Page 3That the <strong>St</strong>. John’s Development Regulations be amended as follows:Add a new subsection under Section 8 – General Site Requirements (8.3.10). Heatpumps, air conditioners, emergency generators, powered exhaust fans and similarequipment shall be located in the rear yard at a distance <strong>of</strong> 2.4 m from the nearestproperty line, except that such equipment shall be permitted to be placed in the sideyard or at a closer distance provided the manufacturer specifications or approvedsound mitigating measures, as determined by the Manager <strong>of</strong> Technical Services,demonstrate that noise emissions do not exceed 55 decibels when measured at thenearest property line.That the <strong>St</strong>. John’s Noise By-Law be amended as follows:Add a new subsection 3.8 which shall read “Heat pumps, air conditioners,emergency generators, powered exhaust fans and similar equipment or devices thatgenerate noise shall not produce a noise level when measured at the property linethat shall not exceed 55 decibels.”6. Proposed Amendments to the Sign By-Law Concerning Changeable Message SignsThe Committee considered a memo dated May 1, <strong>2013</strong> from the Deputy <strong>City</strong> Manager <strong>of</strong> Planning,Development & Engineering regarding the above. The Committee on motion <strong>of</strong> Deputy Mayor Duff;seconded by Councillor Tilley: recommends Council’s approval <strong>of</strong> the following amendments to the SignBy-Law as noted in the highlighted sections below:23.1 Changeable Message Signs shall: (Amendments in Bold)a) i) have a maximum illumination level <strong>of</strong> 1,500 lumens for daytime use and 450 lumensfor night time use;ii) have a light sensing device that will automatically adjust the brightness as ambientlight conditions change;iii) not exceed 6.5 lux above the ambient lighting level measured within 10 meters <strong>of</strong> thesign face. Documentation shall be provided to the <strong>City</strong> at time <strong>of</strong> permit issuance to thiseffect certifying this changeable message sign is incapable <strong>of</strong> exceeding 6.5 lux above theambient lighting;iv) be programmed so that in the event <strong>of</strong> a malfunction shall either turn the display <strong>of</strong>for to a full black background;b) not be located within 30 meters <strong>of</strong> a residential zone unless the sign remains in a staticposition between the hours <strong>of</strong> 11 p.m. to 7 a.m. and is positioned on the lot to have theleast impact to the abutting residential properties as deemed acceptable by theinspector;c) have a maximum transition time from one image or format to the next <strong>of</strong> 2 seconds;d) have a minimum image display time <strong>of</strong> 10 seconds;e) be shielded to reduce glare in a manner acceptable to the inspector;f) have a positive contrast orientation;g) not have animation;h) not have flashing, strobe, intermittent or moving lights; andi) not have lights in a colour or combination <strong>of</strong> colours which in the opinion <strong>of</strong> the inspectormay be misinterpreted as an emergency/warning device or vehicle or other traffic controldevice.j) all existing changeable message signs installed before the adoption <strong>of</strong> these regulationsshall comply with the current By-Law within one year <strong>of</strong> this amendment date.
