Dueto some unavoidable circumstances Shri Manoj Kumar Nandi could not attend the <str<strong>on</strong>g>meeting</str<strong>on</strong>g>. However, asdesired by Shri Manoj Kumar Nandi earlier and as also agreed by other members <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>SEAC</str<strong>on</strong>g> Dr. KalyanRudra chaired the <str<strong>on</strong>g>meeting</str<strong>on</strong>g>. After introductory sessi<strong>on</strong>, three cases were discussed under 'Miscellaneous'secti<strong>on</strong>. Seventeen cases were placed for rec<strong>on</strong>siderati<strong>on</strong>. Five applicants were requested to make theirpresentati<strong>on</strong> before the committee. All the five applicants appeared before the <str<strong>on</strong>g>SEAC</str<strong>on</strong>g> for technicalpresentati<strong>on</strong> <strong>on</strong> their respective project proposal.Sessi<strong>on</strong> IA. Specific c<strong>on</strong>currence regarding water supply and other infrastructural facilities from c<strong>on</strong>cernedauthorities to be submitted.2. Revised proposal for Corporate Social Resp<strong>on</strong>sibility al<strong>on</strong>g with item wise breakup and timeframe to be submitted.3. Depth <str<strong>on</strong>g>of</str<strong>on</strong>g> the recharge well for rain water harvesting to be checked.4. Revised plantati<strong>on</strong> proposal as discussed during the presentati<strong>on</strong> to be submitted.Reply dated 07.06.2012 from the unit was c<strong>on</strong>sidered in the 68 th <str<strong>on</strong>g>SEAC</str<strong>on</strong>g> <str<strong>on</strong>g>meeting</str<strong>on</strong>g> held <strong>on</strong> 14.06.2012,the State Level Expert Appraisal Committee (<str<strong>on</strong>g>SEAC</str<strong>on</strong>g>) made the following recommendati<strong>on</strong>s dated29.06.2012 :­1. After scrutinizing the documentssubmitted by the unit, the committee has noted and recommended that the matter to be referred toSEIAA for informati<strong>on</strong> and necessary acti<strong>on</strong>.2. Letter <str<strong>on</strong>g>of</str<strong>on</strong>g> Dr. Mohit K Ray received <strong>on</strong> 31.10.2012 addressed to the Chairpers<strong>on</strong>, SEIAA and theMember Secretary, WBPCB regarding Calcutta High Court and Karnataka High Court Orders<strong>on</strong> Illegality <str<strong>on</strong>g>of</str<strong>on</strong>g> NABET accreditati<strong>on</strong>.Dr. Mohit K Ray an envir<strong>on</strong>mental specialist working in envir<strong>on</strong>mental field for more than 30 yearshas submitted a letter <strong>on</strong> 31.10.2012 addressed to the Chairpers<strong>on</strong>, SEIAA and the Member Secretary,WBPCB regarding accreditati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> envir<strong>on</strong>mental c<strong>on</strong>sultants by NABET/ QCI in respect <str<strong>on</strong>g>of</str<strong>on</strong>g> threeOffice Memorandum issued by MoEF <strong>on</strong> the said matter.The MoEF had issued O. M. dated 02.12.2009, 18.03.2012 and 28.06.2010 regarding accreditati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g>envir<strong>on</strong>mental c<strong>on</strong>sultants by NABET / QCI.Dr. Ray has enclosed with his above menti<strong>on</strong>ed letter, the proceedings <str<strong>on</strong>g>of</str<strong>on</strong>g> 79 th <str<strong>on</strong>g>meeting</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g> the StateLevel Expert Appraisal Committee (<str<strong>on</strong>g>SEAC</str<strong>on</strong>g>), Karnataka held <strong>on</strong> 9 th and 10 th February 2012 whichmenti<strong>on</strong>s about the stay orders given by the H<strong>on</strong>’ble High Court <str<strong>on</strong>g>of</str<strong>on</strong>g> Karnataka in W.P. No.1530­1531/2012 (GM­RES):(Nanda Kishore Vs. Uni<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> India represented by MoEF, GoI & DFEE,GoK) <strong>on</strong> 18.01.2012 