Secretary, <strong>SEAC</strong> & Member Secretary, WBPCBIn the beginning <strong>of</strong> the 73 rd <strong>meeting</strong> <strong>of</strong> <strong>SEAC</strong>, which was held on 30.11.2012 at 11:00 hrs at theConference Room, Paribesh Bhawan, Bidhan Nagar, the Secretary, <strong>SEAC</strong> welcome all the members. Dueto some unavoidable circumstances Shri Manoj Kumar Nandi could not attend the <strong>meeting</strong>. However, asdesired by Shri Manoj Kumar Nandi earlier and as also agreed by other members <strong>of</strong> <strong>SEAC</strong> Dr. KalyanRudra chaired the <strong>meeting</strong>. After introductory session, three cases were discussed under 'Miscellaneous'section. Seventeen cases were placed for reconsideration. Five applicants were requested to make theirpresentation before the committee. All the five applicants appeared before the <strong>SEAC</strong> for technicalpresentation on their respective project proposal.Session IA. Miscellaneous Section :1. Proposed Four Star Hotel project “MARRIOT COURTYARD” by M/s. Mani Square Ltd. at24/2/39, Mallaguri, Hillcart Road, Pradhan Nagar, Siliguri Municipal Corporation Ward No. III,Siliguri – 734 403, Dist – Darjeeling, West Bengal.Activity:This is a proposal for construction <strong>of</strong> a Four Star Hotel (1 block <strong>of</strong> 2B+G+14 storied building), TotalBuiltup Area 20587.309 sq.m. having 131 rooms, Business Centre, Restaurant, Deli, Pre Function,Meeting Rooms and an Office Tower at the rear <strong>of</strong> the building.Chronology <strong>of</strong> the event:After carefully considering the presentation in the 65 th <strong>SEAC</strong> <strong>meeting</strong> held on 20.03.2012, the StateLevel Expert Appraisal Committee (<strong>SEAC</strong>) made the following recommendations dated 02.04.2012 :1. Specific concurrence regarding water supply and other infrastructural facilities from concernedauthorities to be submitted.2. Revised proposal for Corporate Social Responsibility along with item wise breakup and timeframe to be submitted.3. Depth <strong>of</strong> the recharge well for rain water harvesting to be checked.4. Revised plantation proposal as discussed during the presentation to be submitted.Reply dated 07.06.2012 from the unit was considered in the 68 th <strong>SEAC</strong> <strong>meeting</strong> held on 14.06.2012,the State Level Expert Appraisal Committee (<strong>SEAC</strong>) made the following recommendations dated29.06.2012 :1. The water supply infrastructure as proposed by Siliguri Municipal Corporation needs to be inplace and appropriate record to be submitted in this regard.2. Project proponent should provide for 2 nos. <strong>of</strong> Recharge wells for rainwater harvesting.Page 1 <strong>of</strong> 50

Shrubscan be planted additionally.The PP submitted their reply dated 16.10.2012 and a letter dated 09.11.12 informing that the projecthas been revised and project area becomes 19,494.925 sq.m. In view <strong>of</strong> aforesaid facts, PP iswithdrawing the EC application dated 02.03.12 which is under consideration <strong>of</strong> <strong>SEAC</strong>.Name <strong>of</strong> the Environmental Consultant M/s. Envirotech East Pvt. Ltd. The case was placed forreconsideration in the 73 rd <strong>SEAC</strong> <strong>meeting</strong> held on 30.11.2012. After scrutinizing the documentssubmitted by the unit, the committee has noted and recommended that the matter to be referred toSEIAA for information and necessary action.2. Letter <strong>of</strong> Dr. Mohit K Ray received on 31.10.2012 addressed to the Chairperson, SEIAA and theMember Secretary, WBPCB regarding Calcutta High Court and Karnataka High Court Orderson Illegality <strong>of</strong> NABET accreditation.Dr. Mohit K Ray an environmental specialist working in environmental field for more than 30 yearshas submitted a letter on 31.10.2012 addressed to the Chairperson, SEIAA and the Member Secretary,WBPCB regarding accreditation <strong>of</strong> environmental consultants by NABET/ QCI in respect <strong>of</strong> threeOffice Memorandum issued by MoEF on the said matter.The MoEF had issued O. M. dated 02.12.2009, 18.03.2012 and 28.06.2010 regarding accreditation <strong>of</strong>environmental consultants by NABET / QCI.Dr. Ray has enclosed with his above mentioned letter, the proceedings <strong>of</strong> 79 th <strong>meeting</strong> <strong>of</strong> the StateLevel Expert Appraisal Committee (<strong>SEAC</strong>), Karnataka held on 9 th and 10 th February 2012 whichmentions about the stay orders given by the Hon’ble High Court <strong>of</strong> Karnataka in W.P. No.15301531/2012 (GMRES):(Nanda Kishore Vs. Union <strong>of</strong> India represented by MoEF, GoI & DFEE,GoK) on 18.01.2012 against the operation <strong>of</strong> OM dated 02.12.2009, 