 活 動 ; 及• 揾 快 錢 罪 案 如 店 舖 盜 竊 和 街 頭 騙 案 。36

CHAPTER 1INTRODUCTIONBACKGROUND1.1 In March 1973, the Government set up the Fight Violent CrimeCommittee to tackle the problem of the rising trend of crime since the early1970s. The Committee was chaired by the then Secretary for Home Affairsand comprised only official members. Its terms of reference were to plan,organise and co-ordinate Government and public efforts to assist the Police tocombat violent crime. In 1975, the Fight Violent Crime Committee wasrenamed the Fight Crime Committee (FCC) with its membership expanded toinclude non-official members.1.2 In May 1983, the FCC was reconstituted with the then ChiefSecretary as its new Chairman. It was tasked to draw up plans to reduce crime,to co-ordinate efforts in fighting crime, to monitor the results and to reportprogress to the then Governor. The reconstituted Committee submitted its firstreport to the then Governor in December 1983.1.3 This is the twenty-fifth report of the Committee, and it details thework undertaken by the Committee for the calendar year 2005.FIGHT CRIME COMMITTEE AND ITS SUB-COMMITTEES1.4 The FCC consists of 16 members: eight are members of the publicappointed by the Chief Secretary for Administration and eight are heads ofrelevant government policy bureaux and departments. The Committee’s termsof reference and membership list are at Appendices I(a) & I(b). There are twosub-committees under the FCC -• Standing Committee on Young Offenders• Publicity Sub-CommitteeDetails of terms of reference and the membership lists of the sub-committees areat Appendices II(a) & II(b).MAJOR ISSUES CONSIDERED1.5 In 2005, the FCC held a total of five meetings. Apart fromexamining the overall crime situation as well as that of commercial crimes,87

monitoring progress of the Police Superintendents’ Discretion Scheme,implementing the fight crime publicity work and overseeing the work of DistrictFight Crime Committees (DFCCs), the Committee revisited the strategies on thewar against drugs and money laundering. The Committee also discussed thestrategies and measures to prevent and tackle crimes related to domesticviolence.DISTRICT FIGHT CRIME COMMITTEES1.6 DFCCs are established in the 18 districts of the territory. Thesecommittees, which comprise official and non-official members, play animportant part in promoting the fight against crime and in encouraging publicparticipation at district level. They have cross-membership with DistrictCouncils and are the only committees that are directly concerned with law andorder issues in each of the districts. The terms of reference and membershiplists of the DFCCs are at Appendices III(a) & III(b). The report on the workof DFCCs is in Chapter 9.*****88

GENERAL CRIME SITUATIONCHAPTER 2CRIME SITUATION IN 20052.1 There were 77 437 crimes reported to the Police in 2005, a decreaseof 4.8% compared with 81 315 recorded in 2004. The crime rate, which isdefined as the number of reported crimes per 100 000 population, was 1 116.5, adrop of 5.5% compared with 1 181.5 in 2004. The overall crime detection ratein 2005 was 44.3%, compared with 43.6% in 2004.2.2 A chart showing the figures of reported cases, crime rates anddetection rates of overall crime from 1996 to 2005 is at Appendix IV.VIOLENT CRIME2.3 The total number of violent crimes (which include homicide, rape,indecent assault, wounding, serious assault, robbery, kidnapping, blackmail,criminal intimidation, and arson) recorded in 2005 was 13 890, the same figureas in 2004. There were decreases in robbery and blackmail but increases inserious assault and criminal intimidation. The violent crime rate per 100 000population was 200.3, a drop of 0.7% compared with 201.8 in 2004. Theviolent crime detection rate in 2005 was 59.5%, compared with 57.4% in 2004.2.4 A chart showing the figures of reported cases, crime rates anddetection rates of violent crime from 1996 to 2005 is at Appendix V.ANALYSES OF SELECTED CRIMESRobbery2.5 There were 1 675 robberies recorded in 2005, a drop of 25.1%compared with 2 237 in 2004 (see chart at Appendix VI).2.6 There were 3 robberies involving the use of genuine firearms in2005, the same figure as in 2004. There were 5 cases of robbery with stunguns and 28 cases of robbery with pistol-like objects, compared with 7 and 47 in2004 respectively (see chart at Appendix VII).89

2.7 The number of bank robbery cases was 15 in 2005, compared with16 in 2004. There were 7 cases of goldsmith/watch shop robbery in 2005,compared with 6 cases in 2004. The statistics on bank and goldsmith/watchshop robberies from 1996 to 2005 are at Appendix VIII.Burglary2.8 There were 5 492 burglaries in 2005, a drop of 21.6% comparedwith 7 002 in 2004 (see chart at Appendix IX).Homicide2.9 There were 34 homicide cases in 2005, compared with 45 in 2004(see chart at Appendix X). Among these 34 cases in 2005, 9 cases (26.5%)were domestic in nature. The figure was 20 (44.4%) in 2004. There were 2cases in which 2 children aged 12 or below were killed by their parents in 2005,compared with 9 in 2004.Wounding and Serious Assault2.10 The number of wounding and serious assault cases rose by 4.9%from 7 161 in 2004 to 7 509 in 2005 (see chart at Appendix XI). Some 7.7%of the wounding and serious assault cases in 2005 were triad related, comparedwith 8.8% in 2004.Serious Narcotics Offences2.11 There were 1 780 serious narcotics offences (e.g. trafficking in,manufacturing, and possession of dangerous drugs) recorded in 2005, a decreaseof 17.9% compared with 2 167 in 2004. Altogether 2 224 persons werearrested for serious narcotics offences in 2005, a decrease of 18.0% comparedwith 2 712 in 2004. The arrest of juveniles and young persons aged under 21years old dropped by 43.5% from 499 persons in 2004 to 282 persons in 2005.Among these juveniles and young persons, 254 persons (90.1%) were arrested inconnection with psychotropic drugs.Shop Theft2.12 The number of shop thefts reported to the Police was 8 750, adecrease of 4.7% compared with 9 186 in 2004 (see chart at Appendix XII).The value of the stolen property was HK$ 200 or below in 7 169 cases (81.9%).90

