23. <strong>Misconduct</strong> and Compla<strong>in</strong>ts<strong>Procedure</strong> <strong>for</strong> <strong>Investigat<strong>in</strong>g</strong> <strong>Allegations</strong> <strong>of</strong> <strong>Research</strong> <strong>Misconduct</strong>23.1 Queen Mary University <strong>of</strong> London Policy23.1.1 Introduction and ScopeQueen Mary is a research-led Institution, recently ranked 11th <strong>in</strong> the UK <strong>in</strong> the<strong>Research</strong> Assessment Exercise, committed to ma<strong>in</strong>ta<strong>in</strong><strong>in</strong>g the highest standards <strong>of</strong><strong>in</strong>tegrity and probity <strong>in</strong> the conduct <strong>of</strong> research.This <strong>Procedure</strong> is based on the <strong>Procedure</strong> <strong>for</strong> the Investigation <strong>of</strong> <strong>Misconduct</strong> <strong>in</strong><strong>Research</strong> by the UK <strong>Research</strong> Integrity Office (UKRIO) and outl<strong>in</strong>es the action to betaken when an allegation <strong>of</strong> misconduct <strong>in</strong> academic research is brought aga<strong>in</strong>st anypresent or past member <strong>of</strong> staff <strong>of</strong> the University <strong>in</strong> respect <strong>of</strong> research undertakenwhile employed by the College. A separate procedure is <strong>in</strong> place <strong>for</strong> allegations <strong>of</strong>research misconduct aga<strong>in</strong>st students.The <strong>Procedure</strong> will provide a report that might require action us<strong>in</strong>g the College’sdiscipl<strong>in</strong>ary process or through other non-discipl<strong>in</strong>ary processes. It is not <strong>in</strong>tended to beused as part <strong>of</strong> any discipl<strong>in</strong>ary or regulatory process, and should be viewed as aseparate procedure.23.1.2 Summary <strong>of</strong> <strong>Procedure</strong>The Named Person is responsible <strong>for</strong> receiv<strong>in</strong>g allegations <strong>of</strong> misconduct <strong>in</strong> research,and <strong>for</strong> appo<strong>in</strong>t<strong>in</strong>g a Named Investigator who carries out the detailed <strong>in</strong>vestigation <strong>of</strong>the compla<strong>in</strong>t as outl<strong>in</strong>ed below. The Named Person is a nom<strong>in</strong>ee <strong>of</strong> the Pr<strong>in</strong>cipal (therole <strong>of</strong> the Named Person as outl<strong>in</strong>ed <strong>in</strong> the <strong>Procedure</strong> will be filled by the Senior Vice-Pr<strong>in</strong>cipal). The Named Investigator is appo<strong>in</strong>ted from the academic sectoralrepresentatives on the College <strong>Research</strong> Board.There shall be four stages <strong>of</strong> enquiries <strong>in</strong>to an allegation:1. Register<strong>in</strong>g the Compla<strong>in</strong>t: the Named Person receives and acknowledges theallegation;2. Prelim<strong>in</strong>ary Investigation: the Named Person passes the allegation to a NamedInvestigator, who conducts a prelim<strong>in</strong>ary <strong>in</strong>vestigation to determ<strong>in</strong>e that theallegations fall with<strong>in</strong> the def<strong>in</strong>ition <strong>of</strong> misconduct and the contractual status <strong>of</strong> theRespondent;3. Screen<strong>in</strong>g Stage: by the Named Investigator, to gather <strong>in</strong><strong>for</strong>mation and evidence,and to determ<strong>in</strong>e whether there is prima facie evidence <strong>of</strong> misconduct <strong>in</strong> research;and4. Formal Investigation: a panel is convened to exam<strong>in</strong>e all relevant facts todeterm<strong>in</strong>e whether, on the balance <strong>of</strong> probabilities, misconduct appears to haveoccurred.23.1.3 Stage One: Register<strong>in</strong>g the Compla<strong>in</strong>t<strong>Allegations</strong> must be made <strong>in</strong> writ<strong>in</strong>g (where possible) to the Named Personaccompanied by any support<strong>in</strong>g evidence.Upon receipt <strong>of</strong> allegations <strong>of</strong> misconduct <strong>in</strong> research, the Named Person shall <strong>for</strong>mallyacknowledge receipt <strong>of</strong> the allegations by letter to the Compla<strong>in</strong>ant (and his/herrepresentative by agreement), <strong>in</strong> which he/she shall also advise him/her <strong>of</strong> the<strong>Procedure</strong> that will be followed.The Named Person shall pass responsibility <strong>for</strong> the <strong>in</strong>vestigation <strong>of</strong> a particular
