Human Rights Commission regarding the violations of human rights inaccordance with law, and to record them as human right violators(3) The National Human Rights Commission in performing its functions and dutiesmay use the following power:-(a) exercise the same powers as the court in requiring any person to appearbefore the Commission for recording his/her statement or information andexamining them, receiving and examining evidence as well as ordering forthe production of any physical proof(b) enter, without prior notice, in case the Commission has received theinformation by any source that incidents of the violation of human rights hasoccurred or is going to occur, into any individual’s residence or office, conductsearch and seize any documents and evidences relating to human rightsviolations thereon(c) enter any government premises or other places, without prior notice, in casethe Commission has received information that violation of human rights of aperson is happening thereon and immediate action is required to providerescue(d) order for compensation, in accordance with law, to the victims of humanrights violations1.2. Justification/importance of the fifth SPThe SP serves as the guidelines to steer human rights protection and promotionactivities systematically and carry the annual activities and Action <strong>Plan</strong> of the NHRCto the targeted groups. This will play an important role in the NHRC's efforts to drafta SP and develop a framework for the implementation of the SP in order to supportthe NHRC to fulfill its responsibility effectively in accordance with the changed conceptof human rights. Moreover, since it effectively allocates physical resources, timeframeand responsibilities necessary for the practical transformation of the Strategy, it helpsto accomplish the task in an expected manner making it result-oriented.As all human rights issues are universal, interrelated and indivisible, all human rightsare of equal importance and necessity. This SP provides guidance to establish humanrights, peace and justice, as well as ensure the access to justice for the conflictvictims, civil and political rights, as well as economic, social and cultural rights. ThisStrategy also guides all the activities of the present NHRC to be consistent, andreviews the achievements made in accomplishing the tasks.Moreover, it plays important role to enhance the cooperation with the governmentand constitutional bodies and various commissions to make the NHRC activitiescoherent with the plans and programs of the Government of Nepal, as well as monitorNational Human Rights Action <strong>Plan</strong>. In addition, the SP is expected to help ininvestigating and swiftly settling pending cases filed in the NHRC and take initiationfor the implementation of the recommendations made by the commission so far.3