Motor Vehicles Reported Missing2.13 There were 1 592 motor vehicles reported missing in 2005, adecrease of 8.5% compared with 1 740 in 2004 (see chart at Appendix XIII).2.14 The number of cases involving luxury cars (Mercedes Benz,B.M.W., Toyota Crown and Lexus) dropped to 26, a decrease of 56.7%compared with 60 in 2004. The number of reports involving multi-purposevehicles increased from 156 in 2004 to 162 in 2005, up by 3.8%. The numberof reports involving high performance vehicles decreased from 43 in 2004 to 30in 2005, down by 30.2%. The stealing of container tractors rose to 73compared with 47 in 2004, an increase of 55.3%.2.15 The overall recovery rate of missing motor vehicles in 2005 was46.2%, compared with 48.0% in 2004.Street Deception2.16 There were 393 street deception cases in 2005, a drop of 18.0%compared with 479 in 2004. “Spiritual Treatment” and “BorrowMoney/Mobile Phones” represented the most prevalent types of such crime,accounting for 45.5% (179 cases) and 25.2% (99 cases) of all street deceptioncases in 2005.Triad Related Crimes2.17 The proportion of crimes attributable to triad activities was 3.0%(2 304 cases) in 2005 and 2.9% (2 346 cases) in 2004. In 2005, most of thesecrimes were related to offences such as unlawful society offences (794 cases or34.5%), wounding and serious assault (579 cases or 25.1%), and blackmail (231cases or 10.0%).Domestic Violence2.18 There were altogether 2 628 domestic violence cases handled bythe Police in 2005, a rise of 14.8% compared with 2 289 in 2004. Among these2 628 cases in 2005, there were 1 274 (48.5%) crime cases (such as woundingand serious assault, criminal intimidation, and criminal damage) and 1 354(51.5%) miscellaneous cases (such as disputes and requests for policeassistance/investigation). The figures were 903 (39.4%) for crime cases and1 386 (60.6%) for miscellaneous cases in 2004.91

JUVENILES AND YOUNG PERSONS ARRESTED FOR CRIME2.19 The number of juveniles (aged under 16) arrested for crime in 2005was 4 531, a drop of 7.5% compared with 4 897 persons in 2004. Most ofthem were arrested for shop theft (1 367 persons or 30.2%), miscellaneous thefts(991 persons or 21.9%), and wounding and serious assault (660 persons or14.6%).2.20 The number of young persons (aged between 16 and 20) arrestedfor crime in 2005 was 4 780, a drop of 17.8% compared with 5 812 persons in2004. Most of them were arrested for miscellaneous thefts (835 persons or17.5%), wounding and serious assault (826 persons or 17.3%), and shop theft(491 persons or 10.3%).2.21 A chart showing the arrests of juveniles and young persons forcrime from 1996 to 2005 is at Appendix XIV.*****92

CHAPTER 3RESHAPING AND REFINING HONG KONG’S STRATEGIESON THE WAR AGAINST DRUGS AND MONEY LAUNDERINGBACKGROUND3.1 In view of the changing drug scene, and the growing prevalence ofpsychotropic substance abuse, an International Conference on Tackling DrugAbuse was hosted by Narcotics Division, Security Bureau and ActionCommittee Against Narcotics in February 2005. The purpose of hosting theforum was to exchange information and experience on the latest trends andshare best practices on anti-drug efforts with overseas jurisdictions andMainland counterparts.3.2 The issues of money laundering and terrorist financing havebecome global concerns and the international community has tackled theproblems through setting global standards and monitoring the implementationof such standards. Hong Kong, being an international financial centre, has theneed to update its standards so that they are in step with the best practices. Itis also necessary to exchange experiences with overseas jurisdictions so as tochart our way forward. With this purpose in mind, Narcotics Division andAction Committee Against Narcotics jointly organised an internationalconference entitled “Creating Global Partnership and Synergy in the FightAgainst Money Laundering” in February 2005.RESHAPING AND REFINING HONG KONG’S ANTI-DRUG POLICYAND STRATEGY3.3 Having regard to the information gathered at the conference andpursuant upon discussion at a meeting of the Action Committee AgainstNarcotics, it is concluded that while the five-pronged approach on tackling drugabuse (namely legislation and law enforcement; preventive education andpublicity; treatment and rehabilitation; research; and external cooperation)adopted by the government has served Hong Kong well, the following areasshould be accorded priority in tackling the problem of drug abuse -(a)(b)Directing more resources at high risk groups such asnon-engaged youth, ethnic minority, youth from deprivedbackground, etc.;Adopting a holistic approach to treat and rehabilitate drugabusers;93

(c)(d)Enhancing and strengthening the training of anti-drugworkers so as to raise their professional standards;Engaging stakeholders such as parents, teachers, socialworkers, judiciary and other government departments in theeducation and rehabilitation process;(e) Introducing objective measurements to measure theeffectiveness of educational, publicity andtreatment/rehabilitation programmes;(f)(g)Enhancing international and regional cooperation, especiallyin law enforcement; andStepping up research into specific areas to gather scientificevidence for policy formulation and resource allocation.UPDATING HONG KONG’S ANTI-MONEY LAUNDERING REGIME3.4 Hong Kong has attached great importance to fighting moneylaundering and is a member of the Financial Action Task Force on MoneyLaundering (FATF) and the Asia/Pacific Group on Money Laundering (APG).The former, in particular, is the standard setter of international standards inanti-money laundering. As a result of the terrorist attacks in the United Statesin 2001, the Task Force further introduced special recommendations oncountering of terrorist financing. The 40 recommendations (targeting moneylaundering) and 9 special recommendations (targeting terrorist financing) issuedby FATF have become the global standards used to measure the effectiveness ofjurisdictions in combating these two problems.3.5 The current legislative framework of Hong Kong can only partiallymeet the latest standards. To maintain our status as an international financialcentre, it is important that we should update our legislative framework andstrengthen our regime in order to ensure that our system will not be abused bymoney launderers and terrorists. Given the complexity of the 40 + 9recommendations, a conference was organised for local and overseas experts toshare latest trends and how some jurisdictions put the FATF recommendationsinto effect.3.6 Having reviewed the information gathered at the conference anddevelopments in certain jurisdictions, the following measures are recommendedto be adopted -94

(a)(b)(c)(d)(e)(f)Pushing ahead with the anti money laundering legislativeamendments which will enshrine the basic recommendationsof the FATF (i.e. customer due diligence, record keeping andreporting suspicious transactions, the last of which is alreadyprovided for in our current legislation) which are applicableto both the financial sectors (banking, securities andinsurance) as well as the “designated non-financialbusinesses and professions” (i.e. casinos, lawyers,accountants, real estate agents, trust and company serviceproviders, and dealers in precious metals and dealers inprecious stones). This will be supplemented byadministrative guidelines issued by regulators whereappropriate;Stepping up training and sharing of experience for regulatedsectors;Enhancing educational and publicity programmes for thecommunity as a whole, sensitising them to the need of beingvigilant;Deepening cooperation with other jurisdictions in lawenforcement;Providing feedback to FATF so that ambiguity and untestedconcepts can be further clarified and refined; andActively taking part in mutual evaluation exercises launchedby FATF and APG to gain experience and knowledge whichwill help improve our own anti-money laundering regime.*****95

