5. APPEAL5.1 ProtestsAny actual or prospective proposer may protest the solicitation or award of a contract forviolations of District’s procurement policies or of laws and regulations governing District'sprocurement activities. In order to be considered, all protests must be in writing and filed withand received, not more than five (5) business days following the date of issuance of theDistrict’s Notice of Prequalification and before the Prequalification Submittal Deadline withthe contact below:Contracting Officer, <strong>Build</strong>-<strong>LACCD</strong>, 915 Wilshire Blvd., Suite 810, Los Angeles, CA90017 Failure to timely file the bid protest shall constitute grounds for the District to denythe bid protest without further consideration of the grounds stated therein. The written bid protest sets forth, in detail, all grounds for the bid protest, including allfacts, supporting documentation, legal authorities and argument in support of thegrounds for the bid protest. Any grounds not set forth in the written bid protest shallbe deemed waived. All factual contentions must be supported by competent,admissible and credible evidence. Any bid protest not conforming to the foregoingshall be rejected as invalid. Provided that a bid protest is filed in conformity with the foregoing, its basis shallreviewed and evaluated , and Bidder shall be provided with a written decision, eitherconcurring with or denying the bid protest. The written decision of the ExecutiveDirector or his/her designee shall be final, unless overturned by the Board of Trustees.5.1.1 Statement of Grounds.Upon written request by the Applicant, provided either prior to or included as part of theApplicant’s written submission of its protest, the District shall provide notification to theApplicant in writing of the basis for the disqualification, including a summary of any evidenceadduced by the District in support of its determination.5.1.2 Hearing.An Applicant that has properly filed a protest in accordance with the requirements of this Article5 shall be given notice and opportunity to appear before an officer or Appeal Committee,consisting of individuals appointed by the Board of Trustees for the District, to rebut anyevidence used as a basis for disqualification, and to present evidence as to why the Applicantshould be found qualified.5.1.3 Final Decision.The Appeal Committee shall provide a written decision to the Applicant submitting the protest,either concurring with or denying the protest.
