23. <strong>Misconduct</strong> and Compla<strong>in</strong>ts<strong>Procedure</strong> <strong>for</strong> <strong>Investigat<strong>in</strong>g</strong> <strong>Allegations</strong> <strong>of</strong> <strong>Research</strong> <strong>Misconduct</strong>23.1 Queen Mary University <strong>of</strong> London Policy23.1.1 Introduction and ScopeQueen Mary is a research-led Institution, recently ranked 11th <strong>in</strong> the UK <strong>in</strong> the<strong>Research</strong> Assessment Exercise, committed to ma<strong>in</strong>ta<strong>in</strong><strong>in</strong>g the highest standards <strong>of</strong><strong>in</strong>tegrity and probity <strong>in</strong> the conduct <strong>of</strong> research.This <strong>Procedure</strong> is based on the <strong>Procedure</strong> <strong>for</strong> the Investigation <strong>of</strong> <strong>Misconduct</strong> <strong>in</strong><strong>Research</strong> by the UK <strong>Research</strong> Integrity Office (UKRIO) and outl<strong>in</strong>es the action to betaken when an allegation <strong>of</strong> misconduct <strong>in</strong> academic research is brought aga<strong>in</strong>st anypresent or past member <strong>of</strong> staff <strong>of</strong> the University <strong>in</strong> respect <strong>of</strong> research undertakenwhile employed by the College. A separate procedure is <strong>in</strong> place <strong>for</strong> allegations <strong>of</strong>research misconduct aga<strong>in</strong>st students.The <strong>Procedure</strong> will provide a report that might require action us<strong>in</strong>g the College’sdiscipl<strong>in</strong>ary process or through other non-discipl<strong>in</strong>ary processes. It is not <strong>in</strong>tended to beused as part <strong>of</strong> any discipl<strong>in</strong>ary or regulatory process, and should be viewed as aseparate procedure.23.1.2 Summary <strong>of</strong> <strong>Procedure</strong>The Named Person is responsible <strong>for</strong> receiv<strong>in</strong>g allegations <strong>of</strong> misconduct <strong>in</strong> research,and <strong>for</strong> appo<strong>in</strong>t<strong>in</strong>g a Named Investigator who carries out the detailed <strong>in</strong>vestigation <strong>of</strong>the compla<strong>in</strong>t as outl<strong>in</strong>ed below. The Named Person is a nom<strong>in</strong>ee <strong>of</strong> the Pr<strong>in</strong>cipal (therole <strong>of</strong> the Named Person as outl<strong>in</strong>ed <strong>in</strong> the <strong>Procedure</strong> will be filled by the Senior Vice-Pr<strong>in</strong>cipal). The Named Investigator is appo<strong>in</strong>ted from the academic sectoralrepresentatives on the College <strong>Research</strong> Board.There shall be four stages <strong>of</strong> enquiries <strong>in</strong>to an allegation:1. Register<strong>in</strong>g the Compla<strong>in</strong>t: the Named Person receives and acknowledges theallegation;2. Prelim<strong>in</strong>ary Investigation: the Named Person passes the allegation to a NamedInvestigator, who conducts a prelim<strong>in</strong>ary <strong>in</strong>vestigation to determ<strong>in</strong>e that theallegations fall with<strong>in</strong> the def<strong>in</strong>ition <strong>of</strong> misconduct and the contractual status <strong>of</strong> theRespondent;3. Screen<strong>in</strong>g Stage: by the Named Investigator, to gather <strong>in</strong><strong>for</strong>mation and evidence,and to determ<strong>in</strong>e whether there is prima facie evidence <strong>of</strong> misconduct <strong>in</strong> research;and4. Formal Investigation: a panel is convened to exam<strong>in</strong>e all relevant facts todeterm<strong>in</strong>e whether, on the balance <strong>of</strong> probabilities, misconduct appears to haveoccurred.23.1.3 Stage One: Register<strong>in</strong>g the Compla<strong>in</strong>t<strong>Allegations</strong> must be made <strong>in</strong> writ<strong>in</strong>g (where possible) to the Named Personaccompanied by any support<strong>in</strong>g evidence.Upon receipt <strong>of</strong> allegations <strong>of</strong> misconduct <strong>in</strong> research, the Named Person shall <strong>for</strong>mallyacknowledge receipt <strong>of</strong> the allegations by letter to the Compla<strong>in</strong>ant (and his/herrepresentative by agreement), <strong>in</strong> which he/she shall also advise him/her <strong>of</strong> the<strong>Procedure</strong> that will be followed.The Named Person shall pass responsibility <strong>for</strong> the <strong>in</strong>vestigation <strong>of</strong> a particular