CHAPTER 4STRATEGIES AND MEASURES TO PREVENTAND TACKLE CRIMES RELATED TO DOMESTIC VIOLENCEINTRODUCTION4.1 In the light of the increasing number of crimes related to domesticviolence, the Fight Crime Committee (FCC) discussed the issues related todomestic violence and ways to better prevent and tackle the problem at itsmeeting held on 24 September 2005. The Committee noted that theGovernment had over the past year made a lot of efforts to strengthen theprevention and tackling of domestic violence.EXISTING POLICY AND STRATEGY4.2 The Government does not tolerate domestic violence. The SocialWelfare Department (SWD), the Police and other relevant departments havestrived to follow up all reported cases diligently and appropriate andprofessional actions are taken in accordance with the circumstances and needs ofthe cases. The Police have also been taking prompt and professional responseto any reported violent crime related to domestic violence. Offendersinvolving assaults or other criminal offences will be liable to criminal chargesunder the law, and the prosecuting authorities will take prosecution action inaccordance with the Statement of Prosecution Policy and Practice. Besides, theGovernment continues to adopt a three-pronged approach, i.e. preventivemeasures, supportive services and specialised services, to help victims ofdomestic violence and their families. Preventive work at community level hasbeen strengthened to facilitate early identification of families at risk.IMPROVEMENT MEASURES MADE4.3 Since 2004, the Government has taken additional measures andprovided additional resources to support families in need and to resolve familycrises. FCC noted that the Review Panel on Family Services in Tin Shui Waihad made 25 recommendations for improvements, including strengtheningco-ordination at district level and community building, strengthening shelterservice for battered women, enhancing co-ordination and communicationbetween the Police and SWD, strengthening professional training, developmentof a central database on domestic violence and related cases reported to thePolice, and examining the set up of review mechanism on fatal child abuse cases.SWD, the Police and other departments have actively followed up on the96

ecommendations. In its progress report released in August 2005, the ReviewPanel appreciated that most of the recommendations in the Report had beenfollowed up. The Review Panel considered many of the follow-up actions asprompt and effective in bringing improvement to support families in thecommunity, and tackle the problem of domestic violence and child abuse.4.4 To further strengthen multi-disciplinary and multi-professionalcollaboration at the district level, SWD has since March 2005 established 13District Liaison Groups on Family Violence across the territory, withparticipation of the Family and Child Protective Services Units (FCPSUs),Integrated Family Service Centres (IFSCs), the Police and other relevantorganizations as appropriate. The District Liaison Groups aim to facilitatecommunication, co-ordination and collaboration in the handling of domesticviolence cases at the operational level. SWD has also developed a DistrictWelfare Planning Protocol, which includes a set of social indicators to facilitatedistrict welfare planning. The Police and SWD have since December 2004introduced a new acknowledgement system to strengthen communicationbetween their frontline officers on case referrals.4.5 Besides, to strengthen services and crisis intervention, the SWD hasreinforced the manpower of the FCPSUs and allocated resources to the ClinicalPsychological Unit, IFSCs/Integrated Service Centres (ISCs) and Medical SocialService Unit to strengthen the manpower support for families and individuals incrisis and at risk to domestic violence. Additional places for residential childcare services have been provided through allocation of additional resources andservice re-engineering. SWD has allocated additional funding to the refugecentres for women to enhance support for the women and children. It has alsoprovided additional funding to strengthen the night-time emergency servicehotline. Pilot projects of Batterer Intervention Programme have also beenintroduced to help the abusers change their violent behaviour.4.6 As regards public education, SWD has continued the territory-widepublicity campaign on “Strengthening Families and Combating Violence” topromote family solidarity and combating violence. In addition to the regulartraining programmes, SWD has commissioned a tertiary institution to launch theTraining Programme on Understanding of Family Violence under which 8seminars had been held across the territory to provide basic training on domesticviolence. It will also continue to strengthen the training for social workers andrelated professionals on the handling of child abuse, spouse battering, elderabuse and sexual violence cases. The Police also attach importance to thetraining of frontline officers to strengthen their skills and sensitivity in handlingdomestic violence cases. In addition to the training provided on training days,relevant refresher and special trainings will also be arranged by district97

commanders as necessary, particularly in districts with higher number ofreported domestic violence cases.4.7 The Government has conducted a review on the Domestic ViolenceOrdinance (DVO) with a view to strengthening the protection for victims ofdomestic violence. Amendment proposals include expanding the scope of theOrdinance to cover former spouses and former cohabitants; enabling a nextfriend of a child under the age of 18 to make application to the court for aninjunction order; removing the requirement that the child has to be living withthe applicant; extending the duration of the injunction order; and empoweringthe court, when granting an injunction, to attach a power of arrest if it isreasonably satisfied that there is likelihood that the respondent may cause bodilyharm to the applicant or the child.4.8 Moreover, the Government has since July 2005 implemented theComprehensive Child Development Service (for children up to five years old) inSham Shui Po on a pilot basis to facilitate early identification and provision ofassistance to families in need. In January 2006, the service was extended toTin Shui Wai, Tuen Mun and Tseung Kwan O. The Government has plannedto further extend the service to other districts in phases. In 2006-07, theGovernment has allocated an additional recurrent funding of about $22 million(annual provision of $30 million) to launch a Family Support Programme in theIFSCs/ISCs, FCPSUs and Psychiatric Medical Social Services Units tostrengthen connection with families in need who are unwilling to seek help.WAY FORWARD4.9 FCC appreciated that domestic violence was a multi-facetedproblem requiring the concerted efforts of all parties concerned. It would be ofparamount importance that multi-disciplinary collaboration and co-ordination atvarious levels should continue to be strengthened to combat and prevent theproblem. Violence is only the symptom and the end product of a chain ofproblems. There is a need to tackle domestic violence at the root so as toprevent the occurrence of the problems and provide the families at risk with themost needed assistance in a timely manner.*****98