18.03.2010 and 28.06.2010 issuedby the MoEF, GoI, regarding mandatory accreditation <strong>of</strong> environmental consultants fromNABET/QCI. In view <strong>of</strong> this, the <strong>SEAC</strong>, Karnataka decided to allow environmental consultants formaking presentation / preparation <strong>of</strong> EIA irrespective <strong>of</strong> their accreditation status till the stay isvacated.Writ Petition No. 13896 (W) <strong>of</strong> 2012 was filed by Dr. Ray in Calcutta High Court against the abovementioned O.M. issued by MoEF. The High Court in its Order dated 19.09.2012 has stayed those O.M. ‘in so far its application to the petitioner is concerned till next hearing’. The copy <strong>of</strong> the said orderhas been enclosed along with letter <strong>of</strong> Dr. Ray. Dr. Ray has requested <strong>SEAC</strong>, West Bengal in his lettersubmitted on 31.10.2012, to allow all environmental consultants and organizations to prepare EIAreport irrespective <strong>of</strong> their accreditation status till the stay is vacated.W.P. No. 13896 (W) <strong>of</strong> 2012 and Proceedings <strong>of</strong> the 79 th <strong>meeting</strong> <strong>of</strong> <strong>SEAC</strong>, Karnataka held on 9 th and10 th February 2012 has been enclosed along with his above mentioned letter.The case was placed for discussion in the 73 rd <strong>SEAC</strong> <strong>meeting</strong> held on 30.11.2012. Relevant Office Memorandum No. J103/19/2012IA.III dated 01.11.2012 <strong>of</strong> the Ministry <strong>of</strong>Environment & Forests, Government <strong>of</strong> India.To simplify the procedures relating to grant <strong>of</strong> EC <strong>of</strong> the SEZ projects under the provisions <strong>of</strong> the EIANotification 2006, MoEF has decided to have the following framework in place, in line with thatprescribed for NIMZs under the National Manufacturing Policy, 2011 :i. In respect <strong>of</strong> laws and regulations pertaining to environment, Central/State Governments maydelegate the power as allowed by the relevant statutes to an <strong>of</strong>ficial <strong>of</strong> the SPCB posted in thezone.ii.The EC for SEZs units under the EIA Notification 2006 shall be considered on a high priority.iii. Individual units may be exempted from public hearing in cases where the SEZ as a whole hasundergone public hearing. In cases where the type <strong>of</strong> individual unit/process was not originallyconsidered as a part <strong>of</strong> the SEZ project at the time <strong>of</strong> public hearing for SEZ, a fresh publichearing will be required for the individual unit/process at appropriate time.iv. Facilitative instructions and guidelines may be issued at the Central and State level from timeto time aiming at promotion <strong>of</strong> SEZs while safeguarding environmental integrity.Put up for discussion in the 73 rd <strong>SEAC</strong> <strong>meeting</strong> held on 30.11.2012 and was noted by <strong>SEAC</strong>.B. Reconsideration Proposals :Seventeen reconsideration proposals were placed in the <strong>meeting</strong>.Industry Sector :1. Proposed Iron Ore Beneficiation plant <strong>of</strong> M/s. Onkar Udyog Ltd. at Vill. – Guptamoni, Jl. No. –638, Mouza – Jamsole, PS – Jhargram, Dist. – Paschim Medinipur, West Bengal.Activity:This is a proposal for installation <strong>of</strong> an Iron Ore Beneficiation plant (20 TPH) with capacity <strong>of</strong> 96000TPA throughout and about 70000 TPA iron ore.Salient features <strong>of</strong> the proposed modernisation project are :i. Location <strong>of</strong> the Site – Vill. – Guptamoni, Jl. No. – 638, Mouza – Jamsole, PS – Jhargram, Dist. –Paschim Medinipur, West Bengal.ii. Land Area – 4 acres, 56 decimals. Green Area – 1.4 acres (36.60% <strong>of</strong> land area). Total no. <strong>of</strong>saplings is 1750.iii. Raw Materials – Iron ore fines (90000 TPA).iv. Emission Sources Raw Material Handling Section, Transfer Points, Jaw Crusher (20 TPH),Roller Mill/ Ball Mill (20 TPH), HIM Separator, Belt Conveyor, Screen etc.v. Air Pollution Control System – Adequate Dust Suppression System to be installed to controlfugitive emissions.vi. Total water requirement82 m 3 /hr. Make up Water Requirement – 4 m 3 /hr(Source Groundwater).vii. Wastewater – domestic effluent to be discharged through septic tank to soak pit. , Process waterdischarge Zero effluent dischargeeffluents from ore beneficiation plant shall be treated inthickener and overflow to be recycled.viii. Solid waste: 28,800 MTPA rejects <strong>of</strong> the process. To be disposed <strong>of</strong> in landfilling <strong>of</strong> mines.ix. Subsequentresponse submitted on 19.11.2012 from the unit is given below :Recommendations / Directions <strong>of</strong> theCommittee dated 06.09.20121. Contour