allegation to the appropriate Named Investigator.23.1.4 Stage Two: Prelim<strong>in</strong>ary Investigation(i)(ii)(iii)(iv)(v)(vi)(vii)(viii)(ix)The Named Investigator shall review the nature <strong>of</strong> the allegations and, wherethey concern situations that require immediate action to prevent further risk orharm to staff, participants or other persons, suffer<strong>in</strong>g to animals or negativeenvironmental consequences (where this might contravene the law or fall belowgood practice), then the Named Person shall take immediate appropriate actionto ensure that any such potential or actual danger/illegal activity/risk isprevented/elim<strong>in</strong>ated.It may also be necessary to notify legal or regulatory authorities. As aconsequence, the College may be required to comply with an <strong>in</strong>vestigation ledby a legal or regulatory body, which will ord<strong>in</strong>arily take precedence over this<strong>Procedure</strong>.Where allegations <strong>in</strong>clude behaviour subject to def<strong>in</strong>ed sanctions <strong>in</strong> theCollege’s discipl<strong>in</strong>ary process, then the Named Investigator shall take steps toimplement that discipl<strong>in</strong>ary process.In both cases, this <strong>Procedure</strong> may cont<strong>in</strong>ue <strong>in</strong> parallel but may have to besuspended, to be concluded later, or may have to be declared void by theNamed Person.The Named Person or Named Investigator may consider that the situationpresent<strong>in</strong>g as misconduct may <strong>in</strong> fact be a result <strong>of</strong> a dispute ormisunderstand<strong>in</strong>g between <strong>in</strong>dividuals. Those situations not considered to beserious <strong>in</strong> nature might be resolved by <strong>in</strong><strong>for</strong>mal discussion and/or arbitrationand/or dispute resolution, without the requirement <strong>for</strong> a <strong>for</strong>mal <strong>in</strong>vestigation.Where appropriate, opportunities to resolve matters through mediation shouldbe considered. It may still be appropriate to conduct an <strong>in</strong>itial <strong>in</strong>vestigation toestablish whether the allegation may have sufficient substance to warrant aFormal Investigation <strong>of</strong> misconduct <strong>in</strong> research.Where the allegations are with<strong>in</strong> the def<strong>in</strong>ition <strong>of</strong> misconduct <strong>in</strong> research, theNamed Investigator shall <strong>in</strong><strong>for</strong>m the Named Person, Pr<strong>in</strong>cipal, Head <strong>of</strong> HumanResources, Head <strong>of</strong> <strong>Research</strong> Grants Adm<strong>in</strong>istration/Jo<strong>in</strong>t <strong>Research</strong> andDevelopment Office and Academic Secretary or their nom<strong>in</strong>ees. They will beprovided <strong>in</strong> confidence with the follow<strong>in</strong>g <strong>in</strong><strong>for</strong>mation: The identity <strong>of</strong> the Respondent The identity <strong>of</strong> the Compla<strong>in</strong>ant Details <strong>of</strong> all sources <strong>of</strong> <strong>in</strong>ternal and external fund<strong>in</strong>g Details <strong>of</strong> all <strong>in</strong>ternal and external collaborators <strong>for</strong> the research <strong>in</strong> question Other details that the Named Investigator considers appropriateThe Named Investigator shall then, <strong>in</strong> conjunction with the Head <strong>of</strong> HumanResources and Head <strong>of</strong> <strong>Research</strong> Grants Adm<strong>in</strong>istration/Jo<strong>in</strong>t <strong>Research</strong> andDevelopment Office or their nom<strong>in</strong>ees, <strong>in</strong>vestigate the contractual status <strong>of</strong> theRespondent and the contractual details specific to the research project(s)related to the allegations.The Named Investigator may need to contact the Respondent’s primaryemployer, where an honorary contract is held and any external Sponsors,fund<strong>in</strong>g organisations and/or collaborators. The Named Investigator shall liaisewith the Human Resources Department to ensure that the rights <strong>of</strong> theRespondent and Compla<strong>in</strong>ant, and the <strong>in</strong>tegrity <strong>of</strong> the <strong>in</strong>vestigation are notcompromised by any such actions.The Respondent shall be <strong>in</strong><strong>for</strong>med <strong>of</strong> the prelim<strong>in</strong>ary <strong>in</strong>vestigation <strong>in</strong> aconfidential meet<strong>in</strong>g, with a representative <strong>of</strong> the Human ResourcesDepartment <strong>in</strong> attendance and may be accompanied to this meet<strong>in</strong>g by acolleague or trade union Representative. If the allegations are made aga<strong>in</strong>st