CHAPTER 5COMMERCIAL CRIMESINTRODUCTION5.1 “Commercial Crime” is not a single and legally defined offence,but a mixture of fraud, commercial deception, false accounting, counterfeitinstruments, technology crimes, and other offences of a similar nature.5.2 The following sections provide an overview and comparativeassessment of the annual figures for commercial crimes recorded in 2005.COMMERCIAL CRIMES AND SYNDICATED FRAUDS5.3 In 2005, the number of serious commercial fraud complaintsdecreased by 10.1% from 69 to 62 cases when compared with 2004, but reportedlosses increased significantly from HK$1,485 million to HK$3,290 million (up121.5%). 49% (HK$1.6 billion) of the total reported losses for the year camefrom an investigation into a listed eye lens manufacturer, which defrauded thebanks to release loans for financing fake transactions. They are Letter ofCredit Fraud, Pyramid Scheme Fraud, Modelling Agency Fraud, West AfricanFraud and Bankruptcy Related Fraud.Letter of Credit Fraud5.5 During 2005, four Letter of Credit (L/C) fraud cases were reported,which marked a decrease of 42.9% over 2004. Among the four reported cases,only two actually occurred in 2005. The remaining cases took place during orbefore 2004.99

5.6 Although the amount of reported losses increased by 62.4%compared to 2004, this was mainly attributed to one case which occurred in1996 and involved a loss of HK$280.41 million. The relatively high-profileprosecution of an L/C kiting case involving HK$48 million at the Court of FirstInstance reported in 2004, was upheld at the Court of Appeal in September 2005.Relevant figures are as follows -2004 2005 % ChangeNo. of Reported Cases 7 4 42.9%↓Total Reported Losses(HK$ million)214.53 348.39 62.4%↑Pyramid Scheme Fraud5.7 In 2005, four suspected Pyramid Scheme Related (PSR) fraudreports were received; one report has been confirmed as fraud after investigationand seeking legal advice. As a result, six persons were charged and the casewas scheduled to be tried at District Court in 2006. During the year, oneappeal was heard, which was not only dismissed but the applicant’s sentencewas also increased by a further three months of imprisonment.5.8 The number of complaints remained negligible during 2005.Successful prosecutions have sent a clear message reiterating the illegality ofsuch schemes to the public. Proactive police action will continue, including thecontinued close monitoring of 21 such companies. The losses incurred showed aconsiderable increase which owed almost entirely to the detection of a case inSeptember 2005 involving 77 victims who lost HK$1.95 million in total, withfive culprits arrested so far. The case accounted for 93% of total losses and100

89% of known victims for the year. The number of victims increased from 20in 2004 to 87 in 2005 (up 335.0%), and total reported losses from HK$0.26million in 2004 to HK$2.09 million in 2005 (up 703.8%). Potential victims were then told to attend facial treatment sessions indesignated beauty parlours under the pretence of presenting a better appearance.Following that, they then attended photo shooting sessions for a purportedreward of several hundred dollars. However, this monetary reward was only afraction of what the victims had paid in advance. No further employmentopportunities as promised were offered. It is difficult to prove criminality insuch circumstances as the cases become civil in nature.5.11 The Police adopt a multi-agency approach in collaboration with theConsumer Council, Labour Department and Radio Television Hong Kong ineducating the public through publicity campaigns on the common methodsemployed by fraudsters in modelling agency frauds.West African Fraud 55.12 In 2005, a total of five persons fell victim to West African relatedfrauds. All five cases were the result of advance fee frauds whereby thevictims had been induced to make an upfront fee in the belief that they wouldreceive a large return on their investment. Statistics for West African fraud areas follows -5These frauds were originally perpetrated mainly by West Africians. They comprise typical ‘4-1-9’ (namedafter the corresponding offence in the Nigerian Penal Code) emails relating to certain huge sums of moneyallegedly left intestate to prospective victims who then pay handling fees to the fraudsters via HKSAR bankaccounts to release the alleged funds kept in trust. In recent years, it has become more apparent thatnon-West Africians are increasingly using this type of fraud.101

It wouldappear that publicity highlighting the prevalence of and common modusoperandi used in these types of offences has helped educate the public andreduce the number of victims falling prey to these types of offences. The lowoccurrence may also be attributable to the successful conviction of two Nigerianmales, in separate “4-1-9” fraud cases, in March and April of 2005. Thedefendants in these two cases were sentenced to 4 years and 39 months’imprisonment respectively, and both cases received relatively wide mediacoverage. The latter defendant’s application for appeal against sentence wasrejected in December 2005.Fraud Related to Bankruptcy5.14 Compared to 2004, there was a significant decrease of 59.6% in thenumber of reports received in 2005 on fraud related to bankruptcy. The totalamount of monetary loss for the same period also dropped by 95.4%.5.15 In 2005, there was one prosecution for a case of deception relatingto this type of fraud. However the defendant was acquitted after trial. Thereasons behind the significant decline in bankruptcy-related fraud are believed tobe multifarious in nature. The improving economy, stringent enforcementaction, the benefits of positive credit sharing between financial institutions andbanks, and a coordinated multi-agency governmental publicity-based strategy,are all factors leading to this most welcome change in the trend. Relevantfigures are as follows -102

Potential victims wereoffered jobs in shell trading companies and induced to invest in trading productsthat would allegedly attract profits. The victims were subsequently told thattheir investments had failed and were accused of infringing the company’spolicy by so investing. The majority of victims had therefore not reported theircase to the Police.5.17 The Police are currently investigating seven cases of employmentfraud involving 15 different companies. The Police have raided all 15companies, and a total of 96 persons have been arrested since 2003; allcompanies were subsequently closed. The Police are also monitoring 11 othercases involving non-syndicated employment related fraud that have so far notinvolved the use of premises. The total amount involved in these minor casesamounts to HK$63,011 involving 12 victims. All of these victims haveresponded to newspaper advertisements. The situation remains under controlwith enforcement action and publicity campaigns remaining effective.Insurance Fraud5.18 In 2005, a total of 42 insurance related fraud cases were reported tothe Police, representing a decrease of 38.2% compared with 68 reports in 2004.The amount involved has also significantly dropped from HK$60.15 million in2004 to HK$19.70 million in 2005. The low and declining figures indicate thatthe crime is not prevalent and is well contained. A breakdown is tabledbelow -103