against the operati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> OM dated 02.12.2009, 18.03.2010 and 28.06.2010 issuedby the MoEF, GoI, regarding mandatory accreditati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> envir<strong>on</strong>mental c<strong>on</strong>sultants fromNABET/QCI. In view <str<strong>on</strong>g>of</str<strong>on</strong>g> this, the <str<strong>on</strong>g>SEAC</str<strong>on</strong>g>, Karnataka decided to allow envir<strong>on</strong>mental c<strong>on</strong>sultants formaking presentati<strong>on</strong> / preparati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> EIA irrespective <str<strong>on</strong>g>of</str<strong>on</strong>g> their accreditati<strong>on</strong> status till the stay isvacated.Writ Petiti<strong>on</strong> No. 13896 (W) <str<strong>on</strong>g>of</str<strong>on</strong>g> 2012 was filed by Dr. Ray in Calcutta High Court against the abovementi<strong>on</strong>ed O.M. issued by MoEF. The High Court in its Order dated 19.09.2012 has stayed those O.M. ‘in so far its applicati<strong>on</strong> to the petiti<strong>on</strong>er is c<strong>on</strong>cerned till next hearing’. The copy <str<strong>on</strong>g>of</str<strong>on</strong>g> the said orderhas been enclosed al<strong>on</strong>g with letter <str<strong>on</strong>g>of</str<strong>on</strong>g> Dr. Ray. Dr. Ray has requested <str<strong>on</strong>g>SEAC</str<strong>on</strong>g>, <strong>West</strong> <strong>Bengal</strong> in his lettersubmitted <strong>on</strong> 31.10.2012, to allow all envir<strong>on</strong>mental c<strong>on</strong>sultants and organizati<strong>on</strong>s to prepare EIAreport irrespective <str<strong>on</strong>g>of</str<strong>on</strong>g> their accreditati<strong>on</strong> status till the stay is vacated.W.P. Relevant Office Memorandum No. J­103/19/2012­IA.III dated 01.11.2012 <str<strong>on</strong>g>of</str<strong>on</strong>g> the Ministry <str<strong>on</strong>g>of</str<strong>on</strong>g>Envir<strong>on</strong>ment & Forests, Government <str<strong>on</strong>g>of</str<strong>on</strong>g> India.To simplify the procedures relating to grant <str<strong>on</strong>g>of</str<strong>on</strong>g> EC <str<strong>on</strong>g>of</str<strong>on</strong>g> the SEZ projects under the provisi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> the EIANotificati<strong>on</strong> 2006, MoEF has decided to have the following framework in place, in line with thatprescribed for NIMZs under the Nati<strong>on</strong>al Manufacturing Policy, 2011 :­i. In respect <str<strong>on</strong>g>of</str<strong>on</strong>g> laws and regulati<strong>on</strong>s pertaining to envir<strong>on</strong>ment, Central/State Governments maydelegate the power as allowed by the relevant statutes to an <str<strong>on</strong>g>of</str<strong>on</strong>g>ficial <str<strong>on</strong>g>of</str<strong>on</strong>g> the SPCB posted in thez<strong>on</strong>e.ii.The EC for SEZs units under the EIA Notificati<strong>on</strong> 2006 shall be c<strong>on</strong>sidered <strong>on</strong> a high priority.iii. Individual units may be exempted from public hearing in cases where the SEZ as a whole hasunderg<strong>on</strong>e public hearing. In cases where the type <str<strong>on</strong>g>of</str<strong>on</strong>g> individual unit/process was not originallyc<strong>on</strong>sidered as a part <str<strong>on</strong>g>of</str<strong>on</strong>g> the SEZ project at the time <str<strong>on</strong>g>of</str<strong>on</strong>g> public hearing for SEZ, a fresh publichearing will be required for the individual unit/process at appropriate time.iv. No. –638, Mouza – Jamsole, PS – Jhargram, Dist. – Paschim Medinipur, <strong>West</strong> <strong>Bengal</strong>.Activity:This is a proposal for installati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> an Ir<strong>on</strong> Ore Beneficiati<strong>on</strong> plant (20 TPH) with capacity <str<strong>on</strong>g>of</str<strong>on</strong>g> 