(x)more than one Respondent, the Named Investigator shall <strong>in</strong><strong>for</strong>m each <strong>in</strong>dividualseparately and not divulge the identity <strong>of</strong> any other Respondent. A summary <strong>of</strong>the allegations <strong>in</strong> writ<strong>in</strong>g shall be given to the Respondent (and his/herrepresentative by agreement) at the meet<strong>in</strong>g, together with a copy <strong>of</strong> the<strong>Procedure</strong> to be used and the timeframe <strong>of</strong> the <strong>in</strong>vestigation.This <strong>Procedure</strong> aligns with the College’s Whistleblow<strong>in</strong>g policy. In accordancewith that policy, the allegation and identity <strong>of</strong> the Compla<strong>in</strong>ant will be keptconfidential so far as is reasonably possible by the Named Person/NamedInvestigator until any Formal Investigation is launched, save <strong>for</strong> the provisions <strong>in</strong>paragraphs 22.4.6 – 22.4.9 above.23.1.5 Stage Three: Screen<strong>in</strong>g(i)The Named Investigator shall ensure that all relevant <strong>in</strong><strong>for</strong>mation and evidenceare secured, so that any <strong>in</strong>vestigation conducted under this <strong>Procedure</strong> canhave access to them. This may <strong>in</strong>clude, but is not limited to:a. Secur<strong>in</strong>g all relevant records, materials and locations associated with thework, copies <strong>of</strong> which shall be provided to the Respondentb. Liais<strong>in</strong>g with Human Resources and the relevant l<strong>in</strong>e manager(s) to: Request the temporary suspension <strong>of</strong> the Respondent from duties onfull pay Request the temporary barr<strong>in</strong>g <strong>of</strong> the Respondent from part, or all, <strong>of</strong>the premises <strong>of</strong> the College and any <strong>of</strong> the sites <strong>of</strong> any partnerorganisation(s); and/or Request a temporary restriction be placed on the Respondent requir<strong>in</strong>ghim/her not to have contact with some or all <strong>of</strong> the staff <strong>of</strong> the Collegeand those <strong>of</strong> any partner organisation(s)(ii)(iii)(iv)Such actions shall only be taken where there is a clear risk to <strong>in</strong>dividuals orthat evidence might be destroyed, and will take <strong>in</strong>to account the Respondent’sresponsibilities <strong>for</strong> supervision, teach<strong>in</strong>g and management. A review <strong>of</strong> anysuch action will be taken throughout the <strong>Procedure</strong> to ensure that it is notunnecessarily protracted. The implementation <strong>of</strong> this stage <strong>of</strong> the <strong>Procedure</strong>does not imply guilt.Once <strong>in</strong>itiated the <strong>Procedure</strong> will progress to the natural end-po<strong>in</strong>t irrespective<strong>of</strong>:a. The Compla<strong>in</strong>ant withdraw<strong>in</strong>g the allegations at any stageb. The Respondent admitt<strong>in</strong>g, or hav<strong>in</strong>g admitted, the alleged misconduct, <strong>in</strong>full or <strong>in</strong> partc. The Respondent or the Compla<strong>in</strong>ant resign<strong>in</strong>g, or hav<strong>in</strong>g alreadyresigned, his/her postAll contributions to the process <strong>of</strong> screen<strong>in</strong>g will be recorded and ma<strong>in</strong>ta<strong>in</strong>ed<strong>for</strong> subsequent use. As part <strong>of</strong> the Screen<strong>in</strong>g Stage the Named Investigatorwill:a. Review the submission and support<strong>in</strong>g evidence provided by theCompla<strong>in</strong>antb. Review the evidence and support<strong>in</strong>g documentation from the Respondentc. Review any background <strong>in</strong><strong>for</strong>mation relevant to the allegationsd. Interview the Respondent, the Compla<strong>in</strong>ant and other <strong>in</strong>dividuals whomight provide relevant <strong>in</strong><strong>for</strong>matione. Produce a report <strong>of</strong> the f<strong>in</strong>d<strong>in</strong>gs <strong>of</strong> the Screen<strong>in</strong>g Stage