Police investigationrevealed that these agents had taken out 293 insurance policies generating a totalof HK$4 million in premiums, whereas they pocketed HK$7.8 million incommissions and other remuneration. 15 persons were arrested in an operationin connection with this case.5.20 In order to effectively combat insurance related fraud, CCB hasmaintained close liaison with the Office of the Commissioner of Insurance (OCI)and the insurance industry. A two-pronged approach against the crime wasadopted. Internally, the insurance industry would impose tighter internal controland compliance measures to reduce employees’ malpractices. Customer duediligence would also be enhanced to reduce false claims by customers.Externally, publicity campaigns would be launched by CCB, in collaborationwith OCI, to educate the general public and the industry in the prevention ofinsurance related fraud.Street Deception5.21 Since 1999, small gangs of fraudsters have been approachingpredominantly middle-aged to elderly female victims and tricking them intoreleasing large amounts of cash and valuables within a short period of time.This trend reached its peak in 2002. Since then, the number of StreetDeception reports has shown a downward trend.104

5.22 2005 saw a decrease of 18.0% in the number of reports and acorresponding decrease of 25.0% in the loss amount, compared to 2004. Therelevant figures are as follows -2003 2004 2005No. of Reported Cases 576 479 393Reported Losses(HK$ million)27 28 215.23 “Spiritual Blessing” continued to be the most prevalent methodused by swindlers, with losses incurred amounting to 76.2% (HK$16 million) ofthe overall loss suffered in this type of crime. There was a reduction in allmajor modus operandi of Street Deception when compared with 2004, exceptfor “Dropped Money” which increased slightly. Conversely, “Fake JadeBracelet” cases have basically disappeared.5.24 There were 30 detected cases in 2005, of which 93.0% (53 out of57) of the arrested persons were visitors from the Mainland, most of themcoming from Hainan and Hunan Provinces. They predominantly practiseddeception through the modus operandi of “Spiritual Blessing” and “DroppedMoney”.5.25 CCB coordinates Force-wide operations against Street Deceptionoffences through Operation “Hookworm”. In 2005, more than 800 publicitycampaigns were launched through Crime Prevention Bureau and the RegionalCrime Prevention Offices, targeting the elderly. Through arrangements madewith the Hong Kong Association of Banks, District Response Teams werenotified directly by branches whenever suspected cases occurred (25 cases in2005), resulting in nine successful interventions during the year and theprevention of losses of HK$981,000.5.26 Enhancement of sentencing under the Organized and SeriousCrimes Ordinance, Cap. 455, continued to be one of the effective measures indeterring the growth of this crime. In 2005, there were seven successfulapplications made to the trial court with average enhancements of 25% to 50%,representing increases of 12 months’ imprisonment.Internet Banking Theft5.27 Only three reports of Internet Banking Fraud targeting two majorlocal banks and involving a total loss of HK$178,893 were received in 2005.The last report in the year was received in April 2005.105

5.28 On 30 May 2005, the Hong Kong Monetary Authority (HKMA),Hong Kong Association of Banks (HKAB) and Hong Kong Police jointlyannounced the launch of the “two-factor authentication” for e-bankingtransactions. Since then, no report of successful e-banking theft has beenreceived. CCB continues to work closely with HKMA, the banking industryand HKAB through the e-Banking working group and the e-FIRST project 6 .Child Pornography5.29 Child Pornography crimes are very often committed through theuse of computer technology. With the enactment of the Prevention of ChildPornography Ordinance on 19 December 2003, the Police have commencedefforts to combat this category of technology crime.5.30 Since March 2004, a total of 24 males were arrested underOperation “Stormrider”, with an abundant seizure of child pornographicmaterials in digital format. Subsequently, 16 males were charged with theoffence of “Possession of Child Pornography” with 14 of them convicted.Sentences ranged from heavy fines, community service order to immediatecustodial sentences.5.31 In 2005, six Child Pornography cases were reported, with threedetected and three persons arrested. The situation shows that there are only afew local arrests and involvement of Hong Kong people in cases detectedoverseas is only minimal. There is no indication to suggest that ChildPornography is a serious problem in Hong Kong.Counterfeit Currencies5.32 There was a 54.9% decrease in the number of counterfeit HKbanknotes seized in 2005 when compared with 2004. Of significance is therise in the seizure of HK$500 banknotes, from 4 473 pieces in 2004 to 5 060pieces in 2005. 547 counterfeit HK$500 notes (10.8%) surfaced during severaloperations.5.33 An analysis revealed that among the 547 counterfeit HK$500banknotes seized as a result of arrest operations in 2005, 535 (97.8%) wereproduced by laser printer. This type of counterfeit banknote first surfaced inNovember 2004 and is now the focus of Police action. Police investigations and6e-Finance and Banking Incident Response Strategy (e-FIRST) is a liaison channel established in October 2004between the banks, HKMA and CCB for reporting and exchange of information relating to e-banking crimes.106

intelligence suggest that Mainlanders and minorities from South Asia play anactive role in distributing and passing counterfeit HK$500 banknotes.5.34 Concerning counterfeit HK Dollar coins, 2005 saw a decrease of47.7% from 281 384 to 147 169 in HK$10 coins when compared with 2004.Regarding counterfeit HK$5 coins, although the size of seizure increasedsharply by 580%, from 2 731 in 2004 to 18 574 in 2005, its circulation remainedsmall. Almost all counterfeit HK$5 coins were submitted from publictransportation companies. Intelligence suggested that the counterfeit HK$10coin syndicate has shifted to produce HK$5 coins, and the Mainland is believedto be a major source of counterfeit coins.5.35 The number of counterfeit Renminbi (RMB) banknotes havingsurfaced dropped slightly in 2005. A downward trend wasnoticed in the majority of topical crimes. The CCB will continue to take aproactive approach to tackle existing and developing commercial crimetypologies in the coming year.*****107

CHAPTER 6PUBLICITY CAMPAIGN FORREHABILITATED OFFENDERS IN 2005-06BACKGROUND6.1 Public acceptance and community support are essential forsuccessful re-integration of offenders into society as law-abiding citizens. TheCorrectional Services Department (CSD) has therefore organized a series ofpublicity initiatives since 1999 to help the public better understand the needs ofand the problems commonly faced by rehabilitated offenders, and to appeal forcommunity support for them.6.2 Major publicity activities held for this purpose included three seriesof the TV docu-drama “The Road Back”, radio and television Announcementsin the Public Interest (APIs), symposiums on employment for rehabilitatedoffenders, special TV programmes, competitions for inmates to demonstratetheir talents in cultural and recreational activities, variety shows andcommunity-involvement activities jointly organized with District Fight CrimeCommittees (DFCCs).SURVEYS ON EFFECTIVENESS OF PUBLICITY ACTIVITIES6.3 To assess the effectiveness of the publicity activities organized asperceived by the public, CSD carried out two opinion surveys in mid 2002 andend 2004 respectively. Among other things, the surveys found that -(a)(b)59.5% of the respondents in 2004 agreed that one or more publicityactivities organised in the previous 12 months could enhance theirunderstanding of rehabilitated offenders. In the 2002 survey, onaverage 43% of the respondents agreed that the publicity activitieshelped them understand the inmates/discharged offenders and themessage of giving support to their re-integration; and91.9% of the respondents in 2004 considered it worthwhile for theGovernment to continue to conduct publicity activities to appeal forcommunity support for rehabilitated offenders. 83.6% of therespondents considered so in the 2002 survey.108