96000TPA throughout and about 70000 TPA ir<strong>on</strong> ore.Salient features <str<strong>on</strong>g>of</str<strong>on</strong>g> the proposed modernisati<strong>on</strong> project are :i. The <str<strong>on</strong>g>SEAC</str<strong>on</strong>g>c<strong>on</strong>sidered the submissi<strong>on</strong> by the prop<strong>on</strong>ent and recommended Envir<strong>on</strong>mental Clearance.2. Proposed expansi<strong>on</strong> project by installing Inducti<strong>on</strong> Furnaces with Caster, Re­Rolling Mill byM/s. Shakambhari Ispat & Power Ltd. at the existing plant premises at Vill – Madandhih, PO –Bortoria, PS – Neturia, Dist – Purulia, PIN – 723 121, <strong>West</strong> <strong>Bengal</strong>.Activity:This was a proposal for expansi<strong>on</strong> for installati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Inducti<strong>on</strong> Furnace (1x8 TPH & 2x15 TPH) withCaster (400 TPD) Re­Rolling Mill and Coal / Char Washery (0.9 MTA) for producti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> MS Billets<str<strong>on</strong>g>of</str<strong>on</strong>g> 123000 MT per annum at the existing plant. Now the unit applied for PHASE – IA which is <strong>on</strong>ly 4.283 acres. The <str<strong>on</strong>g>SEAC</str<strong>on</strong>g> requestedthe project prop<strong>on</strong>ent vide letter dated 30.09.2011 to c<strong>on</strong>sider the project in an integrated manner andalso to explain the reas<strong>on</strong>s for reverting to the proposal for sending the sewage to the KMW STPinstead <str<strong>on</strong>g>of</str<strong>on</strong>g> augmenting the capacity <str<strong>on</strong>g>of</str<strong>on</strong>g> the STP at the project site in a modular form. However asmenti<strong>on</strong>ed in the letter issued by KMDA, ithas been menti<strong>on</strong>ed that as rainy seas<strong>on</strong> isslowly approaching, work may be delayed.They also menti<strong>on</strong>ed that out <str<strong>on</strong>g>of</str<strong>on</strong>g> 370 units,they have already obtained C<strong>on</strong>sent to Operatefor 179 units <strong>on</strong> 05.03.2010. Further they havejust completed 191 units and they will applyfor the C<strong>on</strong>sent to Operate <strong>on</strong>ce water supplyat the site is established for these units.2. The distance <str<strong>on</strong>g>of</str<strong>on</strong>g>fire stati<strong>on</strong> from the proposed building isapproximately 10.0 KM.The <str<strong>on</strong>g>SEAC</str<strong>on</strong>g> reviewed the letter submitted by the pp <strong>on</strong> 04.07.2012 in the 69 th <str<strong>on</strong>g>meeting</str<strong>on</strong>g> held <strong>on</strong>25.07.2012 and the <str<strong>on</strong>g>SEAC</str<strong>on</strong>g> has noted that permissi<strong>on</strong> obtained for drawl <str<strong>on</strong>g>of</str<strong>on</strong>g> ground water is notadequate to meet the water demand for phase I for which EC has already been granted and requestedto submit compliance report regarding total water supply for phase I & IA.The PP <strong>on</strong>ce again submitted a letter <strong>on</strong> 06.11.2012 menti<strong>on</strong>ing that available ground water issufficient for the completed villas <str<strong>on</strong>g>of</str<strong>on</strong>g> phase­I and c<strong>on</strong>structi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> remaining villas <str<strong>on</strong>g>of</str<strong>on</strong>g> phase­I will becompleted in end <str<strong>on</strong>g>of</str<strong>on</strong>g> 2013. PP further menti<strong>on</strong>ed that water requirement for whole <str<strong>on</strong>g>of</str<strong>on</strong>g> the project hasbeen assured by KMDA from Padmapukur <str<strong>on</strong>g>of</str<strong>on</strong>g> 10,000 KLD. The entire pipe work has been completedexcept 100m porti<strong>on</strong> under Padmapukur railway track for which approval from railway authority hasbeen sought.