(v)(vi)(vii)(viii)The Screen<strong>in</strong>g Stage will normally aim to be completed with<strong>in</strong> 30 work<strong>in</strong>g daysfrom the receipt <strong>of</strong> the allegations.When there is clear evidence <strong>of</strong> an <strong>in</strong>fr<strong>in</strong>gement that might contravene theCollege’s discipl<strong>in</strong>ary code, the Named Investigator will consult the Head <strong>of</strong>Human Resources on the full and accurate transfer <strong>of</strong> all case <strong>in</strong><strong>for</strong>mation tothe discipl<strong>in</strong>ary process. A full written record shall be kept <strong>of</strong> this decision.When the Named Investigator considers that the allegations are sufficientlyserious and have sufficient substance to warrant recommend<strong>in</strong>g a FormalInvestigation, the Named Investigator shall take immediate steps to set up aFormal Investigation.When the allegations have some substance, but due to a lack <strong>of</strong> clear <strong>in</strong>tent todeceive or due to their relatively m<strong>in</strong>or nature, the matter shall be addressedthrough the College’s competency, education and tra<strong>in</strong><strong>in</strong>g mechanisms, orother non-discipl<strong>in</strong>ary processes, rather than through the <strong>Procedure</strong>’s FormalInvestigation stage. The <strong>in</strong>vestigation us<strong>in</strong>g the <strong>Procedure</strong> would thenconclude at this po<strong>in</strong>t.If the Named Person decides that the allegations are mistaken, frivolous,vexatious and/or malicious, the allegations will then be dismissed. Thisdecision shall be reported <strong>in</strong> writ<strong>in</strong>g to the Respondent and all the parties whohad been <strong>in</strong><strong>for</strong>med <strong>in</strong>itially.23.1.6 Stage Four: Formal Investigation(i)(ii)The Investigation Panel shall exam<strong>in</strong>e the evidence collected dur<strong>in</strong>g theScreen<strong>in</strong>g Stage follow<strong>in</strong>g the orig<strong>in</strong>al allegations and <strong>in</strong>vestigate further asrequired.The Named Investigator shall <strong>in</strong><strong>for</strong>m the follow<strong>in</strong>g (or their nom<strong>in</strong>ees) that aFormal Investigation <strong>of</strong> the allegations is to take place:a. Respondent (and his/her representative by agreement)b. Compla<strong>in</strong>ant (and his/her representative by agreement)c. Named Persond. Pr<strong>in</strong>cipale. Head <strong>of</strong> Human Resourcesf. Head <strong>of</strong> <strong>Research</strong> Grants Adm<strong>in</strong>istrationg. Academic Secretaryh. Named Person <strong>of</strong> any Partner Organisation with which either theRespondent and/or Compla<strong>in</strong>ant has an honorary contract, and throughhim/her the Heads <strong>of</strong> Organisation, Personnel and <strong>Research</strong>(ix)(x)(xi)(xii)The Investigation Panel must be appo<strong>in</strong>ted with<strong>in</strong> 30 work<strong>in</strong>g days <strong>of</strong> theNamed Investigator recommend<strong>in</strong>g a Formal Investigation. The InvestigationPanel will not work to a prescribed timetable but will work as quickly aspossible without compromis<strong>in</strong>g the Pr<strong>in</strong>ciples <strong>of</strong> the <strong>Procedure</strong>.The Investigation Panel shall consist <strong>of</strong> at least three, and always an unevennumber <strong>of</strong>, senior members <strong>of</strong> staff. In select<strong>in</strong>g the panel the NamedInvestigator shall take <strong>in</strong>to consideration the subject matter <strong>of</strong> the allegationsand any potential conflicts <strong>of</strong> <strong>in</strong>terest.It is a requirement that one or more members <strong>of</strong> the Investigation Panel beselected from outside the College, particularly where allegations are especiallyserious or <strong>in</strong>volve senior staff. Such external members replace <strong>in</strong>ternalmembers <strong>of</strong> the Investigation Panel rather than be<strong>in</strong>g <strong>in</strong> addition to them.At least two members <strong>of</strong> the Panel shall have experience <strong>in</strong> the area <strong>of</strong>research <strong>in</strong> which the alleged misconduct has taken place, although they shallnot be members <strong>of</strong> the Department concerned. Where allegations concern