6.4 Having regard to the findings of these surveys, in particular thehigh level of public endorsement of the activities organized, CSD sees a strongand justifiable case to continue with the publicity campaign for rehabilitatedoffenders with a view to further enhancing public support and establishing awider community network to mobilize public involvement.2005-06 PUBLICITY CAMPAIGN6.5 CSD has adopted a systematic approach to planning and launchingsuitable public activities on an annual basis since 1999-2000. Having regard tothe advice of the Committee on Community Support for RehabilitatedOffenders 7 , the effectiveness of past publicity activities and the Department’sown experience, CSD conducted another series of publicity activities in 2005-06targeting four community groups (namely students, general public, employersand district groups) to secure their support in the re-integration of rehabilitatedoffenders. In addition to DFCCs, CSD invited non-governmental organizations(NGOs), community organizations and charitable organizations with interest inthe welfare of rehabilitated offenders to jointly implement the followingpromotional and public education activities -(a)For Students• CSD held a joint school student forum in December 2003 atthe Hong Kong Convention and Exhibition Centre to provideopportunities for secondary school students and rehabilitatedoffenders to interact and discuss the untoward consequences ofcommitting crimes. Thereafter, with the support of theDFCCs, the Department conducted a series of district-basedstudent forums throughout the territory with the last one heldin November 2005. These forums were each participated byabout 150 nominated students and other invited guests fromconcerned community groups. To ensure continuation of thismeaningful and well-received activity as well as promotingcommunity involvement, CSD will launch in 2006 theCommunity Torch for “Option in life” Student Forum whereinNGOs will organize similar student forums in future withCSD’s support.7Comprising members from different sectors of the community, the Committee advises the Commissioner ofCorrectional Services on rehabilitation programmes and re-integration strategies.109

(b)For General Public• To demonstrate inmates’ talents, a music and lyrics writingcompetition for inmates was held in 2005. A concertfeaturing the winning entries of the competition has beenscheduled for 2 February 2006 with the songs performed byprofessional singers, artists and/or inmates.• To make the best out of the music and lyrics writingcompetition for inmates and to let more people know thetalents of the inmates, 10 000 copies of music CDs collectingthe winning entries will be produced for distribution to schoolsand interested organizations and individuals.• A 2006 calendar featuring the winning entries of creativewriting/drawing competition for inmates was produced.Apart from demonstrating the talents of inmates, suitablepublicity message was printed on and conveyed through thecalendar.• Mr Andy Lau Tak-wah, a famous artiste, has been appointedas Rehabilitation Ambassador (RA) since 31 October 2004.CSD will appoint other RAs if there are suitable persons whoare willing to devote their time and efforts to this initiative.• Arrangements were made to display a giant wall banner in oneof CSD’s institutions and publicity posters on CSD’s laundryvehicles. Mural paintings will also be put up at suitablelocations in CSD premises.• New radio and television APIs produced in 2004 werebroadcast on the television and radio starting from May/June2004 and throughout 2005-06 in Government airtime, so thatappeal for public support for rehabilitated offenders may reachdifferent sectors of the community.• As arranged with the Water Supplies Department and ChinaLight and Power Company Limited (CLP),rehabilitation-related publicity messages were printed on waterbills issued from June to Sept 2005 and on electricity billsissued by CLP from June to July 2005.110

• CSD Directorate officers continued to reach out to thecommunity by delivering public speeches via communityorganizations like Lions Clubs, Rotary Clubs and districtcommercial organizations, touching upon the importance ofcommunity acceptance and support for rehabilitated offenders.During 2005, a total of eight such talks were given.(c)For Employers• CSD collaborated with the Merchants Support forRehabilitated Offenders Committee Limited to roll out the“One Company One Job” project to Wong Tai Sin District in2005-06 to appeal to employers for fair employmentopportunities for rehabilitated offenders.• CSD continued to organize institutional visits for potentialemployers to enhance their understanding of the Department’srehabilitation services and programmes, in particular thevocational training for offenders and the work skills obtainablein correctional institutions.(d)For District Groups• Since 2001-02, DFCCs have organized rehabilitation-relatedpublicity activities jointly with CSD. These included visits topenal institutions, exhibitions, experience sharing withinmates/prisoners, variety shows and voluntary work. With agenerous donation of $380,000 from the Lok Sin TongBenevolent Society, Kowloon, a maximum subsidy of $20,000for each district was provided for DFCCs to organize similardistrict-based publicity activities in 2005-06.• Given the success of the co-operation, the DFCCs supportedthe continuation of the initiative at a briefing held by CSD inJune 2005. Regional Liaison Officers of CSD have beenappointed to co-ordinate these district promotional activities.6.6 Apart from the above major publicity and public educationactivities, other publicity initiatives implemented in 2005-06 included a CSDRehabilitation Volunteer Group Awards Presentation Ceremony held on 7 April2005 to give recognition to volunteers’ contribution in offender rehabilitationwork. CSD continues to make full use of the Volunteer Group inimplementing the publicity campaign. Arrangements were also made to111

distribute to interested organizations and individuals copies of album/DVD on“An Unparalleled Show 2004” and DVD on the third series of the TVdocu-drama “The Road Back” in order to sustain the publicity effect of theseprogrammes. In addition, CSD co-operates with RTHK to promote offenderrehabilitation in a radio programme on RTHK Radio 1, viz. “ 萬 千 寵 愛 ”, whichis very popular among prisoners and their families and friends. To publicizethe good examination results of inmates and to demonstrate their efforts andcommitment to personal enhancement, CSD continued to hold certificatepresentation ceremonies in 2005-06 with press coverage as appropriate. TheDepartment continued to reach out to NGOs and community organizations, suchas Zonta Club, Lions Clubs, Rotary Clubs, Care of Rehabilitated OffendersAssociation, etc. to solicit volunteers and expertise in organizing interest classesand skills training for serving offenders.WAY FORWARD6.7 Community support is a key factor contributing to the successfultransition of rehabilitated offenders to law-abiding citizens. This will in turnhelp reduce recidivism and save public expenses. CSD will continue with itspublic education efforts to promote public acceptance of rehabilitated offendersand invite the society to participate in offenders’ re-integration.*****112