map <strong>of</strong> the proposed project siteshould be submitted.2. Item wise break up <strong>of</strong> Corporate SocialResponsibility along with financialcommitment as discussed during thepresentation should be submitted3. Treated water quality report which is to bereused in the process should be furnishedResponse <strong>of</strong> the Proponent submitted on19.11.20121. The proponent has submitted contour map.2. The proponent has mentioned thatestimated CSR budget is 5% <strong>of</strong> projectcost distributed over 7 years. PP submitteditem wise cost break up <strong>of</strong> CSR activities<strong>of</strong> Rs. 5 lakhs per annum.3. The unit has submitted the analysis report<strong>of</strong> treated effluent water after tailingssettling pond.The case was placed for reconsideration in the 73 rd <strong>SEAC</strong> <strong>meeting</strong> held on 30.11.2012. The <strong>SEAC</strong>considered the submission by the proponent and recommended Environmental Clearance.2. Proposed expansion project by installing Induction Furnaces with Caster, ReRolling Mill byM/s. Shakambhari Ispat & Power Ltd. at the existing plant premises at Vill – Madandhih, PO –Bortoria, PS – Neturia, Dist – Purulia, PIN – 723 121, West Bengal.Activity:This was a proposal for expansion for installation <strong>of</strong> Induction Furnace (1x8 TPH & 2x15 TPH) withCaster (400 TPD) ReRolling Mill and Coal / Char Washery (0.9 MTA) for production <strong>of</strong> MS Billets<strong>of</strong> 123000 MT per annum at the existing plant. Effluent – The waste water is treated through ETP and steeling pond with 90% efficiency. Wastewater from cooling process <strong>of</strong> induction furnace will be used in greenbelt development.ix. Solid Waste – Solid waste from APCD will collected and used for landfilling. Slag frominduction furnace will be sold.x. Power Requirement – 22 MVA, DVC. (Existing – 13.5 MVA)xi. Backup Power – DG Sets (1x750 KVA & 1x500 KVA)After carefully considering the presentation in the 71 st <strong>SEAC</strong> <strong>meeting</strong> held on 24.09.2012, the StateLevel Expert Appraisal Committee (<strong>SEAC</strong>) made the following recommendations. Subsequentresponse submitted on 22.11.2012 from the unit is given below :Recommendations / Directions <strong>of</strong> theCommittee dated 06.09.20121. The ambient air quality data should bemonitored and results to be submitted.2. Wastewater treatment system for coalwashery to be submitted. The quantity<strong>of</strong> rejects from coal washery used forlandfilling to be specified.3. Detailed calculations and schematics forrainwater harvesting to be submitted.4. The total number <strong>of</strong> trees for existingand as well as proposed project to bementioned.5. Revised CSR programme to besubmitted as discussed in the <strong>meeting</strong>.Response <strong>of</strong> the Proponent submitted on19.11.20121. The proponent has submitted ambient air qualityreport <strong>of</strong> the locality as well as within factorypremises. Ambient air quality report <strong>of</strong> thelocality are within permissible limit, howeverPM 10 & PM 2.5 results inside plant area aremarginally higher than prescribed limit.2. The proponent has withdrawn the proposal forinstallation <strong>of</strong> 0.9 MTPA coal washery.3. The unit has proposed to store 916.24 KLrainwater in 01 no. rain water storage tank <strong>of</strong>capacity 15x15x4 m 3 .4. No. <strong>of</strong> existing trees 1797 & no. <strong>of</strong> proposedtrees 1603 in 33% <strong>of</strong> total land area i,e 8.25acres5. Item wise break up <strong>of</strong> CSR activities with totalbudgetary expenditure <strong>of</strong> Rs 1.4 cr. Revised area statement should be submitted,the exclusive tree plantation area should beclearly mentioned, the total paved areashould not exceed 25% <strong>of</strong> the land area.2. The list <strong>of</strong> trees proposed to be plantedshould be modified as discussed during thepresentation.3. Concurrence letter for infrastructural supportservices like water supply, solid wastemanagement should be submitted. Source <strong>of</strong>water <strong>of</strong> JUSCO to be submitted.4. The number <strong>of</strong> solar lights proposed forstreet lighting should be mentioned.5. Permission for tree cutting obtained fromcompetent authority should be submitted.6. Details <strong>of</strong> quantity <strong>of</strong> Hazardous andRadioactive wastes to be generated fromlaboratory and their disposal plan to beoutlined.Response <strong>of</strong> the Proponent dated 10.07.20121. The PP has submitted revised areastatement. Plantation area is 20.12% andpaved area is 22.98% <strong>of</strong> the total land area.2. The PP has submitted the modified list <strong>of</strong>trees to be planted.3. The PP has already approached beforeNDITA for concurrence letter from thelocal authority for infrastructural supportservices and has submitted an undertakingdated 13.07.2012 in this regard.4. 