(xiii)(xiv)(xv)highly specialised areas <strong>of</strong> research the Investigation Panel shall have at leastone member with specialised knowledge <strong>of</strong> the field. It is desirable, but notessential, <strong>for</strong> the Panel to <strong>in</strong>clude a member who either holds or has heldjudicial <strong>of</strong>fice or to be a barrister or solicitor <strong>of</strong> at least ten year’s stand<strong>in</strong>g.The Pr<strong>in</strong>cipal, or his nom<strong>in</strong>ee, shall approve the panel members and may vetonom<strong>in</strong>ations <strong>for</strong> the Investigation Panel, record<strong>in</strong>g the reason <strong>for</strong> the veto <strong>in</strong>writ<strong>in</strong>g and communicat<strong>in</strong>g it to all parties.Once convened, the membership <strong>of</strong> the Investigation Panel shall not bechanged or added to. Members who are not able to cont<strong>in</strong>ue will not bereplaced. In the event that the Chair stands down or the membership fallsbelow three, the Named Investigator will take steps to recruit additionalmembers or re-start the Formal Investigation process.To per<strong>for</strong>m its task the Investigation Panel shall:(xvi)(xvii)a. Review the submission(s) and support<strong>in</strong>g evidence provided by theCompla<strong>in</strong>antb. Review the response(s) and support<strong>in</strong>g evidence from the Respondentc. Review background <strong>in</strong><strong>for</strong>mation relevant to the allegationsd. Review any <strong>in</strong>terviews conducted with the Respondent, thee. Compla<strong>in</strong>ant, and other staff who may provide relevant <strong>in</strong><strong>for</strong>mation toassist the Investigation Panelf. Call expert witnesses to give advice if necessaryg. Seek guidance from UKRIO and its advisers, where necessaryThe Investigation Panel shall be serviced by the Academic Secretariat,through whom all documentation and all other communication should bepassed.Communication, either written or oral, by any party (to <strong>in</strong>clude Respondent,Compla<strong>in</strong>ant or any other member(s) <strong>of</strong> staff) directly with members <strong>of</strong> thePanel will not be admitted as part <strong>of</strong> the documentation relat<strong>in</strong>g to the caseexcept when it takes place at the request <strong>of</strong> the Panel, or at <strong>for</strong>mal meet<strong>in</strong>gscalled by the Chair <strong>of</strong> the Investigation Panel.(xviii) A Formal Hear<strong>in</strong>g will be held dur<strong>in</strong>g which the Respondent will be given theopportunity to set out his/her case and respond to the allegations madeaga<strong>in</strong>st him/her. He/she will be allowed to ask questions, to present evidence,call witnesses and raise po<strong>in</strong>ts about any <strong>in</strong><strong>for</strong>mation given by any witness(<strong>in</strong>clud<strong>in</strong>g the Compla<strong>in</strong>ant). The Compla<strong>in</strong>ant and other staff may also be<strong>in</strong>vited to provide evidence when members <strong>of</strong> the Panel consider that it mayhave relevance to the <strong>in</strong>vestigation.(xix)(xx)(xxi)The Chair shall report the progress <strong>of</strong> the Investigation Panel to the NamedInvestigator by the Chair on a bi-weekly basis. If it is believed that the<strong>in</strong>vestigation will take more than one calendar month, progress reports shall bemade on a monthly basis.The Investigation Panel shall provide a draft report <strong>of</strong> its f<strong>in</strong>d<strong>in</strong>gs to the NamedPerson, who will make it available to the Respondent and the Compla<strong>in</strong>ant <strong>for</strong>comment on the factual accuracy <strong>of</strong> the report. Modifications will only be madewhen the report conta<strong>in</strong>s errors <strong>of</strong> fact and matters that have bear<strong>in</strong>g on thefacts.The Investigation Panel shall then provide to the Named Investigator a f<strong>in</strong>alreport that:a. Summarises the conduct <strong>of</strong> the <strong>in</strong>vestigationb. States whether the allegations <strong>of</strong> misconduct <strong>in</strong> research have beenupheld <strong>in</strong> whole or <strong>in</strong> part, giv<strong>in</strong>g the reasons <strong>for</strong> its decision and record<strong>in</strong>gany differ<strong>in</strong>g viewsc. Makes recommendations <strong>in</strong> relation to any matters relat<strong>in</strong>g to anyother misconduct identified dur<strong>in</strong>g the <strong>in</strong>vestigation