CHAPTER 7PROGRESS OF THEPOLICE SUPERINTENDENTS’ DISCRETION SCHEMEBACKGROUND7.1 Under the Police Superintendents’ Discretion Scheme (PSDS), aPolice officer of the rank of Superintendent or above may, at his or herdiscretion, caution a young offender instead of initiating a criminal prosecutionagainst the offender. With effect from 1 September 1995, the age ceiling ofoffenders eligible for the PSDS was raised from the age of under 17 years old tounder 18 years old so that more young offenders may benefit from the Scheme.The Fight Crime Committee (FCC) monitors the progress of the PSDS throughthe half-yearly progress reports submitted by the Commissioner of Police (CP).OVERALL SITUATION7.2 A total of 6 821 juveniles (for the purpose of this chapter, a juvenilerefers to a person under the age of 18) were arrested for various criminaloffences in 2005, representing a decrease of 13.9% compared with 2003 8 (7 918)and a decrease of 9.8% compared with 2004 (7 566). The five most commoncriminal offences committed by juvenile offenders in 2005 included shop theft,miscellaneous thefts, wounding and serious assault, robbery, and unlawfulsociety offences (see chart at Appendix XV).7.3 Not all arrested juveniles are eligible for the PSDS. For thosearrested in 2005, 55.6% were eligible for the Scheme, compared with 50.4% in2003 and 51.9% in 2004. The following guidelines for assessing the eligibilityof juvenile offenders for the Scheme remained unchanged -(a)(b)(c)(d)at the time the caution is administered, the offender is underthe age of 18;the offender has no previous criminal record;the evidence available is sufficient to support a prosecution;the offender voluntarily and unequivocally admits the8As from 1.7.2003, the minimum age of criminal liability has been raised from 7 to 10.113

offence; and(e)the offender and his parents or guardian agree to the caution.7.4 A total of 3 026 juvenile offenders were cautioned in 2005, a rise of0.5% compared with 2003 (3 012) and a rise of 3.3% compared with 2004(2 929). This gives a caution rate of 44.4% out of the juveniles arrested,compared with 38.0% in 2003 and 38.7% in 2004. 7.7 Juveniles who have been referred to the JPS for supervision will bevisited by a member of the JPS team on a regular basis. The member of theJPS team will have an informal interview with the juvenile in the presence of hisor her parents at their home. Such visits will normally continue to beconducted for two years or until the juvenile’s 18th birthday, whichever isearlier.7.8 Such visits usually take place once a month. The frequency mayvary from once every two weeks for juveniles assessed as being at very highrisk, to once every three months for those at low risk. Subjects covered duringthe interview include -(a)(b)(c)the juvenile’s academic progress;leisure activities; andfriends and associates, etc.7.9 The JPS has maintained regular liaison with SWD and EMB, andoften consults them about problems in the juveniles’ families. The JPS alsorefers juveniles under supervision to the CSSS, the Junior Police Call, the HongKong Award for Young People or other organisations as appropriate.7.10 Since mid-1997, the Police have referred increasing numbers ofjuveniles to the CSSS, either as an alternative or as a supplement to the JPS.The purpose of the CSSS is to encourage juveniles who have infringed the lawto return to a decent law-abiding life-style, by means of -(a)(b)(c)(d)(e)(f)counselling or supportive groups;job training and placement;skill learning classes;adventure and outdoor activities;volunteer and community service projects; andprograms for parents/guardians.115

RECIDIVISM7.11 A person is regarded as a recidivist if he or she is re-arrested forcrime within two years from the date of caution, or before he or she reaches18 years of age, whichever occurs first. The recidivist rate for the juvenilescautioned in 2003 was 19.6%. This is compared to 18.9% for those cautionedin 2001 and 17.7% for those cautioned in 2002. Due to the two-year rule, therecidivist rate for those offenders arrested in 2004 and after is not yet available.WAY FORWARD7.12 The FCC will continue to monitor progress of the PSDS throughthe half-yearly progress report submitted by CP. It will also raise concerns onthe report for appropriate follow-up actions.*****116

CHAPTER 8FIGHT CRIME PUBLICITY STRATEGYBACKGROUND8.1 The Publicity Sub-Committee (PSC) formulates the strategy for theFight Crime Publicity Campaign, which starts in early summer every year.The strategy, which usually embraces one or more themes targeting prevailingcrimes and/or areas of major community concern, will be implemented by thePSC following the endorsement of the Fight Crime Committee.REVIEW OF THE 2004-2005 CAMPAIGN8.2 The 2004-05 campaign was accorded a major campaign status witha budget allocation of HK$1.6 million.8.3 “Help Police Fight Crime” was made the theme of Fight CrimePublicity Campaign for 2004-05 to promote awareness of the public in that theyhad a key role to play in the fight against crime. Their co-operation with andsupport for the Police through acts as simple as making a phone call would bevital to both prevention and detection of crime.8.4 Phase One of the campaign was launched in June 2004 andthrough a series of publicity drives, members of the public were reminded tostay alert against crime and to take a more proactive approach by using their“weapons” – eyes, ears, mouth and hands – to help fight crime by reporting tothe Police.8.5 Phase Two of the campaign rolled out in December 2004. Itechoed the same theme and appealed to members of the public to make use oftheir “weapons” to bring crimes to light.8.6 The campaign came with two television Announcements in thePublic Interest (APIs) and two complementing radio APIs. Other publicityitems including posters, bus body advertising and outdoor electronic mediaplacements were used. The TV APIs were also uploaded onto the Governmenthomepage – the Government Information Centre.PUBLICITY STRATEGY FOR 2004-05 CAMPAIGN8.7 The 2005-06 campaign continued to enjoy a major campaign status117

with a budget allocation of HK$1.6 million.8.8 By the end of 2004, the number of reported crimes totalled 81 315,representing a decrease of 8.0% compared with 88 373 crimes recorded in 2003.However, the figures of pick-pocketing and miscellaneous thefts remained highamong other categories, with the figures stood at 1 623 and 19 409 respectively.8.9 To address the problem, “Take Care of Your Own Belongings” wasmade the theme of the campaign. Members of the public were reminded to usetheir weapons – eyes, ears, mouth and hands – to watch over their personalbelongings. A special emphasis was placed on the fact that pickpockets andthieves could not be identified easily.8.10 The campaign, launched in June 2005, came with a TV API and acomplementing radio API. APIs were broadcast on television and radiochannels throughout the year. The TV API was uploaded onto the homepagesof the Government and the Hong Kong Police Force and broadcast additionallyon various outdoor electronic media.8.11 The publicity package also included three posters, bus bodyadvertisements and an octopus cardholder carrying the campaign message.8.12 At the district level, District Fight Crime Committees, Junior PoliceCall and Police crime prevention officers etc. continued to join hands inorganising fight crime activities in support of the campaign theme to help putacross the message to different sectors of the community.*****118

