JCAR890120-1011664r08602603604605606607608609610611612613614615616617618619620621622623624625626627628629630631632633634635636637638639640641642643644A) Incurred expenses are expenses for medical or remedial services:i) recognized under State law;ii) rendered to the person, the person's family, or a financiallyresponsible relative;iii) for which the person is liable in the current month forwhich eligibility is being sought or was liable in any of the3-month retroactive eligibility period described insubsection (a) of this Section; andiv) for which no third party is liable in whole or in part unlessthe third party is a State program.B)A) Incurred medicalMedical expenses shall be applied to thespenddown obligation in the following order:i) Expenses for necessary medical or remedial services, asfunded by DHS or the Department on Aging from sourcesother than federal funds. TheSuch expenses shall be basedon the service provider's usual and customary charges tothe public. TheSuch expenses shall not be based on anynominal amount the provider may assess the personclient.These charges are considered incurred the first day of themonth, regardless of the day the services are actuallyprovided.ii) Payments made for medical expenses within the previoussix months. Payments are considered incurred the first dayof the month of payment.iii) Unpaid medical expenses. These are considered as of thedate of service and are applied in chronological order.C)B) If multiple medical expenses are incurred on the same day, theexpenses shall be applied in the following order:i) Health insurance deductibles (including Medicare and otherco-insurance charges).ii) All copayment charges incurred or paid on spenddown metday.