d. Addresses any procedural matters that the <strong>in</strong>vestigation has brought tolight with<strong>in</strong> the College and relevant partner organisations and/or fund<strong>in</strong>gbodies(xxii) In addition to reach<strong>in</strong>g a conclusion over the nature <strong>of</strong> the allegations, theInvestigation Panel may make recommendations with respect to:a. Whether the allegations should be referred to the relevantorganisation’s discipl<strong>in</strong>ary processb. Whether any action will be required to correct the record <strong>of</strong> researchc. Whether organisational matters should be addressed by the Collegethrough a review <strong>of</strong> the management <strong>of</strong> researchd. Other matters that should be <strong>in</strong>vestigated(xxiii) The Named Investigator shall <strong>in</strong><strong>for</strong>m the follow<strong>in</strong>g <strong>of</strong> the conclusion <strong>of</strong> theFormal Investigation:a. The Respondent and the Compla<strong>in</strong>antb. The Named Person, Pr<strong>in</strong>cipal, the Head <strong>of</strong> Human Resources, theAcademic Secretary, the Head(s) <strong>of</strong> the relevant Department(s) and any otherrelevant members <strong>of</strong> staffc. If the Respondent and/or the Compla<strong>in</strong>ant are employed on jo<strong>in</strong>tcl<strong>in</strong>ical/honorary contracts, the Named Person, the Head <strong>of</strong> Personnel and theHead <strong>of</strong> <strong>Research</strong> <strong>of</strong> the other organisation(s)d. Where appropriate, the responsible person with<strong>in</strong> any relevant partnerorganisations, fund<strong>in</strong>g bodies and/or regulatory or pr<strong>of</strong>essional bodies(xxiv) Evidence <strong>of</strong> further, dist<strong>in</strong>ct <strong>in</strong>stances <strong>of</strong> misconduct <strong>in</strong> research by theRespondent, unconnected to the allegations under <strong>in</strong>vestigation; ormisconduct <strong>in</strong> research by another person or persons, shall be submitted tothe Named Person <strong>in</strong> writ<strong>in</strong>g, along with all support<strong>in</strong>g evidence, <strong>for</strong>consideration under the <strong>in</strong>itial steps <strong>of</strong> the <strong>Procedure</strong>.23.1.7 OutcomesIf all or any part <strong>of</strong> the allegations are upheld, the Named Person, the Head <strong>of</strong> HumanResources and at least one other member <strong>of</strong> senior staff shall then decide whether thematter should be referred to the College’s discipl<strong>in</strong>ary process or <strong>for</strong> other <strong>for</strong>malactions.If the allegations are deemed to be frivolous, vexatious and/or malicious the NamedPerson shall consider recommend<strong>in</strong>g to the appropriate authorities that action be takenunder the College’s discipl<strong>in</strong>ary process aga<strong>in</strong>st anyone who is found to have madefrivolous, vexatious and/or malicious allegations <strong>of</strong> misconduct <strong>in</strong> research.The Respondent shall not have the option <strong>of</strong> appeal<strong>in</strong>g aga<strong>in</strong>st the report <strong>of</strong> theInvestigation Panel. The Respondent has the statutory right <strong>of</strong> appeal if the matter isreferred to the College’s discipl<strong>in</strong>ary process.23.1.8 Follow<strong>in</strong>g the Investigation <strong>of</strong> <strong>Research</strong> <strong>Misconduct</strong>23.1.8.1 Discipl<strong>in</strong>ary ProcessIf the allegations proceed to the College’s discipl<strong>in</strong>ary process, the report <strong>of</strong> theInvestigation Panel shall <strong>for</strong>m the basis <strong>of</strong> the evidence that the Discipl<strong>in</strong>ary Panelreceives. All the <strong>in</strong><strong>for</strong>mation collected and brought to light through the <strong>Procedure</strong> will betransferred to the discipl<strong>in</strong>ary process.23.1.8.2 RecordsThe Named Investigator shall be responsible <strong>for</strong> keep<strong>in</strong>g a written record <strong>of</strong> alldecisions taken throughout all the steps <strong>of</strong> the <strong>Procedure</strong>, <strong>in</strong> conjunction with the