CHAPTER 9WORK OF DISTRICT FIGHT CRIME COMMITTEESINTRODUCTION9.1 District Fight Crime Committees (DFCCs) were first established inSeptember 1976, mainly for the purpose of promoting public awareness of theFight Crime Campaign through organising activities at district level. Sincethen, DFCCs have developed into a focal point for community efforts to fightcrime and their terms of reference, at Appendix III(a), have been broadened toinclude -(a)(b)(c)(d)monitoring the state of crime and law enforcement in thedistrict;co-ordinating district campaign activities;promoting good relationship between the Police andmembers of the public; andadvising the Fight Crime Committee (FCC) on general lawand order issues.9.2 There are 18 DFCCs based on the same geographical boundaries asthe District Councils. DFCCs are independent of District Councils but the twoare very closely related in terms of membership and funding arrangements.MEMBERSHIP9.3 DFCCs have an average size of 34 members. They are chaired bylocal community leaders with a large number of appointed non-official membersdrawn from all sectors of the local community and a small group ofrepresentatives from key local government offices. In 2005-06, there was atotal of 525 non-official members on the 18 DFCCs and many of them wereDistrict Council members. Membership lists of the 18 DFCCs are atAppendix III(b).MONITORING CRIME SITUATION IN THE DISTRICT9.4 DFCCs met every two or three months. Law and order remained astanding item on their meeting agenda. They kept under constant review the119

state of crime and significant trends in district crime statistics. The meetingsprovided a forum where local crime issues were discussed.9.5 Each district has its own crime characteristics due to geographical,demographic and developmental differences. Crimes which have drawnDFCCs’ attention in the report period included -• robbery, burglary and building security issues;• juvenile and youth crime and problem of drug abuse;• triad-related crimes and vice activities; and• quick cash crimes such as shop-theft and street deception.CO-ORDINATION OF COMMUNITY EFFORTS9.6 DFCCs launched district fight crime publicity campaigns withfunds from District Councils and other sponsorship. In addition to the mainpublicity strategy, individual DFCCs also adopted special themes targeting thecrime characteristics of the districts. Some DFCCs also conducted studies andsurveys on local crime problems.9.7 Campaign activities undertaken by DFCCs in the report period tooka variety of forms, including exhibitions, school roving talks, seminars, varietyshows, carnivals and various award schemes, contests/competitions, publicationof fight crime newsletters and distribution of fight crime publicity items. Visitsto Police command and control centres, Police stations, Correctional Servicesinstitutions and drug addiction treatment centres were also organised.LINK BETWEEN FCC AND DFCCs9.8 The FCC received and considered regular progress reports on thework of DFCCs. It also provided advice to DFCCs on their work. A briefreport of the matters discussed in FCC meetings was also prepared after eachmeeting and circulated to DFCCs for information. In addition, FCC membersattended DFCC meetings on a roster basis and brought district concerns back toFCC meetings for discussion. At Appendix III(c) is the roster of visits of FCCMembers to DFCCs in 2005. FCC Members also participated actively inpublicity activities organised by DFCCs. These arrangements not onlyenhanced the exchange of ideas and information on measures to combat crime,but also established a means for positive communication between members ofFCC and DFCCs.120

9.9 To reinforce the close link between the FCC and DFCCs, socialgatherings were also organised. An annual dinner with the DFCC chairmenwas held on 14 March 2005, and the 2005 Fight Crime Reception attended by allDFCC members was held on 3 November 2005. These gatherings providedopportunities for members of the FCC and DFCCs to get together to discussareas of public concern and to exchange views on ways to combat crime.*****121

CHAPTER 10WORK OF SUB-COMMITTEESSTANDING COMMITTEE ON YOUNG OFFENDERS10.1 The Standing Committee on Young Offenders (SCOYO) of theFight Crime Committee (FCC) was established in July 1986 by reconstitutingthe FCC’s Working Group on Youth. Its key objective is to examine factorswhich affect young people at risk of involvement in crime and to considerpreventive and remedial measures that can be taken both within and outside thecurrent education, social and correctional programmes. One of the tasks of theSCOYO was to monitor the work of the Young Offender Assessment Panel, atask force comprising professional staff from both the Correctional ServicesDepartment and the Social Welfare Department, which recommends on the mostappropriate programme of rehabilitation for convicted young offenders. Theterms of reference and the 2005-06 membership list of SCOYO are atAppendix II(a).PUBLICITY SUB-COMMITTEE10.2 The Publicity Sub-Committee (PSC) of the FCC publicises thepolicies, objectives and strategies of the FCC, with a view to fostering publicawareness of crime prevention and motivating the community to play an activerole in the fight against crime. The terms of reference and the 2005-06membership of the PSC are at Appendix II(b).10.3 The PSC is responsible for formulating and implementing the FightCrime Publicity Campaign. This annual campaign usually embraces one ormore themes targeting prevailing crimes and/or areas of major communityconcern. Details of the 2005-06 Fight Crime Publicity Campaign are set out inChapter 8.10.4 In 2005-06, the PSC held five meetings. It planned andimplemented a territory-wide fight crime publicity campaign through the use ofthe mass media and community programmes such as the Good Citizen AwardScheme. The PSC also worked closely with District Fight Crime Committeesin planning and organising publicity activities at district level in support of theterritory-wide campaign.122

GOOD CITIZEN AWARD SCHEME10.5 Sponsored by the Hong Kong General Chamber of Commerce, theGood Citizen Award Scheme was first introduced in 1973 by the FCC to giverecognition to members of the public for their help in the fight against crime.To further arouse public interest in the Scheme, an additional honour – the GoodCitizen of the Year Award – was introduced in 1984 for civic-minded citizens inappreciation of their exemplary courage in preventing or helping to detectcrimes or in apprehending culprits.10.6 Two presentation ceremonies were held in June 2005 and January2006 respectively during which a total of 80 citizens were commended. So far,more than 3 200 citizens have been commended under the Scheme.*****123
