Failure to produce the originals at this stage in support of the attested copies of the abovedocuments submitted earlier would result in disqualification and forfeiture of EMD.20. If it comes to the notice of RINL/VSP at any stage right from request for enlistment/tenderdocument that any of the certificate/documents submitted by applicants for enlistment or bybidders are found to be false/fake/doctored, they will be debarred from participation in allRINL/VSP tenders for a period of 5 years including termination of contract, if awarded.EMD/Security Deposit etc, if any will be forfeited. The Contracting Agency in such casesshall make good to RINL/VSP any loss or damage resulting from such termination.Contracts in operation anywhere in RINL/VSP will also be terminated with attendantfallouts like forfeiture of EMD/Security deposit, if any, and recovery of risk and costcharges etc. Decision of RINL/VSP Management will be final and binding.21. The tender shall be submitted in two parts as follows:a) Part-I in a sealed envelope shall contain three sets (original + 2 copies) of theFollowing:I. Covering letter.II. Form of Tender.III. Declaration of Particulars.IV. All other documents and information except prices.Part-I shall also contain the following:i) Tender Document issued by RINL/VSP/downloaded from company‘swebsite duly signed on all pages including the Terms and Conditions ofcontract in token of acceptance.ii)iii)Earnest Money Deposit.Cost of tender document in case it is down loaded from RINL/VSP’swebsite.This envelope shall be superscribed as Part-I of the tender.b) The tenderer should not alter the Terms and Conditions of Contract and otherdocuments given in the Tender Document issued by RINL/VSP/downloaded from VSP’swebsite. If he wishes to stipulate any deviations to the Terms and Conditions of Contractetc., the same should be given in the covering letter forming part of Part-I of the tender.RINL/VSP reserves the right to accept / reject the deviations. Further, if the tenderer failsto withdraw the deviations, on being requested to do so, RINL/VSP shall have the right toreject the tender.c) Part-II in a separate sealed cover shall contain Schedule of Rates duly filled in. Noconditions shall be mentioned in the price bid. This envelope shall be superscribedas Part-II of the tender.The envelopes containing Part-I & Part-II of the tender shall be kept in a thirdenvelope and sealed. All the three envelopes shall be superscribed with “Tender forappointment of Consignment Sales Agent at VARANASI(UP)”. Tender ReferenceNo. and Tender Submission Date shall also be mentioned on all three envelopes.22. Tenders should be kept valid for a period of 60 (sixty) days from the last date forsubmission of Price Bid / Revised Price Bid.Page 8 of 33
23. In case the tenders are invited for more than one location, tenders for each location has tobe separately submitted in separate sealed envelopes superscribing the name of the locationon it, alongwith separate EMD.24. RINL/VSP reserves the right to accept / reject any or all tenders either in part or in full orsplit up and award the work to more than one agency without assigning any reasons thereofand without any liability to Rashtriya Ispat Nigam Limited.25. RINL/VSP reserves the right to negotiate with the Central Government Departments/Central Public Sector Undertakings / Enterprises with a view to match their price with thelowest tender and award the work, as per the guidelines issued from time to time byGovernment of India.26. The company requires that bidders/suppliers/contractors under this contract observe thehighest standard of ethics during the execution of this contract. In pursuance of this policy,the company defines, for purpose of these provisions, the terms set forth below as follows.“Corrupt practise” means the offering, giving, receiving or soliciting of any thing of valueto influence the action of a Public Official in contract execution and ‘fraudulent practise’means a misrepresentation of facts in order to influence the execution of a contract to thedetriment of the Employer and includes collusive practise among bidders (prior to or afterbid submission) designed to establish bid prices at artificial non competitive levels and todeprive the company of the benefits of free and open competition. The company will rejecta proposal for award of work if it determines that the bidder recommended for award hadengaged in corrupt or fraudulent practise in competing for the tender in question. Thecompany will declare a bidder ineligible, either indefinitely or for a stated period of time, tobe awarded contract/contracts if it any time determines that the bidder has engaged incorrupt or fraudulent practises in competing for, or in executing the contract.Page 9 of 33