Academic Secretariat. The Chair <strong>of</strong> the Investigation Panel shall assume responsibilitywith the Academic Secretariat <strong>for</strong> keep<strong>in</strong>g accurate records <strong>of</strong> the activities,deliberation and report<strong>in</strong>g <strong>of</strong> the Panel. The Academic Secretariat will ma<strong>in</strong>ta<strong>in</strong> the file<strong>for</strong> the case and archive this appropriately at the completion <strong>of</strong> the <strong>Procedure</strong>.23.1.8.3 Specialised researchIt is recognised that the subject area <strong>of</strong> certa<strong>in</strong> cases may be so specialised as torequire equally specialised advice as to how to resolve or correct matters aris<strong>in</strong>g fromthe misconduct <strong>in</strong> research; the recommendations and experience <strong>of</strong> the InvestigationPanel may prove particularly useful if this is the case.23.1.8.4 Support provided to the Compla<strong>in</strong>antWhere allegations have been upheld (<strong>in</strong> full or <strong>in</strong> part), or found to be mistaken but notfrivolous, vexatious and/or malicious, then appropriate support, guidance andacknowledgment shall be given to the Compla<strong>in</strong>ant, given that his/her role <strong>in</strong> theprocess will most likely have been stressful and may well have caused friction withcolleagues. The Named Person shall take whatever steps he/she considers necessaryto support the reputation <strong>of</strong> the Compla<strong>in</strong>ant. For example, if the case has received anypublicity, the Compla<strong>in</strong>ant shall be <strong>of</strong>fered the possibility <strong>of</strong> hav<strong>in</strong>g an <strong>of</strong>ficial statementreleased <strong>for</strong> <strong>in</strong>ternal and/or external purposes.23.1.8.5 Support provided to the RespondentWhere allegations have not been upheld (<strong>in</strong> full or <strong>in</strong> part), the Named Person shalltake such steps as are appropriate, given the seriousness <strong>of</strong> the allegations, to supportthe reputation <strong>of</strong> the Respondent and any relevant research project(s). Appropriatesupport and guidance shall be given to the Respondent, given that his/her role <strong>in</strong> theprocess will most likely have been stressful and may well have caused friction withcolleagues. As above, where the case has received any publicity, the Respondent shallbe <strong>of</strong>fered the possibility <strong>of</strong> hav<strong>in</strong>g an <strong>of</strong>ficial statement released <strong>for</strong> <strong>in</strong>ternal and/orexternal purposes.23.1.8.6 Handl<strong>in</strong>g wrongful allegationsIf the Investigation Panel has found that the Compla<strong>in</strong>ant’s allegations were frivolous,vexatious and/or malicious, the Named Person will consider recommend<strong>in</strong>g that actionbe taken aga<strong>in</strong>st the Compla<strong>in</strong>ant, under the College’s discipl<strong>in</strong>ary process.23.1.8.7 Other actions that may be required or be considered appropriateFollow<strong>in</strong>g the conclusion <strong>of</strong> the <strong>Procedure</strong>, the Investigation Panel may need torecommend additional measures <strong>in</strong> addition to those that may be taken by way <strong>of</strong> theCollege’s discipl<strong>in</strong>ary process. Any such recommendations will be actioned through theCollege’s management structure. This may <strong>in</strong>clude:a. Retraction/correction <strong>of</strong> articles <strong>in</strong> journalsb. Withdrawal/repayment <strong>of</strong> fund<strong>in</strong>gc. Notify<strong>in</strong>g patients/patients’ doctors <strong>of</strong> any potential medical issues that may arised. Notification <strong>of</strong> misconduct to regulatory bodies (such as the MHRA, the Healthcaree. Commission, the Home Office [<strong>for</strong> research <strong>in</strong>volv<strong>in</strong>g animals], pr<strong>of</strong>essional bodies,etc.)f. Notify<strong>in</strong>g other employ<strong>in</strong>g organisationsg. Notify<strong>in</strong>g other organisations <strong>in</strong>volved <strong>in</strong> the research, such as fund<strong>in</strong>g bodiesh. Add<strong>in</strong>g a note <strong>of</strong> the outcome <strong>of</strong> the <strong>in</strong>vestigation to a researcher’s file <strong>for</strong> any futurerequests <strong>for</strong> references; and/ori. Review <strong>in</strong>ternal management and/or tra<strong>in</strong><strong>in</strong>g and/or supervisory procedures <strong>for</strong>research
