(xiii)(xiv)(xv)highly specialised areas <strong>of</strong> research the Investigation Panel shall have at leastone member with specialised knowledge <strong>of</strong> the field. It is desirable, but notessential, <strong>for</strong> the Panel to <strong>in</strong>clude a member who either holds or has heldjudicial <strong>of</strong>fice or to be a barrister or solicitor <strong>of</strong> at least ten year’s stand<strong>in</strong>g.The Pr<strong>in</strong>cipal, or his nom<strong>in</strong>ee, shall approve the panel members and may vetonom<strong>in</strong>ations <strong>for</strong> the Investigation Panel, record<strong>in</strong>g the reason <strong>for</strong> the veto <strong>in</strong>writ<strong>in</strong>g and communicat<strong>in</strong>g it to all parties.Once convened, the membership <strong>of</strong> the Investigation Panel shall not bechanged or added to. Members who are not able to cont<strong>in</strong>ue will not bereplaced. In the event that the Chair stands down or the membership fallsbelow three, the Named Investigator will take steps to recruit additionalmembers or re-start the Formal Investigation process.To per<strong>for</strong>m its task the Investigation Panel shall:(xvi)(xvii)a. Review the submission(s) and support<strong>in</strong>g evidence provided by theCompla<strong>in</strong>antb. Review the response(s) and support<strong>in</strong>g evidence from the Respondentc. Review background <strong>in</strong><strong>for</strong>mation relevant to the allegationsd. Review any <strong>in</strong>terviews conducted with the Respondent, thee. Compla<strong>in</strong>ant, and other staff who may provide relevant <strong>in</strong><strong>for</strong>mation toassist the Investigation Panelf. Call expert witnesses to give advice if necessaryg. Seek guidance from UKRIO and its advisers, where necessaryThe Investigation Panel shall be serviced by the Academic Secretariat,through whom all documentation and all other communication should bepassed.Communication, either written or oral, by any party (to <strong>in</strong>clude Respondent,Compla<strong>in</strong>ant or any other member(s) <strong>of</strong> staff) directly with members <strong>of</strong> thePanel will not be admitted as part <strong>of</strong> the documentation relat<strong>in</strong>g to the caseexcept when it takes place at the request <strong>of</strong> the Panel, or at <strong>for</strong>mal meet<strong>in</strong>gscalled by the Chair <strong>of</strong> the Investigation Panel.(xviii) A Formal Hear<strong>in</strong>g will be held dur<strong>in</strong>g which the Respondent will be given theopportunity to set out his/her case and respond to the allegations madeaga<strong>in</strong>st him/her. He/she will be allowed to ask questions, to present evidence,call witnesses and raise po<strong>in</strong>ts about any <strong>in</strong><strong>for</strong>mation given by any witness(<strong>in</strong>clud<strong>in</strong>g the Compla<strong>in</strong>ant). The Compla<strong>in</strong>ant and other staff may also be<strong>in</strong>vited to provide evidence when members <strong>of</strong> the Panel consider that it mayhave relevance to the <strong>in</strong>vestigation.(xix)(xx)(xxi)The Chair shall report the progress <strong>of</strong> the Investigation Panel to the NamedInvestigator by the Chair on a bi-weekly basis. If it is believed that the<strong>in</strong>vestigation will take more than one calendar month, progress reports shall bemade on a monthly basis.The Investigation Panel shall provide a draft report <strong>of</strong> its f<strong>in</strong>d<strong>in</strong>gs to the NamedPerson, who will make it available to the Respondent and the Compla<strong>in</strong>ant <strong>for</strong>comment on the factual accuracy <strong>of</strong> the report. Modifications will only be madewhen the report conta<strong>in</strong>s errors <strong>of</strong> fact and matters that have bear<strong>in</strong>g on thefacts.The Investigation Panel shall then provide to the Named Investigator a f<strong>in</strong>alreport that:a. Summarises the conduct <strong>of</strong> the <strong>in</strong>vestigationb. States whether the allegations <strong>of</strong> misconduct <strong>in</strong> research have beenupheld <strong>in</strong> whole or <strong>in</strong> part, giv<strong>in</strong>g the reasons <strong>for</strong> its decision and record<strong>in</strong>gany differ<strong>in</strong>g viewsc. Makes recommendations <strong>in</strong> relation to any matters relat<strong>in</strong>g to anyother misconduct identified dur<strong>in</strong>g the <strong>in</strong>vestigation
