This is particularly the case since the growth of the “*no win, nofee” climate where people are encouraged to take legal action when any injury occurs –especially those sustained during leisure time. With this in mind we offer members exclusiverights to our <strong>Fitness</strong> <strong>Professionals</strong> insurance policy to ensure they are protected against anyliability claim that may be made against them by a member of the public including theirclients.This insurance scheme has been specifically designed for us by CMC <strong>Insurance</strong> Consultants,to cater for the needs of our members who require a flexible insurance. In other words, aslong as you are a resident of the UK or Ireland, this cover is available to all fitness instructorswith an accepted qualification and students on recognised courses whether operating locallyor worldwide, in a gym, studio, leisure facility, client’s home or outdoors. It provides forvariable work patterns, for those who are employed, self-employed, on contract or whochange between these options.Policy Cover1. The standard indemnity limit is £5 million for both Public Liability and ProfessionalIndemnity.2. It provides cover for the instructor working within his/her accepted qualifications.3. Includes advice the instructor gives on exercise and nutrition.4. Written on a worldwide basis for members resident in the UK and Ireland.5. There is no limit to the number of participants within a class, providing health andsafety requirements are observed.6. “*Indemnity to Principal” is automatically included to protect the interest ofemployer/contractor/hired or rented premises.7. The policy is on a “*Claims Occurrence” basis.8. No excess payable by the instructor in the event of a claim and no exclusions as longas working within accepted qualifications.9. Legal Expenses included.10. Deals with allegations made against you for injury, damage, libel and slander.11. “*Member to Member” claims included.12. There is no cancellation clause beyond the statutory limitation.Claims1. As the policy is on a “Claims Occurrence” basis, as long as the contract was in forceat the time of the incident, any claim will be dealt with by the insurers even if thepolicy is no longer in force.2. All claims occurring within the period of insurance are dealt with by the insurer.3. The instructor is required to provide information on the incident resulting in a claimbeing made.4. The qualification certificate is required for the activity taking place when incidentoccurred.Additional Information1. Increased indemnity limits of £10m and £20m are available if required.2. Evidence of acceptable qualification required when effecting policy.


3. Once insurance is in force any additional accepted qualification is automaticallyincluded without the need to submit the certificate.4. Children’s exercise is automatically included as long as accepted children’squalification is held and legal requirements adhered to.5. It is available to group trainers, gym instructors, personal trainers and level 4 fitnessinstructors and students on accepted courses.6. Policy extendable for some activities not directly fitness related.Terminology Explained*1. *No win no fee1. Losses from unattended vehicles exclude all sound equipment, including CDs tapes,headsets and associated equipment and clothing other than when loading andunloading.

It may bedisclosed to regulatory bodies for the purposes of monitoring and/or enforcing the insurer’scompliance with any regulatory rules/codes. Your information may also be used for offeringrenewal, research and statistical purposes and crime prevention. It may be transferred to anycountry, including countries outside the European Economic Area for any of these purposesand for systems administration. In assessing any claim made, the insurer or its agents mayundertake checks against publicly available information (such as electoral roll, county courtjudgements, bankruptcy or repossessions). Information may also be shared with otherinsurers either directly or via those acting for the insurer (such as loss adjusters orinvestigators).In order to assess the terms of the insurance contract or administer claims which arise, theinsurer may need to collect data which the Data Protection Act defines as sensitive (such asmedical history or criminal convictions). By proceeding with this application you will signifyyour consent to such information being processed by the insurer or its agents.