20 nos. <strong>of</strong> solar street lights have beenproposed.5. The PP has submitted that necessarypermission from the competent authorityfor tree cutting is under process and hassubmitted an undertaking dated 13.07.2012in this regard.6. The PP has submitted brief description <strong>of</strong>hazardous waste, chemicals and chemicaleffluent expected to be generated from lab.Hazardous wastes will be disposed as perWBPCB norms. Biomedical Wastes will bedisposed <strong>of</strong>f through contract with M/sSembramky Environmental ManagementPvt. Ltd. The chemical effluent will bedisposed <strong>of</strong>f through West Bengal WasteManagement Limited. The PP hassubmitted an undertaking dated 13.07.2012that the institute will be using little quantity<strong>of</strong> chemicals and no chemical waste will bedischarged from their campus to municipalsewer. Radioactive waste shall be handledas per the AERB guidelines.The matter was placed before the <strong>SEAC</strong> in the 69 th <strong>meeting</strong> held on 25.07.2012. The project proponent should submit anundertaking to the effect that the waterbody existing within the premises shouldnot be transformed.Response <strong>of</strong> the Proponent submitted on20.03.20121. The project proponent mentioned that as perMOU and provisional EC, KMDA has agreedto supply treated water from the existingPadmapukur water treatment plant, Howrah toone point on the periphery <strong>of</strong> the project site<strong>of</strong> Kolkata West International City throughdedicated water supply main. A substantialwork in this regards have already been done.KMDA, vide letter no.142/KMDA/WS/G146(VM7) dated24.02.2012 has assured to supply <strong>of</strong> treatedwater within 34 months. However asmentioned in the letter issued by KMDA, ithas been mentioned that as rainy season isslowly approaching, work may be delayed.They also mentioned that out <strong>of</strong> 370 units,they have already obtained Consent to Operatefor 179 units on 05.03.2010. Further they havejust completed 191 units and they will applyfor the Consent to Operate once water supplyat the site is established for these units.2. The proponent submitted the undertakingstating the water bodies as per the ProvisionalEnvironmental Clearance within the premiseswill not be transformed.The unit has also submitted a letter on 13.04.2012, site visit has been done by KMDA and SE Rly on16.02.2012 and it has been expected that work will be completed within 34 months.The <strong>SEAC</strong> reviewed the letter submitted by the pp on 13.04.2012 in the 66 th <strong>meeting</strong> held on25.04.2012 and the <strong>SEAC</strong> has recommended following and the subsequent reply submitted on04.07.2012 <strong>of</strong> the project proponent is given below :–Page 25 <strong>of</strong> 50

At present only 370nos. <strong>of</strong> villas and 1 no. retail unit hasbeen completed with total water demand285 KLD which has been met fromground water supply having totalcapacity 320 KLD (permissionobtained).The potable water for incomplete villaswill be supplied by KMDA before 31 stDecember, 2013 as per the agreementwith KMDA.2. The height <strong>of</strong> the proposed building inPhase – IA is 45.0 m from GL and width<strong>of</strong> the road <strong>of</strong> 30.0 m. The distance <strong>of</strong>fire station from the proposed building isapproximately 10.0 KM.The <strong>SEAC</strong> reviewed the letter submitted by the pp on 04.07.2012 in the 69 th <strong>meeting</strong> held on25.07.2012 and the <strong>SEAC</strong> has noted that permission obtained for drawl <strong>of</strong> ground water is notadequate to meet the water demand for phase I for which EC has already been granted and requestedto submit compliance report regarding total water supply for phase I & IA.The PP once again submitted a letter on 06.11.2012 mentioning that available ground water issufficient for the completed villas <strong>of</strong> phaseI and construction <strong>of</strong> remaining villas <strong>of</strong> phaseI will becompleted in end <strong>of</strong> 2013. PP further mentioned that water requirement for whole <strong>of</strong> the project hasbeen assured by KMDA from Padmapukur <strong>of</strong> 10,000 KLD. The entire pipe work has been completedexcept 100m portion under Padmapukur railway track for which approval from railway authority hasbeen sought. The completion <strong>of</strong> pipe line work will take approximately four months after obtainingNOC from Railway authority.The case was placed for reconsideration in the 73 rd <strong>SEAC</strong> <strong>meeting</strong> held on 30.11.2012.
